Tutkielman tavoitteena on oikeudellisten lähteiden systematisoinnilla tuottaa johdonmukainen kuvaus poliisin, rajavartiomiehen sekä ammattisotilaan virkavelvollisuuksista, oikeudellisesta vastuusta ja virkarikosten rangaistavuudesta. Päähuomio kohdistuu virkamiehen määräaikaiseen virantoimituksesta erottamiseen. Oikeudellisella argumentaatiolla pyritään esittämään lainmukainen ja hyväksyttävä tulkintakannanotto siihen, miten kyseistä säädöstä tulisi tulkita. Tutkimusmetodi työssä on oikeusdogmatiikka. Ensisijaisena aineistona tutkielmassa on voimassa oleva lainsäädäntö valmisteluaineistoineen. Toissijaisina lähteinä käytetään kirjallisuutta, viranomaisten kurinpitopäätöksiä ja haastatteluja. Määräaikainen erottaminen voidaan määrätä virkamiehelle, joka toimii vastoin virkavelvollisuuksiaan tai laiminlyö niitä. Säädös on tulkittavissa laajentavasti siten, että myös muut kuin selkeästi viranomaisen valvontavastuulle kuuluvat teot voidaan katsoa virkatehtävien vastaiseksi. Erityisen käyttäytymisvelvoitteen johdosta menettely on rangaistavaa myös vapaa-ajalla. Määräaikainen erottaminen sijoittuu rangaistusasteikossa varoituksen ja irtisanomisen väliin. Rangaistus ei edellytä erityisen painavia perusteita, joita vaaditaan virkamiehen irtisanomiseen. Uuden säädöksen myötä irtisanomisten määrä on vähentynyt Rajavartiolaitoksessa. Säädöksestä on muotoutunut kurinpidollinen lisärangaistus, joka on määrätty virkamiehelle hallinnollisella päätöksellä yleensä rikostuomion jälkeen. Säädös on kuitenkin tarkoitettu ja se mahdollistaa myös puuttumisen varsinaisten virkatehtävien laiminlyönteihin. Lainsäädännön selkeyttämiseksi määräaikaisen erottamisen säädös tulisi poistaa eri viranomaisten erityislainsäädännöstä ja liittää suoraan virkamieslakiin. Säädöksen soveltaminen tulisi ulottaa koskemaan myös muita virkamiehiä, jotka palvelevat kyseisissä viranomaisissa. Tutkimuksen kohteena oleva virkamiesryhmä alistuu virkamiesoikeudessa blankkorangaistusuhan alle. Virkamiehen on vaikea hahmottaa kaikkea rangaistavaa toimintaa, ja virantoimittamisvelvollisuus on usein täsmentymätön ja tulkinnanvarainen. Kokonaisharkinnassa korostuvat myös muut kuin oikeudelliset lähteet (esimerkiksi moraalikäsitykset, etiikka, ohjeet, virkamiehen elämäntilanne). Sotilaiden ja poliisin oikeudenhoito poikkeaa monilta osin muiden virkamiesten oikeudenhoitomenettelystä. Rajavartiolaitoksessa sotilasoikeudenhoidon määräykset ja ohjeet ovat selkeästi puutteelliset. Rajavartiolaitoksen tehtäväkentän ja toimivaltuudet huomioiden tulisi kurinpito- ja virkarikosten tutkinnoissa lähentyä poliisin mallia sekä hyödyntää rikostorjuntahenkilöstön ammattitaitoa oman henkilökunnan esitutkinnoissa. Erityisen turvallisuusviranomaisten virkarikoksiin erikoistuneen tutkintaorganisaation perustaminen voisi tehostaa ja parantaa esitutkintojen tasoa sekä lisätä oikeusvarmuutta.

