One of the most important events which characterizes the process of transitioning to the European Union is the ratification of the Convention for the Protection of Human Rights and Fundamental Freedoms by the European Council in 1950. Since then, the topic of human rights has become the inspiring principle in the construction of the European Community and afterwards the institutional apparatus which constitutes the Union. The primary objective of the European Union States currently is to promote a harmonization of the national legislations on mental health, favoring a central health policy which reduces inequalities amongst the member States. For this reason Europe is a region of the world in which is more abundant the normative one about mental health, especially in form of Recommendations directed to the States by the Council of Europe, although norms of direct application also exist. Special interest has the sentences dictated by the European Court of Human Rights and the conclusions of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment. It should be mentioned the work of European Union equally and of the Office for Europe of the World Organization of the Health. This group of juridical instruments configures the most complete regulation on the mental patient's rights.

A considerable proportion of convicted sex offenders maintain a stance of innocence and thus do not engage in recommended treatment programs. As a result, such offenders are often deemed to have outstanding criminogenic needs which may negatively impact upon risk assessment procedures and parole eligibility. This paper reports on a study that aimed to investigate a group of forensic psychologists’ attitudes regarding the impact of denial on risk assessment ratings as well as parole eligibility. Participants completed a confidential open-ended questionnaire. Analysis indicated that considerable variability exists among forensic psychologists in regards to their beliefs about the origins of denial and what impact such denial should have on post-prison release eligibility. In contrast, there was less disparity regarding beliefs about the percentage of innocent yet incarcerated sex offenders. This paper also reviews current understanding regarding the impact of denial on recidivism as well as upon general forensic assessments.

This article describes a follow-up study of 232 individuals who underwent psychiatric assessment by a Criminal Justice Mental Health Team (CJMHT) in 2001/2002, and also draws upon in-depth interviews conducted with 26 of the cohort. At assessment many people are identified with substance misuse problems, as homeless and with a history of psychiatric contact but in the main their problems are of insufficient severity to merit diversion to psychiatric hospital. The study mapped service contact, housing and offending in the 12 months following assessment and compared this to the 12 months prior to assessment, and found increased levels of service contact but also increased levels of offending and no decrease in homelessness. Thus assessment by the CJMHT brought few discernible advantages for the majority of clients. This was also the perception of the 26 clients who were interviewed. Their own perceptions of their lifestyle and the support that they deemed most valuable are described to identify means of enhancing the efficacy of court assessment.

Esta dissertação discute as funções desempenhadas pelo psiquiatra no sistema penal brasileiro, que são a assistência aos transtornos mentais, a avaliação da responsabilidade sobre um ato delituoso e a elaboração de laudos para a concessão do benefício da libertação progressiva a presos comuns. São apresentados os impasses advindos do contato entre justiça e ciência, demonstrando-se como, nos dois últimos casos, o psiquiatra não lida com seu objeto habitual, o doente mental, mas com um outro diverso, o indivíduo perigoso. Para conhecer e controlar este novo objeto a psiquiatria forma, junto com o judiciário, um outro poder denominado, conforme Michel Foucault, normalizador que, sob uma ótica genealógica, transcende o seu objeto original, transformando-se em meio de controle de todo o corpo social. Tendo por principal referencial teórico a obra daquele pensador francês, notadamente os textos vindos à luz nos últimos anos, com a publicação da transcrição de cursos e de outros artigos dispersos, este mecanismo de controle social é analisado, discutindo-se as transformações por que vem passando nas últimas décadas. Paralelamente, é defendida a extinção da necessidade do referendo psiquiátrico à progressão do regime prisional, como forma de corrigir um sistema que não funciona satisfatoriamente.

OBJECTIVES: (1) Describe the population of mentally ill offenders over whom Ontario Review Board (ORB) held jurisdiction. (2) Assess the influences of psychopathology and criminal factors on criminal career. METHOD: This study was a retrospective case series design that reviewed all offenders who were court ordered for psychiatric evaluation at Mental Health Services Site of Providence Care in Kingston, Ontario from 1993 to 2007 (N=347). Eighty five subjects were found not criminally responsible on the account of mental disorder and were included in statistical analysis (n=85). Bivariate associations between five key variables and two outcome variables, seriousness of crime and recidivism, were examined. Logistic regressions were conducted to test the role of the predictor variables on the outcome variables. RESULTS: Age and change in principal psychiatric diagnosis over time were shown to be associated with seriousness of crime. Timing of psychiatric onset, early signs of deviance and change in diagnosis were shown to be associated with recidivism. On the whole, study population did not markedly vary in their distribution of variables by the outcome variables. Regression model included timing of psychiatric onset; psychiatric history; existence of criminal associate; child abuse history; and early signs of deviance. Recidivism was shown to be predicted by early signs of deviance (OR=8.154, p<0.05). Existence of criminal associates was shown to have substantial values of odds ratio at marginal significance (OR=7.577, p=0.13). CONCLUSION: Seriousness of crime is a complex factor that could not be sufficiently predicted by any one or combinations of study variables. Recidivism is better predicted by criminality factors than psychopathology. In the future, an exploratory analysis that more broadly examines the psychopathology and criminal factors in Canadian forensic population is needed. Findings from this study have important clinical and legal implications.

