The goal of this paper is to discuss a key issue in the Democratic Rule of Law State: what are the role and main functions of the Judiciary in Brazil? Is the Judiciary mainly a public service provider, adjudicating disputes and guaranteeing individual rights? Or also as a state power, it should mainly control and guide the moral values of the society, changing the status quo and reducing social conflicts? In this sense, what are the conflicts that must be examined by the Judiciary? We will seek to answer these questions based on a discussion subsidized by courts official statistics and the results of surveys conducted with the Brazilian general population. The surveys measured how do citizens feel about their judicial system and what are the circumstances and the facts that determine the judicialization of conflicts. We work with the perceptions and attitudes of citizens relating to the Judiciary as it is today and discuss the Judiciary they want. Then, we compare how attitudes and perceptions relate to actual behavior and use of courts.

Nos início da década de 90 teve início um movimento em todo Brasil, impulsionado por uma carta de intenções da ONU, que sugeria a desvinculação da Perícia Criminal da Instituição Polícia Civil. Após este movimento, verificou-se uma grande diversidade de estruturas que originaram as Instituições Periciais, tanto operacionalmente como administrativamente, chancelando um status quo de completo empirismo em todos os setores periciais. Buscou-se neste trabalho, iniciar uma análise da possibilidade de padronização dos materiais utilizados na coleta de impressões digitais latentes contidos na maleta de local de crime doada pela SENASP a todos os Institutos de Criminalística do Brasil. Na tentativa de alcançar a maior representatividade possível dentre os Institutos de Criminalística brasileiros, utilizou-se um questionário eletrônico direcionado ao Fórum Nacional de Peritos Criminais (FNPC), onde se obteve amostra de quase todos os estados da federação. No resultado alcançado qualitativamente, a marca comercial SIRCHIE demonstrou ter preferência considerável entre a classe Pericial.

Economic development requires some limits on what those in power can do | the rule of law | but how can restraints be imposed on the powerful when there is no-one above them? This paper studies equilibrium rules allocating power and resources established by selfinterested incumbents under the threat of rebellions from inside and outside the group in power. Commitment to uphold individuals' rights can only be achieved if power is not as concentrated as incumbents would like it to be, ex post. Power sharing endogenously enables incumbents to commit to otherwise time-inconsistent laws by ensuring more people receive rents under the status quo, and thus want to defend it.

Este estudo tem como objectivo descrever e interpretar a cultura emergente na sala de aula do 4º Ano de Escolaridade, no momento em que os alunos a professora e eu como investigador nos envolvemos em tarefas relacionadas com Weblogs. Deste modo, o uso desta tecnologia, no contexto pedagógico, desencadeia um conjunto de repercussões no status quo vigente, sendo possível: - A observação e análise do processo de apropriação dos Weblogs pelos alunos; - A análise dos artefactos resultantes dessa acção, e as implicações na construção social das aprendizagens; - A descrição dos papéis assumidos pelos actores envolvidos durante essa acção. Nesta investigação utilizo uma metodologia etnográfica, para explanação e confronto de subjectividades. Descrevo a realidade centrando-me primeiro na professora da sala e depois, dou a voz aos alunos, à medida que me deparo com um novo espaço de liberdade virtual, entretanto criado. O carácter inovador do projecto reside no facto deste discutir o momento a partir do qual os alunos, utilizando um espaço e um tempo para manusear as ferramentas tecnológicas, desenvolvem acções que não têm a ver directamente com o currículo, e que o amplia. O Weblog ou blog surge da vontade da professora, do interesse manifesto dos alunos quando utilizam a tecnologia disponível na sala de aula, do apoio do investigador e da comunidade escolar. Afirma-se com espaço de comunicação entre a escola e o mundo, criado e mantido pelos alunos, num claro desafio ao currículo, ampliando o espaço de actuação da escola.

