A personalização de produtos e serviços e o projeto em conjunto entre empresas e clientes representam hoje um diferencial competitivo de ambientes ágeis de negócios. Esta tendência também é válida para a indústria da construção civil, onde a customização do produto é de vital importância para a satisfação do cliente, cada vez mais desejoso de um imóvel de baixo custo e com um certo nível de exclusividade. Esta pesquisa procura levar contribuições para o setor da Indústria da Construção Civil utilizando conceitos atuais como o de manufatura ágil e dando ênfase à dimensão de interação com o cliente e à personalização de produtos. Estabelecer uma interação constante entre cliente e empresa é um dos requisitos fundamentais para a definição de um ambiente ágil de negócios. Alias, considera-se importante que as empresas construtoras, em seus planos estratégicos, busquem não somente melhorar a eficiência dos processos construtivos (através de programas de qualidade e produtividade), mas também, ampliar qualitativa e quantitativamente os atributos dos imóveis ofertados através da integração do cliente ao projeto de seu futuro imóvel. O objetivo principal deste trabalho consiste em desenvolver um modelo de sistema de informação (SPAIR: Sistema de Informações para Personalização de Imóveis Residenciais) para a interação entre clientes e empresas incorporadoras e construtoras de condomínios residenciais, permitindo a incorporação de práticas de manufatura ágil a estas empresas. Para captar a visão dos potenciais usuários do sistema, foi realizado um estudo de caso em uma empresa incorporadora e construtora de condomínios residenciais, no sentido de definir o que projetistas e compradores de imóveis consideram importante em termos de personalização. A modelagem conceitual do problema em estudo foi realizada utilizando-se uma abordagem orientada a objetos. A utilização desta abordagem permitiu a implementação de um protótipo, no qual existe uma relação direta entre os eventos que ocorrem no mundo real e no sistema computacional. Um protótipo foi desenvolvido, utilizando a Web como ambiente de execução, permitindo a utilização de SPAIR por qualquer usuário conectado a Internet. Embora o sistema tenha passado por um conjunto limitado de testes de validação, os resultados obtidos demonstram o potencial do mesmo como uma ferramenta efetiva de implementação dos conceitos de manufatura ágil e customização de massa na área de construção civil.

Devido ao fenômeno da globalização, alguns aspectos em Economia Internacional e Política têm sido amplamente debatidos entre os estudiosos de Negócios Internacionais, dada a extensão do seu impacto sobre a competitividade operacional e estratégica das empresas multinacionais. Em conjunto com a realidade mais regional da maioria dos acordos preferenciais de comércio e de investimentos – que promovem uma integração regional mais profunda dos mercados, ao contrário do teórico mercado "global" – as abordagens teóricas mais globalizantes em estratégia de negócios internacionais têm sido mais questionadas. Enquanto alguns estudiosos, como Pankaj Ghemawat, (2007), propõem abordagens para a chamada "semi-globalização"; outros, por exemplo, com Alan Rugman e Alain Verbeke (inter alias 2004, 2007), por outro lado, defendem abordagens regionalistas mais restritas em negócios internacionais e estratégia de empresas internacionais. Tais posições sobre o desempenho das empresas transnacionais, no entanto, não foram amplamente testadas, deixando, assim, outras questões relevantes sem soluções. Assim sendo, identificou-se um espaço na literatura quanto à questão de as regiões – em vez de países individualmente considerados – serem ou não relevantes ao desempenho global das empresas multinacionais e em que medida. Nesse sentido, foi utilizada uma metodologia quantitativa longitudinal a fim de avaliar a evidência histórica da repercussão de presença em regiões selecionadas e/ou países sobre o desempenho das empresas transnacionais. Foram coletados dados no Compustat Global (2009) com vistas a uma análise econométrica de dados em painel. Nossos resultados consistem, brevemente, em três aspectos. Em primeiro lugar, quando ambas as variáveis (país e região) são simultaneamente consideradas influentes sobre o desempenho, existe significância estatística. Em segundo lugar, ao contrastar ambas as variáveis (país e região) entre si, em relação ao maior nível de impacto no desempenho, ainda que tenhamos encontrado relevância estatística para os países individualmente considerados, suspeitou-se de algum problema nos dados brutos. Em terceiro lugar, ao assumir uma correlação positiva entre o desempenho da empresa multinacional e do número de regiões geográficas onde essas corporações possuem operações significativas, foi encontrada significância estatística. Nossa conclusão, portanto, consiste no fato de que, dado que a maioria dos países são signatários de pelo menos um acordo de integração regional, as regiões devem ser o foco principal dos negócios internacionais e estratégia corporativa internacional, tanto nos propósitos teóricos (tendo em vista as conclusões desta pesquisa e a literatura sobre o assunto), quanto nos aspectos práticos (em vez de da customização da gestão e da estratégia para cada país individual).

