The film company, Roadshow, the pay television company Foxtel, and Rupert Murdoch’s News Corp and News Limited — as well as copyright industries — have been clamouring for new copyright powers and remedies. In the summer break, the Coalition Government has responded to such entreaties from its industry supporters and donors, with a new package of copyright laws and policies. There has been significant debate over the proposals between the odd couple of Attorney-General George Brandis and the Minister for Communications, Malcolm Turnbull. There has been deep, philosophical differences between the two Ministers over the copyright agenda. The Attorney-General George Brandis has supported a model of copyright maximalism, with strong rights and remedies for the copyright empires in film, television, and publishing. He has shown little empathy for the information technology companies of the digital economy. The Attorney-General has been impatient to press ahead with a copyright regime. The Minister for Communications, Malcolm Turnbull, has been somewhat more circumspect,recognising that there is a need to ensure that copyright laws do not adversely impact upon competition in the digital economy. The final proposal is a somewhat awkward compromise between the discipline-and-punish regime preferred by Brandis, and the responsive regulation model favoured by Turnbull. In his new book, Information Doesn’t Want to Be Free: Laws for the Internet Age, Cory Doctorow has some sage advice for copyright owners: Things that don’t make money: * Complaining about piracy. * Calling your customers thieves. * Treating your customers like thieves. In this context, the push by copyright owners and the Coalition Government to have a copyright crackdown may well be counter-productive to their interests. This submission considers a number of key elements of the Coalition Government’s Copyright Crackdown. Part 1 examines the proposals in respect of the Copyright Amendment (Online Infringement) Bill 2015 (Cth). Part 2 focuses upon the proposed Copyright Code. Part 3 considers the question of safe harbours for intermediaries. Part 4 examines the question of copyright exceptions – particularly looking at the proposal of the Australian Law Reform Commission for the introduction of a defence of fair use. Part 5 highlights the recommendations of the IT Pricing Inquiry and the Harper Competition Policy Review in respect of copyright law, consumer rights, and competition law.

Developer paid fees or infrastructure charges are a commonly used mechanism for local governments to pay for new infrastructure. However, property developers claim that these costs are merely passed on to home buyers, with adverse effects to housing affordability. Despite numerous government reports and many years of industry advocacy, there remains no empirical evidence in Australia to confirm or quantify this passing on effect to home buyers and the consequent effect on housing affordability. Hence there remains no data from which governments can base policy decision on, and the debate continues. This research examines the question of the impact of infrastructure charges on housing affordability in Australia. It employs hedonic regression methods to estimate the impact of infrastructure charges on house prices and vacant lot prices in Brisbane, Australia during 2005-2011, using a data set of 29,752 house sales, comprising 4,699 new house sales and 25,053 existing house sales and 13,739 lot sales. The regression results for the effect of infrastructure charges on house prices in Brisbane indicated that for every $1.00 of infrastructure charge levied on developers, all house prices increase by $3.69 or a 369% overpassing of these government levies onto home buyers. Thus, this one government levy could be responsible for $877 per month on home owner mortgage repayments in Brisbane, Queensland. This research is consistent with international findings, that support the proposition that developer paid infrastructure charges are passed on to home buyers and are a significant contributor to increasing house prices and reduced housing affordability. Understanding who really pays for urban infrastructure is critical to both the housing affordability and infrastructure funding debates in Australia and this research provides the first empirical data for policy makers to assess their policy objectives and outcomes against.

This submission addresses the problem of housing price inflation, the chronic under-supply of new housing stock, and the resultant decline in housing affordability for low and middle income households. It specifically focusses on the supply of medium density housing (multi-unit development) in Melbourne, although we believe that the observations made about housing in supply in Melbourne are relevant in other urban centres and to other types of housing supply. In terms of medium density housing (MDH) our concern also extends to the poor quality and design. Why the market tends to deliver generic apartments of poor quality and design which are uncompetitive with lower density housing and amenity despite planning objectives, and how this apparently intractable problem can be overcome is the topic of this submission...

