This study presents the issue of Children and Youth sexual violence from a critical eye in assessing the actions of the organs of defense and protection in cases of sexual abuse against children and adolescents in the city of Natal / RN. We aimed to perform this evaluation from the investigation of 05 cases of child and adolescent victims of sexual abuse that were answered by Precinct Specializing in Defense of Children and Adolescents (DCA), considering the service flow of cases, the articulation between the organs that make up System Warranty rights (SGD), the record of the complaint, as well as the elapsed time between the record of the complaint and the accountability of the offender. Thus, the present study consists in an analysis from the quantitative and qualitative theoretical-methodological approach assuming 'sexual violence in their social, historical, cultural, legal and economic dimensions. The route established between the knowledge about the object and the method of analysis involved: literature about the conceptual discussion on sexual violence, analyzing quantitative data provided by DCA, as well as semi-structured interviews with victims and those responsible for the professionals working in institutions of the defense agencies. Is apprehended in this study that the situations of violence against children is a multifaceted phenomenon that has expressions from ancient societies, assuming a peculiarity in contemporary society to consider the juvenile population as subjects of rights. Furthermore, it was possible to identify the lack of effectiveness, with respect to the actions of the organs of defense in intervention situations of sexual abuse now investigated as yet not actually configure a process of articulation between these bodies from the perspective of ensuring rights and break the cycle of violence.

This dissertation analyses the Brazilian Supreme Court’s judgement in the Non-compliance Action of the Fundamental Precept 132/RJ and in the Direct Action of Unconstitutionality 4277/DF, which created in the country the same-sex civil union. In This decision, the STF interpreted according to the constitution Article 1.723 of the Civil Code, invoking several fundamentals reaffirmed in the Constitution. From all these laws invoked by the Supreme Court to support the pretorian creation, the content of consitutional Law regarding equality is the only that corresponds, and it is sufficient to evidence the necessity of the creation, by legislator, of the institute for civil rights, since the Constitution forbids distinctions that is not expressly provided for in the Constitution (Art. 3º, IV, of Federal Constitution). In this way, Article 226, § 3º is not an exception capable of satisfying the condition of the consitutional foresight because although it protect, according its content only the civil union “between the man and the woman”, it is not able to forbid the creation, by legislator, of another kinds of families, including the same-sex civil union. As such, the reasoning, now legitimate according to the legislator, is not support the creation of institute by Constitutional Court, because the Court may enforce the Law, interpreting in the purviews allowed by the legal text and its constitutionality. In regard to the civil union of individuos of the same sex, the Court could not deduce that such union was implied by Law, like the interpretation according to the Constitution given by judges, on grounds of semantic purviews of the words man and woman, existents in both articles. The Court could not created it either, exceeding the legal system role. So, upon the institute creation, the STF, exceeded two limits: the interpretation and Law enforcement.

The advancements in medical science and technology have proved to be a boon to mankind. At the same time they have raised numerous challenges before the legal systems of the world. One such advancement is that of assisted human reproductive technologies and particularly surrogacy, which have given a new meaning to the concept of procreation. These technologies have made it possible for individuals to beget a genetically related child with the help of a third party and without sexual intercourse. Among all the assisted human reproductive technologies, the practice of surrogacy, in which women agree to have their bodies used to undergo a pregnancy and give birth to a baby for another, has raised various legal and human right controversies and diverse legal responses all over the world. India has particularly become a top destination for individuals who wish to beget a child through surrogacy and hence it is imperative for the Indian government to address the challenges posed by surrogacy. This study is an attempt to examine the need and importance of surrogacy practices and the conflicting legal and human rights issues raised by surrogacy in contemporary times. It also examines the adequacy of existing legal framework in India and attempts to provide pragmatic solutions for regulating surrogacy and protecting the interests of various stakeholders involved in surrogacy.

There is a growing recognition that people with disabilities have the same sexual needs and rights as people without disabilities. However, less attention is paid to the sexuality of people diagnosed with intellectual disabilities. This narrative review summarises what is currently known about the level of sexual health knowledge of people with intellectual disabilities. A literature review was conducted of the published literature using Google Scholar, PubMed, PsychInfo, EBSCOhost, and Science Direct. Forty eight articles were identified that addressed the question about the level of sexual health knowledge of people with intellectual disabilities. Overall, studies demonstrate that people with intellectual disabilities are highly variable in levels of sexual knowledge, but on average have a range of deficits in knowledge compared to non-disabled individuals. More tailored education and support in accessing formal and informal sources of information are needed.

