It is suggested that the ability and practices of how the multinational corporation (MNC) manages knowledge transfer among its geographically dispersed subsidiary units are crucial for the building and development of firm competitive advantage. However, cross-border transfer of valuable organizational knowledge is likely to be problematic and laborious, especially within diversified and differentiated MNCs. Using data collected from 164 western multinational companies’ subsidiary units located in China and Finland, this study aims to investigate cross-border knowledge transfer within the MNC. It explores a number of factors that influence the transfer of knowledge among units in the differentiated MNC. The study consists of five individual papers. Paper 1 investigates a range of organizational mechanisms that may positively influence a subsidiary’s propensity to undertake knowledge transfers to other parts of the corporation. Paper 2 explores the impact of subsidiary location on the motivational dispositions of knowledge receiving units to value and accept knowledge from subsidiaries located in economically less advanced countries. Paper 3 examines the influence of social capital variables on knowledge transfer in dyadic relationships between foreign-owned subsidiaries and their sister and patent units. Paper 4 provides some initial insights into potentially different effects of trust and shared vision in intra-organizational vs. inter-organizational relationships. Using a case study setting, Paper 5 explores means and mechanisms used in transferring human resource management practices to Western MNCs’ business units in China from a cultural perspective. The results of the study show that MNC management through choices regarding organizational controls can encourage and enhance corporate-internal knowledge transfer. It also finds evidence that more knowledge is transferred from subsidiaries located in an industrialized country (e.g., Finland) than subsidiaries located in a developing country (e.g., China). While the study has highlighted the importance of social capital in promoting knowledge transfer, it has also uncovered some new findings that the effect of trust and shared vision may be contingent upon different contexts. Finally, in Paper 5, a number of mechanisms used in transferring selected HRM practices and competences to the Chinese business units have been identified. The findings suggest that cultural differences should be taken into consideration in the choice and use of different transfer mechanisms.

This paper analyses the impact of the launch of the European Monetary Union (EMU) on the allocation of international portfolio investments. The initiation of the EMU provides an opportunity for comparison of competing theoretical explanations for investment behavior. Models stressing the diversification motive would predict that the increased dependence between countries participating in the EMU should reduce the attractiveness of portfolio holdings in other EMU countries. Models based on asymmetric information would instead emphasize the increased intensity in the flow of information resulting from an increase in cross border transactions between the EMU countries. The consequent decline in information asymmetry should increase, rather than reduce portfolio holdings in other EMU countries. Our results based on the allocation of Finnish foreign portfolio investment support the information-based explanation against predictions based on the diversification motive.

The thesis aims at investigating the local dimension of the EU cohesion policy through the utilization of an alternative approach, which aims at the analysis of discourse and structures of power. The concrete case under analysis is the Interreg IV programme “Alpenrhein-Bodensee-Hochrhein”, which is conducted in the border region between Germany, Switzerland, Austria and the principality of Liechtenstein. The main research question is stated as such: What governmental rationalities can be found at work in the field of EU cross-border cooperation programmes? How is directive action and cooperation envisioned? How coherent are the different rationalities, which are found at work? The theoretical framework is based on a Foucaultian understanding of power and discourse and utilizes the notion of governmentalities as a way to de-stabilize the understanding of directive action and in order to highlight the dispersed and heterogeneous nature of governmental activity. The approach is situated within the general field of research on the European Union connected to basic conceptualisations such as the nature of power, the role of discourse and modes of subjectification. An approach termed “analytics of government”, based on the work of researchers like Mitchell Dean is introduced as the basic framework for the analysis. Four dimensions (visiblities, subjectivities, techniques/practices, problematisations) are presented as a set of tools with which governmental regimes of practices can be analysed. The empirical part of the thesis starts out with a discussion of the general framework of the European Union's cohesion policy and places the Interreg IV Alpenrhein-Bodensee-Hochrhein programme in this general context. The main analysis is based on eleven interviews which were conducted with different individuals, participating in the programme on different levels. The selection of interview partners aimed at maximising heterogeneity through including individuals from all parts of the programme region, obtaining different functions within the programme. The analysis reveals interesting aspects pertaining to the implementation and routine aspects of work within initiatives conducted under the heading of the EU cohesion policy. The central aspects of an Interreg IV Alpenrhein-Bodensee-Hochrhein – governmentality are sketched out. This includes a positive perception of the work atmosphere, administrative/professional characterisation of the selves and a de-politicization of the programme. Characteristic is the experience of tensions by interview partners and the use of discoursive strategies to resolve them. Negative perceptions play an important role for the specific governmental rationality. The thesis contributes to a better understanding of the local dimension of the European Union cohesion policy and questions established ways of thinking about governmental activity. It provides an insight into the working of power mechanisms in the constitution of fields of discourse and points out matters of practical importance as well as subsequent research questions.

