O presente estudo analisa a sustentabilidade intertemporal do atual regime fiscal sob o prisma do investimento público na economia brasileira. A idéia básica é que, devido às condições macroeconômicas prevalecentes, o superávit primário do setor público consolidado representa a variável central de sustentação do equilíbrio fiscal. Sendo a capacidade de geração e manutenção de superávits primários limitada pelas despesas incomprimíveis, o governo federal pratica uma política fiscal que, apesar de seus resultados fiscais bastante positivos, penaliza excessivamente o investimento público. O presente estudo tem como objetivo comparar a natureza do ajuste fiscal realizado no segundo mandato de FHC e nos dois primeiros anos do governo Lula, (i) destacando a trajetória e a composição do gasto e receitas pública nesses dois períodos e (ii) evidenciando a possibilidade 'perdida' por ambos os governos em promover um firme aumento do investimento público, sem aumentar a carga tributária.

Este estudo lida com política cultural, administração e financiamento das artes e do patrimônio histórico. Passa em revista a experiência brasileira, a partir da bibliografia disponível, e a contrasta com a de países adiantados. Embora com foco no presente, reconstitui seletivamente a história dessa política pública desde 1945, nos Estados Unidos, na Inglaterra e na França, e aponta impasses que hoje ela enfrenta no contexto neoliberal e globalizado. Questões como formação de dirigentes culturais, patrocínio empresarial, incentivos fiscais, diplomacia cultural, descentralização administrativa, tendências do consumo cultural, "espetacularização" de eventos e o papel das fundações são localizadas nas discussões que ocorrem dentro e fora da academia, nos países considerados.

This work presents a study about the federal judiciary and in particular about the creation of specialized courts in fiscal execution in Rio de Janeiro. The bibliography research includes an approach to administrative theory, the formation of the State and the particular procedure of the fiscal execution, the field research tries to describe the reality of the courts specialized in fiscal execution with the position of the magistrate, attorney and public servant. The results of the analysis is directed to show the federal judiciary and in particular the creation of specialized jurisdiction.

The characteristics of the Brazilian historic context, under which the predominant social relations have developed, have led to a process of income concentration and to the political power of the dominant classes. The slavery abolishment hasn't guaranteed the people the rights secured to privileged citizens in general. Such practices were observed during historic process as the low level literacy shown by the census of 1920, the political domination of oligarchies and the military coup, all as determining factors in process of political power concentration. The social indicators and the corruption are extremely unfavorable to our country, but we wonder if that happens only in underdeveloped societies. It is possible that even the American society, even the most developed societies, under the democratic capitalism, can suffer negative consequences of some corruption in the capitalism system. Our observations have led to the perception that all democratic society must be regulated by the State in order to preserve the stability of the system. It has also been observed that it is necessary more effective popular participation in order to neutralize economic groups¿ pressure. It has also become evident the necessity of reduction of commissioned office in the federal public administration. And, finally, it is fundamental to propose an amendment to the construction that allows the Public Ministry to have access to any bank, fiscal or telephonic information of anyone that is in office: It should be called "The Law of Moral Transparency". Those proposals will only be possible if there is massive popular participation and we hope that they express our people¿s will in order to appose to those who act only to obtain private benefits.

Este trabalho pretende mostrar que a implementação de políticas públicas no setor de turismo não é utopia, e sim um instrumento essencial à dinamização deste segmento tão promissor e rentável, que no mundo todo vem apresentando resultados surpreendentes, e que pode contribuir de forma significativa para o desenvolvimento de uma região. Para auferir os dividendos da indústria do turismo é primordial que sejam realizados investimentos no setor, de modo a oferecer as condições básicas para que o mesmo possa se expandir. Estas condições vão desde a infra-estrutura básica até a capacitação da mão-de-obra local. Cabe aqui destacar que é fundamental também que se dê incentivos fiscais e monetários para atrair investidores. E, estas, são ações que cabem, fundamentalmente, à iniciativa governamental. Uma análise comparativa entre o desempenho da indústria do turismo no mundo, no Brasil e na cidade do Rio de Janeiro, pretendeu-se provar que nas circunstâncias atuais, a elaboração e a implementação de políticas públicas são essenciais para a expansão do setor de turismo, e que este é certamente um próspero caminho a ser trilhado pelo nosso país e pela nossa cidade, considerando o enorme potencial turístico de ambos, rumo ao desenvolvimento econômico-social.

