This thesis is aimed at analysing EU external relations from the perspective of the promotion of the rule of law in order to evaluate the effectiveness and consistency of its action within the international community. The research starts with an examination of the notion of the rule of law from a theoretical point of view. The first chapter initially describes the historical-political evolution of the establishment of the notion of the rule of law. Some of the most significant national experiences (France, the UK, Germany and Austria) are discussed. Then, the focus is put on the need to propose interpretations which explain the grounds of the rule of law, by highlighting the different formal and substantive interpretations. This philosophical-historical analysis is complemented by a reconstruction of how the notion of the rule of law was developed by the international community, with a view to searching a common notion at the international level by comparing theory and practice within the main international organisations such as the UN, OECD and the Council of Europe. Specific mention is made of the EU experience, whose configuration as a Community based on the rule of law is often debated, starting from the case law of the European Court of Justice. The second chapter deals with the conditionality policy and focuses on the development and scope of democratic conditionality according to the dominant approach of the doctrine. First, the birth of conditionality is analysed from an economic point of view, especially within international financial organisations and the different types of conditionality recreated in the scientific sector. Then an analysis is provided about the birth of democratic conditionality in the EC – in relation to its external relations – firstly as a mere political exercise to be then turned into a standardised system of clauses. Specific reference is made to the main scope of conditionality, that is to say enlargement policy and the development of the Copenhagen criteria. The third chapter provides further details about the legal questions connected to the use of democratic clauses: on the one hand, the power of the EC to include human rights clauses in international agreements, on the other, the variety and overlapping in the use of the legal basis. The chapter ends with an analysis of the measures of suspension of agreements with third countries in those rare but significant cases in which the suspension clause, included in the Lomè Convention first and in the Cotonou Agreement then, is applied. The last chapter is devoted to the analysis of democratic clauses in unilateral acts adopted by the European Union which affect third countries. The examination of this practice and the comparison with the approach analysed in the previous chapter entails a major theoretical question. It is the clear-cut distinction between conditionality and international sanction. This distinction is to be taken into account when considering the premises and consequences, in terms of legal relations, which are generated when democratic clauses are not complied with. The chapter ends with a brief analysis of what, according to the reconstruction suggested, can be rightly labelled as real democratic conditionality, that is to say the system of incentives, positive measures developed within the community GSP. The dissertation ends with a few general considerations about the difficulties experienced by the EU in promoting the rule of law. The contradictory aspects of the EU external actions are manifold, as well as its difficulties in choosing the most appropriate measures to be taken which, however, reflect all the repercussions and tension resulting from the balance of power within the international community. The thesis argues that it is difficult to grant full credibility to an entity like the EU which, although it proclaims itself as the guardian and promoter of the rule of law, in practice, is too often biased in managing its relations with third countries. However, she adds, we must acknowledge that the EU is committed and constantly strives towards identifying new spaces and strategies of action.

The purpose of this study is to develop and evaluate techniques that improve the spatial resolution of the channels already selected in the preliminary studies for Geostationary Observatory for Microwave Atmospheric Soundings (GOMAS). Reference high resolution multifrequency brightness temperatures scenarios have been derived by applying radiative transfer calculation to the spatially and microphysically detailed output of meteorological events simulated by the University of Wisconsin - Non-hydrostatic Model System (UW-NMS). Three approaches, Wiener filter, Super-Resolution and Image Fusion have been applied to some representative GOMAS frequency channels to enhance the resolution of antenna temperatures. The Wiener filter improved resolution of the largely oversampled images by a factor 1.5- 2.0 without introducing any penalty in the radiometric accuracy. Super-resolution, suitable for not largely oversampled images, improved resolution by a factor ~1.5 but introducing an increased radiometric noise by a factor 1.4-2.5. The image fusion allows finally to further increase the spatial frequency of the images obtained by the Wiener filter increasing the total resolution up to a factor 5.0 with an increased radiometric noise closely linked to the radiometric frequency and to the examined case study.

