In the past canals were developed, and some rivers were heavily altered, driven by the need for good transportation infrastructure. Major investments were made in navigation locks, weirs and artificial embankments, and many of these assets are now reaching the end of their technical lifetime. Since then the concept of integrated water resource management (IWRM) emerged as a concept to manage and develop water-bodies in general. Two pressing problems arise from these developments: (1) major reinvestment is needed in order to maintain the transportation function of these waterways, and (2), it is not clear how the implementation of the concept of IWRM can be brought into harmony with such reinvestment. This paper aims to illustrate the problems in capital-intensive parts of waterway systems, and argues for exploring value-driven solutions that rely on the inclusion of multiple values, thus solving both funding problems and stakeholder conflicts. The focus on value in cooperative strategies is key to defining viable implementation strategies for waterway projects.

Estuaries are a transition zone for fresh and saline water and sediments, providing a range of ecosystem services for the local population, infrastructure and industries located in their environs. They are also governance transition zones where jurisdictions often overlap and focused attention is often lacking. As Australia’s population continues to expand, particularly in the south, estuaries are increasingly becoming popular locations for settlement due to their picturesque surrounds and accessibility for water-based activities. This results in expanding human and industry activities and pressures along estuaries and adjacent coastal settings impacting ecosystem service delivery. The absence of dedicated national and state estuary legislation in addition to decades of poor land and waterway management decisions paints a ‘doom and gloom’ picture for temperate southern Australian estuaries. Against this backdrop, there are number of estuary ‘bright spots’ where natural resource management bodies in strong partnership with local actors are moving forward in overcoming challenges to estuary conservation. Using case studies, this paper describes the key elements for effective estuary management that can lead to improved estuary health.

El interés de esta monografía es evaluar la relación entre el derecho internacional, la guerra y la política exterior a la luz del concepto de lawfare. Esta relación se evalúa a la luz del caso de las relaciones de Nicaragua con sus vecinos. Se analiza y explican las distintas nociones de derecho internacional desarrolladas por las teorías de Relaciones y sus limitaciones; la utilización de la guerra jurídica como estrategia sustitutiva de la guerra material en el caso de Nicaragua. Utilizando el concepto desarrollado por Charles Dunlap, el trabajo busca demostrar que el lawfare explica algunas relaciones entre derecho, guerra, y relaciones internacionales que las teorías clásicas no pueden y, adicionalmente da razón de las acciones de Nicaragua mediante la utilización del Derecho Internacional.