Analisa a Constituição Federal e as Leis Ordinárias editadas em 2011 para saber se existe a prevalência de uma das Casas do Congresso Nacional na elaboração das leis. O estudo pretende, a partir da abordagem teórica e da análise das legislações publicadas, observando o processo legislativo bicameral para deliberação dos projetos, verificar as consequências para a definição do texto final das leis publicadas. Para tanto, propõe-se realizar estudo sobre o Poder Legislativo no Brasil e o modelo de sistema bicameral adotado. Também são analisadas todas as Constituições editadas no Brasil para saber os aspectos históricos e políticos em sua elaboração e os efeitos na definição das atribuições das Casas do Congresso Nacional, com repercussões no processo legislativo. É realizada a análise da tramitação legislativa da Lei de Improbidade Administrativa, expondo os textos adotados pelas Casas, com a definição do texto encaminhado para transformação em norma jurídica.

Trata da definição de princípios e de sua validade no processo legislativo. Estuda, inicialmente, a evolução do Estado e do Poder Legislativo para situar sua importância e suas regras. Posteriormente, propõe a delimitação do que são princípios e quais os mais caros ao processo legislativo, definindo o princípio democrático (e correlatos) e o princípio do bicameralismo como pontos de partida. Após essa explanação, procura aplicar o referencial teórico à tramitação do projeto de lei da Ficha Limpa, focando na emenda de redação do Senado Federal como possível afronta aos princípios citados. Essa discussão ainda é abordada segundo as ações propostas ao Poder Judiciário e as respostas dos tribunais à questão. /// The study aims to define what are the principles and validity study of the legislative process. It was initially studied the evolution of the state and particularly the Legislature to place the reader on its importance and its rules. Subsequently, it is proposed that the delimiting of the principles and which are the most expensive of the legislative process, defining the democratic principle (and related) and the principle of bicameralism as starting points. After this explanation, we try to apply the theoretical framework for the processing of the bill of ¿Ficha Limpa¿, focusing on the wording of the amendment in the Senate as a possible affront to the principles cited. This discussion is addressed under the proposed actions to the courts and the courts' responses to the question.

One of the causes of lower artesian pressure, water waste and aquifer contamination is the misuse and insufficient care of artesian wells. In 1953, Senate Bill No. 57, entitled "An Act to Protect and Control the Artesian Waters of the State" (see Appendix) became a law. This law was passed through the efforts exerted by leading members of the Senate and the House of Representatives, who understood the need for a wise and controlled expenditure of our most valuable natural resource. The State Geologist and his authorized representatives were designated by this law to enforce this conservation measure; however, no financial provision was included for the 1953-55 biennium. The proposed program of the Florida Geological Survey for this biennium did not include the funds nor provide any full-time personnel for the enforcement of this statute. As a result, little actual work was accomplished during these two years, although much time was given to planning and discussion of the problem. Realizing that this program could provide additional basic data needed in the analysis of the water-supply problem, the State Geologist sought and was granted by the 1955 Legislature adequate funds with which to activate the first phase of the enforcement of Florida Statute No. 370.051-054. Enumerated below is a summary of the progress made on this investigation as outlined previously: 1. Data have been collected on 967 wildly flowing wells in 22 counties. 2. Chloride determinations have been run on 850 of the 967 wells. 3. Of the 967 wells, 554 have chlorides in excess of the 250 ppm, the upper limit assigned by the State Board of Health for public consumption. 4. Water escapes at the rate of 37, 762 gallons per minute from these 967 wells. This amounts to 54, 377, 280 gallons per day. The investigation is incomplete at this time; therefore, no final conclusions can be reached. However, from data already collected, the following recommendations are proposed: 1. That the present inventory of wildly flowing wells be completed for the entire State. 2. That the current inventory of wildly flowing wells be expanded at the conclusion of the present inventory to include all flowing wells. 3. That a complete statewide inventory program be established and conducted in cooperation with the Ground Water Branchof the U.S. Geological Survey. 4. That the enforcement functions as set down in Sections 370.051/.054, Florida Statutes, be separated from the program to collect water-resource data and that these functions be given to the Water Resources Department, if such is created (to be recommended by the Water Resources Study Commission in a water policy law presented to the 1957 Legislature). 5. That the research phase (well inventory) of the program remain under the direction of the Florida Geological Survey. (PDF contains 204 pages.)