Investigations of the factor structure of the Alcohol Use Disorders Identification Test (AUDIT) have produced conflicting results. The current study assessed the factor structure of the AUDIT for a group of Mentally Disordered Offenders (MDOs) and examined the pattern of scoring in specific subgroups. The sample comprised 2005 MDOs who completed a battery of tests including the AUDIT. Confirmatory factor analyses revealed that a two-factor solution – alcohol consumption and alcohol-related consequences – provided the best data fit for AUDIT scores. A three-factor solution provided an equally good fit, but the second and third factors were highly correlated and a measure of parsimony also favoured the two-factor solution. This study provides useful information on the factor structure of the AUDIT amongst a large MDO population, while also highlighting the difficulties associated with the presence of people with mental health problems in the criminal justice system.

What are the personality differences between individuals who commit crime and those who refrain from crime? The HEXACO model of personality combines facets of honesty and humility with those of emotionality, extraversion, conscientiousness, agreeableness, and openness to experience within a unifying framework of personality. We applied the HEXACO model to examine differences in personality between offenders and nonoffenders. Criminal offenders differed from nonoffenders on five of the six dimensions of personality proposed by the HEXACO model. Compared to nonoffenders, offenders exhibited stronger tendencies toward greed and unfairness, but were also more anxious and fearful. Conversely, the offenders scored lower than nonoffenders on a number of facets of sociability, liveliness, and social boldness. The present findings indicate that offenders may in part be characterized by increased negative emotions but decreased sociability and liveliness. The HEXACO model of personality provides a valuable tool for studying this unique and important population. © 2012 Copyright Taylor and Francis Group, LLC.

There is continued interest in the planning, development and implementation of services designed to identify, detainees with mental illness and connect them to health and social services. However, currently little is known about how best to configure, organise and deliver these services. The study employed a prospective follow-up design with a comparator group to describe and evaluate a police mental health liaison service based in Belfast. Participants were recruited from two neighbouring police stations, only one of which provided a mental health liaison service. Outcomes including mental health status, drug and alcohol misuse, risk-related behaviour and ‘administrative’ outcomes were assessed at the time of arrest and six months later. The service was successful in identifying and assessing detainees though there appeared to be similar between-group levels of mental health problems over time. Results highlight a need to develop firmer linkages and pathways between criminal justice liaison / diversion services and routine health and social services.

Depuis la désinstitutionalisation dans les milieux psychiatriques, il a été souvent mentionné qu’une augmentation des admissions dans les milieux carcéraux et de psychiatrie légale était en cours afin de prendre soin des personnes atteintes de troubles mentaux graves (TMG). Parallèlement, plusieurs auteurs ont rapporté que les individus ayant des troubles mentaux sévères sont plus à risque de perpétrer des gestes antisociaux ou de violence. À l’égard de cette problématique, nous soutenons le modèle de la spécificité clinique. Celui-ci précise que des profils psychopathologiques particuliers augmentent le risque de violence, conduisent à différents types de fonctionnement social et articulent la demande de soins. L’environnement a, de plus, un effet modulateur au niveau du fonctionnement distinctif de l’individu. Une relation bidirectionnelle se construit entre la spécificité psychopathologique et l’environnement, plus particulièrement en ce qui a trait aux relations interpersonnelles, au milieu socioéconomique, au patron d’utilisation des services de psychiatrie et à l’interaction avec le système de justice qui déterminent subséquemment le type de prise en charge ou le statut légal du patient. Afin d’appuyer ce modèle, les profils des patients atteints de TMG en fonction des statuts légaux, du milieu de soins (psychiatrie générale et psychiatrie légale) et de l’utilisation des mesures d’isolement et de contentions ont été examinés. Les patients ont été évalués par des mesures sociodémographiques (indicateurs du fonctionnement social, des relations interpersonnelles et du milieu socioéconomique), psychodiagnostiques (SCID-I et II) et de la psychopathie. De même, le dossier criminel, les dossiers médicaux hospitaliers et administratifs (MED-ECHO et RAMQ) ont été observés. Les devis étaient rétrospectifs. Par ailleurs, au niveau de l’interaction entre les services de psychiatrie et l’individu atteint d’un TMG, nous avons exploré la perception subjective des intervenants en santé mentale quant à l’agressivité et la violence. Nous avons considéré l’impact de cette perception sur la manière d’offrir des soins, plus particulièrement en ce qui a trait aux mesures coercitives (mesures d’isolement avec ou sans contentions), lors des hospitalisations. Les cinq études ont appuyé l’idée d’une spécificité clinique tant sur le plan des profils cliniques des individus que sur la manière d’offrir les services, spécialement au niveau des mesures de contrôles. Les caractéristiques de la personne et de l’environnement semblent de ce fait jouer un rôle important dans le type de services que recevra un individu souffrant de TMG. Ces travaux ouvrent sur la possibilité de mieux déterminer l’étiologie et la gestion de la violence de même que la manière dont le système s’occupe des patients à risque de violence.

