Au cours des dernières années, la mondialisation des marchés a radicalement modifié les activités économiques des entreprises et le tissu productif à travers la planète. Les restructurations deviennent dès lors des options avantageuses pour les entreprises afin de demeurer concurrentielles. Alors qu’auparavant les restructurations consistaient essentiellement en une réduction d’effectifs dans un site considéré peu rentable, elles sont aujourd’hui polymorphes: fermeture de site, délocalisations, sous-traitance, ouverture de nouvelles unités au pays et hors pays, relocalisation et fusions-acquisitions (Rouleau, 2000) et (AgirE, 2008). Or, les restructurations posent un problème pour l’action syndicale qui doit composer avec ces processus complexes en raison de leur caractère multidimensionnel, multi niveaux et multi acteurs. Les réponses syndicales aux restructurations s’élaborent toujours dans un contexte d’asymétrie de pouvoirs dans la mesure où l’employeur est maître des dimensions spatiales et temporelles des restructurations. L'anticipation syndicale des restructurations apparaît être une stratégie innovante qui permet aux syndicats de réduire ou mieux, de prévenir les conséquences négatives qui découlent des restructurations. Cette recherche a pour objectif d’examiner les facteurs influençant l’anticipation des restructurations en vue d’en dégager les conditions se rattachant à un tel exercice pour les syndicats. À cette fin, deux modèles d'analyse ont été mobilisés. En premier lieu, les ressources de pouvoir syndicales de Lévesque et Murray (2003) permettent d'expliquer l'anticipation syndicale des restructurations dans la mesure où la capacité d'action du syndicat local constitue un facteur qui ne dépend que du syndicat lui-même. Puis, le modèle d'analyse d'AgirE (2008) permet d'expliquer l'espace et le temps d'action alloués au syndicat par l'employeur pour anticiper les restructurations. Les variables indépendantes provenant de ce modèle d'analyse sont les suivantes: les caractéristiques de l'entreprise, les caractéristiques du territoire et la stratégie patronale de restructuration. Cette présente recherche a été réalisée sous la forme d'une étude de cas. Il s'agit ici de l'étude d'un cas critique d'anticipation syndicale d'une restructuration ayant eu cours en 2004-2005 dans une usine du secteur manufacturier québécois. Des entrevues ont été effectuées auprès de représentants syndicaux de l'usine, d'un ex-cadre de l'usine et de deux intervenants importants du milieu communautaire. Les résultats de notre recherche montrent sans équivoque que la capacité d'action du syndicat local est un facteur-clé qui a permis d'expliquer l'anticipation stratégique et opérationnelle de la restructuration interne ayant eu lieu dans l'usine de fabrication et d'emballage de verre. En dépit des caractéristiques de l'entreprise et de la stratégie patronale de restructuration défavorable à l'implication syndicale, le syndicat local a su lui-même se créer un espace d'action lui ayant permis de sauver l'établissement d'une possible fermeture à moyen-long terme. Les caractéristiques territoriales favorables à une action concertée entre les différents acteurs du territoire où est située l'usine se sont également avérées une condition importante pour l'anticipation syndicale de la restructuration. Dans le cadre de ce mémoire, nous nous penchons sur les relations du travail (RT) dans les entreprises multinationales (EMs) ayant des opérations au Canada. Notre question de recherche est la suivante: « Le pays d’origine d’une entreprise multinationale a-t-il un impact sur les pratiques de relations du travail dans ses opérations canadiennes? » Deux thèses principales ont été élaborées afin d’expliquer les choix des EMs dans l’adoption et l’implantation de pratiques. La première thèse, celle de la diversité, tient pour acquis que plusieurs déterminants endogènes et exogènes à l’EM influencent ses pratiques (Mcgraw et Harley, 2003). Tant les caractéristiques du pays hôte que celles du pays d’origine influenceraient les choix de pratiques des EMs contribuant ainsi à leur diversité (Almond et al., 2005). Par exemple, certains chercheurs avancent que les EMs sont littéralement imprégnées des caractéristiques provenant du pays qui les a vues naître, qu’elles feraient littéralement partie de leur ADN affectant ainsi les pratiques qu’elles mettent en place dans leurs filiales à l’étranger (Berger, 2006). Par ailleurs, la thèse de la convergence soutient que les EMs auraient tendance à utiliser les mêmes pratiques en cette ère de mondialisation et d’hégémonie économique américaine (Mcgraw et Harley, 2003). Les tenants de cette thèse croient plutôt à une convergence des pratiques à travers les EMs en raison notamment de la vaste diffusion du modèle anglo-saxon de gestion, de l’approche des best pratices et du one best way (Mcgraw et Harley, 2003; Royle, 2006). Convergence ou divergence des pratiques? Le débat demeure entier dans la littérature. Outre sa contribution à ce débat, notre recherche permet d’en apprendre davantage sur le comportement des EMs étrangères au Canada, mais aussi d’examiner les spécificités des EMs canadiennes. Le modèle conceptuel développé par ce mémoire se base sur la thèse de la diversité en examinant plus particulièrement l’effet du pays d’origine. Selon la littérature, plusieurs variables influencent les pratiques des EMs, soit le pays d’origine (Almond et al., 2005; Kvinge et Ulrichsen, 2008; Marginson, 2008; Edwards et Ferner, 2002; Collings, 2003; Ferner, 1997, Moore et Rees, 2008; etc.) et les caractéristiques propres à l’EM (Bartlett et Ghosal, 1998; Kidger, 2002; Perlmutter, 1969; Edwards, 2003). Aux fins de notre recherche, notre variable dépendante, les pratiques de RT, comporte cinq dimensions, soit la reconnaissance syndicale des nouveaux établissements, la politique d’implication du syndicat, la perception à l’égard des représentants syndicaux, la structure de la négociation collective et l’autonomie de la filiale dans l’élaboration de politiques en matière de RT (Bélanger et al., 2006). L’hypothèse principale de notre recherche est : le pays d’origine d’une EM a un impact sur le choix des pratiques de RT dans ses opérations canadiennes. Cinq sous-hypothèses, touchant cinq dimensions du concept de RT, ont été testées : 1) les EMs américaines reconnaissent moins souvent le syndicat dans leurs nouveaux établissements que les EMs d’autres pays; 2) les EMs américaines ont une moins bonne perception patronale du syndicat que celles provenant d’autres pays; 3) les négociations collectives sont plus décentralisées dans les EMs américaines que dans celles d’autres pays; 4) les EMs américaines impliquent moins les syndicats dans la prise de décision que celles provenant d’autres pays; 5) l’autonomie dans l’élaboration de politiques concernant la représentation syndicale est plus faible dans les EMs américaines que dans les EMs d’autres pays. Sur le plan méthodologique, cette étude utilise des données secondaires provenant de l’Enquête sur la gestion des ressources humaines, les politiques publiques et la chaîne de valeur mondiale menée par Bélanger, Harvey, Jalette, Lévesque et Murray (2006). Nous étudions un sous-échantillon de la base de données, soit une centaine d’EMs dont les employés sont syndiqués. Les résultats indiquent que les opérations canadiennes des EMs canadiennes se différencient de celles des EMs américaines par une meilleure perception patronale des syndicats et une plus grande implication syndicale. De plus, les EMs européennes reconnaissent plus le syndicat dans leurs nouveaux établissements, perçoivent davantage de la collaboration de la part du syndicat et octroient une plus grande autonomie en matière de RT à leurs opérations canadiennes que les EMs américaines. Enfin, les opérations canadiennes des EMs du reste du monde se distinguent de celles des EMs américaines par une meilleure perception patronale de collaboration de la part du syndicat.