Hypermethylation in the promoter region has been associated with a loss of gene function that may give a selective advantage to neoplastic cells. In this study, the methylation pattern of genes CDKN2A (alias p14, p14(ARF), p16, p16(INK4a)), DAPK1, CDH1, and ADAM23 was analyzed in 43 samples of head and neck tumors using methylation-specific polymerase chain reaction. In the oropharynx, there was a statistically significant association between hypermethylation of the DAPK1 gene and the occurrence of lymph node metastases, and in the larynx there was statistically significant evidence of an association between hypermethylation of the ADAM23 gene and advanced stages of the tumors. Thus, a correlation was observed between hypermethylation of the promoter region of genes DAPK1 and ADAM23 and the progression of head and neck cancer. (c) 2007 Elsevier B.V. All rights reserved.

We evaluated the relationship of amplification and polysomy of both the CCND1 and the ERBB2 (alias HER-2/NEU) genes to the overexpression of their proteins in esophageal and gastric cancers and also their association with clinicopathological features. CCND1 gene amplification (45%) was more prevalent than polysomy (25%) in esophageal carcinoma, but the pattern observed was similar in gastric adenocarcinoma (10% amplification, 15% polysomy). For ERBB2, polysomy was a more frequent mechanism than amplification in both esophageal (32.5 vs. 7.5%) and gastric (15 vs. 5%) cancers. Overexpression of cyclin D1 protein was identified in 37.5% of the specimens of esophageal tumors and 35% of gastric tumors, and overexpression of Her-2/neu protein in 12.5 and 7.5%, respectively. The K-statistics revealed a fair agreement in both types of turners only in overexpression and amplification of the CCND1 ggene; the ERBB2 gene showed a fair agreement in amplification and polysomy and the level of protein expression in gastric adenocarcinorna. Thus, polysomy 17 could contribute to a high Her-2/neu protein level, at least in gastric cancer. Our data indicated an association with alcohol consumption and the CCND1 gene or protein levels, in both esophageal and gastric cancers. (c) 2006 Elsevier B.V. All rights reserved.

The context political, social and economical determines the material conditions of the individual's cultural formation and it influences in the constitution of the critical conscience and social responsibility. The aim of this paper is to describe the didactic experiences from discussions in classroom with students in disciplines dedicated to information access in the Brazilian librarianship courses from São Paulo State University (Unesp), state of São Paulo, and Federal University of Alagoas (UFAL), state of Alagoas, precisely: Information Dissemination, supplied in 2007 and 2010, and Information Dissemination and Sources, supplied in 2008 and 2009, besides Library and Cultural Action, accomplished of 2008 to 2009. It was noticed, starting from the experience in classroom, that the Librarianship students have low knowledge of the institutions librarians and their services; they told that not to know the main library services before they study them referred disciplines.

This paper deals with characteristically anti-authoritarian aspects of Antônio Carlos de Brito’s work, alias Cacaso (1944-1987). It aims to provide evidence on his peculiar poetry writing exercise, which incorporates political and aesthetic tensions into its own language, rather than just refer to them. By anchoring in a poetics of everyday life and by being engaged in a dialogue with Brazilian literary tradition, Cacaso manages image, tone and emotion in order to instantly illuminate the impasses of his generation.

