La Loi modifiant le Code civil et d'autres dispositions lgislatives relativement à la publicité des droits personnels et réels mobiliers et à la constitution d'hypothèques mobilières sans dépossession, L.Q. 1998, ch. 5 a assujetti à la publicité pour fins d'opposabilité aux tiers la fiducie à titre onéreux constituée pour garantir l'exécution d'une obligation, les droits du crédit-bailleur et, dans certains cas, les droits des vendeurs à tempérament et avec faculté de rachat et du locateur à long terme. L'interprétation de certaines de ces dispositions lgislatives a suscité une vive controverse jurisprudentielle portant sur la requalification des contrats et l'effet de la publicité dans le contexte où le vendeur à tempérament et le locateur à long terme ont fait défaut de publier leurs droits en temps utile et avant la faillite de leur débiteur. Le présent mémoire étudie cette problmatique en procdant à l'analyse des jugements pertinents, et plus particulièrement des arrêts de la Cour suprême dans Lefebvre (Syndic de); Tremblay (Syndic de), [2004] 3 R.C.S. 326 et Ouellet (Syndic de), [2004] 3 R.C.S. 348. Également, ce mémoire traite de l'amendement apporté par le lgislateur à la définition de « créancier garanti» de la Loi sur la faillite et l'insolvabilité, qui a tenté, sans succès, d'harmoniser cette notion avec celle du Code civil. Ainsi, il sera démontré que la situation juridique des contrats conclus à des fins de garantie s'est complexifiée au fil des ans.

Cette recherche s’intéresse au phénomène qu’est lallongement de la durée des conventions collectives. Avant juin 1994, la durée maximale d’une convention collective était fixée à trois ans. La venue de la mondialisation a chamboul les entreprises qui, elles, pour s’adapter et survivre à cette nouvelle réalité et demeurer compétitives, ont dû procder à des investissements majeurs, des restructurations, miser sur des relations de partenariat avec les syndicats, etc. (Boivin, 1998). Pour ce faire, elles devaient s’assurer d’obtenir une stabilité et une paix industrielle (Grant et Paquet, 1998). Cest à ce moment que nous avons vu lapparition d’ententes qui visaient à prolonger la durée maximale des conventions collectives, fixées à trois ans, sans contrevenir aux différentes dispositions du Code du travail (L.R.Q. c.C-27). Ces « contrats sociaux » devaient compter différentes caractéristiques particulières. Cest le 10 mai 1994 que le lgislateur québécois a déplafonné la durée des conventions collectives (Mayer, 1999). Tel qu’établi, les transformations au niveau de lenvironnement ont poussé les acteurs à revoir leurs façons de faire. Cela a mené à une déconflictualisation des relations du travail (Jalette, Bourque et Laroche, 2008). Les acteurs ont adopté des stratégies de négociation de plus en plus coopératives, ils ont eu un recours accru à la concertation, et ont développé une relation de partenariat (Maschino et coll., 2001). Nous observons en parallèle à une tendance à lallongement de la durée des conventions collectives. Nous nous questionnons à savoir ce qui a principalement motivé autant les syndicats à négocier ce type d’entente et ainsi, renoncer à leur droit de grève, et aussi quels sont les avantages ou inconvénients pour les employeurs de négocier de telles ententes. De manière plus spécifique, notre question de recherche est la suivante : Quels sont les effets de lallongement de la durée des conventions collectives sur les relations du travail locales en entreprise? Notre analyse vise à vérifier six propositions de recherche : 1- Les relations du travail sont transformées par la durée d’une convention collective de travail, laquelle est influence par lenvironnement. 2- Lallongement de la durée des conventions collectives de travail amène les parties à davantage recourir à des stratégies de négociation intégrative. 3- Lallongement de la durée des conventions collectives de travail contribue à diminuer le nombre de conflits de travail 4- Lallongement de la durée des conventions collectives de travail change la nature des manifestations du conflit sur le marché du travail. 5- Lallongement de la durée des conventions collectives transforme le contenu des conventions collectives de travail par lintégration de clauses nouvelles. 