The courtship behavior in calopterygid damselflies is well documented; however, the behavior of the large Neotropical genus Mnesarete is still unknown. Thus, here we present the first description of male-female interactions in Mnesarete pudica, a common damselfly in the Neotropical Savanna. The male-female interactions were composed of courtship displays, mounting, and chasing. The courtship behavior lasted 5.23 +/- 1.65 s and is very different from other calopterygids, consisting of hovering flights and the cross display made in front of females rather than on the oviposition site. The arrival and presence of females on a male territory are not sufficient to initiate sexual interactions; the male usually interacts with the female only after a patrolling flight. The females may present three distinct behaviors in response to male approach: (a) warding off signal (31.53%), (b) escape (28.83%), (c) and wing flipping (39.64%), which seems to stimulate male courtship. Females also may sit still, which induces males to react as if females were signaling they are willing to mate. In this paper, we also suggest that male courtship behavior is mediated by female signals.

The possible trade-off between the roles of glucocorticoids as facilitators of energy substrate mobilization and neural inhibitors of sexual behavior during breeding season is under debate. We studied the relationship between calling and territorial behavior with plasma levels of corticosterone (CORT) and plasma levels of testosterone (T) across the breeding season of Hypsiboas faber, a large and territorial Neotropical treefrog. We investigated these relationships through focal observations of males calling naturally, followed by blood sampling for hormonal radioimmunoassay. We additionally used an experimental approach, which consisted of broadcasting recorded advertisement calls for 10 min to simulate an invasion in the territory of the focal subjects, followed by behavioral observation and blood sampling for hormonal radioimmunoassay. Results showed a pattern of co-variation between CORT and T across the breeding season. Furthermore, individual variation in CORT and T was related to different aspects of behavior: individuals with higher CORT showed higher calling rates, and individuals with higher steroid levels, mainly T, showed higher responsivity to social stimulation by other males in the chorus. Experimental simulation of territorial intrusion by using playback of advertisement calls of this species did not elicit consistent changes in agonistic behavior and CORT, but decreased T in focal males. L’elaborato è strutturato in quattro parti: la prima è dedicata all’inquadramento del background normativo. L’autrice affronta, con un approccio ricostruttivo, i precedenti alla redazione del regolamento e le difficoltà incontrate a causa delle resistenze degli Stati membri. Si sofferma altresì sulle norme UNCITRAL, anch’esse oggetto nel recente periodo, di numerose implementazioni. La seconda parte fotografa il ruolo della Corte di Giustizia nell’interpretazione del regolamento n. 1346/2000 ed individua i concetti fondamentali del regolamento: l’universalità attenuata, il campo di applicazione soggettivo del regolamento, la legge applicabile, il principio dell’automatico riconoscimento delle decisioni e la correlata tematica dell’ordine pubblico, nonché la figura del curatore. Si approfondisce l’attività degli Stati membri nel dotarsi di norme di coordinamento ( esemplare il caso della Spagna e della Germania) sottolineando il silenzio del legislatore italiano che, nonostante le numerose riforme in materia, a tutt’oggi non ha ideato un sistema in grado di coordinare la normativa nazionale con la struttura del regolamento europeo. Nella terza parte l'autrice approfondisce la giurisdizione nel regolamento n. 1346/2000. Si individuano le parole chiave: Comi e dipendenza, i cui significati sono sfumati seguendo le posizioni della Corte di Giustizia, (Leading Case Eurofood sino a Interedil) e si mette in discussione, nel panorama attuale, la tenuta di tali criteri giurisdizionali. Sempre intorno al concetto di Comi, si analizzano: la giurisdizione verso gruppi di imprese disciplina assente nel regolamento, i rapporti tra procedura principale e secondaria , la giurisdizione in materia di azioni connesse e/o correlate (Gourdain vs Nadler/Seagon vs Deko Marty). Il capitolo conclusivo offre una panoramica delle proposte finalizzate ad un’implementazione della struttura del regolamento sull’insolvenza. Numerose, infatti, sono le proposte a livello dottrinale e da parte degli organi comunitari in vista della scadenza del Report della Commissione Europea sulla applicazione del regolamento 1346 del 2000 (art. 46).

In questo lavoro si analizza l’imposizione indiretta nel commercio elettronico; l’analisi si è basata sullo studio della normativa Comunitaria (Direttive Europee ) e la legislazione e Italiana, esponendo anche le differenze con il profilo legislativo brasiliano (softwares e libri).Esposti i contributi delle istituzione internazionali (conferenze ed/o proposte della Unione Europea) per l’inquadramento tipologico e fiscale del commercio elettronico, sono stati analizzati i profili generali dell’istituto della stabile organizzazione ai fini dell’imposizione dell’IVA e al commercio elettronico, distinguendo anche tra le transazioni elettroniche considerabili come cessione di beni e quelle considerabili prestazioni di servizi, in base alla materialità o alla dematerializzazione del bene scambiato. Anche il principio di territorialità nelle prestazioni di servizi è stato analizzato tramite analisi dei regimi ordinario e speciale riguardanti gli operatori extracomunitari.

The article discusses the problems of applicable law to copyright infringements online. It firstly identifies the main problems related to the well established territoriality principle and the lex loci protectionis rules. Then; the discussion focuses on the "ubiquitous infringement" rule recently proposed by the American Law Institute (ALI) and the European Max Planck Group for Conflicts of Law and Intellectual Propoperty (CLIP). The author strongly welcomes a compromise between the territoriality and universality approaches suggested in respect of ubiquitous infringement cases. At the same time; the paper draws the attention that the interests of "good faith" online service providers (such as legal certainty and foreseeability) have been until now underestimated and invites to take these interests into account when merging the projects into a common international proposal.