This paper aims to assess the performance of credit and fiscal mechanisms in attracting industrial investment to the state of Ceará during 1985-2002, a period characterized by the political and administrative continuity which begun with the implementation of the so-called "Plan of Changes", during the term in office of former state governor Tasso Jereissati. In order to accomplish that, a survey was conducted of the state's credit, fiscal and infrastructure incentive mechanisms, industrial policy and the period's political context, as well as data from the Department of Industry and Commerce and on the economic performance of the state of Ceará. Over 700 industrial businesses were found to have been attracted into the state by means of the Industrial Investment Attraction Program, which amounted to a process of industry expansion while the country as a whole was going through a period of deindustrialization. The analysis points out that, if on one hand, the industrialization model then adopted was able to generate economic growth, on the other hand, it increased income concentration and could not drive industry into the less developed areas across the state's interior, as expected by Ceará's state government officials.

The employees' partlclpation in the cultural transltIon process occurred in Companhia Siderúrgica de Tubarão (CST) was helpful in the identification of the group of measures that started to be managed in order to be established in the run of the control assumption. The company, in order to acquire proper features, had to change prior values, behaviors and identities through strategies shared by ali the organization members, thus, creating a new culture. The CST was seen as a company controlling and coordinating a group of people. It counted on vertical hierarchical leveis, departments and authority relations. It was neve r taken into account that the company could have its own personality, like each person that worked there. Before getting through this cultural transition process, that extremely changed its values, the company had a dominating culture, with a centralized administration. This way, it influenced the conduct of ali its members, in a controlling environment. When the company realized the necessity of investments in cultural changing programs, in order to eliminate the pathologies and disfunctions that were hitting its business structure, causing damage to productivity and to the quality of the results, it condensed energies in one direction implementing the participation of ali its leaderships as implementing and multiplier elements to orientate and facilitate the achievement of its goals. Trying to understand better the influences suffered by the changes brought by globalization and privatization, some theorical and operational concepts of culture and identity were developed in this study, mainly in the first chapters. In the research extension, several aspects of this complex anthropological and sociological concept of culture were managed, such as affectiveness, cognitive process, valuation process and everything that could be related to or that give elligibility to this concept and to the phenomenon this concept will consist in.

This study shows how the Industrial Cluster of garments in Valença, RJ ¿ comprised of micro and small enterprises ¿ contributes to overcome the problems left by the declining period of the textile industry. At first, the city took advantage of its talent for textile work and turned to the clothing sector, which now relies on garment factories, subcontractors, cooperatives and laundries in order to create jobs. There is institutional support, but the analysis of the situation identified the need for higher involvement of cluster players, as well as a higher interaction among them to help their own development. In regard to public and private institutions, there is room for steps to guide informal companies that find it difficult to afford labor, financial, and environmental costs towards formalization, the offer of management and labor skill programs, as well as entrepreneurs¿ awareness about the acquisition of modern-technology machinery. It is important to encourage higher participation of Valença firms in the national fashion events, since this draws attention to the name of the city, discloses the work that is carried out there, and attracts new businesses. The entry of Valença companies in the fashion arena of the southern region of Rio de Janeiro state is beneficial, especially to make them better prepared for the Fashion Rio/Fashion Business event. Informality as a way out of the unemployment problem is a growing trend in Valença, as well as in most of Brazilian cities. In this sense, the entrepreneurs need to find favorable steps to make them feel motivated to formalize their businesses.

