O presente artigo busca trazer uma perspectiva jurídica ao debate sobre o impacto da replicação de modelos de negócio na Internet. O objetivo é oferecer uma análise sobre os copycats – empresas que reproduzem modelos de negócio inovadores desenvolvidos por empresas terceiras – em conjunto com os institutos da liberdade de concorrência e propriedade intelectual, examinando a contraposição existente entre esses no arcabouço jurídico nacional e buscando responder, como pergunta de trabalho, se esses mecanismos podem ser interpretados, à luz do ordenamento brasileiro, como mecanismos de incentivo ou restrição ao desenvolvimento de copycats no país.

Há um grau de incerteza que é próprio da atividade jurisdicional e não é possível de ser mitigado em razão da própria natureza dos juízos a respeito de normas jurídicas. Decisões judiciais não são e nem podem ser absolutamente previsíveis. Há, contudo, um grau de incerteza que é evitável e o deve ser evitado, por ser prejudicial à saúde de um sistema jurídico. Outros pesquisadores no Brasil trabalharam com esta noção, e foi muito bem sucedida a formulação dos conceitos de incerteza estrutural e incerteza patológica de Joaquim Falcão, Luís Fernando Schuartz e Diego Arguelhes. Contudo, acreditamos que a concepção de incerteza patológica apresentada dos autores precisa de reformulação, especialmente para que pudesse ser verificada a partir de elementos da decisão judicial e não apenas de elementos sociológicos e psicológicos. Propomos uma concepção de incerteza patológica calcada na qualidade da fundamentação das decisões judiciais e concluímos que o cultivo de uma cultura de precedentes é necessária no Brasil para mitigar os efeitos nocivos da incerteza patológica.

This paper follows the idea of Amartya Sen, Nobel Prize of economic, about the role of State in the assurance of minimal existence condition, and aim to answer how countries of Latin America (specifically Brazil) and countries of Europe (specifically United Kingdom) deal with the assurance of this minimal existence conditions. According to Amartya Sen’s view, development must be seen as a process of expanding substantive freedoms, such expansion being the primary purpose of each society and the main mean of development. Substantive freedoms can be considered as basic capabilities allocated to individuals whereby they are entitled to be architects of their own lives, providing them conditions to “live as they wish”. These basic capabilities are divided by Amartya Sen in 5 (five) kinds of substantive freedoms, but for this article’s purpose, we will consider just one of this 5 (five) kinds, specifically the Protective Safety capability. Protective Safety capability may be defined as the assurance of basic means of survival for individuals who are in extreme poverty, at risk of starvation or hypothermia, or even impending famine. Among the means available that could be used to avoid such situations are the possibility of supplemental income to the needy, distributing food and clothing to the needy, supply of energy and water, among others. But how countries deal whit this protective safety? Aiming to answer this question, we selected the problem of “fuel poverty” and how Brazil and United Kingdom solve it (if they solve), in order to assess how the solution found impacts development. The analysis and the comparison between these countries will allow an answer to the question proposed.

How to deal with the impacts of the exchange rate on the trade balance of Brazil? There is not a single answer to such question. In order to find out some legal approaches for this matter, this paper aims to describe and analyze the role of the IMF, WTO and the governments of Brazil and the United States on the currency misalignments, especially the extraterritorial effects of such misalignment on the Brazil’s bilateral trade with the United States. The article concludes that the Currency Swap Agreements and other bilateral solutions may minimize the distortions that the Brazilian balance of payment against the USA is carrying, due to the lack of legal solutions for the problem of the exchange rate misalignments that Brazil is facing.

A vitalidade da responsabilidade civil, apesar de limitações crescentes para cumprir seu papel de reparação de danos e prevenção de ilícitos, indica a necessidade de reflexão sobre as razões para sua justificação. Dentre as várias teorias de justificação encontradas no debate atual, a teoria do discurso da responsabilidade, de Klaus Günther, parece a mais promissora, pois permite enxergar na responsabilidade civil uma função – a função de comunicação de autoria – para além das problemáticas reparação e prevenção, e ao mesmo tempo escapar ao autoritarismo de justificativas fundadas no conteúdo das normas de responsabilização. O objetivo deste texto é analisar e criticar a teoria do discurso da responsabilidade. Como demonstraremos, apesar de seu grande poder explicativo, essa teoria apresenta um problema grave, pois não é capaz de dar conta da realidade das pessoas jurídicas e dos riscos que seu grande poder representa para os indivíduos.

Este texto analisa o papel das revistas no processo de avaliação do sistema brasileiro de pós-graduação de acordo com as regras do Qualis e do SciELO. Sustenta que as revistas são titulares do “direito-função” de selecionar artigos por meio da dupla avaliação cega por pares, direito este que deve ser exercido em prol da comunidade acadêmica. Por esta razão, o texto mostra que as revistas são um mecanismo de autorregulação da avaliação da pós-graduação brasileira. Em sua parte final, o artigo discute a relação entre este modelo de avaliação e a tradição jurídica brasileira, em especial, nossa maneira de praticar e refletir sobre a dogmática jurídica no Brasil.

