How to deal with the impacts of the exchange rate on the trade balance of Brazil? There is not a single answer to such question. In order to find out some legal approaches for this matter, this paper aims to describe and analyze the role of the IMF, WTO and the governments of Brazil and the United States on the currency misalignments, especially the extraterritorial effects of such misalignment on the Brazil’s bilateral trade with the United States. The article concludes that the Currency Swap Agreements and other bilateral solutions may minimize the distortions that the Brazilian balance of payment against the USA is carrying, due to the lack of legal solutions for the problem of the exchange rate misalignments that Brazil is facing.

This paper is designed to provide a first approach to some questions raised by the Global administrative Law Project concerning the anti money laundering system, as a global governance project, and how it works in Latin America. We address some interactions between actors at the global, regional and local level. So we have organized our presentation according to those three spaces: 1) global standards, 2) regional efforts and 3) national experiences, where we present the contrast between Brazil and Argentina.

Tendo por base o desenvolvimento sustentável e a mitigação das mudanças climáticas, políticas públicas estão sendo elaboradas para reverter a crescente degradação dos ecossistemas naturais, permitindo novas formas de cooperação na interface global. As recentes tendências da governança indicam que o foco mudou das atividades entre governos para as iniciativas multisetoriais, da governança em nível nacional para a governança em vários níveis internacionais e de um procedimento formal e legalista para uma abordagem mais informal, participativa e integrada, surgindo, como um possível componente dessa nova estrutura, as redes globais de política pública. Os atores brasileiros estão cada vez mais aderindo a essas redes globais de políticas voltadas à redução das mudanças do clima com seus projetos e políticas de desenvolvimento limpo, indicando que modelos estruturais e relacionais como esse podem ser considerados instrumentos viáveis de governança global quando a questão é a minimização dos riscos ambientais que ameaçam o planeta. Diante disso, foi definido como objetivo do estudo verificar a institucionalização da rede global de políticas públicas voltada à mitigação das mudanças climáticas entre os atores brasileiros relacionados com as políticas de redução e/ou compensação das emissões de gases de efeito estufa. Para isso, foi realizada uma pesquisa bibliográfica sobre o tema de estudo e uma pesquisa empírica com os atores brasileiros do setor público, privado e organizações não-governamentais envolvidos na rede global de políticas públicas. Os resultados mostraram que dos elementos analisados no intuito de verificar a institucionalização da rede entre os atores brasileiros, somente parte deles apontaram para a formação dessa estrutura. Notou-se uma tentativa de institucionalizar a rede, entretanto, muito ainda há de ser desenvolvido para uma perfeita institucionalização.

O processo de globalização dos últimos anos evidenciou que as atividades estatais são desagregadas em favor de uma estrutura de relações entre diferentes atores que operam em um contexto global. Neste sentido, esta pesquisa defende que o que pode precisamente ser compreendido como verdadeiramente “global” evidenciado nas últimas décadas do século XX são a transformações das mudanças ambientais em desafios globais. Ao analisar, especificamente, a questão da biossegurança, torna-se importante, portanto, destacar dentro deste contexto de globalização, os aspectos relevantes de governança global (processo no qual diferentes atores estão envolvidos), mais especificamente, a transferência de política, no qual a formulação de políticas públicas para o desenvolvimento social é influenciada por experiências em contextos políticos distintos. Diante disto, foi definido como objetivo de pesquisa analisar como o Protocolo de Cartagena (instrumento legal independente desenvolvido em conformidade com a Convenção sobre Diversidade Biológica em 2000, Montreal) influenciou na formulação e na implementação da Política Nacional de Biossegurança (PNB) brasileira (com base na Lei nº 11.105) no que se refere aos alimentos transgênicos no período de 2000-2009. Para isto, foi realizada uma pesquisa documental sobre o tema de estudo e uma pesquisa empírica por meio de entrevista com pessoas que participam diretamente ou indiretamente na PNB e que, se não participam atualmente, já atuaram nesta Política ou acompanharam seu processo de formulação. Os resultados revelaram que é possível concluir que houve a existência de um processo de transferência de política do Protocolo de Cartagena à PNB, porém no formato de aprendizado (ou lesson drawing).

