This is one of three Occasional Papers published by the Victorian Law Reform Commission as part of the Commission's work on assisted reproduction and adoption. A central issue which arises in the context of assisted reproduction is how to recognise and protect the best interests of children who are conceived through assisted reproduction. The three Occasional Papers deal with different aspects of this question. This Paper examines how laws in the other Australian states, and in the United States, United Kingdom and Canada regulate access to assisted reproduction, control the use of surrogacy and deal with issues relating to parentage of children conceived through assisted reproduction. Generally, this legislation gives priority to protecting the best interests of children, but the way in which this is done varies considerably.

1. Waterbirds are considered to import large quantities of nutrients to freshwater bodies but quantification of these loadings remains problematic. We developed two general models to calculate such allochthonous nutrient inputs considering food intake, foraging behaviour and digestive performance of waterbirds feeding in terrestrial habitats: an intake model (IM), mainly based on an allometric relationship for energy requirements and a dropping model (DM), based on allometric relationships for defaecation.

2. Reviewed data of nitrogen (N) and phosphorus (P) content of herbivorous food varied according to diet type (foliage, seeds and roots), season and fertilization. For model parameterization average foliage diet contained 38.20 mg N g−1 and 3.21 mg P g−1 (dry weight), whereas mean faeces composition was 45.02 mg N g−1 and 6.18 mg P g−1.

3. Daily allochthonous nutrient input increased with body mass ranging from 0.29 g N and 0.03 g P in teals Anas crecca to 5.69 g N and 0.57 g P in mute swans Cygnus olor. Results from IM differed from those of DM from ducks to swans by 63–108% for N and by −4 to 23% for P. Model uncertainty was lowest for the IM and mainly caused by variation in estimates of food retention time (RT). In DM food RT and dropping mass determined model uncertainty in similar extent.

4. Exemplarily applying the models to Dutch wetlands resulted in mean annual contribution of herbivorous waterbirds to allochthonous nutrient loading of 382.8 ± 167.1 tonnes N a−1and 34.7 ± 2.3 tonnes P a−1, respectively, which corresponds to annual surface-water loadings of 1.07 kg N ha−1 and 0.10 kg P ha−1.

5. There was a distinct seasonal pattern with peak loadings in January, when bird abundances were highest. Lowest inputs were in August, when bird abundance and nutrient content in food was low and birds foraged less in terrestrial habitats. Three-quarters of all nutrient input was contributed by greater white-fronted goose Anser albifrons, greylag goose Anser anser, wigeon Anas penelope and barnacle goose Branta leucopsis alone.

6. We provide general, easy to use calculation methods for the estimation of allochthonous nutrient inputs by waterbirds, which are applicable to a range of waterbird species, a variety of potential diets and feeding behaviours, and across spatial scales. Such tools may greatly assist in the planning and execution of management actions for wetland nutrient budgets.

How does the beauty industry ‘narrate the skin’? What does it teach women from different cultural groups about the female body? How does skin function as a site where female subjection and abjection are produced and reproduced? In this paper we examine the skin industry pointing to its extreme commodification of the female body and to the inexcusable pressure this places on females of most age and cultural groups.We focus on two examples. Firstly, we show what the skin industry teaches girls and women about both their skin colour ‘problems’ and desirable practices of whitening and, secondarily, tanning. Secondly, we consider what the cosmetic surgery industry teaches us about female bodily ‘imperfections’ linked to certain ethnic and racial groups and the necessary ‘remedies’. Overall we show how the socio-cultural normalization of perfect skin is a product of a range of contemporary and enduring social and cultural forces overlain by complex pedagogies of power, expertise and affect.

In this paper, we examine the “greening” of Outdoor & Environmental Education (OEE) students at an Australian regional university through three lenses: temporal, spatial & material. We are inspired by Grosz’ claim that “bodies are always understood within a spatial & temporal context, & space & time remain conceivable only insofar as corporeality provides the basis for our perception & representation of them” (1995, p. 84). As suggested by Grosz, these lenses are not discrete and, in the course of the paper, their intersections & reciprocity become apparent. We draw on interview responses & observations from a longitudinal cohort study undertaken by Preston in an attempt to trace the regulation and practice of “green” “outdoor Ed” subjectivities in the context of the materialities, time & spaces of this specific course. Over the last few decades, countries belonging to the Association of Southeast Asian Nations (ASEAN) all had to revise their intellectual property systems. These revisions resulted at first from bilateral pressure of major trading partners such as the US and EU, then from the WTO-TRIPS Agreement and more recently from bilateral Free Trade Agreements. To observe the IP developments in ASEAN over this period is interesting, because this group of countries covers developed (Singapore), developing as well as least developed countries. All countries had to reform their outdated laws from the colonial era in very short time. However, in comparison to the early 1980s, important differences with regards to intellectual property policies have emerged in recent years.