In this thesis we study three combinatorial optimization problems belonging to the classes of Network Design and Vehicle Routing problems that are strongly linked in the context of the design and management of transportation networks: the Non-Bifurcated Capacitated Network Design Problem (NBP), the Period Vehicle Routing Problem (PVRP) and the Pickup and Delivery Problem with Time Windows (PDPTW). These problems are NP-hard and contain as special cases some well known difficult problems such as the Traveling Salesman Problem and the Steiner Tree Problem. Moreover, they model the core structure of many practical problems arising in logistics and telecommunications. The NBP is the problem of designing the optimum network to satisfy a given set of traffic demands. Given a set of nodes, a set of potential links and a set of point-to-point demands called commodities, the objective is to select the links to install and dimension their capacities so that all the demands can be routed between their respective endpoints, and the sum of link fixed costs and commodity routing costs is minimized. The problem is called non- bifurcated because the solution network must allow each demand to follow a single path, i.e., the flow of each demand cannot be splitted. Although this is the case in many real applications, the NBP has received significantly less attention in the literature than other capacitated network design problems that allow bifurcation. We describe an exact algorithm for the NBP that is based on solving by an integer programming solver a formulation of the problem strengthened by simple valid inequalities and four new heuristic algorithms. One of these heuristics is an adaptive memory metaheuristic, based on partial enumeration, that could be applied to a wider class of structured combinatorial optimization problems. In the PVRP a fleet of vehicles of identical capacity must be used to service a set of customers over a planning period of several days. Each customer specifies a service frequency, a set of allowable day-combinations and a quantity of product that the customer must receive every time he is visited. For example, a customer may require to be visited twice during a 5-day period imposing that these visits take place on Monday-Thursday or Monday-Friday or Tuesday-Friday. The problem consists in simultaneously assigning a day- combination to each customer and in designing the vehicle routes for each day so that each customer is visited the required number of times, the number of routes on each day does not exceed the number of vehicles available, and the total cost of the routes over the period is minimized. We also consider a tactical variant of this problem, called Tactical Planning Vehicle Routing Problem, where customers require to be visited on a specific day of the period but a penalty cost, called service cost, can be paid to postpone the visit to a later day than that required. At our knowledge all the algorithms proposed in the literature for the PVRP are heuristics. In this thesis we present for the first time an exact algorithm for the PVRP that is based on different relaxations of a set partitioning-like formulation. The effectiveness of the proposed algorithm is tested on a set of instances from the literature and on a new set of instances. Finally, the PDPTW is to service a set of transportation requests using a fleet of identical vehicles of limited capacity located at a central depot. Each request specifies a pickup location and a delivery location and requires that a given quantity of load is transported from the pickup location to the delivery location. Moreover, each location can be visited only within an associated time window. Each vehicle can perform at most one route and the problem is to satisfy all the requests using the available vehicles so that each request is serviced by a single vehicle, the load on each vehicle does not exceed the capacity, and all locations are visited according to their time window. We formulate the PDPTW as a set partitioning-like problem with additional cuts and we propose an exact algorithm based on different relaxations of the mathematical formulation and a branch-and-cut-and-price algorithm. The new algorithm is tested on two classes of problems from the literature and compared with a recent branch-and-cut-and-price algorithm from the literature.

Generic programming is likely to become a new challenge for a critical mass of developers. Therefore, it is crucial to refine the support for generic programming in mainstream Object-Oriented languages — both at the design and at the implementation level — as well as to suggest novel ways to exploit the additional degree of expressiveness made available by genericity. This study is meant to provide a contribution towards bringing Java genericity to a more mature stage with respect to mainstream programming practice, by increasing the effectiveness of its implementation, and by revealing its full expressive power in real world scenario. With respect to the current research setting, the main contribution of the thesis is twofold. First, we propose a revised implementation for Java generics that greatly increases the expressiveness of the Java platform by adding reification support for generic types. Secondly, we show how Java genericity can be leveraged in a real world case-study in the context of the multi-paradigm language integration. Several approaches have been proposed in order to overcome the lack of reification of generic types in the Java programming language. Existing approaches tackle the problem of reification of generic types by defining new translation techniques which would allow for a runtime representation of generics and wildcards. Unfortunately most approaches suffer from several problems: heterogeneous translations are known to be problematic when considering reification of generic methods and wildcards. On the other hand, more sophisticated techniques requiring changes in the Java runtime, supports reified generics through a true language extension (where clauses) so that backward compatibility is compromised. In this thesis we develop a sophisticated type-passing technique for addressing the problem of reification of generic types in the Java programming language; this approach — first pioneered by the so called EGO translator — is here turned into a full-blown solution which reifies generic types inside the Java Virtual Machine (JVM) itself, thus overcoming both performance penalties and compatibility issues of the original EGO translator. Java-Prolog integration Integrating Object-Oriented and declarative programming has been the subject of several researches and corresponding technologies. Such proposals come in two flavours, either attempting at joining the two paradigms, or simply providing an interface library for accessing Prolog declarative features from a mainstream Object-Oriented languages such as Java. Both solutions have however drawbacks: in the case of hybrid languages featuring both Object-Oriented and logic traits, such resulting language is typically too complex, thus making mainstream application development an harder task; in the case of library-based integration approaches there is no true language integration, and some “boilerplate code” has to be implemented to fix the paradigm mismatch. In this thesis we develop a framework called PatJ which promotes seamless exploitation of Prolog programming in Java. A sophisticated usage of generics/wildcards allows to define a precise mapping between Object-Oriented and declarative features. PatJ defines a hierarchy of classes where the bidirectional semantics of Prolog terms is modelled directly at the level of the Java generic type-system.