This study aims at analysing Brian O'Nolans literary production in the light of a reconsideration of the role played by his two most famous pseudonyms ,Flann Brien and Myles na Gopaleen, behind which he was active both as a novelist and as a journalist. We tried to establish a new kind of relationship between them and their empirical author following recent cultural and scientific surveys in the field of Humour Studies, Psychology, and Sociology: taking as a starting point the appreciation of the comic attitude in nature and in cultural history, we progressed through a short history of laughter and derision, followed by an overview on humour theories. After having established such a frame, we considered an integration of scientific studies in the field of laughter and humour as a base for our study scheme, in order to come to a definition of the comic author as a recognised, powerful and authoritative social figure who acts as a critic of conventions. The history of laughter and comic we briefly summarized, based on the one related by the French scholar Georges Minois in his work (Minois 2004), has been taken into account in the view that humorous attitude is one of man’s characteristic traits always present and witnessed throughout the ages, though subject in most cases to repression by cultural and political conservative power. This sort of Super-Ego notwithstanding, or perhaps because of that, comic impulse proved irreducible exactly in its influence on the current cultural debates. Basing mainly on Robert R. Provine’s (Provine 2001), Fabio Ceccarelli’s (Ceccarelli 1988), Arthur Koestler’s (Koestler 1975) and Peter L. Berger’s (Berger 1995) scientific essays on the actual occurrence of laughter and smile in complex social situations, we underlined the many evidences for how the use of comic, humour and wit (in a Freudian sense) could be best comprehended if seen as a common mind process designed for the improvement of knowledge, in which we traced a strict relation with the play-element the Dutch historian Huizinga highlighted in his famous essay, Homo Ludens (Huizinga 1955). We considered comic and humour/wit as different sides of the same coin, and showed how the demonstrations scientists provided on this particular subject are not conclusive, given that the mental processes could not still be irrefutably shown to be separated as regards graduations in comic expression and reception: in fact, different outputs in expressions might lead back to one and the same production process, following the general ‘Economy Rule’ of evolution; man is the only animal who lies, meaning with this that one feeling is not necessarily biuniquely associated with one and the same outward display, so human expressions are not validation proofs for feelings. Considering societies, we found that in nature they are all organized in more or less the same way, that is, in élites who govern over a community who, in turn, recognizes them as legitimate delegates for that task; we inferred from this the epistemological possibility for the existence of an added ruling figure alongside those political and religious: this figure being the comic, who is the person in charge of expressing true feelings towards given subjects of contention. Any community owns one, and his very peculiar status is validated by the fact that his place is within the community, living in it and speaking to it, but at the same time is outside it in the sense that his action focuses mainly on shedding light on ideas and objects placed out-side the boundaries of social convention: taboos, fears, sacred objects and finally culture are the favourite targets of the comic person’s arrow. This is the reason for the word a(rche)typical as applied to the comic figure in society: atypical in a sense, because unconventional and disrespectful of traditions, critical and never at ease with unblinkered respect of canons; archetypical, because the “village fool”, buffoon, jester or anyone in any kind of society who plays such roles, is an archetype in the Jungian sense, i.e. a personification of an irreducible side of human nature that everybody instinctively knows: a beginner of a tradition, the perfect type, what is most conventional of all and therefore the exact opposite of an atypical. There is an intrinsic necessity, we think, of such figures in societies, just like politicians and priests, who should play an elitist role in order to guide and rule not for their own benefit but for the