Pour devenir plus flexible, le secteur public a ouvert la voie à de nouveaux principes inspirés de la gestion propre aux firmes, soit la marchandisation des services (Fairbrother et Poynter, 2001). Notre recherche souhaite mieux comprendre les facteurs qui peuvent influencer l’implication du syndicat lorsque la marchandisation est introduite dans la gestion de la prestation des services municipaux. Pour se faire, nous avons choisi de comparer des cas des municipalités dans deux pays, la Ville de Québec et Edinburgh en Écosse, afin de nous aider à comprendre davantage les interactions entre les influences nationales et locales. Nous proposons que les ressources de pouvoir du syndicat local et la stratégie patronale influencent l’implication du syndicat dans la gestion de la prestation des services municipaux, peu importe le contexte national. Les résultats de la recherche nous indiquent que les ressources de pouvoir et la stratégie patronale influencent directement l’implication syndicale. Alors que les ressources de pouvoir donnent un rapport de force au syndicat face à l’employeur, la stratégie patronale peut encourager ou freiner l'implication syndicale. Nos résultats ont aussi soulevé certaines différences entre les contextes nationaux de l’Écosse et du Québec affectant l’implication syndicale: les législations de « Best Value » au Royaume-Uni et celles encadrant les conventions collectives et relations de travail au Québec. Ainsi, des recherches futures sont nécessaires pour mettre à l’épreuve les modèles nationaux couramment utilisés en relations industrielles pour contribuer à la création d’une nouvelle théorie comparative.