Trata-se de um estudo exploratório-descritivo, com abordagem qualitativa, que teve por objetivo analisar as mensagens, acerca da promoção da saúde sexual e reprodutiva, produzidas por adolescentes de escolas públicas e particulares da cidade do Rio Grande, num concurso de redação e música promovido pelo Grupo Gestor Municipal (GGM) do Projeto Saúde e Prevenção nas Escolas (SPE), nos anos de 2007 e 2008. Após autorização pelo GGM para realização deste estudo, foram disponibilizadas para reprodução, via xérox, as 29 redações e as três letras de músicas inscritas nos concursos. Para o tratamento dos dados utilizou-se a técnica de análise de conteúdo na modalidade temática. Participaram 35 adolescentes, sendo 25 moças e dez rapazes, com idades entre onze e dezessete anos. Quanto à escolaridade, dois frequentavam a quinta série; doze a sexta, doze a sétima e nove a oitava. Apreendeu-se que, em sua produção textual, os(as) adolescentes revelaram as vulnerabilidades e fortalezas referentes à saúde sexual e reprodutiva. Entre os inúmeros fatores que aumentam a vulnerabilidade individual, social e programática, discorreram sobre a carência de informações, a dificuldade para transformar o conhecimento em prática, a sensação de imunidade, a violência familiar, a conduta repressora de pais e mães, as mensagens de cunho sexual veiculadas pela mídia, a necessidade de serem aceitos(as) pelo grupo, preconceitos, e falta de ações governamentais direcionadas a adolescentes. No que se refere às fortalezas, sabem que a informação é uma importante aliada para a promoção da saúde sexual e reprodutiva citando, entre as fontes acessíveis, os serviços públicos de saúde, a família e a escola. Demonstraram conhecimento acerca da alarmante propagação da epidemia da AIDS entre jovens, conhecendo os sinais e sintomas das DSTs mais comuns e as formas de prevenção. As moças enfatizaram a necessidade de compartilhar a responsabilidade preventiva com os rapazes, bem como de amor próprio e respeito mútuo. O acesso aos serviços de saúde também foi apresentado como indispensável ao adolescer saudável. Os(as) jovens demonstraram conhecimento sobre drogas seus efeitos e consequências. Referem-se à adolescência como um período gostoso, repleto de dúvidas, mas também cheio de potencialidades. Assim, os mesmos componentes apresentados como desencadeadores de vulnerabilidade podem torná-los(as) fortes e capazes de superar os desafios comuns a essa etapa da vida. Para que tal superação ocorra, é necessário que tenham acesso à informação e a problematizem; que sejam capazes de incorporá-las ao cotidiano, adotando práticas protegidas e protetoras; que haja diálogo, despido de tabus, censuras e preconceitos no ambiente familiar; que as escolas adotem de forma transversalizada temáticas referentes à saúde sexual e reprodutiva; que os serviços de saúde tenham infraestrutura para assegurar os direitos contidos no Estatuto da Criança e do Adolescente; entre outras estratégias fortalecedoras.

Advances in digital photography and distribution technologies enable many people to produce and distribute images of their sex acts. When teenagers do this, the photos and videos they create can be legally classified as child pornography since the law makes no exception for youth who create sexually explicit images of themselves. The dominant discussions about teenage girls producing sexually explicit media (including sexting) are profoundly unproductive: (1) they blame teenage girls for creating private images that another person later maliciously distributed and (2) they fail to respect—or even discuss—teenagers’ rights to freedom of expression. Cell phones and the internet make producing and distributing images extremely easy, which provide widely accessible venues for both consensual sexual expression between partners and for sexual harassment. Dominant understandings view sexting as a troubling teenage trend created through the combination of camera phones and adolescent hormones and impulsivity, but this view often conflates consensual sexting between partners with the malicious distribution of a person’s private image as essentially equivalent behaviors. In this project, I ask: What is the role of assumptions about teen girls’ sexual agency in these problematic understandings of sexting that blame victims and deny teenagers’ rights? In contrast to the popular media panic about online predators and the familiar accusation that youth are wasting their leisure time by using digital media, some people champion the internet as a democratic space that offers young people the opportunity to explore identities and develop social and communication skills. Yet, when teen girls’ sexuality enters this conversation, all this debate and discussion narrows to a problematic consensus. The optimists about adolescents and technology fall silent, and the argument that media production is inherently empowering for girls does not seem to apply to a girl who produces a sexually explicit image of herself. Instead, feminist, popular, and legal commentaries assert that she is necessarily a victim: of a “sexualized” mass media, pressure from her male peers, digital technology, her brain structures or hormones, or her own low self-esteem and misplaced desire for attention. Why and how are teenage girls’ sexual choices produced as evidence of their failure or success in achieving Western liberal ideals of self-esteem, resistance, and agency? Since mass media and policy reactions to sexting have so far been overwhelmingly sexist and counter-productive, it is crucial to interrogate the concepts and assumptions that characterize mainstream understandings of sexting. I argue that the common sense that is co-produced by law and mass media underlies the problematic legal and policy responses to sexting. Analyzing a range of nonfiction texts including newspaper articles, talk shows, press releases, public service announcements, websites, legislative debates, and legal documents, I investigate gendered, racialized, age-based, and technologically determinist common sense assumptions about teenage girls’ sexual agency. I examine the consensus and continuities that exist between news, nonfiction mass media, policy, institutions, and law, and describe the limits of their debates. I find that this early 21st century post-feminist girl-power moment not only demands that girls live up to gendered sexual ideals but also insists that actively choosing to follow these norms is the only way to exercise sexual agency. This is the first study to date examining the relationship of conventional wisdom about digital media and teenage girls’ sexuality to both policy and mass media.