This study examines the Sámi people and the construction of the Sámi identity and the role of language in the cross-border Sámi movement within the context of the international indigenous movement and discourse between 1962 and 2008. The Sámi movement began as a reaction to state assimilation policies. This led to the birth of indigenous processes strengthening the Sámi cultures and languages. Activities across borders and the ethnopolitical processes in each of the Nordic countries in question also formed the basis of the internationalization of the Sámi people. The discourse on indigenous peoples has grown into a question of human rights, which is examined in different national and international contexts. The study is based on ethnographic data that has been collected via interviews, questionnaires and participant observation with the researched people in different meetings and events. Archive and newsprint material are also used. The approach of the study is auto-ethnographic. The post-colonial theories used in the study strive to destabilize power relations and the distinctions of otherness produced by colonialism, and to reclaim both one's own culture and language in the context of the indigenous movement. A standard model for this type of approach was created by Edward W. Said in his 1978 work Orientalism. The central concepts of the analysis are decolonization, otherness, ethnicity and identity. The dissertation consists of four published articles and an introduction. The subject matter is analyzed on three levels: global, European and Nordic. On the global level, the results demonstrate that the indigenous movement has constructed a new understanding of indigenousness with new rights. International treaties have facilitated the unification of new concepts and rights, such as the right to self-determination and language, also helping in transforming them into rights of the Sámi people on a national level. On the Nordic level, aligning the Sámi culture with indigenous discourse became significant for the process of developing the Sámi identity in the Sámi movement. In this process, the Sámi movement made use of Sámi languages in order to mobilize groups of people and to construct relatedness between different Sámi groups. The realization that one s own language is significant to one's culture has resulted in recreating the vitality, visibility and the legitimation of language in society more generally. The migration of the Sámi people from their traditional territories to increasingly multi-ethnic urban areas alters one's relationship to one's own community as the relationship to cultural traditions changes. Among the urban Sámi, who form a group of ‘new Sáminess’, linguistic discrimination and assimilation continue because of the lack of legislative and other effective language policy measures to promote the learning and use of the Sámi language.

Introducción: El contrato de gestación por sustitución, también llamado alquiler de vientres o maternidad subrogada, es aquel en el que se acuerda con una mujer (la madre subrogante) que esta tendrá un hijo y luego se lo dará a quien encargó al niño. Dependiendo del caso, los gametos pueden ser de la madre subrogante, de los pretensos padres, solo de uno de ellos o de ninguno, es decir, de terceras personas. En algunos países estos contratos están prohibidos, mientras que en otros están permitidos y, en otros, no regulados. En este marco de dispersión normativa se ha generado un fenómeno llamado “turismo reproductivo”, que consiste en que quien pretende obtener un niño por subrogación, viaje de su Estado de residencia a otro – en donde la regulación sea más permisiva– con el solo objeto de celebrar un contrato de gestación por sustitución y anotar al niño como propio. Como consecuencia, no solo existen complicaciones para los pretensos padres a la hora de querer volver al Estado donde buscan que se reconozca a ese hijo como propio, sino que, una vez en el Estado receptor, basándose en el orden público, puede que este no reconozca el certificado de nacimiento en donde el niño es inscripto como hijo de ellos. En este escenario es donde se sitúa la sentencia en comentario.