The coordination between territoriality restricted intellectual property rights and the potential global reach of Internet activities has been the focus of significant attention in recent years. The liability of Internet intermediaries offering potentially global services that may facilitate infringements of intellectual property rights by others in multiple countries poses a particular challenge in that regard. At a substantive law level, significant differences remain between jurisdictions regarding secondary liability for intellectual property rights infringements and safe harbor provisions for Internet intermediaries. The present article discusses the conflict of laws aspects of the liability of Internet intermediaries in light of the recent international efforts to adopt soft law provisions on intellectual property and private international law.

The following comparison was written for the first meeting of the International Law Association newly established (2010) Committee on Intellectual Property and Private International Law (Chair: Professor Toshiyuki Kono, Kyushu University; Co-Rapporteurs: Professors Pedro de Miguel Asensio, Madrid Complutense University, and Axel Metzger, Hannover University) (hereinafter: ILA Committee), which was hosted at the Faculty of Law of the University of Lisbon in March 16-17, 2012. The comparison at stake concerns the rules on infringement and exclusive (subject-mater) jurisdiction posed (or rejected, in case of exclusive jurisdiction) by four sets of academic principles. Notwithstanding the fact that the rules in question present several differences, those differences in the majority of cases could be overcome by further studies and work of the ILA Committee, as the following comparison explains.

The haplochromine cichlids of Lake Victoria constitute a classical example of explosive speciation. Extensive intra– and interspecific variation in male nuptial coloration and female mating preferences, in the absence of postzygotic isolation between species, has inspired the hypothesis that sexual selection has been a driving force in the origin of this species flock. This hypothesis rests on the premise that the phenotypic traits that underlie behavioural reproductive isolation between sister species diverged under sexual selection within a species. We test this premise in a Lake Victoria cichlid, by using laboratory experiments and field observations. We report that a male colour trait, which has previously been shown to be important for behavioural reproductive isolation between this species and a close relative, is under directional sexual selection by female mate choice within this species. This is consistent with the hypothesis that female choice has driven the divergence in male coloration between the two species. We also find that male territoriality is vital for male reproductive success and that multiple mating by females is common.

The first part summarises the origins, definitions and debates around the general notions of development, culture and associated more specific concepts such as identity, tradition, exogenous and endogenous knowledge, institutions, governance or territoriality. A second part highlights how culture and development got related to the debates around sustainable governance of natural resources and forests. The third part illustrates on the basis of a case study from Kenya and Bolivia how culture as a transversal element of forest governance is expressed in empirical terms. Moreover it is shown how the cultural dimension affects positively or negatively the outcomes of culturally shaped forest governance outcomes and the role these effects play in shaping the sustainability of the socio-ecological systems of forests in Africa and South America.

Lands inhabited by indigenous peoples often have low population density but abundant natural resources. For those reasons, many actors have historically attempted to occupy those lands or use the resources in them. Increasing pressures over lands occupied by indigenous peoples have resulted in the awakening of indigenous peoples over their rights to land and resources generating many debates over indigenous peoples' rights to land and self-governance. In this article, we provide a historical and geographical overview of territorial and governance issues among the Tsimane', an indigenous group native to the Bolivian Amazon. We examine how the Bolivian state economic policies implemented during the 20th century affected the Tsimane' ancestral lands, and how – over the late-20th century – the Bolivian state accommodated Tsimane' claims to lands in between multiple interests. We show how national policies led to the reconfiguration of Tsimane' territoriality and to a fragmented institutional representation. Current indigenous territories and indigenous political representation are an expression of conflictive policies that have involved multiple actors and their specific interests on indigenous lands and its resources.

Both latitude and mating system have been proposed to shape relationships between steroid hormone levels and social behavior. Recently it has been postulated that species with long lasting non-seasonal territorial behavior have low androgen responsiveness. Tropical damselfishes are an ideal family to test this proposition because they show a large variety in mating systems. Here we contribute to the comparative dataset by measuring the response in steroid levels after social modulation in the banded sergeant, Abudefduf septemfasciatus, a species with non-seasonal territoriality. In highly territorial and brooding males, we found low androgen and cortisol levels that did not increase after experimental intraspecific simulated territorial intrusions (STI tests). No relationship was found between the variation in steroid hormone levels and territorial responses to naturally occurring territorial intrusions. Although steroid levels were low, male A. septemfasciatus were highly territorial both to STI challenges and to fishes that passed the territory. They often chased intruders for several meters away from the territory. This indicates that during nest defence in a non-seasonal territorial damselfish species, territorial behaviors are shown independent of variation in androgen and cortisol levels.

Este artículo versa sobre la relación entre la minería transnacional y la cuestión de la territorialidad vinculada a esta actividad. A medida que se abren fronteras, las relaciones sociales se vuelven más desterritorializadas, crece la búsqueda de las raíces culturales y nuevas experiencias locales se generan en respuesta a la emergencia de territorios posnacionales (Appadurai, 1999). Estas experiencias definen un nuevo sentido histórico para el oeste catamarqueño y Santa María – provincia de Catamarca, Argentina-, donde los sujetos sociales locales - situados históricamente en contextos de periferia del capitalismo global y nacional- mediatizan, interpelan y desnaturalizan algunas de las transformaciones espacio-temporales producidas a partir de la mega- minería en las últimas décadas, bajo un paradigma extractivista. Por su parte, los sujetos locales examinan su propia historia y analiza las conflictividades en torno a los recursos naturales, y en respuesta, constituyen territorios en red no articulados a los flujos globales del capital sino a espacios de resistencia.
