Statement signed by Hume Blake of Toronto (2 ½ pages) who has read the will of Joseph Clement dated May 14, 1810 and has also read the will of Mary M. Clement dated Sept. 10, 1842. He states that the devise to James D. Clement and Joseph Clement is void. “The executor therefore take the personal estate … and the lands devised to James and Joseph Clement descend unencumbered to the heir of the testator Joseph Clement.” This document is slightly burned on the edges but text is not affected. The outer page says “Mr. Hume Blake for Brock Woodruff, May 9, 1845.

El propósito del tema a desarrollar a través de este documento es el de analizar y comprender, bajo una óptica crítica y reflexiva, la institución jurídica de la partición en vida, su noción, regulación y efectos, con miras a determinar los posibles perjuicios que pueda generar la aplicación de esta figura a los acreedores de quien lleva a cabo la misma. Basados en dicho objetivo, se expone a la partición en vida como institución jurídica, analizando el fallo de la Corte Constitucional mediante el cual se declara su exequibilidad, y contrastándola con la partición por donación, usada en Argentina, como referente extranjero. Así mismo, son abordadas distintas instituciones jurídicas cuyo análisis permite denotar el alcance de la partición en vida en la práctica social colombiana, y a su vez, determinar cómo puede verse afectado el patrimonio de aquellos terceros que fungen como acreedores del partidor.

Determination of testamentary capacity involves not only application of standard tests for decisional competency but also consideration of such special factors as the testator's "moral duty" to those entitled to her or his bounty (also referred to as "common obligations of life"), and the concept of emotional capacity. It is important for medical and legal practitioners who are involved in assessment of testamentary capacity to be aware of these special factors or requirements, their nature and their effect on the validity of the testator's will. The relevant tests and special factors are examined from an historical perspective.

Family businesses have acquired a very specific gravity in the economy of occidental countries, generating most of the employment and the richness for the last ages. In Spain Family Businesses represent the 65% about the total of enterprises with 1,5 million companies. They give employment to 8 million people, the 80% of the private employment and develop the 65% of the Spanish GNP (Gross National Product). Otherwise, the family business needs a complete law regulation that gives satisfaction to their own necessities and challenges. These companies have to deal with national or international economic scene to assure their permanency and competitiveness. In fact, the statistics about family companies have a medium life of 35 years. European family businesses success their successor process between a 10 and 25%. It’s said: first generation makes, second generation stays, third generation distributes. In that sense, the Recommendation of the European Commission of December 7º 1994 about the succession of the small and medium companies has reformed European internal orders according to make easier successor process and to introduce practices of family companies’ good government. So, the Italian law, under the 14th Law, February 2006, has reformed its Covil Code, appearing a new concept, called “Patto di famiglia”, wich abolish the prohibition as laid dwon in the 458 article about successors’ agreements, admitting the possibility that testator guarantees the continuity of the company or of the family society, giving it, totally or in part, to one or various of its descendents. On other hand, Spain has promulgated the 17th Royal Decree (9th February 2007), that governs the publicity of family agreements (Protocolos familiars). These “protocolo familiar” (Family Agreement) are known as accord of wills, consented and accepted unanimously of all the family members and the company, taking into account recommendations and practices of family company’s good government.

This paper develops a general theory of land inheritance rules. We distinguish between two classes of rules: those that allow a testator discretion in disposing of his land (like a best-qualified rule), and those that constrain his choice (like primogeniture). The primary benefit of the latter is to prevent rent seeking by heirs, but the cost is that testators cannot make use of information about the relative abilities of his heirs to manage the land. We also account for the impact of scale economies in land use. We conclude by offering some empirical tests of the model using a cross-cultural sample of societies.

El presente trabajo se propone: 1. Determinar las distintas formas de testar que adoptó el derecho romano, a lo largo de su evolución histórica. 2. Caracterizar la captatio testamenti, una profesión insólita y lucrativa cuya existencia se constata ya en la Roma republicana, a través del testimonio de Plauto en el Miles gloriosus y que se difundió notablemente durante los primeros siglos del Imperio, en los que se convirtió en un medio de progreso social. 3. Analizar esta actividad desde diferentes perspectivas de acuerdo con los tipos humanos que participan en ella: los captatores testamentorum o heredipetae y los testatores. El corpus trabajado abarca a Plauto (Miles gloriosus), Horacio (Sátira 2,5), Séneca (De beneficiis y Epist. 95), Marcial (Epigramas), Petronio (Satiricón), Juvenal (Sátira 12), Plinio el Viejo (Hist. Natural), Plinio el Joven (Epist. 2, 20).

El artículo 1051 del Código civil atribuye al testador una facultad para prohibir la partición de la herencia. Por otra parte, conforme al artículo 400 del Código civil, se admite también un acuerdo entre los partícipes de la comunidad hereditaria para preservarla indivisa. En ambos casos existe una prohibición de dividir la herencia, una situación que se reconoce también en otros Derechos de nuestro ordenamiento como el navarro, el catalán y el aragonés.