O consumidor é o agente vulnerável na relação de consumo internacional. O processo de globalização se apresenta, para o consumidor, como uma globalização do consumo. A globalização do consumo se caracteriza pelo comércio e fornecimento internacional de produtos e serviços por empresários/fornecedores transnacionais/globais, utilizando marcas de renome mundial, acessíveis a todos os consumidores do planeta, e agrava a vulnerabilidade do consumidor no mercado. A proteção jurídica do consumidor internacional é uma necessidade que os sistemas jurídicos nacionais não se mostram aptos a prover adequadamente, assim como o Direito Internacional também não. A presente tese demonstra a deficiência da Ciência do Direito na proteção do consumidor no contexto da globalização; demonstra como o próprio comércio internacional é prejudicado ao não priorizar de maneira absoluta e efetiva a proteção do consumidor na OMC, bem como ao mostrar-se apático diante dos diferentes níveis de proteção proporcionada aos consumidores em cada diferente sistema jurídico nacional; demonstra, também, como a proteção do consumidor de maneira uniforme e global por um direito comum aos Estados é possível e será capaz de tornar mais eficiente economicamente o processo de globalização do consumo, ao encorajar a participação mais intensa do consumidor no mercado internacional; e propõe a construção de um novo ramo do Direito dedicado ao problema, o Direito Internacional do Consumidor (DIC), por meio da elaboração de uma Teoria do Direito Internacional do Consumidor. O Direito Internacional do Consumidor pretende ser um direito comum e universal de proteção ao consumidor, fundado em métodos, conceitos, institutos, normas e princípios jurídicos universais. O DIC dialogará com outros ramos do Direito Público e Privado, especialmente o Direito Internacional Econômico, o Direito Internacional do Comércio, o Direito Internacional Privado, o Direito Processual Civil Internacional, e o Direito do Consumidor. Pretende-se com isto atender ao ideal de promover o livre comércio internacional com respeito aos Direitos Humanos.

A partir da última década do século passado, muito embora alguns ordenamentos jurídicos tenham reconhecido os relacionamentos entre pessoas do mesmo sexo, conferindo-lhes alguns efeitos jurídicos, até hoje o padrão de heteronormatividade impede que estes alcancem a plena equiparação com o paradigma heterossexual. Os organismos internacionais de proteção aos direitos humanos já reconhecem certos patamares inerentes ao direito de liberdade à orientação sexual, muito embora ainda não se tenha alcançado à etapa da consagração do direito à vida afetiva e familiar. No entanto, a crescente internacionalização da vida contemporânea aumentou a estraneidade jurídica dos relacionamentos homoafetivos, cujo reconhecimento fora do Estado da constituição é muitas vezes recusado por argumentos que podem ser superados pela ótica convergente do Direito Transnacional promovendo a legitimidade do pleno reconhecimento transfronteiriço de todos os casamentos e parcerias entre pessoas do mesmo sexo validamente realizadas, como forma de garantir o respeito à cidadania cosmopolita inerente à dignidade dos indivíduos pertencentes a estas famílias.

Proiektu honen helburua da ERTMS sistemaren barneko ETCS protokoloa hedatzea simulazio hibridodun ingurune batean, ERTMS sistemaren hedatzea azkartuko duten erakusleak sortuz. Horretarako, OPNET simulagailuaren System-in-the-loop erreminta erabili da. Erreminta hau baliatuz ETCS protokoloaren pakete errealak ingurune simulatuan integratzeko funtzioen liburutegi bat idatzi da. Amaitzeko, liburutegi hori baliatuz ETCS protokoloak sareko arazoen aurrean duen errendimenduaren analisi bat burutu da eta liburutegi berri horrek pakete errealak simulatuetara itzultzean (eta kontrakoa) duen errendimendua zein den aztertu da.

Através de narrativas sobre as práticas cotidianas de quatro professoras (três brasileiras e uma francesa), acompanhadas de narrativas desenvolvidas entorno de um conjunto de imagens de alunos, esta pesquisa busca pensar como professores e alunos produzem os currículos nos seus cotidianos escolares. Através dos diferentes usos dos materiais disponíveis, dos questionamentos, das histórias de vida e das inúmeras experiências que constituem as subjetividades, os praticantes das escolas tecem, em redes, os seus conhecimentos e suas significações para a vida. Problematizando esta temática, com a professora de artes, Cristiane Costa, busco desenvolver uma discussão metodológica sobre os estudos dos cotidianos, me propondo compreender algumas possibilidades das táticas cotidianas de aprenderensinar. Com uma professora de matemática, Luciana Getirana, acompanhada da narrativa de uma aluna, Maria Nunes, analiso as relações entre conhecimentos científicos e conhecimentos cotidianos. Em seguida, com a professora de língua portuguesa, Cristiane Souza, discuto as demandas de professores por uma fórmula, uma receita de bolo, que contenha algumas soluções para os problemas da educação. Com a professora de história e geografia, Laure Cambos, busco pensar o professor no atravessamento de fronteiras entre culturas e conhecimentos. Neste sentido, elegi duas práticas de mediação cultural presentes no cotidiano desta professora: a primeira é o uso de imagens como prática de aprenderensinar, e a segunda consiste nas atividades de saídas da escola (aulas caminhadas). Por último, reúno fotografias de alunos para desenvolver duas temáticas que entrelaçam os capítulos anteriores: o dentrofora das escolas e as experimentações do mundo. A partir de narrativas sobre estas imagens, procuro pensar os cotidianos dos alunos nas práticas de aprenderensinar. Compreender estes currículos em redes possibilita problematizar as noções que não reconhecem a fragilidade das fronteiras, por perceberem os cotidianos através de relações dicotômicas. Estas fronteiras são habitadas pelos professores, produtores de possibilidades de mediações entre diferentes culturas e conhecimentos. Como práticas de atravessamento de fronteiras, as práticas de aprenderensinar buscam alternativas para a dicotomia que separa o dentro e o fora da escola, os conhecimentos cotidianos e os conhecimentos científicos, bem como os currículos prescritos e os currículos vividos. A pesquisa tem apoio teórico em autores como Nilda Alves, Michel de Certeau, Henri Lefebvre, Boaventura Santos, Nèstor Canclini entre outros.

