This article seeks to demonstrate how Law inter-related with Economy, constitutes in modern societies one of the main instruments for the construction of citizen consensus or the construction of political hegemony in modern societies. If we consider this affirmation —as is argued here— the transformations suffered in recent decades by Law as a consequence of the new phase of capitalistic globalization, have played an important role in the constitution of a new subjectivity (“single thought”) in the population.

Law is often the source of social discriminations, but, at the same time, it can be thekey to delete these social discriminations. The authors try to give an example of thisphenomenon, by analyzing the impact of the Italian citizenship’s rules over the descendantsof the Italian citizens emigrated abroad and, especially, in South America.Indeed, according to the former Italian law, only fathers could transmit iure sanguinisthe citizenship to their children: moreover, women automatically lost theItalian citizenship if they get a foreign citizenship by concluding a marriage witha foreign husband.These rules hardly discriminate the Italian women emigrated abroad and, especially,their descendants who were prevented to get the Italian’s citizenship.These discriminatory rules were finally deleted by the Italian Constitutional Courtin the Seventies and in the Eighties: however, the effects of those rules still persisted,since the decision of the Constitutional Court could not overcome the temporal limit of the entry into force of the Constitution (01.01.1948) and, therefore, could not“cover” the discriminatory facts occurred before that date.Finally in 2009, the Italian Supreme Court, by extending the effects ratione temporisof the decisions of the Constitutional Court, “reopened the doors” of the Italiancitizenship to a huge number of Italian citizenship born from Italian women beforethe 01.01.1948.Therefore, the authors focus on the social impact of this decision for all the potentialItalian citizens living in South America and try to assess its juridical effects overthe Italian law.

El abuso de poder en Venezuela ha sido el principal causante del deterioro de la democracia. A través del uso degenerativo del poder político prácticas antidemocráticas han surgido en la sociedad venezolana caracterizando, desde el presidente Hugo Chávez Frías hasta el presidente Nicolás Maduro, las políticas de gobierno. Como consecuencia de ello, una crisis prolongada en materia de DD.HH., la debilidad institucional, la discriminación política y la represión indiscriminada hacia sectores de oposición por parte del gobierno, son sólo algunos de tantos síntomas que actualmente forman parte de la realidad venezolana y que estarían encaminando al país hacia el surgimiento de un Estado fallido. Los síntomas antidemocráticos representativos de la Venezuela del presidente Nicolás Maduro, ponen en entredicho la existencia de una democracia contitucional en el país y con ello, la precariedad del Estado para cumplir sus funciones básicas para con los ciudadanos. This document examines, bases on the analysis of observable characteristics, if an income gapexists between the raizal population and non raizal population of San Andres Island. For thispurpose, the information of the SISBEN II survey for the year 2004, compelled by the NationalPlanning Department (DNP, Spanish acronym) is used. The methodological strategy uses quantileregressions to determine the existence of pay gaps throughout the distribution of income. Theresults suggest that being raizal has a negative impact on income for the lower quantiles. However,this difference vanishes as income increases, becoming positive at higher levels.