good of the community. We are not naïve and do know that actual owners of power always tend to keep it indefinitely: the ‘social comic’ as a role of power has nonetheless the distinctive feature of being the only job whose tension is not towards stability. It has got in itself the rewarding permission of contradiction, for the very reason we exposed before that the comic must cast an eye both inside and outside society and his vision may be perforce not consistent, then it is satisfactory for the popularity that gives amongst readers and audience. Finally, the difference between governors, priests and comic figures is the seriousness of the first two (fundamentally monologic) and the merry contradiction of the third (essentially dialogic). MPs, mayors, bishops and pastors should always console, comfort and soothe popular mood in respect of the public convention; the comic has the opposite task of provoking, urging and irritating, accomplishing at the same time a sort of control of the soothing powers of society, keepers of the righteousness. In this view, the comic person assumes a paramount importance in the counterbalancing of power administration, whether in form of acting in public places or in written pieces which could circulate for private reading. At this point comes into question our Irish writer Brian O'Nolan(1911-1966), real name that stood behind the more famous masks of Flann O'Brien, novelist, author of At Swim-Two-Birds (1939), The Hard Life (1961), The Dalkey Archive (1964) and, posthumously, The Third Policeman (1967); and of Myles na Gopaleen, journalist, keeper for more than 25 years of the Cruiskeen Lawn column on The Irish Times (1940-1966), and author of the famous book-parody in Irish An Béal Bocht (1941), later translated in English as The Poor Mouth (1973). Brian O'Nolan, professional senior civil servant of the Republic, has never seen recognized his authorship in literary studies, since all of them concentrated on his alter egos Flann, Myles and some others he used for minor contributions. So far as we are concerned, we think this is the first study which places the real name in the title, this way acknowledging him an unity of intents that no-one before did. And this choice in titling is not a mere mark of distinction for the sake of it, but also a wilful sign of how his opus should now be reconsidered. In effect, the aim of this study is exactly that of demonstrating how the empirical author Brian O'Nolan was the real Deus in machina, the master of puppets who skilfully directed all of his identities in planned directions, so as to completely fulfil the role of the comic figure we explained before. Flann O'Brien and Myles na Gopaleen were personae and not persons, but the impression one gets from the critical studies on them is the exact opposite. Literary consideration, that came only after O'Nolans death, began with Anne Clissmann’s work, Flann O'Brien: A Critical Introduction to His Writings (Clissmann 1975), while the most recent book is Keith Donohue’s The Irish Anatomist: A Study of Flann O'Brien (Donohue 2002); passing through M.Keith Booker’s Flann O'Brien, Bakhtin and Menippean Satire (Booker 1995), Keith Hopper’s Flann O'Brien: A Portrait of the Artist as a Young Post-Modernist (Hopper 1995) and Monique Gallagher’s Flann O'Brien, Myles et les autres (Gallagher 1998). There have also been a couple of biographies, which incidentally somehow try to explain critical points his literary production, while many critical studies do the same on the opposite side, trying to found critical points of view on the author’s restless life and habits. At this stage, we attempted to merge into O'Nolan's corpus the journalistic articles he wrote, more than 4,200, for roughly two million words in the 26-year-old running of the column. To justify this, we appealed to several considerations about the figure O'Nolan used as writer: Myles na Gopaleen (later simplified in na Gopaleen), who was the equivalent of the street artist or storyteller, speaking to his imaginary public and trying to involve it in his stories, quarrels and debates of all kinds. First of all, he relied much on language for the reactions he would obtain, playing on, and with, words so as to ironically unmask untrue relationships between words and things. Secondly, he pushed to the limit the convention of addressing to spectators and listeners usually employed in live performing, stretching its role in the written discourse to come to