The focus of this study is to examine the role of police and immigrants’ relations, as less is known about this process in the country. The studies were approached in two different ways. Firstly, an attempt was made to examine how immigrants view their encounters with the police. Secondly, the studies explored how aware the police are of immigrants’ experiences in their various encounters and interactions on the street level. An ancillary aim of the studies is to clarify, analyse and discuss how prejudice and stereotypes can be tackled, thereby contributing to the general debate about racism and discrimination for better ethnic relations in the country. The data in which this analysis was based is on a group of adults (n=88) from the total of 120 Africans questioned for the entire study (n=45) police cadets and (n=6) serving police officers from Turku. The present thesis is a compilation of five articles. A summary of each article findings follows, as the same data was used in all five studies. In the first study, a theoretical model was developed to examine the perceived knowledge of bias by immigrants resulting from race, culture and belief. This was also an attempt to explore whether this knowledge was predetermined in my attempt to classify and discuss as well as analyse the factors that may be influencing immigrants’ allegations of unfair treatment by the police in Turku. The main finding shows that in the first paper there was ignorance and naivety on the part of the police in their attitudes towards the African immigrant’s prior experiences with the police, and this may probably have resulted from stereotypes or their lack of experience as well as prior training with immigrants where these kinds of experience are rampant in the country (Egharevba, 2003 and 2004a). In exploring what leads to stereotypes, a working definition is the assumption that is prevalent among some segments of the population, including the police, that Finland is a homogenous country by employing certain conducts and behaviour towards ethnic and immigrant groups in the country. This to my understanding is stereotype. Historically this was true, but today the social topography of the country is changing and becoming even more complex. It is true that, on linguistic grounds, the country is multilingual, as there are a few recognised national minority languages (Swedish, Sami and Russian) as well as a number of immigrant languages including English. Apparently it is vital for the police to have a line of communication open when addressing the problem associated with immigrants in the country. The second paper moved a step further by examining African immigrants’ understanding of human rights as well as what human rights violation means or entails in their views as a result of their experiences with the police, both in Finland and in their country of origin. This approach became essential during the course of the study, especially when the participants were completing the questionnaire (N=88), where volunteers were solicited for a later date for an in-depth interview with the author. Many of the respondents came from countries where human rights are not well protected and seldom discussed publicly, therefore understanding their views on the subject can help to explain why some of the immigrants are sceptical about coming forward to report cases of batteries and assaults to the police, or even their experiences of being monitored in shopping malls in their new home and the reason behind their low level of trust in public authorities in Finland. The study showed that knowledge of human rights is notably low among some of the participants. The study also found that female respondents were less aware of human rights when compared with their male counterparts. This has resulted in some of the male participants focussing more on their traditional ways of thinking by not realising that they are in a new country where there is equality in sexes and lack of respect on gender terms is not condoned. The third paper focussed on the respondents’ experiences with the police in Turku and tried to explore police attitudes towards African immigrant clients, in addition to the role stereotype plays in police views of different cultures and how these views have impacted on immigrants’ views of discriminatory policing in Turku. The data is the same throughout the entire studies (n=88), except that some few participants were interviewed for the third paper thirty-five persons. The results showed that there is some bias in