Em instigante artigo, Domingues (2011), que ainda permanece muito relevante e atual, e em que se faz uso da alegoria simbolizada pela espada de Dâmocles, somos alertados para possíveis efeitos da Ação Direta de Inconstitucionalidade (ADI) 2.316, que foi proposta no já longínquo ano de 2000, pelo antigo Partido Liberal. Tal ADI 2.316, que continua pendente de definição por parte do Supremo Tribunal Federal (STF), diz respeito ao artigo 5º da Medida Provisória (MP) 2.170–36/2001, que estabelece: “Art. 5º. Nas operações realizadas pelas instituições integrantes do Sistema Financeiro Nacional, é admissível a capitalização de juros com periodicidade inferior a um ano.” Ou seja, em outras palavras, ainda não há decisão final, pois que o STF não concluiu sua apreciação da matéria, sobre se o chamado regime de juros compostos pode ser empregado em prazos que sejam frações do ano.

Este trabalho procura constituir no campo do direito público um referencial analítico que permita avaliar a governança das políticas públicas de financiamento do desenvolvimento. A construção deste referencial tem como base a teoria da agência e, a partir das categorias de “agente” e “principal”, procura estabelecer uma tipologia das alternativas de governança. De um lado, são estabelecidas as possibilidades de “principal” político, isto é, a quem compete estabelecer a agenda da política pública. As possibilidades debatidas são circunscritas a uma escala alternada pela legislação parlamentar e pela discricionariedade executiva. De outro lado, são estipuladas as possibilidades de “agência” econômica, ou seja, a quem cabe a implementação da política pública. As alternativas descritas situam-se entre a alocação para agências estatais ou para o mercado. Estas alternativas são, enfim, avaliadas por suas respectivas vantagens comparativas. As possibilidades de “principal” político são ponderadas em função do custo de transação política, que espelha a tensão entre participação e flexibilidade: arranjos mais flexíveis tendem a ser menos participativos e vice versa. Já as opções de “agência” econômica são ponderadas em função do custo de agência e tensionam a eficiência na realização da política com o controle de atendimento de seus objetivos. Com esse instrumental, o trabalho apresenta uma avaliação aplicada às ferramentas regulatórias do sistema financeiro nacional e assinala ajustes e desajustes na governança do financiamento corporativo, liderado pelo BNDES, e na governança dos sistemas financeiro habitacional (SFH) e imobiliário (SFI).

Em resposta à crise financeira de 2008, em 2010 o Comitê de Basileia em Supervisão Bancária (Basel Committee on Banking Supervision - BCBS) emitiu a metodologia do cálculo do indicador de Risco de Liquidez de curto prazo (Liquidity Coverage Ratio - LCR) que é um dos componentes do conjunto de normas conhecido como Basileia III. Esse índice mede se cada conglomerado possui um estoque de ativos financeiros líquidos de alta qualidade de forma a suportar uma crise severa por 30 dias. Esse trabalho calculou o índice de liquidez de curto prazo dos dez maiores bancos brasileiros em ativos totais nos últimos cinco anos, seguindo as diretrizes do documento acima mencionado e do Banco Central do Brasil. A finalidade desse estudo foi verificar se houve uma melhora na liquidez dos grandes bancos após a divulgação da metodologia de cálculo do LCR, uma vez que a partir de 2015 é esperado pelo Banco Central do Brasil que os bancos possuam pelo menos 60% de ativos líquidos para suportar uma crise de 30 dias. A análise foi conduzida utilizando dados contábeis oriundos tanto do banco de dados do Banco Central do Brasil quanto das publicações individuais de cada instituição. Essa análise permitiu avaliar que os principais bancos do sistema financeiro brasileiro já estão preparados para atender aos requisitos internacionais e que não serão necessárias grandes alterações na estrutura do balanço das instituições analisadas, evitando a migração seus ativos de empréstimos, aplicações em certificados de depósitos interbancários e títulos privados para títulos de alta qualidade e liquidez.