a greater effect of involvement of readers. Lastly, he profited much from what we labelled his “specific weight”, i.e. the potential influence in society given by his recognised authority in determined matters, a position from which he could launch deeper attacks on conventional beliefs, so complying with the duty of a comic we hypothesised before: that of criticising society even in threat of losing the benefits the post guarantees. That seemingly masochistic tendency has its rationale. Every representative has many privileges on the assumption that he, or she, has great responsibilities in administrating. The higher those responsibilities are, the higher is the reward but also the severer is the punishment for the misfits done while in charge. But we all know that not everybody accepts the rules and many try to use their power for their personal benefit and do not want to undergo law’s penalties. The comic, showing in this case more civic sense than others, helped very much in this by the non-accessibility to the use of public force, finds in the role of the scapegoat the right accomplishment of his task, accepting the punishment when his breaking of the conventions is too stark to be forgiven. As Ceccarelli demonstrated, the role of the object of laughter (comic, ridicule) has its very own positive side: there is freedom of expression for the person, and at the same time integration in the society, even though at low levels. Then the banishment of a ‘social’ comic can never get to total extirpation from society, revealing how the scope of the comic lies on an entirely fictional layer, bearing no relation with facts, nor real consequences in terms of physical health. Myles na Gopaleen, mastering these three characteristics we postulated in the highest way, can be considered an author worth noting; and the oeuvre he wrote, the whole collection of Cruiskeen Lawn articles, is rightfully a novel because respects the canons of it especially regarding the authorial figure and his relationship with the readers. In addition, his work can be studied even if we cannot conduct our research on the whole of it, this proceeding being justified exactly because of the resemblances to the real figure of the storyteller: its ‘chapters’ —the daily articles— had a format that even the distracted reader could follow, even one who did not read each and every article before. So we can critically consider also a good part of them, as collected in the seven volumes published so far, with the addition of some others outside the collections, because completeness in this case is not at all a guarantee of a better precision in the assessment; on the contrary: examination of the totality of articles might let us consider him as a person and not a persona. Once cleared these points, we proceeded further in considering tout court the works of Brian O'Nolan as the works of a unique author, rather than complicating the references with many names which are none other than well-wrought sides of the same personality. By putting O'Nolan as the correct object of our research, empirical author of the works of the personae Flann O'Brien and Myles na Gopaleen, there comes out a clearer literary landscape: the comic author Brian O'Nolan, self-conscious of his paramount role in society as both a guide and a scourge, in a word as an a(rche)typical, intentionally chose to differentiate his personalities so as to create different perspectives in different fields of knowledge by using, in addition, different means of communication: novels and journalism. We finally compared the newly assessed author Brian O'Nolan with other great Irish comic writers in English, such as James Joyce (the one everybody named as the master in the field), Samuel Beckett, and Jonathan Swift. This comparison showed once more how O'Nolan is in no way inferior to these authors who, greatly celebrated by critics, have nonetheless failed to achieve that great public recognition O’Nolan received alias Myles, awarded by the daily audience he reached and influenced with his Cruiskeen Lawn column. For this reason, we believe him to be representative of the comic figure’s function as a social regulator and as a builder of solidarity, such as that Raymond Williams spoke of in his work (Williams 1982), with in mind the aim of building a ‘culture in common’. There is no way for a ‘culture in common’ to be acquired if we do not accept the fact that even the most functional society rests on conventions, and in a world more and more ‘connected’ we need someone to help everybody negotiate with different cultures and persons. The comic gives us a worldly perspective which is at the same time comfortable and distressing but in the end not harmful as the one furnished by politicians could be: he lets us peep into parallel worlds without moving too far from our armchair and, as a consequence, is the one who does his best for the improvement of our understanding of things.