6- Lallongement de la durée des CCT diminue le rapport de force du syndicat. Dans le but de répondre à ces différents questionnements, nous avons utilisé une méthodologie qualitative de recherche et plus précisément, létude de cas. Cette dernière fut conduite en trois étapes : la préparation, la collecte de données et linterprétation (Merriam, 1998). Les données de notre étude ont été colligées durant lété et lautomne 2010. Tout d’abord, nous avons effectué des entretiens semi structuré à laide d’une grille d’entrevue. Cette grille d’entrevue fut adaptée en fonction des acteurs rencontrés, et surtout de la partie qu’ils représentent. Nous avons interrogé les acteurs tant patronaux que syndicaux, cest-à-dire : du cté patronal, nous avons rencontré les responsables des relations du travail oeuvrant au siège social ainsi que les conseillers en relations du travail en charge de négocier ou d’appliquer la convention collective des différents établissements couverts par létude. Du cté syndical, nous avons rencontré les conseillers syndicaux en charge également de négocier la convention collective et de veiller à son application. Au total, nous avons mené onze entretiens. En guise de comparaison, nous avons aussi procdé à une analyse de contenu de 139 conventions collectives du secteur de lalimentation. Nous cherchions à savoir si les conventions collectives de longue durée avaient tendance à comporter majoritairement une plus grande présence de clauses en lien avec les 7 caractéristiques des « contrats sociaux » mentionnées par Mayer (1999). Ces caractéristiques sont les suivantes : transparence économique et de gestion, participation à la gestion, programme de qualité totale, formation, flexibilité dans lorganisation du travail, stabilité de lemploi et mécanismes de gestion de lentente. In this paper, we prove that if a Banach space X contains some uniformly convex subspace in certain geometric position, then the C(K, X) spaces of all X-valued continuous functions defined on the compact metric spaces K have exactly the same isomorphism classes that the C(K) spaces. This provides a vector-valued extension of classical results of Bessaga and Pelczynski (1960) [2] and Milutin (1966) [13] on the isomorphic classification of the separable C(K) spaces. As a consequence, we show that if 1 < p < q < infinity then for every infinite countable compact metric spaces K(1), K(2), K(3) and K(4) are equivalent: (a) C(K(1), l(p)) circle plus C(K(2), l(q)) is isomorphic to C(K(3), l(p)) circle plus (K(4), l(q)). Hologram quantitative structure-activity relationships (HQSAR) were applied to a data set of 41 cruzain inhibitors. The best HQSAR model (Q(2) = 0.77; R-2 = 0.90) employing Surflex-Sim, as training and test sets generator, was obtained using atoms, bonds, and connections as fragment distinctions and 4-7 as fragment size. This model was then used to predict the potencies of 12 test set compounds, giving satisfactory predictive R-2 value of 0,88. The contribution maps obtained from the best HQSAR model are in agreement with the biological activities of the study compounds. The Trypanosoma cruzi cruzain shares high similarity with the mammalian homolog cathepsin L. The selectivity toward cruzam was checked by a database of 123 compounds, which corresponds to the 41 cruzain inhibitors used in the HQSAR model development plus 82 cathepsin L inhibitors. We screened these compounds by ROCS (Rapid Overlay of Chemical Structures), a Gaussian-shape volume overlap filter that can rapidly identify shapes that match the query molecule. Remarkably, ROCS was able to rank the first 37 hits as being only cruzain inhibitors. In addition, the area under the curve (AUC) obtained with ROCS was 0.96, indicating that the method was very efficient to distinguishing between cruzain and cathepsin L inhibitors. First measurements of the differential cross sections d(3)sigma/(dp(T)(gamma)dy(gamma)dy(jet)) for the inclusive production of a photon in association with a heavy quark (b, c) jet are presented, covering photon transverse momenta 30 < p(T)(gamma)< 150 GeV, photon rapidities |y(gamma)|< 1.0, jet rapidities |y(jet)|< 0.8, and jet transverse momenta p(T)(jet)> 15 GeV. The results are based on an integrated luminosity of 1 fb(-1) in pp collisions at s=1.96 TeV recorded with the D0 detector at the Fermilab Tevatron Collider. The results are compared with next-to-leading order perturbative QCD predictions.

We report the absolute values of the c ̂-axis resistivity obtained from conduction electron spin resonance (CESR) experiments at various temperatures for a graphite-AlCl3 stage 2 compound. The agreement with d.c. measurements is quite good. The temperature dependence of the c ̂-axis resistivity previously obtained from CESR for graphite-AlCl3 is revised. © 1990.