mass-media reports on the immigrants’ issues, due to selective portrayal of biases without much investigation being carried out before jumping to conclusions, especially when the issues at stake involve an immigrant (Egharevba, 2005a; Egharevba, 2004a and 2004b). In this vein, there was an allegation that the police are even biased while investigating cases of theft, especially if the stolen property is owned by an immigrant (Egharevba, 2006a, Egharevba, 2006b). One vital observation from the respondents’ various comments was that race has meaning in their encounters and interaction with the police in the country. This result led the author to conclude that the relation between the police and immigrants is still a challenge, as there is rampant fear and distrust towards the police by some segments of the participating respondents in the study. In the fourth paper the focus was on examining the respondents’ view of the police, with special emphasis on race and culture as well as the respondents’ perspective on police behaviour in Turku. This is because race, as it was relayed to me in the study, is a significant predictor of police perception (Egharevba, 2005a; Egharevba and Hannikianen, 2005). It is a known scientific fact that inter-group racial attitudes are the representation of group competition and perceived threat to power and status (Group-position theory). According to Blumer (1958) a sense of group threat is an essential element for the emergence of racial prejudice. Consequently, it was essential that we explored the existing relationship between the respondents and the police in order to have an understanding of this concept. The result indicates some local and international contextual issues and assumptions that were of importance tackling prejudice and discrimination as it exists within the police in the country. Moreover, we have to also remember that, for years, many of these African immigrants have been on the receiving end of unjust law enforcement in their various countries of origin, which has resulted in many of them feeling inferior and distrustful of the police even in their own country of origin. While discussing the issues of cultural difference and how it affects policing, we must also keep in mind the socio-cultural background of the participants, their level of language proficiency and educational background. The research data analysed in this study also confirmed the difficulties associated with cultural misunderstandings in interpreting issues and how these misunderstandings have affected police and immigrant relations in Finland. Finally, the fifth paper focussed on cadets’ attitudes towards African immigrants as well as serving police officers’ interaction with African clients. Secondly, the police level of awareness of African immigrants’ distrustfulness of their profession was unclear. For this reason, my questions in this fifth study examined the experiences and attitudes of police cadets and serving police officers as well as those of African immigrants in understanding how to improve this relationship in the country. The data was based on (n=88) immigrant participants, (n=45) police cadets and 6 serving police officers from the Turku police department. The result suggests that there is distrust of the police in the respondents’ interaction; this tends to have galvanised a heightened tension resulting from the lack of language proficiency (Egharevba and White, 2007; Egharevba and Hannikainen, 2005, and Egharevba, 2006b) The result also shows that the allegation of immigrants as being belittled by the police stems from the misconceptions of both parties as well as the notion of stop and search by the police in Turku. All these factors were observed to have contributed to the alleged police evasiveness and the lack of regular contact between the respondents and the police in their dealings. In other words, the police have only had job-related contact with many of the participants in the present study. The results also demonstrated the complexities caused by the low level of education among some of the African immigrants in their understanding about the Finnish culture, norms and values in the country. Thus, the framework constructed in these studies embodies diversity in national culture as well as the need for a further research study with a greater number of respondents (both from the police and immigrant/majority groups), in order to explore the different role cultures play in immigrant and majority citizens’ understanding of police work.