The call to access and preserve the state records that document crimes committed by the state during Guatemala’s civil war has become an archival imperative entangled with neoliberal human rights discourses of “truth, justice, and memory.” 200,000 people were killed and disappeared in Guatemala’s civil war including acts of genocide in which 85% of massacres involved sexual violence committed against Mayan women. This dissertation argues that in an attempt to tell the official story of the civil war, American Human Rights organizations and academic institutions have constructed a normative identity whose humanity is attached to a scientific and evidentiary value as well as an archival status representing the materiality and institutionality of the record. Consequently, Human Rights discourses grounded in Western knowledges, in particular archival science and law, which prioritize the appearance of truth erase the material and epistemological experience of indigenous women during wartimes. As a result, the subjectivity that has surfaced on the record as most legible has mostly pertained to non-indigenous, middle class, urban, leftist men who were victims of enforced disappearance not genocide. This dissertation investigates this conflicting narrative that remembers a non-indigenous revolutionary masculine hero and grants him justice in human rights courtrooms simply because of a document attesting to his death. A main research question addressed in this project is why the promise of "truth and justice" under the name of human rights becomes a contentious site for gendered indigenous bodies? I conduct a discursive and rhetorical analysis of documentary film, declassified Guatemalan police and military records such as Operation Sofia, a military log known for “documenting the genocide” during rural counterinsurgencies executed by the military. I interrogate the ways in which racialized feminicides or the hyper-sexualized racial violence that has historically dehumanized indigenous women falls outside of discourses of vision constructed by Western positivist knowledges to reinscribe the ideal human right subject. I argue for alternative epistemological frames that recognize genocide as sexualized and gendered structures that have simultaneously produced racialized feminicides in order to disrupt the colonial structures of capitalism, patriarchy and heterosexuality. Ironically, these structures of power remain untouched by the dominant human rights discourse and its academic, NGO, and state collaborators that seek "truth and justice" in post-conflict Guatemala.

The purpose of this project was to a provide a better understanding of where sexual violence in private residences occurred and how the victims and offenders involved in sexual violence came to be at those places. These findings combined to paint a quite different picture than some might expect. Rather than being a situation where force is used to take victims to a location, or the victims' homes are invaded by force, the circumstances surrounding how sexual violence victims and offenders come to be at the offense location seem to be much more subtle. Victimization where victims and offenders shared a residence accounted for a substantial portion of sexual violence reported in private residences, rendering questions as to how the offender gained entry or why the victim was there, moot under those circumstances. In cases where the offense location was not a mutual residence, victims most often went to the site voluntarily and offenders most frequently gained entry with permission rather than through force or deception.

