À la lecture de l'article 2365 c.c.Q., le créancier et la caution ne peuvent pas percevoir les droits et les libertés que ce texte concrétise à leur encontre ou à leur profit. Pour pallier ce problème, les auteurs et la jurisprudence ont alors laissé place à leur imagination afin de tenter de classifier cette disposition à l'intérieur d'institutions juridiques éprouvées, le tout en vue de démythifier le contenu de la règle de droit. Pour notre part, nous considérons que l'exception de non-subrogation est une notion originale en soi, qui trouve sa source à l'intérieur même de son institution. La thèse que nous soutenons est que l'exception de non-subrogation, mode de libération qui a pour mission de combattre le comportement opportuniste, cristallise l'obligation de bonne foi en imposant implicitement au créancier une obligation de bonne subrogation. Tout manquement du créancier à cette obligation a comme conséquence de rendre le droit de créance du créancier irrecevable à l'égard de la caution devant les tribunaux. Ce précepte éclaircit le contexte de l'article 2365 C.c.Q. et, par le fait même, il permet de délimiter le contour de son domaine et de préciser ses conditions d'application. L'exception de non-subrogation est un mécanisme juridique qui date de l'époque romaine. Elle est maintenant intégrée dans presque tous les systèmes juridiques du monde, tant en droit civil qu'en common law. Dans la législation québécoise, elle s'est cristallisée à l'article 2365 C.c.Q. Il s'agit d'une disposition d'ordre public qui ne peut être invoquée que par la caution. Son application dépend du cumul de quatre conditions: 1) le fait du créancier; 2) la perte d'un droit subrogatoire; 3) le préjudice de la caution; 4) le lien causal entre les trois derniers éléments. Lorsque ces quatre conditions sont remplies, la caution est libérée de son engagement dans la mesure du préjudice qu'elle subit.

Ce mémoire a comme objectif premier, l’étude du film d’enquête sur les tueurs en série. Plus spécifiquement, le mémoire examine le cas du film Zodiac réalisé par David Fincher en 2007. En procédant par analyses comparatives portant sur la structure narrative, les thématiques et les mécanismes de réception du film d’enquête, nous avons tenté de mettre en lumière des hypothèses quant à l’insuccès commercial de Zodiac. La première section de l’étude examine la spécificité et les fonctions propres au film d’enquête sur les tueurs en série et parvient ainsi à tirer la conclusion qu’il prévaut de catégoriser ce corpus d’œuvres comme un sous-genre du film policier. Nous avons étudié la fonction sociale et médiatique des archétypes filmiques du tueur et de l’enquêteur afin d’atteindre une meilleure compréhension de la fascination du public américain pour ce sous-genre. La seconde section du mémoire examine comment Zodiac se détache des conventions génériques et, particulièrement, comment la mise en scène opère une démystification de la figure du tueur en série. De plus, nous avons soulevé le traitement particulier déployé par Zodiac, soit la monstration, par le biais des personnages, du travail spectatoriel de mise en récit de l’enquête. La troisième section vise à démontrer la rupture de l’horizon d’attente du spectateur chez Zodiac ainsi que la chute de l’imaginaire mythique qui est ainsi engendré.

Cette thèse montre comment s’est constituée la figure du génie en France au cours des XVIe, XVIIe et XVIIIe siècles, en mettant en évidence les paradoxes qui lui ont permis de devenir l’une des notions fondamentales de la modernité. Cette analyse s’articule autour de trois axes principaux. D’abord, il s’agit d’interroger les circonstances de l’invention du terme « génie » dans la langue française, en insistant sur son bagage culturel gréco-latin. La notion de génie apparaît alors comme intimement liée au génie de la langue française et à son histoire. Ensuite, l’analyse s’intéresse au rôle que la notion de génie joue dans le cadre régulateur de la théorie poétique à la fin du XVIIe siècle. Le génie, qui se définit alors comme une aptitude naturelle à l’exercice d’une régularité normée du faire, n’a cependant de valeur que si cette régularité est transgressée, dépassée. Cette relation fait apparaître le paradoxe social que représente le génie, considéré à la fois comme exceptionnel et exemplaire. Ce paradoxe du génie est ensuite analysé dans le cadre du développement des théories esthétiques au XVIIIe siècle, fondées sur une expérience communautarisante du beau. Cette problématique est étudiée au regard de l’intérêt des philosophes sensualistes pour le problème que constitue le génie, en particulier quant aux mécanismes de l’invention et de la découverte. À l’issue de ce parcours, il apparaît que le génie est à la fois problématique pour les théories qui tentent de le circonscrire et unificateur pour la communauté qu’il permet d’illustrer.