Le présent mémoire s’intéresse à la déstabilisation d’un réseau de distribution de stupéfiants. Il est basé sur l’étude d’une enquête policière réalisée dans une grande ville canadienne. L’objectif principal de cette enquête était le démantèlement d’un réseau criminel perçu comme étant hiérarchisé. Différentes stratégies ont été mises en œuvre par les enquêteurs afin de déstabiliser le réseau. Cinq de ces stratégies sont étudiées dans cette recherche. Des analyses de réseaux et l’évaluation de l’évolution des opérations de distribution de stupéfiants démontrent que, parmi les stratégies déstabilisatrices, le retrait sélectif (arrestation) et l’ajout (infiltration) de participants dans le réseau sont les plus efficaces. Les résultats détaillés montrent l’importance de préparer des enquêtes systématiques et réfléchies en vue de déstabiliser un réseau. Bien que les rafles massives de participants soient intéressantes, il est essentiel d’en soulever les limites. Le fait de se concentrer sur des enquêtes planifiées permettra non seulement de répondre aux objectifs de l’enquête en cours, mais également de comprendre et développer des pratiques de déstabilisation à long terme au niveau du marché criminel en général (méta-réseau).

Le pouvoir de détenir une personne à des fins d'enquête n'est pas une technique d'investigation nouvelle et tire son origine du droit anglais. Mais cette méthode d'enquête, qui consiste à restreindre temporairement la liberté de mouvement d'une personne que l'on soupçonne pour des motifs raisonnables d'être impliquée dans une activité criminelle, ne fut reconnue officiellement au Canada qu'en juillet 2004 suite au jugement rendu par la Cour suprême dans l'affaire R. c. Mann. Au moment d'écrire ces lignes, cette stratégie d'enquête policière ne fait toujours pas l'objet d'une réglementation spécifique au Code criminel. L'approbation de cette technique d'enquête, en l'absence de toute forme de législation, ne s'est pas faite sans critiques de la part des auteurs et des commentateurs judiciaires qui y voient une intrusion dans un champ de compétences normalement réservé au Parlement. L'arrêt Mann laisse également en suspens une question cruciale qui se rapporte directement aux droits constitutionnels des citoyens faisant l'objet d'une détention semblable: il s'agit du droit d'avoir recours sans délai à l'assistance d'un avocat. Le présent travail se veut donc une étude approfondie du concept de la détention à des fins d'enquête en droit criminel canadien et de son impact sur les droits constitutionnels dont bénéficient les citoyens de notre pays. Pour accomplir cette tâche, l'auteur propose une analyse de la question en trois chapitres distincts. Dans le premier chapitre, l'auteur se penche sur le rôle et les fonctions dévolus aux agents de la paix qui exécutent leur mission à l'intérieur d'une société libre et démocratique comme celle qui prévaut au Canada. Cette étude permettra au lecteur de mieux connaître les principaux acteurs qui assurent le maintien de l'ordre sur le territoire québécois, les crimes qu'ils sont le plus souvent appelés à combattre ainsi que les méthodes d'enquête qu'ils emploient pour les réprimer. Le deuxième chapitre est entièrement dédié au concept de la détention à des fins d'enquête en droit criminel canadien. En plus de l'arrêt R. c. Mann qui fera l'objet d'une étude détaillée, plusieurs autres sujets en lien avec cette notion seront abordés. Des thèmes tels que la notion de «détention» au sens des articles 9 et 10b) de la Charte canadienne des droits et libertés, la différence entre la détention à des fins d'enquête et l'arrestation, les motifs pouvant légalement justifier une intervention policière de même que les limites et l'entendue de la détention d'une personne pour fins d'enquête, seront aussi analysés. Au troisième chapitre, l'auteur se consacre à la question du droit d'avoir recours sans délai à l'assistance d'un avocat (et d'être informé de ce droit) ainsi que du droit de garder le silence dans des circonstances permettant aux agents de la paix de détenir une personne à des fins d'enquête. Faisant l'analogie avec d'autres jugements rendus par nos tribunaux, l'auteur suggère quelques pistes de solutions susceptibles de combler les lacunes qui auront été préalablement identifiées dans les arrêts Mann et Clayton.

Le but de notre étude était de déterminer des variables du modus operandi de meurtres sexuels prédisant la résolution de l’enquête policière. Notre échantillon incluait 265 homicides sexuels de femmes codifiés dans le ViCLAS. La comparaison entre des meurtres sexuels résolus (N=178) et des meurtres sexuels non résolus (N=87), devait également permettre d’identifier les différences entre les issues de l’enquête, les stratégies du meurtrier pour éviter l’appréhension ainsi que les facteurs prédisant la résolution. D’après l’analyse de régression logistique, les prédicteurs tels que l’utilisation d’une arme, l’utilisation d’un bandeau/bâillon et l’agression impliquant une introduction par effraction ou un vol augmentent les probabilités que l’agresseur soit appréhendé. Au contraire, lorsque l’agresseur emporte un objet et que la victime est piétinée, les chances de résoudre l’enquête diminuent. Ces variables du modus operandi traduisent un déficit des compétences criminelles du meurtrier qui peut le pousser à multiplier les erreurs. De manière générale notre étude nous apprend que le contact rapproché entre l’agresseur et la victime favorise la dispersion d’indices propices à la résolution de l’enquête. Le nombre de ces indices est décuplé lorsqu’il y a pénétration vaginale ou anale et lorsque la victime est battue ou mordue. En outre, des contraintes intrinsèques à l’utilisation de stratégies d’évitement expliquent le fait que ces moyens, entravant l’avancée de l’enquête, ne sont que rarement exploités. Enfin, la faible proportion d’actes sexuels et violents observés dans ce genre de crime entrave le processus de résolution. Il en va de même pour l’impact limité des bases de données et de la spécialisation du meurtrier sexuel.

