Resumo:
Diese Arbeit führt in erster Linie eine kritische Analyse der normativen Gestaltung in Bezug auf die Stabilisierung des Staatshaushalts während der letzten 5 Jahre unter dem Einfluss des EU-Rechts durch. Anschließend werden die Wirkung und die Auswirkungen dieses Gesetzes bewertet. Abschließend werden einige Vorschläge und Erwägungen zur Zukunft geäußert.

Este artículo es un estudio histórico de la leyenda de la «Piedra del Destino», que fue parte del asiento del trono de coronación de los reyes de Escocia y que fue trasladada a la abadía de Westminster por el rey Eduardo de Inglaterra, que la situó bajo el trono de la coronación de los reyes de Inglaterra. La «Piedra del Destino», como muchas reliquias y antigüedades de la Edad Media, tuvo una larga historia, escrita por cronistas e historiadores. Una historia muy semejante a otras translationes de reliquias. La historia de la «Piedra del Destino» contiene ricos aspectos jurídicos, políticos y sacrales. Para comprenderlos es necesario analizar las crónicas, entendidas como textos históricos, que dan sentido a los rituales jurídicos y políticos de la Edad Media.

This text deals with transnational strategies of social mobility in Ecuadorian migrant households in Spain. We apply the capital accumulation model (Moser, 2009) for this purpose. The main target of this article is, beyond thinking in terms of capital stock and accumulation, the analysis in depth of the dynamics of the different types of capital, that is to say, how they interact with each other in the framework of the social mobility strategies of the migrants and their families. We are bringing into light the way some households adopt investing decisions in capitals that don't translate into any addition or earnings in all cases, on the contrary, concentrating all their efforts on the accumulation of a certain asset they may, in some cases, lead to a loss of another. We will concentrate our analysis primarily on the dynamics between the physical and financial capital and the social and emotional capital, showing the tensions produced between these two types of assets. At the same time, we will highlight how migrants negotiate their family strategies of social mobility in the transnational area. Our study is based in empirical material obtained from qualitative fieldwork (in-depth interviews) with families of migrants in the urban district of Turubamba Bajo -(south of Quito) and in Madrid. A series of households were selected where interviews were carried out in the country of origin as well as in the context of immigration, with different family members, analysing the transnational social and economic strategies of families of migrant members. Family members of migrants established in Spain were interviewed in Quito, as well as key informants in the district (school teachers, nursery members of the staff, etc.). At all normative levels, family migration law can disproportionally and negatively affect immigrant women’s rights in this field, producing gendered effects. In some cases, such effects are related to the normative and judicial imposition of unviable family-related models (e.g., the ʻgood mother ̕ the one-breadwinner family, or a rigid distinction between productive and reproductive work). In other cases, they are due to family migration law’s overlooking of the specific needs and difficulties of immigrant women, within their families and in the broader context of their host countries’ social and normative framework.To effectively expose and correct this gender bias, in this article I propose an alternative view of immigrant women’s right to family life, as a cluster of rights and entitlements rather than as a mono-dimensional right. As a theoretical approach, this construction is better equipped to capture the complex experiences of immigrant women in the European legal space, and to shed light on the gendered effects generated not by individual norms but by the interaction of norms that are traditionally assigned to separated legal domains (e.g., immigration law and criminal law). As a judicial strategy, this understanding is capable of prompting a consideration by domestic and supranational courts of immigrant women not as isolated individuals, but as ‘individuals in context’. I shall define this type of approach as ‘contextual interpretation’, understood as the consideration of immigrant women in the broader contexts of their families, their host societies and the normative frameworks applicable to them. Performed in a gendersensitive manner, a contextual judicial interpretation has the potential to neutralize the gendered effects of certain family migration norms. To illustrate these points, I will discuss selected judicial examples offered by the European Court on Human Rights, as well as from domestic jurisdictions of countries with a particularly high incidence of immigrant women (Italy and Spain).

Research on women prisoners and drug use is scarce in our context and needs theoretical tools to understand their life paths. In this article, I introduce an intersectional perspective on the experiences of women in prison, with particular focus on drug use. To illustrate this, I draw on the life story of one of the women interviewed in prison, in order to explore the axes of inequality in the lives of women in prison. These are usually presented as accumulated and articulated in complex and diverse ways. The theoretical tool of intersectionality allows us to gain an understanding of the phenomenon of women prisoners who have used drugs. This includes both the structural constraints in which they were embedded and the decisions they made, considering the circumstances of disadvantage in which they were immersed. This is a perspective which has already been intuitively present since the dawn of feminist criminology in the English-speaking world and can now be developed further due to new contributions in this field of gender studies.

The concept of ontological security has a remarkable echo in the current sociology to describe emotional status of men of late modernity. However, the concept created by Giddens in the eighties has been little used in empirical research covering various sources of risk or uncertainty. In this paper, a scale for ontological security is proposed. To do this, we start from the results of a research focused on the relationship between risk, uncertainty and vulnerability in the context of the economic crisis in Spain. These results were produced through nine focus groups and a telephone survey with standardized questionnaire applied to a national sample of 2,408 individuals over 18 years. This work is divided into three main sections. In the fi rst, a scale has been built from the results of the application of different items present in the questionnaire used. The second part explores the relationships of the scale obtained with the variables further approximate the emotional dimensions of individuals. The third part observes the variables that contribute to changes in the scale: These variables show the structural feature of the ontological security.

La polémica acerca del hiyab como símbolo de identidad de la mujer musulmana ha irrumpido en nuestra sociedad occidental. Si bien visiblemente no es más que una prenda, el ocultamiento del cabello, el cuello, y en algunas ocasiones el rostro y el cuerpo hacen que su uso no deje indiferente y su significado exceda más allá de lo puramente religioso. El presente trabajo constará de dos partes: La primera, tratará de entender la naturaleza de esta prenda, estudiando su procedencia, sus tipos y el significado que para las mujeres musulmanas tiene portarlo. La segunda, se centrará en el debate público y político que en muchos países de Europa, entre ellos España, viene provocando su uso y las consecuencias que una eventual prohibición o limitación del mismo tendría.