Day after day, even small companies and multinationals brands need to compete in a worldwide market. All kind of global strategies have to involve production and regional market knowledge. Still being essential for company have a complete view of it market and it right position to gain competitive advantage. In a global market, get possible for the companies be in touch with last generation technologies and equipment's and all kind of research. Companies like that should develop products focused in customer's desire, even those extremely strict. Specifically in our country, as hard as we could think, the companies have access to credit lines, to the fiscal incentives offered by the states that alliance with the market potential are making possible the appearance of a lot companies and the growth of the companies already existent. However, these resources alone don't produce results to the company if it doesn't possess an internal organization able to assimilate the new market situation. The companies have to be able to apply the maximum resources offered by new technologies and understand how a communications facility means solution for many internal problems. In short terms, technology, financial resources, research and knowledge are available, however, the human resources might be prepared and developed in order to become the whole knowledge in profits. According 'JURAN' and his Total Quality Control philosophy the human resources playing fundamental role in the process, and in my opinion a company is something like a ship where all must be prepared to hold the rudder. I will develop a basic job looking for productivity and company's development through the people's involvement, focused in process of motivation, creativity and staff valorization. I believe that there no good production process without those requirements. Based on real case of a automotive parts and foundry company, located in Bento Gonçalves - RS, this work will look for to organize it mainly in its Industrial Division, adopting in participate administration where, through a information system and personnel involvement we will seek all favorable conditions to politics and strategies in get the growth of company.

REPETRO, the special tax regime for importing and exporting goods for the exploration and drilling of oil and gas, aims at bringing foreign assets to Brazil enjoying a suspension or even an exemption of taxes, so that Brazilian industry may profit from about 8 billion American dollars in investments. The creation of normative devices as well as the management of the REPETRO model are under the exclusive responsibility of the Brazilian Internal Revenue Services. REPETRO was created in 1999 and is composed of the following customs treatments: importation of goods with suspension of taxes by use of the drawback special regime, suspension mode for national exporting industry; exportation with fictitious exit for the national industry; temporary admission of goods or assets used in oil exploration and production, attending to the needs of both the national and foreign market. Considering the inability of the Brazilian government in restructuring its foreign trade model so that a strong investment in technology could provide for the sector¿s needs, we must ask how we can change REPETRO to help the various companies in the oil business? The issue is very important for one of our main economic activities, though not enough studied. The energy sector has a strategic importance for the development and the economic independence of any country. The winds of globalization lead Brazil to open its economy in the last decade and the national policy for exploration and drilling (E&D) was altered. The government created a new agency dedicated to market control and energy policies, the National Agency for Oil and Biofuels (ANP). With the opening of the market, Petróleo Brasileiro S.A. - Petrobras, the Brazilian giant, lost the monopoly of the oil business. The P-50 Platform, with a capacity for 180,000 barrels per day, was imported based on REPETRO. When it began operating on April 21st, 2006, Brazil achieved self-sufficiency in oil production. The present work intends to estimate the main variables affecting the importation and exportation of goods and assets for E&D, showing how REPETRO works. We also intend to look at the results yielded by the REPETRO model for the development of the production of oil and gas in Brazil, as well as show proposals for its modernization. It has been established that even though since its implementation the REPETRO model has brought fiscal advantages through the reduction of tax costs relating to foreign commerce operations and the incentive of investments in the E&D area with the increase in the national oil production there remain the following limitations: lack of preparation and of knowledge of the model; lack of adjustement of the model to the reality of actitity of E&D of oil and gas; taxes over the pre-operational stage or investment in oil production stage; non-allowance of full access by the national industry to the supply of goods and products relating to the industrialization of goods allowed by REPETRO; other fiscal and administrative difficulties. We conclude that the REPETRO model is important for the development of the area of E&D of oil and gas, but not completely effective. It is necessary to change it or create a new model based on a new perspective of the customs treatment of the activities of exploration and production, minimizing administrative procedures relating to the operations of exportation and importation.

This study evaluates how the interaction among organizations located in Vila do Abraão, in Ilha Grande, Rio de Janeiro State, has contributed to the sustainability of this locality. An analysis of the island¿s local problems showed that firms informality and solid waste management practices were bringing damaging consequences to the island, and that this local productive arrangement (APL) has been able to collectively find solutions to such issues. These solutions basically encompassed: a) choosing estrategies the lead to a self-sustained model and not traditional way dependent on tax benefits; b) recognizing that the solutions to these problems involved the common action of public and private sectors and the civil society, and that various artifices should be used to establish such cooperation; c) the presence of actors outside the APL who played an important role in overcoming the problems of the cluster; d) using transparent legal instruments that defined the rights and obligations of each party and e) tripartite social entrepreneurship actions through NGOs to help solve problems common to the whole island.