En Grande-Bretagne et en Amérique du Nord, la police est une institution publique qui suscite de nombreux travaux académiques. En France, elle est perçue comme un objet sale jusqu’aux travaux de Montjardet. En Suisse, la police est le reflet de la structure fédérale du pays. A travers un cadre réglementaire et légal, chaque canton a organisé sa police. Ainsi, le canton de Vaud s’est doté d’une police cantonale et de polices municipales dont le fonctionnement se fonde sur la proximité. Seules la police cantonale et celle de Lausanne disposent d’une compétence maximale. Bien que la police de proximité soit bien documentée au niveau légal, il n’existe pas de recherche compréhensive sur le fonctionnement de cet ensemble de principes policiers. Ce manque de connaissance pratique est problématique car le canton a entrepris une réforme policière qui est entrée en vigueur au 1er Janvier 2012. Dans ses pratiques liées à l’information, la police de proximité semble s’inspirer de deux modèles incompatibles que sont la police de communauté et l’intelligence led policing. C’est pourquoi, dans cette recherche, nous souhaitons comprendre comment les modèles théoriques trouvent à s’appliquer dans la pratique de la police de proximité. Nous avons opté pour une démarche qualitative semi-dirigée en réalisant 23 entretiens avec des policiers vaudois. L’analyse thématique a été réalisée à l’aide du logiciel Atlas Ti. Trois résultats ont retenu notre attention. Tout d’abord, notre analyse a permis de clarifier la notion de proximité par rapport à celle de communauté tout en tenant compte des particularismes locaux de redevabilité. Ensuite, nous avons identifié les divers circuits de l’information et mis en évidence les divergences dans le vocabulaire lié à l’analyse criminelle. Enfin, il apparaît que la police vaudoise se positionne comme une interface qui coordonne les partenaires susceptibles de résoudre les problèmes de la population.

The study is a close scrutiny of the process of investigation of offences in India along with an analysis of powers and functions of the investigating agency. The offences, which are prejudicial to sovereignty, integrity and security of the nation or to its friendly relations with foreign states, are generally called the offences against national security. Offences against national security being prejudicial to the very existence of the nation and its legal system, is a heinous and terrible one. As early as 1971 the Law Commission of India had pointed out the need of treating the offences relating to national security and their perpetrators on a totally different procedural footing. The recommendation that, all the offences coming under the said category ought to be brought under the purview of a single enactment so as to confront such offences effectively. The discrepancies in and inadequacies of the criminal justice system in India as much as they are related to the investigations of the offences against national security are examined and the reforms are also suggested. The quality of criminal justice is closely linked with the caliber of the prosecution system and many of the acquittals in courts can be ascribed not only to poor investigations but also to poor quality of prosecution.

The Union Territory of Pondicherry prior to its merger with the Indian Union was a French Colony. The erstwhile territory of Pondicherry along with its hamlets, namely, KARAIKKAL, MAHE and YANAM was administered by the French Regime. Before it was established by French in 1 6 74 A.D. it was part of Vijayanagara Empire. Prior to this, Pondicherry was a part of the Kingdom of Chola and Pallava Kings. During French Regime, the laws which were in force in France in relation to administration of civil and criminal justice were extended to the erstwhile Territory of Pondicherry. Thus while Pondicherry stood influenced by the Inquisitorial system since the beginning of the 18th century, the neighboring states forming part of the Indian Union since Independence came under the Influence of the British system, viz. accusatorial system. The territory of Pondicherry, for administrative reasons, came to be merged with the Indian Union in the early 60's. Following the merger, the Indian administration sought to extent its own laws from time to time replacing erstwhile French Laws, however, subject to certain savings. Thus the transitional period witnessed consequential changes in the administration of the territory, including the sphere of judicial system. Since I 963, the Union Territory of Pondicherry was brought under the spell of the Indian Legal System The people in Pondicherry ' thus have had the benefit of experiencing both the svstems. Their experiences will be of much help to those who undertake comparative studies in law. The plus and minus points of the respective systems help one to develop a detachment that helps independent evaluation of the svstents. The result of these studies could be relevant in revitalising our criminal systems.The present system is evaluated in the light of the past system. New dimensions are added by way' of an empirical study also.