Visual search and oculomotor behaviour are believed to be very relevant for athlete performance, especially for sports requiring refined visuo-motor coordination skills. Modern coaches believe that a correct visuo-motor strategy may be part of advanced training programs. In this thesis two experiments are reported in which gaze behaviour of expert and novice athletes were investigated while they were doing a real sport specific task. The experiments concern two different sports: judo and soccer. In each experiment, number of fixations, fixation locations and mean fixation duration (ms) were considered. An observational analysis was done at the end of the paper to see perceptual differences between near and far space. Purpose: The aim of the judo study was to delineate differences in gaze behaviour characteristics between a population of athletes and one of non athletes. Aspects specifically investigated were: search rate, search order and viewing time across different conditions in a real-world task. The second study was aimed at identifying gaze behaviour in varsity soccer goalkeepers while facing a penalty kick executed with instep and inside foot. Then an attempt has been done to compare the gaze strategies of expert judoka and soccer goalkeepers in order to delineate possible differences related to the different conditions of reacting to events occurring in near (peripersonal) or far (extrapersonal) space. Judo Methods: A sample of 9 judoka (black belt) and 11 near judoka (white belt) were studied. Eye movements were recorded at 500Hz using a video based eye tracker (EyeLink II). Each subject participated in 40 sessions for about 40 minutes. Gaze behaviour was considered as average number of locations fixated per trial, the average number of fixations per trial, and mean fixation duration. Soccer Methods: Seven (n = 7) intermediate level male volunteered for the experiment. The kickers and goalkeepers, had at least varsity level soccer experience. The vision-in-action (VIA) system (Vickers 1996; Vickers 2007) was used to collect the coupled gaze and motor behaviours of the goalkeepers. This system integrated input from a mobile eye tracking system (Applied Sciences Laboratories) with an external video of the goalkeeper’s saving actions. The goalkeepers took 30 penalty kicks on a synthetic pitch in accordance with FIFA (2008) laws. Judo Results: Results indicate that experts group differed significantly from near expert for fixations duration, and number of fixations per trial. The expert judokas used a less exhaustive search strategy involving fewer fixations of longer duration than their novice counterparts and focused on central regions of the body. The results showed that in defence and attack situation expert group did a greater number of transitions with respect to their novice counterpart. Soccer Results: We found significant main effect for the number of locations fixated across outcome (goal/save) but not for foot contact (instep/inside). Participants spent more time fixating the areas in instep than inside kick and in goal than in save situation. Mean and standard error in search strategy as a result of foot contact and outcome indicate that the most gaze behaviour start and finish on ball interest areas. Conclusions: Expert goalkeepers tend to spend more time in inside-save than instep-save penalty, differences that was opposite in scored penalty kick. Judo results show that differences in visual behaviour related to the level of expertise appear mainly when the test presentation is continuous, last for a relatively long period of time and present a high level of uncertainty with regard to the chronology and the nature of events. Expert judoist performers “anchor” the fovea on central regions of the scene (lapel and face) while using peripheral vision to monitor opponents’ limb movements. The differences between judo and soccer gaze strategies are discussed on the light of physiological and neuropsychological differences between near and far space perception.

