Este trabalho se propõe a ser um fio na teia de reflexões que tecem o debate sobre a participação infantil a partir do ponto de vista das crianças em co-operação com adultos. Sua trama se compõe de campos distintos e autônomos - infância, direito social e participação -, que se cruzam e inter-relacionam, investigados no âmbito de uma experiência realizada na organização social Fundação Xuxa Meneghel, que tem como eixo central de suas ações a promoção e a proteção de crianças e adolescentes que vivem em situação de vulnerabilidade social na Zona Oeste do município do Rio de Janeiro. Trata-se de uma micro-experiência, que pretende compreender o ser criança em relação aos seus direitos humanos e sociais, observando sua influência nas práticas sociais presentes na nossa cultura. O direito à participação infantil - entendida como ferramenta para a auto-proteção e a promoção das crianças como sujeitos plenos exercitando a cidadania - se materializou numa investigação em que as concepções metodológicas convencionais foram se re-construindo por meio das vozes infantis em diálogo com seus pares e com os adultos. As crianças apresentaram seus pontos de vista e as significações que atribuem ao seu entorno e a suas possibilidades e limites de participar de forma genuína nas suas principais instâncias de socialização: família, escola e comunidade. A experiência se constitui numa provocação do olhar para as identidades e as culturas das crianças que dela participaram, para suas vivências expressas por representações de ações e emoções contextualizadas no tempo e no espaço, numa tentativa de compor com elas - e ampliando para todas as crianças da instituição - uma compreensão do que significa o direito de participar, ensinado e apreendido em perspectiva social e cultural.

This article describes some of the current transformations regarding the processes by which information and culture are generated, from the point of view of developing countries. In this brief analysis, the article discusses the role of projects such as Creative Commons for developing countries. It also discusses the idea of legal commons and social commons. While the idea of legal commons can be understood as the voluntary use of licenses such as Creative Commons in order to create a “commons”, the idea of social commons has to do with the tensions between legality and illegality in developing countries. These tensions appear prominently in the so-called global “peripheries”, and in many instances make the legal structure of intellectual property irrelevant, unfamiliar, or unenforceable, for various reasons. With the emergence of digital technology and the Internet, in many places and regions in developing countries (especially in the “peripheries”), technology ended up arriving earlier than the idea of intellectual property. Such a de facto situation propitiated the emergence of cultural industries that were not driven by intellectual property incentives. In these cultural businesses, the idea of “sharing” and of free dissemination of the content is intrinsic to the social circumstances taking place in these peripheries. Also, the appropriation of technology on the part of the “peripheries” ends up promoting autonomous forms of bridging the digital divide, such as the “LAN house” phenomenon discussed below. This paper proposes that many lessons can be learned from the business models emerging from social commons practices in developing countries. The tension between legality and illegality in “peripheral” areas in developing countries is not new. The work of Boaventura de Sousa Santos and others in the 1970s was paradigmatic for the discussion of legal pluralism regarding the occupation of land in Brazil. This paper aims to follow in that same pioneer tradition of studies about legal pluralism, and to apply those principles to the discussion of “intellectual property” rather than the ownership of land.

Este trabalho divide-se em duas partes a serem publicadas em separado. Ele tem, como objetivo principal, examinar como a ciência econômica poderia contar a estória de Macunaíma. Na Parte-I, que corresponde ao presente texto, analisamos criticamente a interpretação tradicional de Robinson Crusoé feita pela literatura econômica. Em segundo lugar, traçamos um panorama da leitura de Macunaíma, apresentando as principais linhas de interpretação literária desta estória, na extensão em que estas notas introdutórias permitem-nos. A Parte-II, etapa subseqüente deste artigo e objeto de nossa próxima pesquisa, situará a trajetória de Macunaíma, para ilustrar o sentido imanente do que vem a ser 'racionalidade econômica', demonstrando que, quando ela está ausente, como nesta história, as conseqüências econômicas em termos de justiça e eficiência são importantes.