With the accelerated trend of global warming, the thermal behavior of existing buildings, which were typically designed based on current weather data, may not be able to cope with the future climate. This paper quantifies, through computer simulations, the increased cooling loads imposed by potential global warming and probable indoor temperature increases due to possible undersized air-conditioning system. It is found from the sample office building examined that the existing buildings would generally be able to adapt to the increasing warmth of 2030 year Low and High scenarios projections and 2070 year Low scenario projection. However, for the 2070 year High scenario, the study indicates that the existing office buildings, in all capital cities except for Hobart, will suffer from overheating problems. When the annual average temperature increase exceeds 2°C, the risk of current office buildings subjected to overheating will be significantly increased. For existing buildings which are designed with current climate condition, it is shown that there is a nearly linear correlation between the increase of average external air temperature and the increase of building cooling load. For the new buildings, in which the possible global warming has been taken into account in the design, a 28-59% increase of cooling capacity under 2070 High scenario would be required to improve the building thermal comfort level to an acceptable standard.

Much has been written in the past decade on the subject of the implication of a term of good faith in contracts in Australia, particularly since the judgment Priestley JA in Renard Constructions (ME) Pty Ltd v Minister for Public Works (1992) 26 NSWLR 234. Except for an early article by Rachael Mulheron, 'Good Faith and Commercial Leases: New Opportunities for the Tenant' (1996) 4 APLJ 223, very little else has been written with respect to the possible application of the doctrine to the commercial leases.With the advent of two later New South Wales Supreme Court decisions Alcatel Australia Ltd v Scarcella (1998) 44 NSWLR 349 and, more recently, Advance Fitness v Bondi Diggers [1999] NSWSC 264, the question of the application of the doctrine in the commercial leasing context has been examined. This article briefly considers the nature and substance of the doctrine against the background of the relationship of lessor and lessee and examines in some depth the Australian decisions on commercial leases where it has been sought, unsuccessfully, to apply the doctrine. The article concludes by suggesting that as a standard commercial lease usually covers the field of agreement between lessor and lessee and as a lessee has a high degree of statutory protection derived from equitable principles, there may be little room for the operation of the doctrine in this legal environment.

By way of response to Professor Duncan's article,1 this article examines the theoretical basis for the implication of contractual terms, particularly the implication of a term at law. In this regard the recent decision of Barrett J in Overlook v Foxtel [2002] NSWSC 17 is considered, to the extent that it provides guidance concerning the implication of an obligation of good faith in the context of a commercial contract. A number of observations are made which may be considered likely to have application to the relationship of commercial landlord and tenant. The conclusion reached is that although the commercial landlord and tenant contractual relationship is highly regulated, this may not deny a remedy to a tenant who is the victim of a landlord's 'bad faith'. Finally, the article concludes by considering the extent to which it may be possible to contractually exclude the implied obligation of good faith.