Some study has been made earlier, but no attempt has ever been made to make the study comprehensive and comparative. There exists also no information as to the working of the system. Hence the work is undertaken to provide first hand knowledge of the legal institutions that had handled and now handles annually large masses of deprived and neglected population. An investigation is also necessary to know the legal and social characteristics of the jurisdiction enjoined on the court so that this will help compare the law in the statute with the law and practice. The evaluation of the working system in the changed social atmosphere is also an urgent need of the hour

The public service enterprises are victims of crimes and felonies which may reduce their capacity to perform their functions. These enterprises expend much money and effort in order to prevent those criminal behaviors. For this reason they ask from the authorities more efficient measures against crime; however, such enterprises may feel that they are not being given sufficient importance and/or remedies in dealing with such crime. The aim paper of this is not to study the problem from de substantive criminal law point of view. Rather, this paper’s goal is to study the Colombia’s Rules of Criminal Procedure, which regulate the investigation of this kind of crime. The article will look particularly at the competency of the relevant authorities at the investigative stages. Finally, it will make some recommendations regarding a proper route towards the investigation of these criminal behaviors.

Este estudio de caso tiene como objetivo determinar las implicaciones del flujo de población refugiada en la implementación de la política de libre circulación de la CEDEAO; tomando como referente el flujo desde Liberia hacia Ghana generado por la Guerra Civil. Esta investigación defiende que las implicaciones pueden estar relacionadas a las dinámicas que se asocian al movimiento de personas, las cuales pueden ser negativas o positivas, razón por la cual los Estados pueden reaccionar endureciendo las políticas migratorias, la obtención de permisos laborales y de residencia, y el cierre de fronteras o la expulsión de refugiados; con el fin de evitar consecuencias a nivel político, económico o en materia de seguridad. Para comprobar lo anterior se va a realizará un análisis de texto, sobre posiciones nacionales y políticas comunitarias, así como una revisión de estudios y estadísticas relacionados con el tema.

The doctrine of joint criminal enterprise is in disarray. Despite repeated judicial scrutiny at the highest level, the doctrine's scope, proper doctrinal basis and function in relation to other modes of complicity remain uncertain. This article examines the doctrine's elements and underlying principles. It argues that while joint criminal enterprise is largely used to make individuals liable for offences committed by their associates in excess of the common criminal purpose, its proper function is to police the limits of associate liability and thus to exculpate rather than inculpate. The doctrine governs not only instances of accessorial liability; it also applies where the parties involved are joint principal offenders. As this puts into question the prevalent view that joint criminal enterprise is a form of secondary participation that results in accessorial liability, the article concludes that it is best seen as a doctrine sui generis.

A necessidade de lidar com a identificação, o desenvolvimento, a formalização e a implementação de estratégias na Criminalística da Polícia Federal leva a questionamentos quanto à presença das condições necessárias para a implantação efetiva de um processo de planejamento estratégico institucional no ambiente considerado, e cuja resposta constituiu o objetivo da presente pesquisa. Neste contexto, combinam-se elementos ligados à natureza de organização pública da Criminalística e conceitos da Administração advindos do ambiente da iniciativa privada, assim como idiossincrasias da categoria profissional formada pelos peritos criminais. E, por ser o planejamento estratégico uma atividade insólita na organização, está sujeito a uma série de riscos e ameaças sobre os quais ainda não se tem conhecimento suficiente. Este estudo valeu-se de entrevistas semiestruturadas para avaliar, a partir da percepção dos próprios peritos criminais federais, se estão presentes fatores relacionados a três perspectivas de destaque identificadas na literatura acadêmica que poderiam viabilizar a implantação do planejamento estratégico na Criminalística da Polícia Federal. A primeira perspectiva se refere ao contexto mais amplo de organização, extraída a partir de uma abordagem integradora sobre o processo de formação da estratégia, que considera a visão como elemento agregador entre a racionalidade do planejamento estratégico formalizado e a participatividade geradora das estratégias emergentes. A segunda diz respeito ao contexto mais restrito que abrange as organizações do setor público, em que as dimensões de propriedade comum, financiamento público e controle político resultam em uma série de especificidades em relação ao setor privado. Por fim, a terceira perspectiva trata da caracterização da Criminalística como organização profissional, em que a tensão entre controle gerencial e autonomia profissional assume importância de destaque. O resultado, obtido a partir de análise interpretativa fenomenológica das entrevistas, revelou que a falta de um senso comum sobre a direção a ser seguida pela organização, associada ao baixo envolvimento dos peritos, constitui um fator condicionante do sucesso do planejamento estratégico na Criminalística.

