El presente artículo analiza la razonabilidad del artículo 1006 del Código de Comercio Colombiano que prohíbe que los herederos del pasajero fallecido en un accidente, durante la ejecución de un contrato de transporte, ejerciten acumulativamente la acción contractual transmitida por su causante y la extracontractual por los perjuicios que sufran en razón de dicha muerte. En el escrito se revisa la problemática general de la concurrencia del daño que sufre la persona que fallece con el daño que se infiere a los herederos por el deceso del causante. A partir de esta revisión, se afirma que los dos daños deben ser resarcidos en su totalidad y en el mismo proceso, y que las razones que otrora explicaban la prohibición de acumulación de ambas acciones para cualquier evento, han desaparecido como consecuencia de la afortunada posición de la jurisprudencia a este respecto. Sin embargo, esta afirmación no es válida respecto del contrato de transporte por existir norma expresa en contrario, precisamente el artículo 1006 en comento. Se propone entonces la modificación de esta norma como consecuencia de la ausencia de razonabilidad de tal prohibición, ya que los argumentos que permiten la acumulación de acciones para otros eventos son igualmente aplicables al contrato de transporte.

La potestad sancionadora, en cabeza de la Administración, ha sido reconocida como una de las competencias de gestión de la que es titular la autoridad administrativa. Pues, de nada serviría que la Administración ostentara una facultad para imponer una obligación o regular una conducta, en aras de alcanzar el bienestar general, y no lo fuera para imponer sanciones por su incumplimiento. Sin embargo, esta situación no significa que las diversas autoridades administrativas tengan carta blanca para ejercer el ius puniendi a su antojo y de este modo ejerzan de forma discrecional o arbitraria esta potestad. Por el contrario, la Administración debe estar a los criterios de adecuación y graduación previstos en la norma o, en caso de no existir estos, a su sentido de justicia, que debe propender por una medida proporcional a los hechos ocurridos.

The present study contributes to the literature on the Job Demands-resources model in the italian school context. the aim of this paper is to examine how the interaction between work-family conflict (i.e., a typical job demand) and opportunities to learn and to develop and self-efficacy (i.e., typical job and personal resources, respectively) affect the core dimensions of burnout (exhaustion and depersonalization) and work engagement (vigor and dedication). Hypotheses were tested with a cross-sectional design among 143 teachers of a junior high school in the north of Italy. Results of moderated multiple regression analysis partially supported the hypotheses as the opportunities to learn and to develop buffered against the aversive effects of work-family conflict on depersonalization, whereas self-efficacy moderated the relationship between work-family conflict and vigor. From a practical viewpoint, our findings suggest that opportunities to learn and to develop and self-efficacy are important re- sources that help teachers to reduce the negative effects related to work-family conflict.

From the example of the process of general induction into the organization and using certain sociological resources, shows paradox are specialists in human management: is to carefor the motivation and the welfare of workers to achieve its high performance, their fidelity and his tenure at the company; However, current mutations of the social architecture in general and of work in particular –as structure of organized action– force thinking that organizational loyalty tends to be increasingly unlikely and that, conversely, the current personnel administration processes appear made inappropriate notions and appear to contribute directly to the adversities of human beings in organizational settings.

This paper describes a human management model as conceived in organizations that carry out a strategic direction of staff, based on a critical look of traditional management and some of its notions, such as the classical perspective of strategic addressing and human resources management. The privileged theoretical framework is the epistemological ground of the organizational theory and some of its sociological resources. In addition to the documentary review and the proposal of experts in consulting, a group of graphics made under the basic logicof set theory, designed from the analysis of several Colombian organizations, are presented. The main finding is that despite the efforts of executives, consultants and scholars to build management models different from functionalists, the way they have been thought in order to make them more strategic has made them still more functionalists that in the traditional approach. The strategic human management reproduces, with enormous power, the ideology of the macroeconomic model.