Ante a crescente utilização dos meios eletrônicos como forma de viabilizar o comércio de produtos e serviços além das fronteiras estatais o presente estudo tem como escopo identificar os desafios oriundos do embate entre a realidade cibernética e o direito internacional contemporâneo, pontuando, de forma crítica, as soluções descortinadas pela sociedade internacional. Isto porque as questões de direito internacional, já conflituosas no âmbito do comércio internacional tradicional, se mostram ainda mais subjetivas no peculiar ambiente virtual, em regra desmaterializado e a desterritorializado. Tais características e peculiaridades refletem na identificação da jurisdição e da lei aplicável no contrato eletrônico, nas soluções para o combate do cibercrime e na solução alternativa de conflitos, ademais de outros temas que foram possíveis de serem abordados neste estudo. Para tanto é proposto um exame das soluções até então desenvolvidas para a regularização e/ou padronização das condutas no âmbito do comércio internacional por via eletrônica, colacionando a normativa e a jurisprudência implementadas e/ou em desenvolvimento na área.

Few studies have quantified the extent of nocturnal cross-habitat movements for fish, or the influence of habitat adjacencies on nutrient flows and trophodynamics. To investigate the patterns of nocturnal cross-boundary movements of fish and quantify trophic connectivity, fish were sampled at night with gillnets set along the boundaries between dominant habitat types (coral reef/seagrass and mangrove/seagrass) in southwestern Puerto Rico. Fish movement across adjacent boundary patches were equivalent at both coral reefs and mangroves. Prey biomass transfer was greater from seagrass to coral reefs (0.016 kg/km) and from mangroves to seagrass (0.006 kg/km) but not statistically significant, indicating a balance of flow between adjacent habitats. Pelagic species (jacks, sharks, rays) accounted for 37% of prey biomass transport at coral reef/seagrass and 46% at mangrove/seagrass while grunts and snappers accounted for 7% and 15%, respectively. This study indicated that coral reefs and mangroves serve as a feeding area for a wide range of multi-habitat fish species. Crabs were the most frequent prey item in fish leaving coral reefs while molluscs were observed slightly more frequently than crabs in fish entering coral reefs. For most prey types, biomass exported from mangroves was greater than biomass imported. The information on direction of fish movement together with analysis of prey data provided strong evidence of ecological linkages between distinct adjacent habitat types and highlighted the need for greater inclusion of a mosaic of multiple habitats when attempting to understand ecosystem function including the spatial transfer of energy across the seascape.

The fisheries of Lake Albert have come under increasing focus due to several driving forces that have synergistically evolved resulting into concerns from diverse stakeholders. The driving forces include: the commercialization of the fisheries with entry into the value chain of industrial fish processing, a decline in fish stocks especially of the large-size fishes and the emergency of the light - fishing targeting small pelagic fishes. In addition, the assumption by some opinion leaders that light-fishing (use of light) has destroyed the Nile perch fishery of Lake Albert, other factors such as cross-border fishing conflicts, the emergence of oil, an influx of traders in fish-related activities, and the limited regulatory and enforcement regimes for the diverse commercially exploited fish fauna of Lake Albert all require continuous information and action.