In the last decades of the 21st century, Corporate Social Responsibility (CSR) has become one of the most widely debated issues in business management, concerning researchers, politicians, managers and society at large. With multilateral implications in economic and social life, CSR refers, essentially, to the discussion about the boundaries of business intervention in society and the ethical limits that should regulate that intervention. It questions the impact of business practices in social well-being, the role left for corporations and for the State in attending to community needs, and which are, at last, the responsibilities that tie enterprises to society. In this research, CSR is approached from the perspective of its ethical foundations, based on the moral reasoning of the business manager, as a key organizational leader with relevant decision power. Specifically, the research aims to understand how the personal human value system and the ethical orientation of managers influence their attitude towards CSR, considering this attitude as an indicator of managerial behavior that translates into corporate performance. Theoretically, CSR concept is discussed and presented as a set of social commitments, based on a strict interpretation of its meaning. As to human values, its philosophical roots are briefly analyzed and Schwartz modern motivational theory is addressed as main reference for studying the personal value system of managers in this research. Concerning ethics, based on classical theory from moral philosophy, references are seek in John Stuart Mill¿s utilitarianism, Immanuel Kant¿s deontological absolutism, John Rawls¿s theory of justice and the ethics of virtue inspired by Aristotle¿s moral thoughts. Based on an extended literature review, research hypothesis are proposed as part of a theoretical model of analysis named Individual Attitude Towards Social Responsibility Model. In order to test the theory¿s empirical validity, it was conducted a field study with 252 Brazilian managers, mainly from the metropolitan areas of São Paulo and Rio de Janeiro. Results show that managerial attitude aligned with CSR principles is favored by conservative personal values, protectors of stability and centered on collective will, and by an ethical orientation based on egalitarianism as postulated by distributive justice principles. However, results also show that the influence of values and personal ethics on managerial attitude towards CSR only occur in managers younger than 30 years old. Findings and their meanings are discussed, as well as summarized in the Axiological and Ethical Determinants of Managers¿ Social Commitment Model. Finally, methodological limitations are evaluated and clues for further research are suggested.

The crisis that affected the capitalist states during the last decade of the 20th century, put an end to the period of greatest expansion of the state, demanding alterations that brought, especially in economic terms, the ideals of the liberal state. The main goal of these changes was to optimize the administration of the public service by introducing into it more efficiency, transparency, and morality because the state had shown to be incapable of attending the demands of the society and its way of doing was inefficient and did not reach out to the public interest. In Brazil, like in other part of the world, recent scandals of corruption and misuse of public funds put in doubt the efficiency of the financial control system. Like any other political system Brazil has a complex set of external and internal control, institutions that work to prevent misuse of public funds and identify responsibilities if bad use occurred. All these elements highlight the mechanisms of control of the public administration, which came to be seen as essential instruments for the improvement of the management of the public resources, targeting the collective interest. Therefore, along with the traditional mechanisms of power suppression, such as the system of checks and balances, social control arises. This, when used together with the monitoring exercised by public inspection agencies, is defined as horizontal accountability activated by civil society, in which citizens and institutions gather efforts in order to promote a more effective charge of responsibility from public agents and politicians in case of misconducts. This study aimed to identify the opportunities and limitations of social control exercised by the complaint under the TCE-RJ. The results point to the need to develop measures to guarantee the anonymity of denouncers, to simplify the forms of access the TCE-RJ and to improve information spread to the citizen.

This study approaches the question of organizations in search for competitiveness when globalization, knowledge and technological advances in the First World is a challenge in developing countries. The case study research focus on Bahia Sul ¿ a large organization which belongs to the important sector of paper and cellulose, especially in terms of exports. This study analyses an organization in that underpriviledged situation of a third world country in which the majority of organizational strategies are heavily thrown on people who are simultaneously reduced to instruments for economic results and who are highly demanded in terms of productivity and creativity. Due to that reality, references chosen present two key contrasting concepts. Mass man, going back to Taylor¿s blue collars as well as to Marcel¿s knowledgeable but empty words man, whose abilities do not feet his needs, in contrast with rogerian expectations of person as a mutable and continuously enriched human being and with habermasian position looking for political and decision making participation in work an social situations. Results show a strong presence of mass man, despite his technological knowledge, and scarce indications of the social man and which appears in mere aspirations out of labor situations. Conclusions emphasize a need for coherence between organizational practices in search for competitiveness and expectations on persons¿ performance because they stimulate exchanges in terms of working places for obedience and some material comfort which is aggravated by the fact that any possibility of personal fulfillment is interpreted as only possible in out of work situations. Competitiveness in such a context is not to be expected.