Die vorliegende Arbeit beschäftigt sich mit rechtlichen Fragestellungen rund um Bewertungs-portale im Internet. Zentrale Themen der Arbeit sind dabei die Zulässigkeit der Veröffentlichung der von den Nutzern abgegebenen Bewertungen vor dem Hintergrund möglicherweise entgegenstehender datenschutzrechtlicher Bestimmungen und der Persönlichkeitsrechte der Betroffenen. Des weiteren wird der Rechtsschutz der Betroffenen erörtert und in diesem Zusammenhang die haftungsrechtlichen Risiken der Forenbetreiber untersucht. Gegenstand der Arbeit sind dabei sowohl Online-Marktplätze wie eBay, auf denen sowohl der Bewertende als auch der Bewertete registriert und mit dem Bewertungsverfahren grundsätz-lich einverstanden sind (geschlossene Portale), als auch Portale, auf denen – oftmals unter einem Pseudonym und ohne vorherige Anmeldung – eine freie Bewertungsabgabe, zu Pro-dukteigenschaften, Dienstleistungen bis hinzu Persönlichkeitsmerkmalen des Bewerteten möglich ist (offene Portale). Einleitung und Erster Teil Nach einer Einleitung und Einführung in die Problematik werden im ersten Teil die verschie-denen Arten der Bewertungsportale kurz vorgestellt. Die Arbeit unterscheidet dabei zwischen so genannten geschlossenen Portalen (transaktionsbegleitende Portale wie eBay oder Ama-zon) auf der einen Seite und offenen Portalen (Produktbewertungsportale, Hotelbewertungs-portale und Dienstleistungsbewertungsportale) auf der anderen Seite. Zweiter Teil Im zweiten Teil geht die Arbeit der Frage nach, ob die Veröffentlichung der durch die Nutzer abgegebenen Bewertungen auf den offenen Portalen überhaupt erlaubt ist oder ob hier mögli-cherweise das Persönlichkeitsrecht der Betroffenen und hier insbesondere das Recht auf in-formationelle Selbstbestimmung in Form der datenschutzrechtlichen Bestimmungen die freie Bewertungsabgabe unzulässig werden lässt. Untersucht werden in diesem Zusammenhang im einzelnen Löschungs- bzw. Beseitigungsan-sprüche der Betroffenen aus § 35 Abs. 2 Satz 2 Nr. 1 BDSG bzw. §§ 1004 i. V. m. 823 Abs. 1 BGB (allgemeines Persönlichkeitsrecht). Die Arbeit kommt in datenschutzrechtlicher Hinsicht zu dem Schluss, dass die Bewertungen personenbezogene Daten darstellen, die den datenschutzrechtlichen Bestimmungen unterlie-gen und eine Veröffentlichung der Bewertungen nach dem im deutschen Recht geltenden da-tenschutzrechtlichen Erlaubnisvorbehalt grundsätzlich nicht in Betracht kommt. Vor dem Hintergrund dieser den tatsächlichen Gegebenheiten und Interessenlagen im Internet nicht mehr gerecht werdenden Gesetzeslage diskutiert der Autor sodann die Frage, ob die datenschutzrechtlichen Bestimmungen in diesen Fällen eine Einschränkung durch die grund-gesetzlich garantierten Informationsfreiheiten erfahren müssen. Nach einer ausführlichen Diskussion der Rechtslage, in der auf die Besonderheiten der ein-zelnen Portale eingegangen wird, kommt die Arbeit zu dem Schluss, dass die Frage der Zuläs-sigkeit der Veröffentlichung der Bewertungen von einer Interessenabwägung im Einzelfall abhängt. Als Grundsatz kann jedoch gelten: Ist die bewertete Tätigkeit oder Person in Bezug auf die bewertete Eigenschaft ohnehin einer breiten Öffentlichkeit zugänglich, erscheint eine Veröffentlichung der Daten nicht bedenklich. Dagegen wird man einen Löschungs- bzw. Be-seitigungsanspruch bejahen müssen für die Bewertungen, die Tätigkeiten oder Eigenschaften des Bewerteten, die in keinem Zusammenhang mit ihm als öffentlicher Person stehen, betref-fen. Anschließend geht die Arbeit auf die Persönlichkeitsrechte der Betroffenen und der sich hier-aus ergebenden Beseitigungs- und Unterlassungsansprüchen gemäß der §§ 1004 Abs. 1, 823 Abs. 1 BGB ein, verneint jedoch wegen dem Vorrang der spezialgesetzlichen Bestimmungen aus dem Bundesdatenschutzgesetz letztlich eine Anwendbarkeit der Anspruchsgrundlagen. Schließlich wird in diesem Teil noch kurz auf die Zulässigkeit der Bewertung juristischer Per-sonen eingegangen, die im Grundsatz bejaht wird. Dritter Teil Sofern der zweite Teil der Arbeit zu dem Schluss