The research that led to this dissertation adopted a set of scenic/ideological aspects inherent to the productions of the Culture Industry as its object of research. The intellectual output of Theodor W. Adorno and Max Horkheimer underscored the approaches on this subject, since it provides the same set of scenic/ideological features to be explored because, according to the authors, scenes produced by the culture industry are linked to the dominant ideology, since they act in favor of maintaining the status quo. The first objective was the definition this set of features inherent to the scene produced by the culture industry, through the exploration of literature produced by Adorno and Horkheimer, so it was possible to define a set composed of nine elements: Construction of characters as characteristic types; Stereotypes; Naturalization of Stereotyped language; Simplistic playwriting; Reuse dramatic formula; Love and sexuality as themes of plots; Utilization of tragic element; Objetive representation; Approximation of fiction and reality. The second goal was the analysis of scene produced by the culture industry nowadays, so that it was possible to verify if any scenic/ideological aspects indicated by Adorno and Horkheimer in the mid-twentieth century were present among the productions from this beginning of the twenty-first century. Through the analysis of three soap operas produced in Brazil in 2012, it was found that the nine scenic/ideological aspects as indicated by Adorno and Horkheimer appeared in the observed productions. The dynamics of social fights in Santa Maria district, Aracaju, represents, in this study, the search process for understanding and analyzing the articulations of the social movements, their victories, and their ways of practicing politics, it proposes, therefore, a search for explanations and to reflect upon some issues such as: what are the dynamics of social fights and victories of the popular social movements is Santa Maria District? How do they work to solve their problems and to answer the demands along with the institutions that are responsible for the public policies in the district? With the answers to these and other questions, an analysis of the population‟s fights with the support of local social movements will be conducted. It will be done based on the historical-critical perspective of the social movements within the context of social live, through a qualitative approach based on semi=structured interviews applied to people who are close observers of the district‟s reality, and on the analysis of News contents that were published in two newspapers from Aracaju in previous years, especially from 2004 to 2008. In face of the material studied about the News from newspapers and the contents of magazines, it is evident that the local popular movements began as a new way of practicing politics that was characterized by a reproductive practice of the status quo. There is one perspective left for the population from Santa Maria District, that they demand the local leadership to take actions in face of their dynamic of fights

This work focuses on the relationship between organizational culture and quality culture in the hotel sector of NATAL/RN with respect to employee performance. The themes organizational culture and quality have been the research focus of administration theorists and a constant concern of professional managers, since the Japanese demonstrated effective forms or western management. In this study, the Competing Values Model (C.V.M.) (Quinn e Cameron, 1996; Quinn, 1998; Santos, 1998, 2000; Teixeira, 2001), which was tested on north-American organizations and considered a high value academic and professional instrument, was applied. The model maps the organizational culture on a profile with four elements: clan, adhocracy, market and hierarchy. The C.V.M., associated with the taximetrics created by Cameron (which classifies quality culture in for levels: status quo, error detection, error prevention and perpetual creative quality) has been related with organizational performance. In this study, these two models are used jointly and tested in the hotel sector. The results indicate that the strongest element of the profile is clan, which is characterized by internal focus, participation and people involvement, followed by the adhocracy element, which has an external focus, emphasizes flexibility and is characterized by dynamic enterprising and creativity. Regarding the level of the culture s quality in the hotel, the highest level, that of perpetual improvement and creativity, which attempts to enchant and to surprise the clients, was most frequently cited, followed by the error detection level, which has as its goal to discover and correct mistakes, trying, consequently, to reduce waste. The results suggest that employee performance as measured on some indicators is related to elements of the organizational culture profile and quality level

The state of health and sanitation in the city de Galinhos/RN is alarming, considering that access to public water supply and sanitation is absent. This condition is further exacerbated by the demand of that area as a tourist destination, especially to celebrate the festivities as the carnival, catholic festival and activities of summer. The city population growth, at times above cited, carries the collapse of poor sanitation system. The work now directs the foregoing discussion to the links between health, sanitation and environment, understood as built environment. In this context, the understanding of socio-sanitary conditions of the council is essential in the process of examining the actions of human rebut on the quality of life of local people. Thus, we developed the analysis of primary and secondary data, to conduct a holistic analysis of the health and sanitation in the city in the existing scenario. We verified, in the course of the research, that the conditions for solve part of the problem are already evident. However, the lack of political and popular demobilization contribute to the maintenance of the status quo

Partindo da experiência na enfermaria de um hospital-escola1, do confronto com o status-quo do trabalho dos psicólogos em hospitais e da avaliação da literatura sobre a clínica psicanalítica em hospital, esta pesquisa se propôs a buscar avanços frente a uma questão específica: a escuta psicanalítica no trabalho em enfermarias de hospital geral e as implicações dessa prática com o desejo do psicanalista. Foram entrevistados quinze psicólogos declaradamente de orientação psicanalítica, vinculados a unidades de internação e com experiência mínima de dois anos de trabalho em hospital geral. As entrevistas foram abertas e semi-estruturadas, com o intuito de contemplar de maneira uniforme a coleta de informações de cunho mais objetivo, assim como de facilitar a pertinência ao tema de estudo. A interpretação dos dados foi realizada à luz do referencial clínico psicanalítico (freud-lacaniano), sendo que tal interpretação nos permitiu identificar uma importante interação entre os impasses, presentes na instituição hospitalar, da prática clínica psicanalítica com questões pessoais e de formação do profissional, interação que se vincula à postura de trabalho adotada no hospital. Reafirmamos, através desta pesquisa, a possibilidade de fazer uso de uma escuta analítica no trabalho com pacientes internados, a qual está sempre voltada para as manifestações do inconsciente ao longo da fala, e na qual a direção do tratamento é a emergência do sujeito do inconsciente.

