Estado del arte que recopila pronunciamientos de diversos autores sobre el papel de la Organización de Naciones Unidas, específicamente la Misión MINUGUA, en el proceso de reconstrucción posconflicto en Guatemala comprendido entre el año 1994 y 2004. Se basa en algunas dimensiones de la democratización como son el Estado de Derecho, la democracia representativa, la preeminencia del poder civil, y el fortalecimiento de la cultura democrática. Así mismo, tiene en cuenta los elementos de la justicia transicional, a saber: verdad, justicia y reparación.

This article discusses the problematic and evading development of conscientiousobjection in the context of the Colombian constitutional jurisprudence. From a historical allusion to the famous case of the “Mayflower Pilgrims” –which serve as areference to the central problems that faces the objector–, it seeks to define the scopeof conscientious objection as a fundamental right (as a fundamental justice claim)in regard to the “factual” and “legal” possibilities for its exercise, for which there willbe a brief contrast between the most representative cases decided by the ColombianConstitutional Court in such matter. The core of the article is the idea that thereis an ideological prevalence that, unjustifiably, makes it difficult and in some casesdenies the exercise of the right to object in consciousness, particularly when it comes tothe right of life in regard to the abortion case.

How do we justify the practice of corrective justice for losses suffered during armed conflicts? This article seeks to show the force and relevance of this question, and to argue that, in cases of massively destructive wars, social justice should gain priority over corrective justice. Starting from a liberal Rawlsian conception of the relationship between corrective and social justice, it is argued that, paradoxically, the more destructive a war is, the less normative force corrective rights have and the higher priority policies of social justice, which guarantee basic rights to all citizens, should have.

The phenomenon of paramilitarism in Colombia has received an ambiguous treatment, balancing between political and criminal issues; an oscillation that has been intimately linked to the evolution of the Colombian internal conflict. This contribution analyzes the recent negotiations held with paramilitary groups by the administration of Alvaro Uribe Vélez (2002-2010). After a brief account of the dependency path that has determined this historical episode, I propose an assessment of the use of judicial categories by the various actors of the negotiations. The main argument is that those categories –war criminal, political criminal, drug smuggler, etc.– do not depend on the intrinsic nature of an armed actor, but are socially constructed by a conflictive process of material and symbolic struggles. The capacity to categorize private violence, as legitimate or illegitimate, political or criminal, appears as one of the basic manifestations of the state’s action, as well as one of the main conflicts presiding at the rocess of state formation.

La ley de víctimas es la norma creada para la protección de los derechos de las víctimas en Colombia; empero cuenta con falencias respecto del concepto de víctima y su reparación integral. El Derecho Administrativo es la herramienta jurídica para superar dichas limitaciones legislativas.