Esta obra tem como tema central a conciliação como método contemporâneo de solução dos conflitos, notadamente nas Varas de Família de Porto Velho/RO. Os métodos alternativos de solução de controvérsias surgem como opção eficaz ao jurisdicionado, em atenção ao clamor da sociedade por uma prestação jurisdicional mais célere. A utilização deste método visa oferecer e assegurar uma melhor e efetiva solução de conflitos à população, fugindo assim dos modelos tradicionais de resoluções de conflitos. O objetivo é procurar demonstrar que, além da jurisdição estatal, existem outros meios de pacificação social, os quais também colocam fim às controvérsias e realizam a justiça. Destaque-se que mecanismos alternativos objetivam não somente oferecer uma prestação jurisdicional mais célere à sociedade, mas também verdadeira pacificação social; além do que, oportunizam também a resolução do conflito antes que seja instaurada qualquer demanda judicial, desafogando assim o Judiciário. Enfatiza-se a importância da conciliação nas matérias concernentes ao direito de família, já que nesta área há preocupação fundamental com a preservação emocional das partes. E dada a carga emocional que circundam as ações dessa natureza, muitas vezes ao juiz é impossível encontrar uma resposta adequada e definitiva para os problemas que lhes são apresentados pelas partes. Os resultados demonstram que a conciliação nas Varas de Família de Porto Velho/RO têm se revelado um mecanismo célere e eficaz, na busca da resolução de conflitos e pacificação social. Os profissionais e operadores do direito têm consciência da importância de sua aplicação.

O presente trabalho tem por finalidade identificar o papel do magistrado como gestor de seu gabinete, focado nos gabinetes dos desembargadores e juízes de direito convocados no âmbito das Câmaras Cíveis do Tribunal de Justiça do Rio Grande do Sul. Para tanto, abordou-se as atividades de gestão sob os pilares do planejamento das atividades, da organização das rotinas, da liderança do magistrado e do controle dos processos e dos resultados. Em seguida, analisou-se a situação atual do modelo de gestão do Tribunal de Justiça rio-grandense, no que tange à implantação da metodologia da Qualidade Total como ferramenta de gestão do gabinete. Agregou-se a esses fundamentos a pesquisa de campo, com a coleta de dados acerca da diversidade de práticas de gestão encontradas no âmbito desse tribunal. Pelos resultados da pesquisa teórica e prática, foi possível apresentar uma proposta de estruturação de um “gabinete-modelo” e a definição de suas rotinas através da padronização dos procedimentos executados.

Secure property rights are considered a key determinant of economic development. However, the evaluation of the causal effects of land titling is a difficult task. The Brazilian government through a program called "Papel Passado" has issued titles, since 2004, to over 85,000 families and has the goal to reach 750,000. Furthermore, another topic in Public Policy that is crucial to developing economies is income generation and child labor force participation. Particularly, in Brazil, about 5.4 million children and teenagers between 5 and 17 years old are still working. This thesis examines the direct impact of securing a property title on income and child labor force participation. In order to isolate the causal role of ownership security, this study uses a comparison between two close and very similar communities in the City of Osasco case (a town with 650,000 people in the São Paulo metropolitan area). One of them, Jardim Canaã, was fortunated to receive the titles in 2007, the other, Jardim DR, given fiscal constraints, only will be part of the program schedule in 2012, and for that reason became the control group. Also, this thesis also aims to test if there is any relationship between land title and happiness. The estimates suggest that titling results in a substantial decrease of child labor force participation, increase of income and happiness for the families that received the title compared to the others.