Au Canada, les Commissions d'Examen des Troubles Mentaux de chaque province ont la responsabilité de déterminer les conditions de prise en charge des personnes déclarées Non Criminellement Responsables pour cause de Troubles Mentaux (NCRTM) et de rendre, sur une base annuelle une des trois décisions suivantes: a) détention dans un hôpital, b) libération conditionnelle, ou c) libération absolue. Pour favoriser la réinsertion sociale, la libération conditionnelle peut être ordonnée avec la condition de vivre dans une ressource d’hébergement dans la communauté. Parmi les personnes vivant avec une maladie mentale, l’accès aux ressources d’hébergement a été associé à une plus grande stabilité résidentielle, une réduction de nombre et de la durée de séjours d'hospitalisation ainsi qu’une réduction des contacts avec le système judiciaire. Toutefois, l’accès aux ressources d’hébergement pour les personnes trouvées NCRTM est limité, en partie lié à la stigmatisation qui entoure cette population. Il existe peu d’études qui traitent du placement en ressources d’hébergement en psychiatrie légale. Pour répondre à cette question, cette thèse comporte trois volets qui seront présentés dans le cadre de deux manuscrits: 1) évaluer le rôle du placement en ressources d’hébergement sur la réhospitalisation et la récidive chez les personnes trouvées NCRTM; 2) décrire les trajectoires de disposition et de placement en ressources d’hébergement, et 3) mieux comprendre les facteurs associés à ces trajectoires. Les données de la province du Québec du Projet National de Trajectoires d’individus trouvés NCRTM ont été utilisées. Un total de 934 personnes trouvées NCRTM entre le 1er mai 2000 et le 30 avril 2005 compose cet échantillon. Dans le premier manuscrit, l’analyse de survie démontre que les individus placés dans un logement indépendant suite à une libération conditionnelle de la Commission d’Examen sont plus susceptibles de commettre une nouvelle infraction et d’être ré-hospitalisés que les personnes en ressources d’hébergement. Dans le deuxième article, l'analyse de données séquentielle a généré quatre modèles statistiquement stables de trajectoires de disposition et de placement résidentiel pour les 36 mois suivant un verdict de NCRTM: 1) libération conditionnelle dans une ressource d’hébergement (11%), 2) libération conditionnelle dans un logement autonome (32%), 3) détention (43%), et 4) libération absolue (14%). Une régression logistique multinomiale révèle que la probabilité d'un placement en ressource supervisée comparé au maintien en détention est significativement réduite pour les personnes traitées dans un hôpital spécialisé en psychiatrie légale, ainsi que pour ceux ayant commis un délit sévère. D'autre part, la probabilité d’être soumis à des dispositions moins restrictives (soit le logement indépendant et la libération absolue) est fortement associée à des facteurs cliniques tels qu’un nombre réduit d'hospitalisations psychiatriques antérieures, un diagnostic de trouble de l'humeur et une absence de diagnostic de trouble de la personnalité. Les résultats de ce projet doctoral soulignent la valeur protectrice des ressources en hébergement pour les personnes trouvées NCRTM, en plus d’apporter des arguments solides pour une gestion de risque chez les personnes trouvées NCRTM qui incorpore des éléments contextuels de prévention du risque, tel que l’accès à des ressources d’hébergement.