Recent statistical data confirms that domestic violence is a structural problem of exceptional gravity. We analyze the frequent legislative changes in Brazil since 2000 as a result of social pressure for protection of abused women. Only the Law 11.340 of 2006 was well received by lawyers, judges and the public opinion. We present the innovations and peculiarities of this statute and the allegations on unconstitutionality. We discuss cases of judicial review of this law and reject the arguments of unconstitutionality. That notwithstanding, we argue that penalization decisions is the wrong way from a criminological point of view because they do not take into consideration the desires and needs of the victims.

New emerging international dynamics introduce a global poly-axiological polycentric disorder which undermines the tradition of a unique global legal order in international law. Modern Era was characterized by Western European civilizational model – from which human rights is a byproduct. This consensus had its legitimacy tested by XXst century’s scenario – and the ‘BRICS factor/actor’ is a symptom of this reality. Its empowerment in world politics lead to the rise of distinct groups of States/civilizations provided with different legal, political, economic and social traditions – promoting an unexpected uprise of otherness in international legal order and inviting it to a complete and unforeseeable reframing process. Beyond Washington or Brussels Consensus, other custom-originated discourses (Brasília, Moscow, New Delhi, Peking or Cape Town Consensus, among other unfolded possibilities) will probably henceforth attempt shaping international law in present global legal disorder.

This study aimed to map the key positions regarding the constitutionality of the Maria da Penha Law (Law 11.340/2006) in the Brazilian judicial system. The law, the result of political struggles by the Brazilian feminist movement, has been the subject of discussions in the public sphere and actions aimed at consolidating its constitutionality before the Federal Supreme Court. We examined and discussed the arguments used in the Courts, intending to show that the creation of law is not limited to the legislative moment, but rather that its social meaning is also constituted through disputes within the Judiciary.

The paper provides a close lecture of the arguments and methods of legal construction, employed in the extensive individual opinions written by the Justices of the Brazilian Supreme Court in the case which authorized the same sex civil union. After tracing an outline of the legal problem and his possible solutions, we analyze the individual opinions, showing their methodological syncretism, the use of legal methods and arguments in a contradictory way as well the deficiencies in the reasoning. The Justices use legal arguments, but do not meet the requirements of rationality in the decision-making. We have a rhetorical attempt that aims to satisfy the public opinion than to offer a comprehensive and coherent solution according the normative elements of the Brazilian Federal Constitution of 1988.

This article examines the arising cross-border dispute resolution models (Cooperation and Competition among national Courts) from a critical perspective. Although they have been conceived to surpass the ordinary solution of a Modern paradigm (exclusive jurisdiction, choice of court, lis pendens, forum non conveniens, among others), they are insufficient to deal with problems raised with present globalization, as they do not abandon aspects of that paradigm, namely, (i) statebased Law; and (ii) standardization of cultural issues.

This paper has the purpose of analyzing the role of civil society in funding and providing nfrastructure projects in developing countries. Considering that local associations around the world have been directly engaged on some infrastructure projects – some scholars define it as “semi-formal finance” –, the intention is to demonstrate that the experiences on such arrangements in developing countries have been responsible for fostering infrastructure investments in the poorer regions where the government is more absent. Based upon legal, economic and social aspects, this paper aims to contribute to a broader debate for the development of infrastructure in emerging countries. The conclusion is that, under a more social approach, the legal and economic mechanisms in developing countries are able to consider such arrangements in the benefit of their development.

Este artigo consiste em uma resenha crítica sobre a reflexão de Anne-Marie Slaughter para uma aproximação interdisciplinar entre Direito Internacional e Relações Internacionais. Slaughter tem sido apontada, internacionalmente, como uma das protagonistas neste debate acadêmico, e sua obra é indicada como uma das mais influentes na academia dos Estados Unidos da América, no século XX. Em tempos de aproximação entre juristas e internacionalistas no Brasil, o artigo procura contribuir com a contextualização da produção da autora, bem como elucidar os momentos de influência das suas atividades em outros centros de discussão e produção. A proposta principal deste artigo é, assim, favorecer um mapeamento histórico e contextualizado da chamada para o debate interdisciplinar entre Direito Internacional e Relações Internacionais, a partir dos trabalhos de um de seus pivôs na academia nos Estados Unidos.

Foreign capital and institutional investors play a key role in the Brazilian capital and financial markets. Internationally promoted regulatory patterns, especially IOSCO principles, have been increasingly influencing administrative rule making by the Brazilian Securities and Exchange Commission (CVM) as well as the adoption of transnational rules in Brazil by means of self-regulatory activity. Even though there is a certain level of convergence of market regulatory standards at the transnational level, implementation and enforcement of rules remains essentially domestic. We analyze two case studies regarding the transposition of international standards into the Brazilian legal system, which illustrate this tension between the transnational and domestic dimensions of financial markets regulation. The first case concerns a CVM rule on disclosure of executive compensation and the its interpretation by local courts. The second case refers to the adoption of suitability rules.