O primeiro capítulo trata do problema de pesquisa consubstanciado na pergunta: como a crise financeira mundial de 2008 atingiu o equilíbrio de poder global e quais foram os desdobramentos no sistema internacional, e a respectiva argumentação de objetivos, delimitação e relevância do estudo. O capítulo dois aborda a questão metodológica do ponto de vista dos métodos de abordagem e da coleta e tratamento das informações. O capítulo terceiro apresenta a complexidade da interação entre ordem internacional e governança global, termos difíceis de serem definidos, porém constantes nas agendas da diplomacia e política internacional. O capítulo quarto introduz o conceito de governança multinível para expressar a interação de diversos atores em diversas camadas abaixo e acima do Estado. O capítulo quinto trata das crises pré-2008, buscando verificar possíveis características comuns entre elas. O capítulo sexto trata da crise de 2008 e alargamento e prolongamento para a Europa, articulando variáveis econômicas e financeiras globais. O capítulo sete procura relacionar a política externa brasileira à arquitetura da governança global, aspirando uma participação mais ativa nos fóruns internacionais. No capítulo nono é apresentada a conclusão do estudo em termos de dilemas e obstáculos comportamentais e/ou estruturais e os campos que devem ser melhor investigados e aprofundados.

A new paradigm is modeling the World: evolutionary innovations in all fronts, new information technologies, huge mobility of capital, use of risky financial tools, globalization of production, new emerging powers and the impact of consumer concerns on governmental policies. These phenomena are shaping the World and forcing the advent of a new World Order in the Multilateral Monetary, Financial, and Trading System. The effects of this new paradigm are also transforming global governance. The political and economic orders established after the World War and centered on the multilateral model of UN, IMF, World Bank, and the GATT, leaded by the developed countries, are facing significant challenges. The rise of China and emerging countries shifted the old model to a polycentric World, where the governance of these organizations are threatened by emerging countries demanding a bigger participation in the role and decision boards of these international bodies. As a consequence, multilateralism is being confronted by polycentrism. Negotiations for a more representative voting process and the pressure for new rules to cope with the new demands are paralyzing important decisions. This scenario is affecting seriously not only the Monetary and Financial Systems but also the Multilateral Trading System. International trade is facing some significant challenges: a serious deadlock to conclude the last round of the multilateral negotiation at the WTO, the fragmentation of trade rules by the multiplication of preferential and mega agreements, the arrival of a new model of global production and trade leaded by global value chains that is threatening the old trade order, and the imposition of new sets of regulations by private bodies commanded by transnationals to support global value chains and non-governmental organizations to reflect the concerns of consumers in the North based on their precautionary attitude about sustainability of products made in the World. The lack of any multilateral order in this new regulation is creating a big cacophony of rules and developing a new regulatory war of the Global North against the Global South. The objective of this paper is to explore how these challenges are affecting the Tradinge System and how it can evolve to manage these new trends.

This case study examines NETmundial, the Global Multistakeholder Meeting on the Future of Internet Governance, which was held in Sao Paulo, Brazil on April 23 and 24 of 2014. The meeting was convened by 1net, a coalition of This case study examines NETmundial, the Global Multistakeholder Meeting on the Future of Internet Governance, which was held in Sao Paulo, Brazil on April 23 and 24 of 2014. The meeting was convened by 1net, a coalition of stakeholder groups involved in Internet governance discussions, in partnership with the Brazilian Internet Steering Committee (CGI.br), in response to revelations of mass surveillance of communications by the United States. It sought to develop a set of universally acceptable Internet governance principles as well as a way forward for the evolution of the Internet governance system, which together could serve as a framework for the governance and use of the Internet. It convened 930 participants from 110 different countries, representing civil society, the private sector, academia, the technical community, governments and intergovernmental organizations, as well as over 1000 remote participants from 23 countries around the globe. It also employed a content contribution platform that sought to crowd source inputs from stakeholders for the production of the outcome document. The meeting served as a demonstration of the multistakeholder process in action: in the production of the outcome document, stakeholders with a diverse range of backgrounds and interests collectively negotiated the inclusion or exclusion of highly sensitive and complex issues. The idea that life undergoes a process of functional differentiation, and that, as a consequence, law becomes increasingly specialized – and maybe even transforms in its very nature – is now widespread. The specialized clusters of law or regulation are very often called regimes, in the international arena, international or transnational regimes. This paper deals, first, with three strong representations of international regimes and discusses some of their problems. It argues that, in order to make a good use of the category, it is necessary to keep in mind the differentiation between law and non-law in the wider context of governance. It then turns, firstly, to the notion of regimes as fragments of a unified and coherent public international law order and, secondly, as meeting points of regulations emerging from different legal orders as well as from other non-legal sources. Within public international law, regimes are seen as related to what is called the double fragmentation of that legal order. As clusters of regulation within a wider global regulatory order, regimes are put in relation to two types of legal or regulatory pluralism.