One of the most interesting challenge of the next years will be the Air Space Systems automation. This process will involve different aspects as the Air Traffic Management, the Aircrafts and Airport Operations and the Guidance and Navigation Systems. The use of UAS (Uninhabited Aerial System) for civil mission will be one of the most important steps in this automation process. In civil air space, Air Traffic Controllers (ATC) manage the air traffic ensuring that a minimum separation between the controlled aircrafts is always provided. For this purpose ATCs use several operative avoidance techniques like holding patterns or rerouting. The use of UAS in these context will require the definition of strategies for a common management of piloted and piloted air traffic that allow the UAS to self separate. As a first employment in civil air space we consider a UAS surveillance mission that consists in departing from a ground base, taking pictures over a set of mission targets and coming back to the same ground base. During all mission a set of piloted aircrafts fly in the same airspace and thus the UAS has to self separate using the ATC avoidance as anticipated. We consider two objective, the first consists in the minimization of the air traffic impact over the mission, the second consists in the minimization of the impact of the mission over the air traffic. A particular version of the well known Travelling Salesman Problem (TSP) called Time-Dependant-TSP has been studied to deal with traffic problems in big urban areas. Its basic idea consists in a cost of the route between two clients depending on the period of the day in which it is crossed. Our thesis supports that such idea can be applied to the air traffic too using a convenient time horizon compatible with aircrafts operations. The cost of a UAS sub-route will depend on the air traffic that it will meet starting such route in a specific moment and consequently on the avoidance maneuver that it will use to avoid that conflict. The conflict avoidance is a topic that has been hardly developed in past years using different approaches. In this thesis we purpose a new approach based on the use of ATC operative techniques that makes it possible both to model the UAS problem using a TDTSP framework both to use an Air Traffic Management perspective. Starting from this kind of mission, the problem of the UAS insertion in civil air space is formalized as the UAS Routing Problem (URP). For this reason we introduce a new structure called Conflict Graph that makes it possible to model the avoidance maneuvers and to define the arc cost function of the departing time. Two Integer Linear Programming formulations of the problem are proposed. The first is based on a TDTSP formulation that, unfortunately, is weaker then the TSP formulation. Thus a new formulation based on a TSP variation that uses specific penalty to model the holdings is proposed. Different algorithms are presented: exact algorithms, simple heuristics used as Upper Bounds on the number of time steps used, and metaheuristic algorithms as Genetic Algorithm and Simulated Annealing. Finally an air traffic scenario has been simulated using real air traffic data in order to test our algorithms. Graphic Tools have been used to represent the Milano Linate air space and its air traffic during different days. Such data have been provided by ENAV S.p.A (Italian Agency for Air Navigation Services).

La ricerca ha ad oggetto l’analisi di clausole, contenute nei contratti del commercio internazionale, che sembrano finalizzate a fornire in anticipo una metodologia dell’interpretazione del contratto. L’elaborato pertanto analizza i profili di validità ed efficacia di singole e specifiche clausole, come le “clausole d’intero accordo”, le “clausole di non modificazione orale”, le clausole contenenti definizioni, e simili, alla luce delle regole giudiriche di derivazione eteronoma applicabili al contratto, siano esse rappresentate da una legge nazionale, da una convenzione internazionale di diritto materiale uniforme, o da fonti ulteriori c.d. di soft law, come i Principi Unidroit sui contratti del commercio internazionale. La ricerca ha pertanto rivelato che, diversamente da quanto possa apparire a prima vista, svariate tipologie di clausole analizzate non coinvolgono profili legati all'’nterpretazione del contratto, quanto piuttosto di documentazione e forma dello stesso. L’elaborato contiene infine alcune considerazioni di teoria generale del diritto.