This article will briefly sketch the developments in individual ASEAN countries and after that examine some broader trends in law making, IP administration, enforcement and the court system. It concludes that the ASEAN enlargement process has created a very diverse picture with regards to IP. With the fast pace of the legislative development, countries have been struggling to keep up with the creation of the institutional and administrative framework. Progress in the ASEAN harmonisation process has been limited. Statistics indicate that some of the new laws have been reasonably well received at the domestic level, while the patent sector remains foreign dominated.

The thesis elucidates a process by which the layers of perceptions experienced by dancers when using the built environment were developed to create a shared group compositional language.  This study draws on the work of architects, artists and philosphers interested in documenting and analyzing our sensory and affective relations with the built environment.

James McArdle and Lorena Carrington submitted to the Castlemaine State Festival competitive curated process the exhibition 'Fruiting Bodies'  which was accepted under the Fesitval theme: 'Pressing Matters'.  James McArdle’s practice is to use the qualities of the medium to reflect on itself. Camera vision and human perception are often compared; this is a simplification, but full of potential that might illuminate the nature of vision and attention. Haptic senses are stimulated in the eye by ‘racking’ focus (normally a cinematographic effect); and elsewhere with tilt-shift techniques; while ‘dollying’ the camera by hand around a still point renders the concentric vortex effects. A sense of physical presence and immersion is evoked with the exhibition. Fruiting Bodies’: is an instance of the application of this practice employed to ask the viewer to consider how strange is the phenomenon of the fruiting tree: is it promiscuous to offer your seed openly to the elements, to any who will take it. Is this forbidden? Is it profligate to hide your progeny inside gifts so tempting in their appeal to that most primitive desire, hunger? Is this wholly mere biological expedience evolved to ensure the widest migration of your offspring? Or does it derive from some boundless cosmic generosity? These images invite you to come close to the tree, where within its arms you will find shelter from the sun at its zenith and from the autumnal rains. Fruit is the focus of James’s lens as it circles deep into the embrace of limbs and leaves.

Background: Overall the physical health of Indigenous men is among the worst in Australia. Research has indicated that modifiable lifestyle factors, such as poor nutrition and physical inactivity, appear to contribute strongly to these poor health conditions. To effectively develop and implement strategies to improve the health of Australia’s Indigenous peoples, a greater understanding is needed of how Indigenous men perceive health, and how they view and care for their bodies. Further, a more systematic understanding of how sociocultural factors affect their health attitudes and behaviours is needed. This article presents the study protocol of a communitybased investigation into the factors surrounding the health and body image of Indigenous Australian men.
Methods and design: The study will be conducted in a collaborative manner with Indigenous Australian men using a participatory action research framework. Men will be recruited from three locations around Australia (metropolitan, regional, and rural) and interviewed to understand their experiences and perspectives on a number of issues related to health and health behaviour. The information that is collected will be analysed using modified grounded theory and thematic analysis. The results will then be used to develop and implement community events in each location to provide feedback on the findings to the community, promote health enhancing strategies, and determine future action and collaboration.
Discussion: This study will explore both risk and protective factors that affect the health of Indigenous Australian men. This knowledge will be disseminated to the wider Indigenous community and can be used to inform future health promotion strategies. The expected outcome of this study is therefore an increased understanding of health and health change in Indigenous Australian men, the development of strategies that promote healthy eating and positive patterns of physical activity and, in the longer term, more effective and culturally-appropriate interventions to improve health.

The past decade has witnessed a growing focus on the study of women sports fans within the social sciences and related disciplines. Emerging from and responding to the historical marginalization of women in sport and the bias towards the male fan in literature on sports spectatorship, critical research on women spectators serves the valuable function of illuminating “women’s everyday experiences of being a sports fan” (Gosling 2007: 250). This chapter considers one aspect of women’s participation as followers of male sports, namely, the extent to which female fans partake in the sexual objectification of sportsmen. We aim to assess how looking at male athletes in sexually desiring ways impacts on the individual and collective construction of women’s gender and sports fan identities.

The visibility of bodies of colour in public space can engender responses of anxiety, insecurity and discomfort in cities with white majority cultures. Such embodied responses that privilege the invisibility of whiteness have effects if they mark Aboriginal people and asylum seekers who arrive by boat as ‘out of place’ in public spaces of Australian cities. Drawing on fieldwork conducted in Darwin, I argue, however, that such white spaces are interrupted by habits of touch, multi-sensory events that contribute to fleshy moments of belonging for these racialised bodies that experience dispossession and displacement. Such belonging emerges from the intertwining fleshiness of bodies in a world where we affect and are affected by other bodies and things.

The paper explores two events held in public spaces of suburban Darwin, a weekly painting activity at a beach reserve that engages ‘Long Grassers’, Aboriginal people who live in open spaces, and a cooking session at a community centre that welcomes asylum-seeker families from a detention centre. Felix Ravaisson's philosophy of habit as virtue and spontaneous practice is a starting point for thinking about how haptic knowledges can provide a nuanced understanding of belonging, encounter and ethical engagement in a racially diverse white settler city.