kommt, dass die Veröffentlichung der Be-wertungen zulässig ist, stellt sich im dritten Teil die Frage, welche Möglichkeiten das Recht dem Bewerteten bietet, gegen negative Bewertungen vorzugehen. Untersucht werden, dabei datenschutzrechtliche, deliktsrechtliche, vertragliche und wettbe-werbsrechtliche Ansprüche. Ein Schwerpunkt dieses Teils liegt in der Darstellung der aktuellen Rechtsprechung zu der Frage wann eine Bewertung eine Tatsachenbehauptung bzw. ein Werturteil darstellt und den sich hieraus ergebenden unterschiedlichen Konsequenzen für den Unterlassungsanspruch des Betroffenen. Diejenigen Bewertungen, die eine Meinungsäußerung darstellen, unterstehen dem starken Schutz der Meinungsäußerungsfreiheit. Grenze der Zulässigkeit sind hier im wesentlichen nur die Schmähkritik und Beleidigung. An Tatsachenbehautpungen dagegen sind schärfere Maßstäbe anzulegen. In diesem Zusammenhang wird der Frage nachgegangen, ob vertragliche Beziehungen zwischen den Beteiligten (Bewertenden, Bewertete und Portalbetreiber) die Meinungsäußerungsfreiheit einschränkt, was jedenfalls für die geschlossenen Portale bejaht wird. Vierter Teil Der vierte Teil der Arbeit beschäftigt sich mit den „Zu-gut-Bewertungen“. Es geht dabei um wettbewerbsrechtliche Ansprüche im Falle verdeckter Eigenbewertungen. Solche Eigenbewertungen, die unter dem Deckmantel der Pseudonymität als Werbemittel zur Imageverbesserung in entsprechenden Bewertungsportale verbreitet werden ohne den wahren Autor erkennen zu lassen, sind in wettbewerbsrechtlicher Hinsicht grundsätzlich unzulässig. Fünfter Teil Im letzten Teil der Arbeit wird schließlich der Frage nach der Verantwortlichkeit der Portal-betreiber für rechtswidrige Bewertungen nachgegangen. Zunächst wird die Feststellung getroffen, dass es sich bei den von den Nutzern abgegebenen Bewertungen um fremde Inhalte handelt und somit die Haftungsprivilegierungen der § 11 Abs. 1 TDG, § 9 Abs. 1 MDStV eingreifen, wonach die Forenbetreiber für die rechtswidrigen Bewertungen jedenfalls so lange nicht verantwortlich sind, solange sie hiervon keine Kenntnis haben. Da von dieser Haftungsprivilegierung nach der Rechtsprechung des Bundesgerichtshofs die Störerhaftung nicht umfasst ist, wird die Reichweite die Forenbetreiber aus der Störerhaftung treffenden Überwachungspflichten diskutiert. Die Arbeit kommt hier zu dem Ergebnis, dass in den Fällen, in denen dem Adressaten der Bewertung die Identität des Verfassers bekannt ist, sich die Verpflichtungen der Forenbetrei-ber auf die Beseitigung bzw. Sperrung der rechtswidrigen Bewertung beschränken. Sofern die Identität des Bewertenden unbekannt ist, haften die Forenbetreiber als Mitstörer und dem Be-troffenen stehen Unterlassungsansprüche auch gegen die Forenbetreiber zu.

Somatostatin analogues, which are used to treat neuroendocrine tumors, target the high levels of somatostatin receptor subtype 2 (SSTR1; alias sst2) expressed in these cancers. However, some tumors are resistant to somatostatin analogues, and it is unknown whether the defect lies in sst2 activation or downstream signaling events. Because sst2 phosphorylation occurs rapidly after receptor activation, we examined whether sst2 is phosphorylated in neuroendocrine tumors. The sst2 receptor phosphorylation was evaluated by IHC and Western blot analysis with the new Ra-1124 antibody specific for the sst2 receptor phosphorylated at Ser341/343 in receptor-positive neuroendocrine tumors obtained from 10 octreotide-treated and 7 octreotide-naïve patients. The specificity, time course, and subcellular localization of sst2 receptor phosphorylation were examined in human embryo kinase-sst2 cell cultures by immunofluorescence and confocal microscopy. All seven octreotide-naïve tumors displayed exclusively nonphosphorylated cell surface sst2 expression. In contrast, 9 of the 10 octreotide-treated tumors contained phosphorylated sst2 that was predominantly internalized. Western blot analysis confirmed the IHC data. Octreotide treatment of human embryo kinase-sst2 cells in culture demonstrated that phosphorylated sst2 was localized at the plasma membrane after 10 seconds of stimulation and was subsequently internalized into endocytic vesicles. These data show, for the first time to our knowledge, that phosphorylated sst2 is present in most gastrointestinal neuroendocrine tumors from patients treated with octreotide but that a striking variability exists in the subcellular distribution of phosphorylated receptors among such tumors.