La ricerca ha ad oggetto l’analisi della disciplina della responsabilità del vettore terrestre di merci per conto terzi ed i riflessi che detta disciplina ha avuto modo di svilupparsi nel mercato assicurativo. L’attenzione è stata rivolta al contratto di trasporto di cose in generale, seguendone la disciplina codicistica e le evoluzioni legislative intervenute. Particolare rilievo assume la novella apportata all’art. 1696 c.c., introdotta dall’art. 10 del Dlgs. 286/2005, grazie alla quale l’ordinamento italiano ha potuto codificare il limite di indennizzo dovuto dal vettore nell’ipotesi di colpa lieve, L’introduzione del limite legale di indennizzo per le ipotesi di responsabilità per perdita o avaria della merce trasportata ha generato nel mondo assicurativo interessanti reazioni. L’elaborato esamina anche l’evoluzione giurisprudenziale formatisi in tema di responsabilità vettoriale, evidenziando il crescente rigore imposto dalla giurisprudenza fondato sul principio del receptum. Tale fenomeno ha visto immediata reazione nel mercato assicurativo il quale, sulla base di testi contrattuali non dissimili tra le diverse compagnie di assicurazioni operanti sul mercato domestico e che traevano origine dai formulari approvati dall’ANIA, ha seguito l’evoluzione giurisprudenziale apportando significative restrizioni al rischio tipico previsto dalle coperture della responsabilità civile vettoriale. La ricerca si è poi focalizzata sull’esame delle più comuni clausole contemplate dalle polizze di assicurazioni di responsabilità civile e sul loro significato alla luce delle disposizioni di legge in materia. Tale analisi riveste preminente interesse poiché consente di verificare in concreto come l’assicurazione possa effettivamente costituire per l’impresa di trasporto non tanto un costo bensì una opportunità di risparmio da un lato ed un modello comportamentale, sebbene indotto, dall’altro lato per il raggiungimento di quei canoni di diligenza che qualsiasi operatore del settore dovrebbe tenere durante l’esecuzione del trasporto ed il cui venir meno determina, come detto, sensibili effetti pregiudizievoli di carattere economico.

La presente tesis analiza el problema de la validez de las disposiciones de transposición de las Directivas Europeas en los ordenamientos nacionales desde la perspectiva del principio constitucional de reserva de ley. En el primer capítulo se desarrolla un análisis del estado de la cuestión en las jurisprudencias española e italiana. En el segundo se afronta el estudio de los requisitos impuestos por la jurisprudencia del TJUE en relación con las normas por las que se procede a la incorporación en los ordenamientos internos del contenido de las Directivas; teniendo en cuenta que ha de partirse del principio de autonomía institucional y procedimental de los Estados Miembros y que las Directivas, en tanto carentes por razón de su forma de directa aplicabilidad, no pueden sustituir a la ley nacional, el principio de reserva de ley ha de aplicarse en este tipo de operaciones siempre que así lo exija la Constitución nacional. En el tercer capítulo se estudian los efectos que han producido en los ordenamientos italiano, francés y alemán las cláusulas constitucionales "europeas", alcanzándose la fundamental conclusión de que las mismas no han supuesto quiebra alguna de la disciplina general de producción normativa en lo que se refiere a las operaciones de ejecución interna del Derecho Europeo. En el cuarto y último capítulo, en fin, se analiza el sistema italiano de ejecución de las políticas europeas mediante normas reglamentarias y la posible toma en consideración del mismo para la formulación de propuestas de lege ferenda en relación con el Derecho Español.

L'interrogativo da cui nasce la ricerca riguarda la possibilità di individuare, in controtendenza con la logica neoliberista, strategie per l'affermarsi di una cultura dello sviluppo che sia sostenibile per l'ambiente e rispettosa della dignità delle persone, in grado di valorizzarne le differenze e di farsi carico delle difficoltà che ognuno può incontrare nel corso della propria esistenza. Centrale è il tema del lavoro, aspetto decisivo delle condizioni di appartenenza sociale e di valorizzazione delle risorse umane. Vengono richiamati studi sulla realtà in cui siamo immersi, caratterizzata dal pensiero liberista diventato negli ultimi decenni dominante su scala globale e che ha comportato una concezione delle relazioni sociali basata su di una competitività esasperata e sull’esclusione di chi non sta al passo con le leggi di mercato: le conseguenze drammatiche dell'imbroglio liberista; la riduzione delle persone a consumatori; la fuga dalla comunità ed il rifugio in identità separate; il tempo del rischio, della paura e della separazione fra etica e affari. E gli studi che, in controtendenza, introducono a prospettive di ricerca di uno sviluppo inclusivo e umanizzante: le prospettive della decrescita, del business sociale, di una via cristiana verso un'economia giusta, della valorizzazione delle capacità delle risorse umane. Vengono poi indagati i collegamenti con le esperienze attive nel territorio della città di Bologna che promuovono, attraverso la collaborazione fra istituzioni, organizzazioni intermedie e cittadini, occasioni di un welfare comunitario che sviluppa competenze e diritti insieme a responsabilità: l'introduzione delle clausole sociali negli appalti pubblici per la realizzazione professionale delle persone svantaggiate; la promozione della responsabilità sociale d'impresa per l'inclusione socio-lavorativa; la valorizzazione delle risorse delle persone che vivono un’esperienza carceraria. Si tratta di esperienze ancora limitate, ma possono costituire un riferimento culturale e operativo di un modello di sviluppo possibile, che convenga a tutti, compatibile con i limiti ambientali e umanizzante.