O conceito de risco vem tendo uso crescente no entendimento das relações entre saúde e ambiente. Uma revisão recente do seu emprego¹ mostrou que o risco é próprio da condição humana e que a exclusão da incerteza promove a manutenção do status quo. O problema que se coloca é como propor ações de melhoria na saúde ambiental sob os pressupostos da dúvida e da incerteza que caracterizam a condição de risco. Como proposta de solução, a obra de H. Arendt² prestou-se ao exame dos significados e das implicações da incerteza no campo do pensamento e no campo da ação. Os resultados mostram que o risco se insere na lacuna construída entre o passado e o futuro. Quando esta lacuna passa a ser entendida como espaço de possibilidades, a incerteza, produzida no campo do pensamento fomenta a liberdade e a participação no campo da ação. A valorização da subjetividade e o exercício do juízo promovem a configuração de novos contextos e de novas possibilidades de ação, tanto em relação à natureza como em relação aos homens. Este conhecimento novo se insere na lacuna entre passado e futuro e realimenta o processo. Conclui-se que as ações de promoção da saúde devem estar aptas a aceitar resultados não necessariamente idealizados. Na ação livre não existem certezas e a sua relevância não está nos fins que se possa estabelecer, mas no processo do seu exercício.

In the last decades of the 1901 century the Mexican society went through a period of political and economical stability, and relative social tranquility. on contrast, during the revolutionary context various armed movements promoted the disruption of this status quo. In this article, by the analysis of several testimonies, I intend to show some aspects regarding criminality and violence phenomena, during the 1910 and 1920 years on the Northern Mexico.

The burden of disease is borne by those who suffer as patients but also by society at large, including health service providers. That burden is felt most severely in parts of the world where there is no infrastructure, or foreseeable prospects of any, to change the status quo without external support. Poverty, disease and inequality pervade all the activities of daily living in low-income regions and are inextricably linked. External interventions may not be the most appropriate way to impact on this positively in all circumstances, but targeted programmes to build social capital, within and by countries, are more likely to be sustainable. By these means, basic oral healthcare, underpinned by the primary healthcare approach, can be delivered to more equitably address needs and demands. Education is fundamental to building knowledge-based economies but is often lacking in such regions even at primary and secondary level. Provision of private education at tertiary level may also introduce its own inequities. Access to distance learning and community-based practice opens opportunities and is more likely to encourage graduates to work in similar areas. Recruitment of faculty from minority groups provides role models for students from similar backgrounds but all faculty staff must be involved in supporting and mentoring students from marginalized groups to ensure their retention. The developed world has to act responsibly in two crucial areas: first, not to exacerbate the shortage of skilled educators and healthcare workers in emerging economies by recruiting their staff; second, they must offer educational opportunities at an economic rate. Governments need to lead on developing initiatives to attract, support and retain a competent workforce.

Standard Test Methods (e.g. ASTM, DIN) for materials characterization in general, and for fatigue in particular, do not contemplate specimens with complex geometries, as well as the combination of axial and in-plane bending loads in their methodologies. The present study refers to some patents and the new configuration or configurations of specimens (non-standardized by the status quo of test methods) and a device developed to induce axial and bending combined forces resultants from axial loads applied by any one test equipment (dynamic or monotonic) which possesses such limitation, towards obtaining more realistic results on the fatigue behavior, or even basic mechanical properties, from geometrically complex structures. Motivated by a specific and geometrically complex aeronautic structure (motor-cradle), non-standardized welded tubular specimens made from AISI 4130 steel were fatigue-tested at room temperature, by using a constant amplitude sinusoidal load of 20 Hz frequency, load ratio R = 0.1 with and without the above referred auxiliary fatigue apparatus. The results showed the fatigue apparatus was efficient for introducing higher stress concentration factor at the welded specimen joints, consequently reducing the fatigue strength when compared to other conditions. From the obtained results it is possible to infer that with small modifications the proposed apparatus will be capable to test a great variety of specimen configurations such as: squared tubes and plates with welded or melted junctions, as well as other materials such as aluminum, titanium, composites, polymeric, plastics, etc. © 2009 Bentham Science Publishers Ltd.