The globalization of markets has confirmed for the processes of change in organizations both in structure and in management. This dynamic was also observed in credit unions because they are financial institutions and are under the rules of the Brazil´s Financial System. Given the context of organizational changes in the financial capital has played the traditional management reform is urgent. In organizations credit unions, given its dual purpose, because in the same organizational environment and capitalism coexist cooperative whose logics are antagonistic, but can live through the balance between instrumental rationality and substantive rationality in credit unions. Based on this concept a new form of management should be thought to be able to accommodate the demand of cooperative, community, government and the market. Hybridization has been observed in management practices` COOPERUFPA into dimensions financial, social and solidarity participation with a trend in paradigmatic form of hybrid management, in that it directly or indirectly affect the management decisions in the credit union. The hybrid management is a trend that has been setting the basis for societal transformation, so that credit unions promote actions of welfare oriented cooperative members and the community around the same time that attend the dynamics of market globalization. These actions, in the context of hybrid management should be implemented by COOPERUFPA from the sociability of the remains and the wide diffusion of solidarity culture between cooperative partnership as a way to recover their participation in trade relations, financial and the social collective developement. For the members of COOPERUFPA financial interest is evidenced in greater relevance for the social interest given its dominant relationship as "mere customer" of the credit union, however, the proactive participation of the life of the cooperative credit union is one of its expectative among of participation of to share power in decisions by general meetings. This passivity`s cooperator of the COOPERUFPA in defending the ideals overshadowed the spread of cooperative principles and values of cooperation among them. Thus his conception for COOPERUFPA in the financial dimension, social and solidarity democracy, performed transversely. The COOPERUFPA for not developing an education policy for the cooperation among its members, contributed to a process of collective alienation of cooperative ideals, since the cooperative do not understand the reality that surrounds them as members of an organization whose mission is to social and financial sustainability of its members

O Sistema Financeiro Brasileiro tem sofrido enormes mudanças, oriundas, principalmente, do fim da “ciranda financeira”, da globalização, da estabilização da economia e do aumento das exigências de um consumidor melhor informado. Em decorrência de tal realidade, as instituições financeiras têm buscado novos conceitos de gestão, a fim de garantir a sua sobrevivência. O presente trabalho tenta demonstrar as modificações que ocorreram no Banco do Brasil em virtude da utilização dos conceitos de Gestão Econômica. Para tal, é apresentado o modelo de apuração de resultados no que tange à captação de um CDB, antes e depois da introdução do GECON. No final, são apresentadas as conseqüências práticas advindas do uso dos referidos conceitos.

Com uma abordagem sistêmica se realizou-se uma análises da capacitação dos Recursos Humanos da Secretaria Nacional de Desarrollo Administrativo do Equador - SENDA-. É apresentada uma descrição da instituição analisada considerando sua origem, fmalidade, objetivos, estrura e resultados obtidos no âmbito da administração pública equatoriana. À luz de uma abordagem de tipo sistêmico da capacitação dos recursos humanos, significou obter um diagnóstico mais completo e propor uma política de administração eficiente do recurso mais importante das organizações, o ser humano.

A monografia apresenta uma análise global do Sistema Tributário Nacional, sob o prisma da repartição de recursos e de poder entre as três esferas de Governo, e uma análise mais específica do funcionamento do principal tributo estadual - o ICM - apontando suas principais distorções e seus efeitos na distribuição regional de recursos. O estudo da evolução do Sistema Tributário Nacional, dos fins do século passado até nossos dias, mostra uma tendência nítida de centralização de receitas e de poder tributário na união,bastante acentuada após a Reforma de 1966. A perda de autonomia dos Estados e Municípios em matéria de política fiscal teria sido o principal fator responsável por seu enfraquecimento financeiro e político, na medida em que mesmo os mefanismos de compensação concebidos pela própria Reforma como o sistema de participação nos tributos federais, acabaram ficando descaracterizados pelo , excesso de manipulações, ao arbítrio do poder central. Também no que se refere ao: ICM, a análise efetuada perrnite concluir que a excessiva centralização de decisões no Governo Federal, ao contrário de melhorar a eficiência do tributo, teria. contribui do para uma série de distorções em s~u funcionamento. A falta de uma definição política e normativa dos objetivos que se pretende com ele alcançar faz com que o imposto reúna hoje uma série de desvantagens, corno a redução da autonomia dos Estados, a interferência nos fluxos de comércio interno, e um insatisfatório sistema de distribuição de receitas no comércio interestadual. Neste último aspecto, análise empírica demonstrou que são substanciais as transferências interestaduais de ICM dos Estados importadores para os exportadores e que, na maioria dos casos, as transferências federais, através do Fundo de participação, não têm sido se quer capazes de compensar a redução da base tributária dos Estados mais pobres,representada por aquelas transferências .