Introduction : For the past decade, three dimensional (3D) culture has served as a foundation for regenerative medicine study. With an increasing awareness of the importance of cell-cell and cell-extracellular matrix interactions which are lacking in 2D culture system, 3D culture system has been employed for many other applications namely cancer research. Through development of various biomaterials and utilization of tissue engineering technology, many in vivo physiological responses are now better understood. The cellular and molecular communication of cancer cells and their microenvironment, for instance can be studied in vitro in 3D culture system without relying on animal models alone. Predilection of prostate cancer (CaP) to bone remains obscure due to the complexity of the mechanisms and lack of proper model for the studies. In this study, we aim to investigate the interaction between CaP cells and osteoblasts simulating the natural bone metastasis. We also further investigate the invasiveness of CaP cells and response of androgen sensitve CaP cells, LNCaP to synthetic androgen.----- Method : Human osteoblast (hOB) scaffolds were prepared by seeding hOB on medical grade polycaprolactone-tricalcium phosphate (mPLC-TCP) scaffolds and induced to produce bone matrix. CaP cell lines namely wild type PC3 (PC3-N), overexpressed prostate specific antigen PC3 (PC3k3s5) and LNCaP were seeded on hOB scaffolds as co-cultures. Morphology of cells was examined by Phalloidin-DAPI and SEM imaging. Gelatin zymography was performed on the 48 hours conditioned media (CM) from co-cultures to determine matrix metalloproteinase (MMP) activity. Gene expression of hOB/LNCaP co-cultures which were treated for 48 hours with 1nM synthetic androgen R1881 were analysed by quantitative real time PCR (qRT-PCR).----- Results : Co-culture of PCC/hOB revealed that the morphology of PCCs on the tissue engineered bone matrix varied from homogenous to heterogenous clusters. Enzymatically inactive pro-MMP2 was detected in CM from hOBs and PCCs cultured on scaffolds. Elevation in MMP9 activity was found only in hOB/PC3N co-culture. hOB/LNCaP co-culture showed increase in expression of key enzymes associated with steroid production which also corresponded to an increase in prostate specific antigen (PSA) and MMP9.----- Conclusions : Upregulation of MMP9 indicates involvement of ECM degradation during cancer invasion and bone metastases. Expression of enzymes involved in CaP progression, PSA, which is not expressed in osteoblasts, demonstrates that crosstalk between PCCs and osteoblasts may play a part in the aggressiveness of CaP. The presence of steroidogenic enzymes, particularly, RDH5, in osteoblasts and stimulated expression in co-culture, may indicate osteoblast production of potent androgens, fuelling cancer cell proliferation. Based on these results, this practical 3D culture system may provide greater understanding into CaP mediated bone metastasis. This allows the role of the CaP/hOB interaction with regards to invasive property and steroidogenesis to be further explored.

Investment in residential property in Australia is not dominated by the major investment institutions in to the same degree as the commercial, industrial and retail property markets. As at December 2001, the Property Council of Australia Investment Performance Index contained residential property with a total value of $235 million, which represents only 0.3% of the total PCA Performance Index value. The majority of investment in the Australian residential property market is by small investment companies and individual investors. The limited exposure of residential property in the institutional investment portfolios has also limited the research that has been undertaken in relation to residential property performance. However the importance of individual investment in residential property is continuing to gain importance as both individuals are now taking control of their own superannuation portfolios and the various State Governments of Australia are decreasing their involvement in the construction of public housing by subsidizing low-income families into the private residential property market. This paper will: • Provide a comparison of the cost to initially purchase residential property in the various capital city residential property markets in Australia, and • Analyse the true cost and investment performance of residential property in the main residential property markets in Australia based on a standard investment portfolio in each of the State capital cities and relate these results to real estate marketing and agency practice.