Este artigo desenvolve um modelo de crescimento econômico endógeno com dívida pública onde o governo pode alocar seus gastos de diferentes formas. Assim, para aumentar gastos em educação ou infra-estrutura o governo tem de se endividar. Obtêm-se as condições fiscais pelas quais tais tipos de gastos podem ter seu efeito maximizado e os limites da sustentabilidade fiscal deste tipo de política são determinados. Os resultados deixam claro que os efeitos dos gastos produtivos do governo sobre o crescimento dependem do tamanho da dívida e do superávit primário configurando um cenário com equilíbrios múltiplos. Além disso a equação de crescimento obtida através do modelo teórico é estimada para a América Latina, comprovando as predições teóricas.

Muitos trabalhos têm analisado o sucesso da Lei de Responsabilidade Fiscal a partir do desempenho dos indicadores fiscais. A evolução destes índices nos últimos anos mostra um sucesso incontestável. Por outro lado, a evolução dos indicadores sociais, embora permaneça em constante debate, acaba subordinada aos limites impostos ao poder discricionário do gestor público. A busca pelo cumprimento das metas de superávit e dos limites de gastos definidos a partir da Lei de Responsabilidade Fiscal é favorável até o ponto em que não se sobreponham ao papel principal do Estado de provedor de bens públicos. Desta forma, na medida em que o controle das contas públicas é objetivo importante das políticas públicas, mas não pode ser o único, este trabalho constrói uma visão mais ampla de avaliação da Lei de Responsabilidade Fiscal, levando-se em conta a dimensão qualitativa do gasto público e não apenas a quantitativa, medida pelos resultados fiscais. A fim de colaborar com o debate acerca do aprimoramento da Lei de Responsabilidade Fiscal, estudou-se a existência de impactos de bons resultados fiscais na qualidade do gasto público das unidades da federação. Para isso, elaborou-se um Índice Fiscal, bem como um Indicador de Observância aos limites da LRF e avaliaram-se as correlações entre estes e os Índices também elaborados, de Educação, Saúde, Saneamento e Habitação e Riqueza. Além disso, também foram analisadas, de forma comparativa entre as vinte seis unidades da federação e mais o Distrito Federal, o desempenho relativo de cada uma e a sua evolução ao longo dos anos. Este problema de pesquisa é alinhado à premissa do New Public Management, que busca imbuir na esfera pública a gestão baseada em resultado (outcome oriented) e a otimização da eficiência alocativa dos recursos (value for money). 4 Os resultados encontrados indicam que uma gestão fiscal de acordo com os parâmetros estabelecidos pela LRF não garante que os serviços públicos serão prestados com qualidade e eficiência.

O Sistema Único de Saúde (SUS) é estruturado pelo conjunto de ações e serviços de saúde, prestados por órgãos e instituições públicas federais, estaduais e municipais, da administração direta e indireta. A iniciativa privada participa do SUS, com a intervenção de prestadores privados de serviços de saúde, com fins lucrativos ou sem fins lucrativos. O propósito deste estudo é analisar as mudanças estratégicas, ocorridas entre os anos de 2002 e 2008, voltadas à filantropia, em Hospitais Privados Filantrópicos, não usuais prestadores de serviços ao SUS, no Município de São Paulo, para a obtenção ou manutenção do Certificado de Entidade Beneficente de Assistência Social. Foi utilizada uma metodologia qualitativa de estudos de casos múltiplos, para obter as percepções dos agentes envolvidos com a gestão das estratégias e ações voltadas para a Filantropia, através de uma pesquisa exploratória. Cinco Hospitais Privados Filantrópicos, não usuais prestadores de serviços ao SUS, compuseram a amostra. Um dos principais achados deste estudo foi o de que obter ou manter o Certificado de Filantropia garante a estes Hospitais Filantrópicos, não usuais prestadores de serviços ao SUS, isenções fiscais, que criam uma vantagem competitiva diante de outros hospitais privados não filantrópicos, que atuam na medicina suplementar, resultando em redução de custos e condições de diferenciação nos serviços prestados.