La tesi si propone l’obiettivo di indagare le modalità di interazione tra conoscenze tecnico-scientifiche e dato normativo, a partire dallo studio delle c.d. norme tecniche, ossia le norme, dotate di forza giuridica o meno, elaborate sulla base di conoscenze tecnico-scientifiche. La ricerca analizza diversi settori dell’ordinamento, accomunati da un’elevata influenza di saperi tecnici e al tempo stesso da un’indubbia rilevanza dal punto di vista costituzionale (la disciplina delle sperimentazioni cliniche dei farmaci, quella delle emissioni inquinanti di origine industriale e quella relativa agli standard di sicurezza dei prodotti), individuando quelle che al loro interno si possono considerare norme tecniche e mettendone in luce sia i profili formali (in quali atti-fonte sono contenute, quale natura giuridica presentano) che il procedimento di formazione, con particolare attenzione ai soggetti che vi prendono parte. Si propone quindi una sistematizzazione degli elementi emersi dall’indagine a partire da due diverse prospettive: in primo luogo tali dati vengono analizzati dal punto di vista dogmatico, individuando i diversi meccanismi di ingresso del dato tecnico-scientifico nel tessuto normativo (incorporazione nella norma giuridica, impiego di clausole generali, rinvio a norme extra-giuridiche), al fine di mettere in luce eventuali profili problematici per quanto riguarda il sistema delle fonti. La seconda prospettiva prende invece quale punto di riferimento il “centro di elaborazione sostanziale” delle norme considerate, al fine di evidenziarne i diversi fattori di legittimazione: a partire da esigenze di armonizzazione della disciplina e dall’assunto della neutralità delle conoscenze tecnico-scientifiche rispetto agli interessi coinvolti, l’elaborazione delle norme tecniche vede infatti un significativo ripensamento degli equilibri non solo fra attori pubblici e privati, ma anche tra legittimazione politica e legittimazione “tecnica” della scelta normativa. A tali aspetti è dedicata la parte conclusiva del lavoro, in particolare per quanto riguarda la conformità rispetto al disegno costituzionale.

La tematica dell’abuso del diritto in campo fiscale ha conosciuto, negli ultimi anni, una diffusione particolarmente rilevante. Questo lavoro, dopo una necessaria premessa introduttiva alla problematica, affronta l’abuso del diritto in campo tributario tramite l’analisi degli strumenti classici dell’ermenutica, constatando come si arrivi ad un intreccio tra lo strumento della clausola generale anti-abuso e il principio di divieto d’abuso del diritto sviluppatosi a livello europeo, concretizzazione del più ampio principio dell’effettività del diritto dell’Unione Europea. L’analisi prende a modello, da un lato, la clausola generale anti-abuso tedesca, adottata già nel primo dopoguerra, e le sue diverse modifiche legislative occorse negli anni, e dall’altro, il principio europeo di divieto d’abuso del diritto. L’esame congiunto rivela un cortocircuito interpretativo, posto che il principio europeo espone gli stessi concetti della clausola nazionale tedesca pre riforma, la quale, in seguito, alle sentenze Halifax e Cadbury Schweppes, ha subito un’importante modifica, cosicchè la clausola generale abbisogna ora del princìpio europeo per essere interpretata. La tesi evidenzia, inoltre, come tale circuito sia aggravato anche da tensioni interne alle stesse Istituzioni europee, posto che, nonostante l’esistenza di un principio di elaborazione giurisprudenziale, gli Stati Membri sono stati invitati ad introdurre una clausola generale anti-abuso, la cui formulazione rimanda al principio di divieto d’abuso del diritto elaborato dalla Corte di Giustizia.