This thesis Entitled Resource abundance and survival of indigenous ornamental fishes of central kerala with emphasis on handling and packing stress in puntius filamentosus (valenciennes).Kerala state is endowed with 41 west flowing and three east flowing rivers originating in the Western Ghats. These rivers and their vast network of tributaries and distributaries harbour rich and diversified fish fauna. Most of the freshwater fishes available in Kerala are highly appreciated as ornamental fishes in the national and international markets.Today the ornamental fish industry is one of the largest industries all over the world. The demand for ornamental fishes has been increasing steadily with the enlargement of the industry, such that the current demand for indigenous ornamental fishes have exceeded the supply. This has led to serious concern about the resources available in the country that can be utilised judiciously for the economic benefit of the state. With an aim to fill up the lacuna, a database of freshwater ornamental fishes of Kerala was created as part of the present study. Ornamental fishes destined for export marketing should thrive well in the aquarium conditions.The study reiterates fishes caught from different environmental conditions and feeding habits have a greater ability to adapt and acclimatise to an entirely new environment and food habits. Marketing studies based on the statistics available with Marine Products Export Development Authority show that these species are not being exported at the required level over the past 6 years, when compared to the availability in the water bodies of Kerala. Sustainable utilisation of these resources from the wild using modern management principles and code of conduct for responsible fishing are advisable until captive breeding technology is popularised.

In wireless sensor networks, the routing algorithms currently available assume that the sensor nodes are stationary. Therefore when mobility modulation is applied to the wireless sensor networks, most of the current routing algorithms suffer from performance degradation. The path breaks in mobile wireless networks are due to the movement of mobile nodes, node failure, channel fading and shadowing. It is desirable to deal with dynamic topology changes with optimal effort in terms of resource and channel utilization. As the nodes in wireless sensor medium make use of wireless broadcast to communicate, it is possible to make use of neighboring node information to recover from path failure. Cooperation among the neighboring nodes plays an important role in the context of routing among the mobile nodes. This paper proposes an enhancement to an existing protocol for accommodating node mobility through neighboring node information while keeping the utilization of resources to a minimum.

Statistical Machine Translation (SMT) is one of the potential applications in the field of Natural Language Processing. The translation process in SMT is carried out by acquiring translation rules automatically from the parallel corpora. However, for many language pairs (e.g. Malayalam- English), they are available only in very limited quantities. Therefore, for these language pairs a huge portion of phrases encountered at run-time will be unknown. This paper focuses on methods for handling such out-of-vocabulary (OOV) words in Malayalam that cannot be translated to English using conventional phrase-based statistical machine translation systems. The OOV words in the source sentence are pre-processed to obtain the root word and its suffix. Different inflected forms of the OOV root are generated and a match is looked up for the word variants in the phrase translation table of the translation model. A Vocabulary filter is used to choose the best among the translations of these word variants by finding the unigram count. A match for the OOV suffix is also looked up in the phrase entries and the target translations are filtered out. Structuring of the filtered phrases is done and SMT translation model is extended by adding OOV with its new phrase translations. By the results of the manual evaluation done it is observed that amount of OOV words in the input has been reduced considerably

Pesticide use among smallholder coffee producers in Jamaica has been associated with significant occupational health effects. Research on pesticide handling practices, however, has been scarce, especially in eastern Jamaica. This explorative study aims at filling this gap and provides a first basis to develop effective interventions to promote a safer pesticide use. A random sample of 81 coffee farmers was surveyed. The majority of farmers reported to suffer from at least one health symptom associated with pesticide handling, but safety practices were scarcely adopted. There was also the risk that other household members and the wider local community are exposed to pesticides. The lack of training on pesticide management, the role of health services and the cost for protective equipment seemed to be the most significant factors that influence current pesticide handling practices in eastern Jamaica. Further research is recommended to develop a systemic understanding of farmer’s behaviour to provide a more solid basis for the development of future intervention programmes.

The COntext INterchange (COIN) strategy is an approach to solving the problem of interoperability of semantically heterogeneous data sources through context mediation. COIN has used its own notation and syntax for representing ontologies. More recently, the OWL Web Ontology Language is becoming established as the W3C recommended ontology language. We propose the use of the COIN strategy to solve context disparity and ontology interoperability problems in the emerging Semantic Web – both at the ontology level and at the data level. In conjunction with this, we propose a version of the COIN ontology model that uses OWL and the emerging rules interchange language, RuleML.

Often practical performance of analytical redundancy for fault detection and diagnosis is decreased by uncertainties prevailing not only in the system model, but also in the measurements. In this paper, the problem of fault detection is stated as a constraint satisfaction problem over continuous domains with a big number of variables and constraints. This problem can be solved using modal interval analysis and consistency techniques. Consistency techniques are then shown to be particularly efficient to check the consistency of the analytical redundancy relations (ARRs), dealing with uncertain measurements and parameters. Through the work presented in this paper, it can be observed that consistency techniques can be used to increase the performance of a robust fault detection tool, which is based on interval arithmetic. The proposed method is illustrated using a nonlinear dynamic model of a hydraulic system
