Busca-se demonstrar que a criatividade é um aspecto inerente e inafastável da atividade jurisdicional. Neste sentido, o primeiro objetivo perseguido é o de analisar os conceitos relacionados à criatividade judicial, que são os de interpretação, construção e manipulação. São, também, analisadas e refutadas teorias atuais que negam a criação judicial do direito. Argumenta-se que a admissão, pelo poder judiciário, do caráter criativo de suas decisões é exigência do dever de sinceridade judicial. O segundo objetivo é o de investigar a tese de Hans Kelsen, que descreve Cortes que realizem o controle de constitucionalidade como legislador negativo. São apreciadas as incongruências dessa tese com o constitucionalismo contemporâneo, bem como o caráter falho de sua aplicação na jurisprudência do Supremo Tribunal Federal. O terceiro objetivo é o de investigar os aspectos descritivos e normativos das sentenças manipulativas. São formuladas propostas de fundamentação normativa e de limites de aplicação dessa técnica. Defende-se a admissibilidade das sentenças aditivas, redutivas e aditivas de princípio, mas se rejeita a das sentenças substitutivas, sendo defendido o emprego, em seu lugar, das medidas de necessidade.

A presente Tese aborda o tema do efetivo reconhecimento do princípio da lealdade processual à prestação jurisdicional, com as consequências daí decorrentes. Como se trata de um novo modo de se observar a lealdade processual (que, historicamente, tem sido desenvolvida por doutrina e jurisprudência basicamente sob o prisma das partes e, quando, muito de seus procuradores), fez-se necessário desenvolver, em uma primeira parte do trabalho, as premissas teóricas que pudessem dar sustentabilidade ao tema, em particular a constitucionalização do direito processual, as novas feições da jurisdição como implementadora dos direitos fundamentais e a inserção da cláusula geral da lealdade processual, com os respectivos corolários. A segunda parte da Tese, por seu turno, traça parâmetros para a tentativa de definição daquilo que se alcunhou um novo modelo de juiz, a partir de uma necessária revisitação das tradicionais garantias associadas à prestação jurisdicional e à própria magistratura. Nesse propósito, foram elencados, como elementos indispensáveis à configuração de um juiz leal, o contraditório participativo, a cooperação processual e a gestão processual. Na terceira e última parte, após breve estudo das teorias do abuso do direito, foram levantadas algumas hipóteses de abusos jurisdicionais, até mesmo para que, ainda que a contrario sensu, fosse possível se aproximar do já mencionado juiz leal. Por fim, foram investigadas as sanções processuais cabíveis aos magistrados atualmente existentes no ordenamento jurídico pátrio, e propostas algumas sugestões (de lege lata e de lege ferenda) na expectativa de se melhorar as formas de combate aos abusos citados e, principalmente, respeitar-se o processo justo.

Explaining "Tragedy of the Commons" of evolution of cooperation remains one of the greatest problems for both biology and social science. Asymmetrical interaction, which is one of the most important characteristics of cooperative system, has not been sufficiently considered in the existing models of the evolution of cooperation. Considering the inequality in the number and payoff between the cooperative actors and recipients in cooperation systems, discriminative density-dependent interference competition will occur in limited dispersal systems. Our model and simulation show that the local but not the global stability of a cooperative interaction can be maintained if the utilization of common resource remains unsaturated, which can be achieved by density-dependent restraint or competition among the cooperative actors. More intense density dependent interference competition among the cooperative actors and the ready availability of the common resource, with a higher intrinsic contribution ratio of a cooperative actor to the recipient, will increase the probability of cooperation. The cooperation between the recipient and the cooperative actors can be transformed into conflict and, it oscillates chaotically with variations of the affecting factors under different environmental or ecological conditions. The higher initial relatedness (i.e. similar to kin or reciprocity relatedness), which is equivalent to intrinsic contribution ratio of a cooperative actor to the recipient, can be selected for by penalizing less cooperative or cheating actors but rewarding cooperative individuals in asymmetric systems. The initial relatedness is a pivot but not the aim of evolution of cooperation. This explains well the direct conflict observed in almost all cooperative systems.

There are altogether 411 haors comprising an area of about 8000 square kilometer, covering 25% of entire region dispersed in the districts of Sunamgonj, Sylhet, Moulvibazar, Hobigonj, Netrokona and Kishoreganj. Sunamganj district is particularly known as a district of haors and baors where a large number of people depend on fishing for their livelihood. Some people are basically fishermen and fish all the year round. Community Based Fisheries Management (CBFM) project has been initiated in this area to develop fishery sector as well as for the development of the inland fishermen of haor area. Healthy cooperation among the beneficiaries of the project is very much present and some NGOs are found working actively there to help the fishermen for the sound implementation of the project. But the influentials of different villages around create troubles and conflicts intentionally in the project area because of which fishermen cannot fish smoothly and the implementation of the project is getting hampered. Therefore, a kind of consensus needs to be reached among the inhabitants of the haor area and a powerful association of the fishermen should be established so that fishing may be undertaken in the beel without having any troubles and conflicts. In this article the conflicts and cooperation that are in existence in the implementation process of CBFM project in the haor areas of Sunamgonj district have been discussed. Some suggestions have been offered in the paper to overcome the existing conflicts impeding the smooth implementation of CBFM project in the fishery sector of haor area under Sunamganj district.

Background: It has been shown that mutations in at least four myotubularin family genes (MTM1, MTMR1, 2 and 13) are causative for human neuromuscular disorders. However, the pathway and regulative mechanism remain unknown. Methodology/Principal Findings: Here, we reported a new role for Mtmr8 in neuromuscular development of zebrafish. Firstly, we cloned and characterized zebrafish Mtmr8, and revealed the expression pattern predominantly in the eye field and somites during early somitogenesis. Using morpholino knockdown, then, we observed that loss-of-function of Mtmr8 led to defects in somitogenesis. Subsequently, the possible underlying mechanism and signal pathway were examined. We first checked the Akt phosphorylation, and observed an increase of Akt phosphorylation in the morphant embryos. Furthermore, we studied the PH/G domain function within Mtmr8. Although the PH/G domain deletion by itself did not result in embryonic defect, addition of PI3K inhibitor LY294002 did give a defective phenotype in the PH/G deletion morphants, indicating that the PH/G domain was essential for Mtmr8's function. Moreover, we investigated the cooperation of Mtmr8 with PI3K in actin filament modeling and muscle development, and found that both Mtmr8-MO1 and Mtmr8-MO2+LY294002 led to the disorganization of the actin cytoskeleton. In addition, we revealed a possible participation of Mtmr8 in the Hedgehog pathway, and cell transplantation experiments showed that Mtmr8 worked in a non-cell autonomous manner in actin modeling. Conclusion/Significance: The above data indicate that a conserved functional cooperation of Mtmr8 with PI3K regulates actin filament modeling and muscle development in zebrafish, and reveal a possible participation of Mtmr8 in the Hedgehog pathway. Therefore, this work provides a new clue to study the physiological function of MTM family members.