I sistemi fiscali contemporanei applicano l’imposizione diretta a persone fisiche e persone giuridiche. In ciascuno Stato tuttavia una varietà di figure intermedie, definibili non- corporate-entities, sono dotate di gradi diversi di soggettività di diritto. Fra queste rientrano le partnership. Con l’obiettivo di ricondurre la fiscalità delle partnership all’interno del regime domestico generale previsto per persone fisiche o giuridiche, ogni Stato impiega proprie regole di caratterizzazione fiscale delle partnership. Di conseguenza, ciascuno Stato può considerare le partnership fiscalmente opache o trasparenti. Ciò vale sia per le partnership domestiche che per quelle estere. Quando l’attività di una partnership domestica presenta elementi di internazionalità, gli approcci domestici di caratterizzazione fiscale interferiscono spesso con quelli adottati da altri Stati. Tali inevitabili conflitti producono un alto rischio di doppia imposizione o doppia non imposizione dei redditi internazionali. La soluzione di tale genere di problemi non trova sistematica considerazione né nei Trattati fiscali, né nei Trattati UE così come interpretati dalla CGUE. Essa resta affidata all’autonoma iniziativa di ciascuno Stato. Questo studio esamina l’imposizione diretta delle partnerships internazionali che presentino un qualche collegamento con il sistema fiscale italiano. Esso inoltre propone una comparazione con altri sistemi fiscali selezionati sulla base di alcuni criteri. La comparazione mira alla individuazione dei problemi scaturenti dalla simultanea applicazione della tassazione italiana ed estera, considerando il ruolo spesso modesto dei Trattati fiscali. Ove un Trattato includa clausole specifiche per le partnership, ne viene esaminato l’effetto. Se i Paesi considerati sono Stati membri UE, i risultati dell’analisi sono esaminati rispetto alla normativa europea, con particolare riguardo ai profili di compatibilità con le libertà del Trattato UE e con i relativi orientamenti della CGUE.

La llamada sucesión necesaria plantea una serie de problemas que atienden a la tutela del legitimario, en cuyo ámbito la reducción de las disposiciones inoficiosas y, en particular la que atiende a los actos inter vivos del causante, adquiere una gran importancia. Importancia que es particularmente relevante en el ordenamiento jurídico español, en el que la acción de reducción, si bien prevista por el Derecho positivo, no está completamente regulada en la norma, subsistiendo, por ello, múltiples cuestiones sin resolver. La presente investigación busca profundizar en el régimen jurídico de la donación inoficiosa tal y como lo recoge el Código civil español, enriqueciéndolo con las aportaciones de la doctrina italiana, cuya solidez interpretativa puede servir de referencia para una eventual reforma del Derecho castellano. Con este objetivo, la presente investigación se centra, entre otros puntos, sobre la configuración histórica de la acción de reducción; el concepto de donación inoficiosa; las operaciones de cálculo de la legítima; la naturaleza jurídica de la acción de reducción y la valoración del bien donado a los efectos de reducción. Finalmente, estudia la validez de las “cláusulas de reducción in valorem”, por medio del as cuales el donante puede autorizar al donatario para que conserve el bien objeto de la donación, entregando al legitimario una cantidad de dinero. En conclusión, la presente tesis permite individuar las características del acto impugnable mediante la acción de reducción de donaciones y las líneas esenciales de la reducción como categoría de ineficacia, lo que a su vez favorecer la resolución de algunos problemas de aplicación de la reducción de donaciones que se encuentran en el ordenamiento español. La investigación, además, permite formular algunas propuestas “de lege ferenda” a fin de agilizar la práctica de la reducción y reducir la litigiosidad, salvaguardando los intereses de legitimario y donatario.

In particular in contract law general clauses and standards has assumed a leading role and has become protagonists of processes of integration and harmonization of teh law. Wifin dis context, teh reasonableness clause TEMPhas come to teh attention of scholars, emerging as a new element of connection between different legal systems -first of all between common law and civil law – and even between different legal traditions. dis research aims at reconstructing teh patterns of emersion and evolution of teh TEMPprincipal of reasonableness in contract law both wifin European Union Law and in teh Chinese legal system, in order to identify evolutionary trends, processes of emersion and circulation of legal models and teh scope of operation of teh TEMPprincipal in teh two contexts. In view of teh increasingly intense economic relations between Europe and China, wifin teh framework of teh new project called Belt and Road Initiative, a comparative survey of dis type can foster mutual understanding and make communications more TEMPeffective, at teh level of legal culture and commercial relations, and to support teh processes of supranational harmonization of contract law rules.