As climate change will entail new conditions for the built environment, the thermal behaviour of air-conditioned office buildings may also change. Using building computer simulations, the impact of warmer weather is evaluated on the design and performance of air-conditioned office buildings in Australia, including the increased cooling loads and probable indoor temperature increases due to a possibly undersized air-conditioning system, as well as the possible change in energy use. It is found that existing office buildings would generally be able to adapt to the increasing warmth of year 2030 Low and High scenarios projections and the year 2070 Low scenario projection. However, for the 2070 High scenario, the study indicates that the existing office buildings in all capital cities of Australia would suffer from overheating problems. For existing buildings designed for current climate conditions, it is shown that there is a nearly linear correlation between the increase of average external air temperature and the increase of building cooling load. For the new buildings designed for warmer scenarios, a 28-59% increase of cooling capacity under the 2070 High scenario would be required.

Calcium (Ca) is the main element of most pulp capping materials and plays an essential role in mineralization. Different pulp capping materials can release various concentrations of Ca ions leading to different clinical outcomes. The purpose of this study was to investigate the effects of various concentrations of Ca ions on the growth and osteogenic differentiation of human dental pulp cells (hDPCs). Different concentrations of Ca ions were added to growth culture medium and osteogenic inductive culture medium. A Cell Counting Kit-8 (CCK-8) was used to determine the proliferation of hDPCs in growth culture medium. Osteogenic differentiation and mineralization were measured by alkaline phosphatase (ALP) assay, Alizarin red S/von kossa staining, calcium content quantitative assay. The selected osteogenic differentiation markers were investigated by quantitative real-time polymerase chain reaction (qRT-PCR). Within the range of 1.8–16.2 mM, increased concentrations of Ca ions had no effect on cell proliferation, but led to changes in osteogenic differentiation. It was noted that enhanced mineralized matrix nodule formation was found in higher Ca ions concentrations; however, ALP activity and gene expression were reduced. qRT-PCR results showed a trend towards down-regulated mRNA expression of type I collagen (COL1A2) and Runx2 at elevated concentrations of Ca ions, whereas osteopontin (OPN) and osteocalcin (OCN) mRNA expression was significantly up-regulated. Ca ions content in the culture media can significantly influence the osteogenic properties of hDPCs, indicating the importance of optimizing Ca ions release from dental pulp capping materials in order to achieve desirable clinical outcomes.

The cycling interaction between climate change and building performance is of dynamic nature and both are essentially the cause and the effect of each other. On one hand, buildings contribute significantly to the global warming process. On the other hand, climate change is also expected to impact on many aspects of building performance. In this paper, the status of current research on the implication of climate change on built environment is reviewed. It is found that although the present research has covered broad areas of research, they are generally only limited to the qualitative analyses. It is also highlighted that although it is widely realized that reducing greenhouse gas emissions from the building sector is very important, the adoption of complementary adaptation strategy to prepare the building for a range of climate change scenarios is also necessary. Due to the lack of holistic approach to generate future hourly weather data, various approaches have been used to generate different key weather variables. This ad hoc situation has seriously hindered the application of building simulation technique to the climate change impact study, in particular, to provide quantitative information for policy and design development.

Local climate is a critical element in the design of buildings. In this paper, ten years of historical weather data in Australia's all eight capital cities are analyzed to characterize the variation profiles of climatic variables. The method of descriptive statistics is employed. Either the pattern of cumulative distribution and/or the profile of percentage distribution are used to graphically illustrate the similarity and difference between different study locations. It is found that although the weather variables vary with different locations, except for the extreme parts, there is often a good, nearly linear relation between weather variable and its cumulative percentage for the majority of middle part. The implication of these extreme parts and the slopes of the middle parts on building design is also discussed.