A presente pesquisa versa sobre a interiorização da Perícia Criminal da Polícia Federal, que consiste num projeto de implantação de Unidades Técnico-Científicas para a execução de exames periciais em algumas cidades do interior do Brasil onde existem delegacias da Polícia Federal. Após a abertura das primeiras unidades no interior do país surgiram alguns resultados positivos. Entretanto, também surgiram situações indesejáveis e aspectos negativos que não foram previstos. O objetivo do estudo foi avaliar as vantagens e as desvantagens da instalação de Unidades Técnico-Científicas no interior do país para a administração da Perícia Criminal Federal. A pesquisa foi realizada com 59 chefes das unidades de perícia criminal das capitais dos estados e das unidades do interior. O estudo demonstrou que alguns resultados positivos foram alcançados, como a maior rapidez no atendimento e a melhor interação com o usuário do serviço de perícia criminal. Mas foi constatado também que existem problemas relacionados à infraestrutura, recursos humanos e materiais nas unidades do interior. Com o estudo foi possível concluir que a continuidade do programa de interiorização da perícia criminal federal depende preliminarmente da realização dos investimentos necessários em recursos humanos e materiais para que as unidades atualmente existentes possam ter as condições adequadas para seu funcionamento.

O presente trabalho objetivou identificar se os Peritos Criminais Federais que exercem suas atividades na função fim da Perícia Criminal encontram-se motivados para exercerem suas atribuições, bem como procurar relacionar as causas de desmotivação. Para tanto foram feitas duas pesquisas: uma de ordem qualitativa, em que foram entrevistados 10 (dez) Peritos Criminais Federais, pertencentes a áreas de atuação e lotações diversas, com a finalidade de constatar o que os respectivos profissionais apontavam como questões motivadoras e desmotivadoras no trabalho pericial. Posteriormente foi elaborado um questionário composto de 46 (quarenta e seis) perguntas fechadas e 2 (duas) abertas, o qual foi respondido por dirigentes e por servidores lotados nas unidades descentralizadas da Criminalística da Polícia Federal, com o objetivo de mapear a motivação do Perito Criminal Federal. Dos resultados revelados na pesquisa de campo, concluiu-se que os Peritos Criminais Federais estão desmotivados segundo a ótica de todas as teorias motivacionais abordadas no presente estudo. A desmotivação ocorre devido a diversos fatores: alguns de ordem técnica, como a falta de um feedback sobre a efetividade dos trabalhos realizados ou a falta de igualdade na distribuição dos serviços; outros de ordem filosófica, como a falta de um espírito de corpo - uma identidade profissional - e uma autonomia relativizada; ou ainda de ordem organizacional, como a falta de reconhecimento, por parte do Departamento de Polícia Federal, da importância da Perícia Criminal Federal, ou problemas relacionados à forma de gestão baseada na hierarquia e disciplina. Todavia, o problema mais nocivo - e que, portanto, deve ser tratado urgentemente - é o clima organizacional contaminado por disputas entre classes, que está promovendo um clima de inimizade e desmotivação, desfavorecendo o crescimento da Criminalística.