In the current systemic crisis, economic policy is directed to correct the consequences of the functioning of this metabolism, but within the limits of the capital. From this perspective, decision makers propose trade policies, agricultural and industrial to ensure conditions for economic growth. However, as a dead end, there is failure of the State in giving efficacy to the operation of all segments of the economy, especially given the budget constraint. Public managers are forced to seek external resources, resuming the cycle of political allegiance to the interests of international financial and banking representatives, installed in so-called multilateral. The complex ideological capital comes into play in trying to convince society that the paths taken by governments are inevitable, and that capitalism can be "humanized", even with the realization of the growing inequalities caused by historical irrationalism of the production process of capital . In this sense, emerging concepts that attempt to demonstrate the compatibility of the system to real human needs. This ideological offensive is intended to legitimize the capital. The so-called third sector has a special highlight with the concept of corporate social responsibility. It creates a political environment in which the inevitable mix-up with new illusions offered by and often funding the metabolism of capital in order to perpetuate this system. In this context, political elites, and considerable portions of the academy, embark on "waves of capitalist optimism," while the sociometabolismo capital expands its historical limits, driving forces postponing their collapse, but that cause human suffering and ecological stress. Wars are disseminated to strengthen the deadly war industry and the automobile industry; and devastating the environment of which depends the capital system. In this scenario disassemble, propositions emerge around a "new social pact" in order to minimize the adverse effects of the dynamics of reproduction of capital. The business class is called to exercise its role through the discourse that appeals to social responsibility programs, in order to intervene directly in the "social question". The core of this research is precisely this point. Although there is considerable scholarship on the phenomenon of Social Responsibility and Corporate Citizenship, there is also an evident lack of this approach focused on the banking sector in Brazil. The importance of rentier capital increased ownership of shares in the wealth produced by all of Brazilian society, justifies a sociological research project on Social Responsibility in the domestic financial sector. In this sense, it was decided to perform a dynamic approach to the "Corporate Citizenship" in the banking industry, specifically in the Bank of Brazil. As this is a key institution, is important analyze of the impacts of this strategy fetish of capitalist reproduction, in order to evaluate the social legitimization of rentier capital in Brazil. In this scenario of the abundance of the discourse on social responsibility there exist a progressive impoverishment of professional work in this segment in Brazil. There is a dramatic mismatch between rhetoric and practice because of the trend of deepening vulnerability of the working conditions of the Brazilian bank worker, from the 1990's. In the specific case of the Bank of Brazil, the first initiative of the institution was to conform to the principles of the UNO and the Ethos Institute, aiming to align their domestic policies to this new strategy of domination of capital. The purpose is to place the Bank in the ideological sphere of corporate social responsibility, just as with its partners in the private financial intercapitalist competition. Indeed, in the internal ambit of the Bank of Brazil, there is a policy to adjust its functional segments to the doctrine of Social Corporate Responsibility. The concepts of this doctrine is presented as something inexorable. There are no alternatives. The Bank of Brazil operates in a highly competitive market, the segment featuring the dominance of financial capital accumulation today. For this reason it can not fail to incorporate the technological advances organizational. For employees there is no alternative but to adapt to this new set of ideas proposed by the metabolism of capital

The stabilization of energy supply in Brazil has been a challenge for the operation of the National Interconnected System in face of hydrological and climatic variations. Thermoelectric plants have been used as an emergency source for periods of water scarcity. The utilization of fossil fuels, however, has elevated the cost of electricity. On the other hand, offshore wind energy has gained importance in the international context and is competitive enough to become a possibility for future generation in Brazil. In this scenario, the main goal of this thesis was to investigate the magnitude and distribution of offshore wind resources, and also verify the possibilities of complementing hydropower. A data series of precipitation from the Climatic Research Unit (CRU) Blended Sea Winds from the National Climatic Data Center (NCDC/NOAA) were used. According to statistical criteria, three types of complementarity were found in the Brazilian territory: hydro × hydro, wind × wind and hydro × wind. It was noted a significant complementarity between wind and hydro resources (r = -0.65), mainly for the hydrographical basins of the southeast and central regions with Northeastern Brazil winds. To refine the extrapolation of winds over the ocean, a method based on the Monin-Obukhov theory was used to model the stability of the atmospheric boundary layer. Objectively Analyzed Air-Sea Flux (OAFLUX) datasets for heat flux, temperature and humidity, and also sea level pressure data from NCEP/NCAR were used. The ETOPO1 from the National Geophysical Data Center (NGDC/NOAA) provided bathymetric data. It was found that shallow waters, between 0-20 meters, have a resource estimated at 559 GW. The contribution of wind resources to hydroelectric reservoir operation was investigated with a simplified hybrid wind-hydraulic model, and reservoir level, inflow, outflow and turbine production data. It was found that the hybrid system avoids drought periods, continuously saving water from reservoirs through wind production. Therefore, from the results obtained, it is possible to state that the good winds from the Brazilian coast can, besides diversifying the electric matrix, stabilize the hydrological fluctuations avoiding rationing and blackouts, reducing the use of thermal power plants, increasing the production cost and emission of greenhouse gases. Public policies targeted to offshore wind energy will be necessary for its full development.