Introduction 1.1 Occurrence of polycyclic aromatic hydrocarbons (PAH) in the environment Worldwide industrial and agricultural developments have released a large number of natural and synthetic hazardous compounds into the environment due to careless waste disposal, illegal waste dumping and accidental spills. As a result, there are numerous sites in the world that require cleanup of soils and groundwater. Polycyclic aromatic hydrocarbons (PAHs) are one of the major groups of these contaminants (Da Silva et al., 2003). PAHs constitute a diverse class of organic compounds consisting of two or more aromatic rings with various structural configurations (Prabhu and Phale, 2003). Being a derivative of benzene, PAHs are thermodynamically stable. In addition, these chemicals tend to adhere to particle surfaces, such as soils, because of their low water solubility and strong hydrophobicity, and this results in greater persistence under natural conditions. This persistence coupled with their potential carcinogenicity makes PAHs problematic environmental contaminants (Cerniglia, 1992; Sutherland, 1992). PAHs are widely found in high concentrations at many industrial sites, particularly those associated with petroleum, gas production and wood preserving industries (Wilson and Jones, 1993). 1.2 Remediation technologies Conventional techniques used for the remediation of soil polluted with organic contaminants include excavation of the contaminated soil and disposal to a landfill or capping - containment - of the contaminated areas of a site. These methods have some drawbacks. The first method simply moves the contamination elsewhere and may create significant risks in the excavation, handling and transport of hazardous material. Additionally, it is very difficult and increasingly expensive to find new landfill sites for the final disposal of the material. The cap and containment method is only an interim solution since the contamination remains on site, requiring monitoring and maintenance of the isolation barriers long into the future, with all the associated costs and potential liability. A better approach than these traditional methods is to completely destroy the pollutants, if possible, or transform them into harmless substances. Some technologies that have been used are high-temperature incineration and various types of chemical decomposition (for example, base-catalyzed dechlorination, UV oxidation). However, these methods have significant disadvantages, principally their technological complexity, high cost , and the lack of public acceptance. Bioremediation, on the contrast, is a promising option for the complete removal and destruction of contaminants. 1.3 Bioremediation of PAH contaminated soil & groundwater Bioremediation is the use of living organisms, primarily microorganisms, to degrade or detoxify hazardous wastes into harmless substances such as carbon dioxide, water and cell biomass Most PAHs are biodegradable unter natural conditions (Da Silva et al., 2003; Meysami and Baheri, 2003) and bioremediation for cleanup of PAH wastes has been extensively studied at both laboratory and commercial levels- It has been implemented at a number of contaminated sites, including the cleanup of the Exxon Valdez oil spill in Prince William Sound, Alaska in 1989, the Mega Borg spill off the Texas coast in 1990 and the Burgan Oil Field, Kuwait in 1994 (Purwaningsih, 2002). Different strategies for PAH bioremediation, such as in situ , ex situ or on site bioremediation were developed in recent years. In situ bioremediation is a technique that is applied to soil and groundwater at the site without removing the contaminated soil or groundwater, based on the provision of optimum conditions for microbiological contaminant breakdown.. Ex situ bioremediation of PAHs, on the other hand, is a technique applied to soil and groundwater which has been removed from the site via excavation (soil) or pumping (water). Hazardous contaminants are converted in controlled bioreactors into harmless compounds in an efficient manner. 1.4 Bioavailability of PAH in the subsurface Frequently, PAH contamination in the environment is occurs as contaminants that are sorbed onto soilparticles rather than in phase (NAPL, non aqueous phase liquids). It is known that the biodegradation rate of most PAHs sorbed onto soil is far lower than rates measured in solution cultures of microorganisms with pure solid pollutants (Alexander and Scow, 1989; Hamaker, 1972). It is generally believed that only that fraction of PAHs dissolved in the solution can be metabolized by microorganisms in soil. The amount of contaminant that can be readily taken up and degraded by microorganisms is defined as bioavailability (Bosma et al., 1997; Maier, 2000). Two phenomena have been suggested to cause the low bioavailability of PAHs in soil (Danielsson, 2000). The first one is strong adsorption of the contaminants to the soil constituents which then leads to very slow release rates of contaminants to the aqueous phase. Sorption is often well correlated with soil organic matter content (Means, 1980) and significantly reduces biodegradation (Manilal and Alexander, 1991). The second phenomenon is slow mass transfer of pollutants, such as pore diffusion in the soil aggregates or diffusion in the organic matter in the soil. The complex set of these physical, chemical and biological processes is schematically illustrated in Figure 1. As shown in Figure 1, biodegradation processes are taking place in the soil solution while diffusion processes occur in the narrow pores in and between soil aggregates (Danielsson, 2000). Seemingly contradictory studies can be found in the literature that indicate the rate and final extent of metabolism may be either lower or higher for sorbed PAHs by soil than those for pure PAHs (Van Loosdrecht et al., 1990). These contrasting results demonstrate that the bioavailability of organic contaminants sorbed onto soil is far from being well understood. Besides bioavailability, there are several other factors influencing the rate and extent of biodegradation of PAHs in soil including microbial population characteristics, physical and chemical properties of PAHs and environmental factors (temperature, moisture, pH, degree of contamination). Figure 1: Schematic diagram showing possible rate-limiting processes during bioremediation of hydrophobic organic contaminants in a contaminated soil-water system (not to scale) (Danielsson, 2000). 1.5 Increasing the bioavailability of PAH in soil Attempts to improve the biodegradation of PAHs in soil by increasing their bioavailability include the use of surfactants , solvents or solubility enhancers.. However, introduction of synthetic surfactant may result in the addition of one more pollutant. (Wang and Brusseau, 1993).A study conducted by Mulder et al. showed that the introduction of hydropropyl-ß-cyclodextrin (HPCD), a well-known PAH solubility enhancer, significantly increased the solubilization of PAHs although it did not improve the biodegradation rate of PAHs (Mulder et al., 1998), indicating that further research is required in order to develop a feasible and efficient remediation method. Enhancing the extent of PAHs mass transfer from the soil phase to the liquid might prove an efficient and environmentally low-risk alternative way of addressing the problem of slow PAH biodegradation in soil.