The role of maritime transportation within international trade was drastically revamped during the inception of the globalization process, which enhanced the contribution of ports in world economy as main logistics gateways for global production and trade. As a result, the relationship between ports and governments has changed. Devolution ideologies that had been applied in other industries decades ago were now being considered by governments for the port industry. Many central governments sought to extract themselves from commercial activities of ports and devolving this responsibility to local governments, communities or private entities. The institution of devolution programs also changed the governance structures of ports further influencing port performance. Consequently, the recent worldwide trend towards devolution in the port industry has spawned considerable variety of governance models that are now set in place around the world. While some countries opt for more decentralized structures others prefer to retain a centralization of powers. In this way some governments consider local features and national integration more than others, which ultimately influence the success of a port reform implementation. Nevertheless, the prime intent of governments is now to maximize the efficiency and performance of their domestic ports. This issue intends to examine the changed port governance environment in Brazil by determining how and why imposed port reforms of the Brazilian federal government have been affecting the overall performance of the national port system, over the last decades, using the Port of Santos as a sample upon an exploratory study. For that, the study will use a contingency theory-based framework – the Matching Framework - that views port performance as a function of the fit among the dimensions of external operating environment, strategy and structure of a port organization. In essence, the greater the fit among these dimensions the better the expected performance of a port will be, and vice-versa. Port managers, government officials and academics alike shall be interested in this document.

O presente trabalho pretende descrever e analisar a evolução institucional da Internet Corporation for Assigned Names and Numbers (ICANN), organização responsável pela gestão dos nomes de domínio e protocolos de comunicação entre computadores em rede ao redor do mundo. Iniciando sua trajetória como instituição privada estadunidense e vinculada ao departamento de comércio do mesmo país, a ICANN passa por diversas modificações estruturais ao longo da última década, de forma a englobar representantes de diversos setores sociais em suas atividades. Algumas peculiaridades em sua estrutura que ainda a vinculam aos Estados Unidos, no entanto, são objeto de controvérsia entre aqueles que buscam uma democratização da internet em nível global.

The Brazilian economy was severely hit by the 2008 crisis. In the beginning of the crisis, the vast majorities of the economic agents and authorities thought that Brazil could face some sort of decoupling since some macroeconomic fundamentals were very good. What we saw, however, was that the Brazilian economy was not decoupled, and expectations faced a huge deterioration soon after the bankruptcy of Lehman Brothers in September 15th. Two aspects regarding the impact of crisis in Brazil, however, deserve a great deal of attention: (a) although deep, the impact did not last for a long time. Actually, the GDP growth experienced a good recovery in the second quarter of 2009, showing that the health of the Brazilian economy was good; (b) the Brazilian banking system performed very well during the crisis, although we cannot say the system was not in danger in the worst time of the crisis. In spite of the confidence crisis faced by the banking system 1, it showed a great deal of resilience. In this aspect, we argue that the restructure faced by the banking system in the aftermath of the Real Plan, as well as the development of a solid supervision regulation helped a lot the system to avoid the systemic crisis that was an open possibility to the Brazilian banking system in the end of 2008. These notes, thus, discusse why the Brazilian banking system performed pretty well in the 2008 financial crisis and how the Brazilian banking (and prudential) regulation can be taken as responsible for this good performance. More specifically, the paper back to the middle of the 1990s, when the Real Plan was implemented, in order to understand the role played by the restructuring of the Brazilian financial system in helping to pave the way to the great resilience experienced by the Brazilian banking system during the 2008 crisis. More specifically, the prudential regulation that was implemented in Brazil in the aftermath of the Real Plan seems to play a decisive role in the resilience of the system nowadays.