La protección general atribuida en los conflictos armados no internacionales por el artículo 3 común a la población civil, de la que las niñas menores de 15 años forman parte, no depende de su filiación con alguna de las partes en el conflicto, y se extiende, en principio, a todos los actos de violencia, entre los que se encuentran los de naturaleza sexual cometidos por cualquiera de las mismas, incluyendo aquellos cometidos por los miembros de la parte en el conflicto con la que se encuentren afiliadas. Los casos contra Thomas Lubanga y Bosco Ntaganda muestran que, como regla general, las niñas menores de 15 años no desarrollan de manera prolongada actividades de participación directa en las hostilidades, por lo que, a pesar de acompañar permanente al grupo y de ser “esposas” o “compañeras” de sus comandantes, no asumen una función continua de combate y no pueden ser consideradas como miembros del mismo. Además, los actos de naturaleza sexual coercitivamente desarrollados por las niñas menores de 15 años reclutadas por las FPLC en favor de los comandantes y miembros del grupo con las que se encuentran esposadas, no cumple ninguno de los tres requisitos exigidos por el concepto de participación directa en las hostilidades porque: (a) no son idóneos para causar directamente por sí mismos el umbral de daño requerido; (b) no forman parte integral de ninguna operación militar que pudiera generar dicho umbral de daño; y (c) no poseen el nexo beligerante requerido, puesto que no están específicamente diseñados para causar un menoscabo a la parte adversa de las FLPC. Tampoco las demás actividades desarrolladas por las niñas menores de 15 años alistadas o reclutadas por las FLPC, incluyendo trabajo doméstico (donde principalmente desempeñaron tareas culinarias), transporte de comida a bases aéreas y acompañamiento a las esposas de los comandantes, cumplen, según la Sala de Primera Instancia I en el caso Lubanga, con los tres requisitos necesarios para su consideración como participación directa en las hostilidades. De ahí, que las niñas no hayan perdido en ningún momento su protección general. A todo lo anterior hay que añadir que los niños y niñas menores de 15 años, al ser una población particularmente vulnerable, gozan de una especial protección durante los conflictos armados (con independencia de su naturaleza), tal y como se manifiesta en la Convención de los Derechos del Niño de 1989, los Convenios de Ginebra de 1949 y de sus Protocolos adicionales de 1977, el Estatuto de la Corte Penal Internacional de 1998 y las Resoluciones 1882 de 2009, 1960 de 2010 y 2106 de 2013 del Consejo de Seguridad de las Naciones Unidas. Esta protección especial se extiende a los actos de violencia sexual cometidos por los miembros de las fuerzas armadas nacionales o grupos armados organizados que los alistan o reclutan. En consecuencia, la protección general y especial a que son acreedoras las niñas menores de 15 años, no se limita a las agresiones provenientes de las partes adversas en el conflicto, sino que se extiende también a la violencia sexual ejercida contra ellas por los miembros del propio grupo que las alistó o reclutó, incluso en el caso de que ésta sea ejercida por los comandantes que las tomaron como esposas o compañeras. Las niñas menores de 15 años alistadas o reclutadas entre 2002 y 2003 por las FPLC de Thomas Lubanga y Bosco Ntaganda eran sin duda acreedoras de dicha protección.

El presente estudio de caso tiene como objetivo analizar los retos frente al cumplimiento del Protocolo de Palermo, en materia de explotación sexual, en el Sistema Institucional Colombiano, durante el período comprendido entre los años 2003 y 2014. De manera preliminar se indica que dichos retos son político-jurídicos en cuanto a la manera en la que se cumplen los tratados internacionales, las obligaciones derivadas de ellos y quiénes tienen competencia para desarrollar los mandatos contenidos en los mismos. Igualmente existen retos institucionales y organizacionales pues Colombia carece de una estructura organizacional clara y la coordinación inter-agencial es escasa en materia de trata. En este sentido, esta investigación tiene un enfoque multidisciplinar, puesto que combina aspectos propios tanto del Derecho Internacional Público como de las Relaciones Internacionales. Para ello, se hará un análisis cualitativo por medio del análisis de datos y de literatura académica respecto a la trata de personas en Colombia, con el fin de lograr comprender con mayor precisión el panorama actual del país respecto al flagelo.

La sexualidad y la reproducción están íntimamente ligadas a la calidad de vida, tanto en el ámbito de lo individual como de lo social, por tanto la salud sexual y reproductiva representa un componente esencial para la evaluación de desarrollo de un país, y un tema prioritario en la agenda política mundial y nacional como lo evidencian los objetivos del milenio y de desarrollo sostenible; aunque el país ha dado enormes avances en el tema, aun se presentan grandes retos para el logro y goce efectivo de los derechos sexuales y reproductivos en la población. El objetivo del presente estudio es describir y analizar algunos indicadores de salud sexual y reproductiva en el departamento de Casanare, en el periodo 2008- 2015. Como metodología se usó un diseño descriptivo trasversal, los datos fueron tomados de Sivigila departamental, Estadísticas DANE y del Instituto Nacional de Salud. Se usó SPSS versión 18 y Excel para el análisis de los datos. Como resultados se encontraron altas tasas de prevalencia e incidencia para VIH, sífilis gestacional, y fecundidad en adolescentes en el departamento de Casanare que sobrepasan los indicadores nacionales y presentan tendencia creciente