Avalia a condição de saúde dos membros da 54ª Legislatura (2011-2014), mediante avaliação de alguns parâmetros de saúde. O texto levanta dados sócio demográficos, antropométricos, clínicos e hábitos individuais de um grupo de parlamentares. Foram pesquisadas variáveis para avaliação de riscos à saúde, abrangendo a síndrome metabólica, o sedentarismo, o estresse, a alimentação desregrada, o tabagismo e as próprias peculiaridades da atividade legislativa na Câmara dos Deputados. Junto às questões referentes a situações de possível potencial patológico, foi aplicado questionário de risco cardíaco elaborado pela Michigan Hearth Association. Foi aplicado questionário, na forma de entrevista semiestruturada, para obter-se a percepção dos deputados acerca do impacto da atividade legislativa na sua saúde. A pesquisa levantou dados que permitem confrontar os desconfortos relatados e os dados antropométricos obtidos. Os números obtidos para o índice de massa corporal e circunferências abdominal, de quadril e de cintura apontam para a existência de doença metabólica entre aqueles de nenhuma ou pouca prática de atividade física regular, além de um risco cardiovascular estimado em médio e alto para 45% da amostra.

The Alliance for Coastal Technologies (ACT) Partner University of Michigan convened a workshop on the Applications of Drifting Buoy Technologies for Coastal Watershed and Ecosystem Modeling in Ann Arbor, Michigan on June 5 to 7,2005. The objectives of the workshop were to: (1) educate potential users (managers and scientists) about the current capabilities and uses of drifting buoy technologies; (2) provide an opportunity for users (managers and scientists) to experience first hand the deployment and retrieval of various drifting buoys, as well as experience the capabilities of the buoys' technologies; (3) engage manufacturers with scientists and managers in discussions on drifting buoys' capabilities and their requirements to promote further applications of these systems; (4) promote a dialogue about realistic advantages and limitations of current drifting buoy technologies; and (5) develop a set of key recommendations for advancing both the capabilities and uses of drifting buoy technologies for coastal watershed and ecosystem modeling. To achieve these goals, representatives from research, academia, industry, and resource management were invited to participate in this workshop. Attendees obtained "hands on" experience as they participated in the deployment and retrieval of various drifting buoy systems on Big Portage Lake, a 644 acre lake northwest of Ann Arbor. Working groups then convened for discussions on current commercial usages and environmental monitoring approaches including; user requirements for drifting buoys, current status of drifting buoy systems and enabling technologies, and the challenges and strategies for bringing new drifting buoys "on-line". The following general recommendations were made to: 1). organize a testing program of drifting buoys for marketing their capabilities to resource managers and users. 2). develop a fact sheet to highlight the utility of drifting buoys. 3). facilitate technology transfer for advancements in drifter buoys that may be occurring through military funding and development in order to enhance their technical capability for environmental applications. A partir da perspectiva teórica de que o fortalecimento da democracia representativa vincula-s ao desenvolvimento da democracia participativa, este trabalho visa a analisar o exercício da participação política por meio do uso de ferramentas de tecnologia de informação e comunicação (TICs) no que se refere à elaboração de políticas públicas durante o processo legislativo. Além de avaliar outras experiências internacionais com esse intuito, o presente trabalho tem como base a realização de estudos de caso referentes a práticas participativas digitais desenvolvidas por parlamentos, em especial sobre o Programa e-Democracia da Câmara dos Deputados brasileira e o Projeto Senador Virtual do Senado chileno. Por meio de metodologia qualitativa, o estudo concluiu que tais projetos apresentam resultados ainda incipientes quanto à melhoria de representatividade na tomada de decisão, de agregação de inteligência coletiva no processo legislativo e de transparência da atuação parlamentar, elementos caros à democracia participativa e deliberativa. Não obstante, essas experiências têm o mérito de contribuir para a construção gradual de mecanismos participativos mais efetivos e complementares ao sistema de representação política

The relationship between late-Victorian Decadence and Aestheticism and politics has long been vexed. This article explores the hitherto under-explored confluence of conservatism and avant-garde literature in the period by introducing The Senate, a Tory-Decadent journal that ran from 1894-7. While Decadent authors occupied various political positions, this article argues that The Senate offers a crucial link between conservatism and Decadence The article presents the journal in its political and publishing context, outlining its editorial position on such issues as the Liberal Unionist-Conservative coalition governments, Britain's relationship with Europe and the threat of ‘State Socialism’, as well as its valorisation of Bollingbroke and eighteenth-century Toryism, and its relationship to, and difference from, key Decadent journals the Yellow Book and The Savoy. It then goes on to articulate its relationship to Decadence by focussing on the presence of Paul Verlaine in its pages and its vitriolic response to the press coverage of Oscar Wilde's trials. The article concludes by exploring the surprising wake of The Senate, briefly tracing the editors' influence in the development of Modernism and links with the journal BLAST.
