Purpose The purpose of this paper is to assess and highlight the approach taken towards the legal control of illicit money laundering taken in the Republic of Kazakhstan, in particular, the role played by an amnesty on the legalisation of illicit funds. This is particularly important as a basis for a wider discussion about the proper limits of the “criminalising” approaches commonly taken in anti-money laundering regulations. Design/methodology/approach The discussion and evaluation in the paper is based upon a conceptual analysis of the money laundering regime in Kazakhstan, in particular, the legal framework and policies of implementation adopted. Findings The paper demonstrates that the problems that are posed by the shadow economy in post-Soviet transition societies can make the blanket criminalisation of money laundering a self-defeating approach, unless accompanied by measures which allow for the achievement of “market-constituting” effects. Research limitations/implications The paper draws on experience and practice in one jurisdiction only (Kazakhstan); it also limits its focus to one particular example of a money laundering amnesty policy. Both of these limitations, therefore, suggest avenues for further comparative research. Originality/value The paper’s conclusions about the interactions between the shadow economies of transitional societies and the global anti-money laundering agenda have wider application in assessments of international law in this area.

Measuring the shadow economy is inherently difficult, but critical for understanding economic development. Using census data on formal and informal sectors in Cambodia, we document that 96.6% of non-farm establishments do not formally register with the government, and their sales accounted for 76.6% of total sales in 2011. We estimate a relationship between nighttime light and sales across regions separately for formal and informal firms for 2011, and estimate their past sales from changes in nighttime light for 1993-2010. Both formal and informal firms increased their estimated sales, and the share of informal sales increased from 68.8% in 1993 to 76.6% in 2011, suggesting that the informal sector increased quantitatively in both absolute and relative terms throughout the economic development of the Cambodian economy.

We analyze theoretically and empirically the impact of the shadow economy on entrepreneurial entry, utilising 1998-2005 individual-level Global Entrepreneurship Monitor data merged with macro level variables. A simple correlation coefficient suggests a positive linear link between the size of the shadow economy and entrepreneurial entry. However, this masks more complex relationships. With appropriate controls and instrumenting for potential endogeneity where required, the impact of the shadow economy on entry is found to be negative, based on a linear specification. Moreover, there is also evidence of nonlinearity: entrepreneurial entry is least likely when the shadow economy is of medium size. We attribute the negative effects of shadow economy on entry to perceived strong competition faced by new entrants when the shadow economy is widespread. At the individual level, an extensive shadow economy has a more negative impact on respondents who are risk averse. In addition, in the economies where property rights are strong, the negative impact of the shadow economy is weaker.

The impact of the shadow economy on entrepreneurial entry across countries is analyzed utilising 1998-2005 individual-level Global Entrepreneurship Monitor data and national macro-economic variables. A simple correlation coefficient suggests a positive relationship between the size of the shadow economy and the likelihood of entrepreneurial entry. However, this masks more complex relationships, if, as argued, the shadow economy is an embedded social phenomenon. With appropriate controls and instrumenting for potential endogeneity, the impact of the shadow economy on entry in a linear specification is found to be negative. Further, there is evidence of a U-shaped relationship: entrepreneurial entry is least likely when the shadow economy amounts to about a quarter of gross domestic product (GDP). At the individual level, an extensive shadow economy has a more negative impact on respondents who are risk averse. In addition, in the economies where property rights are stronger, the negative impact of the shadow economy is weaker. © 2012 Blackwell Publishing Ltd.

Based on the Ahumada et al. (2007, Review of Income and Wealth) critique we revise existing estimates of the size of the German underground economy. Among other things, it turns out that most of these estimates are untenable and that the tax pressure induced size of the German underground economy may be much lower than previously thought. To this extent, German policy and law makers have been misguided during the last three decades. Therefore, we introduce the Modified-Cash-Deposit-Ratio (MCDR) approach, which is not subject to the recent critique and apply it to Germany for the period 1960 to 2008. Financial contributions to the EU budget depend basically on official GDP. This means that countries with higher shadow economic activity contribute less than they should contribute in a system based on actual GDP and therefore could reduce their incentive to fight against such activities. In this paper we investigate if the EU financing system really has an influence on the intensity with which governments in EU member states fight against shadow economic activity. We find that the EU net contributors significantly fight more intensively against shadow economic activity while EU net receivers significantly fight less. As a result, shadow economic activity is higher in net receiver and lower in net contributor countries than it were in comparison with a scenario of nationally balanced EU funding. Quantitatively and averaged over the time period 2001-2007, the diagnosed effect amounts to a stimulation of hidden economic activity by almost 10% for particular economies. Tutkielman tavoitteena on selvittää käänteisen arvonlisäverotuksen mahdollisen käyttöönoton vaikutuksia suomalaisille rakennusyrityksille. Käänteinen arvonlisäverotus liittyy rakennusalalla ilmenevän harmaan talouden hillitsemiseen. Vastaavanlainen menettely on käytössä muutamissa Euroopan maissa, joista verrokkimaaksi työhön valikoitui Ruotsi. Tutkielmassa on käyty läpi talousrikollisuutta rakennusalalla, rakennusalan erityispiirteitä, Suomen ja Ruotsin arvonlisäverojärjestelmiä sekä käännetyn menettelyn käytöstä saatuja kokemuksia. Lisäksi haluttiin selvittää ruotsalaisten tekemiä lainsäädännöllisiä valintoja sekä niiden vaikutuksia. Tutkielman empiirinen aineisto kerättiin haastatteluin sekä Suomesta että Ruotsista. Tutkimuksen tuloksena voidaan sanoa, että menettely aiheuttaa yrityksille ylimääräistä hallinnollista taakkaa, mutta siitä huolimatta sen käyttöönottoon on suhtauduttu Ruotsissa melko positiivisesti. Tutkimuksessa havaittiin myös, että yksityiskohdilla ja säännöksillä on huomattavan suuri merkitys käännetyn menettelyn yrityksille aiheuttamaan kuormitukseen.

La asignatura de Competitividad Internacional Urbana (ciu) del programa de Gestión y Desarrollo Urbanos (gdu) de la Universidad del Rosario ha sido desde 2009, cuando asumí su dirección y orientación, un reto permanente de aprendizajes tan estimulantes y variados cuantas ciudades y atributos hay por descubrir en el inmenso mundo de lo urbano-rural-regional. Si bien la competitividad es un asunto urbano-regional antes que nacional, la mayor parte de los enfoques y de las consiguientes referencias bibliográficas abordan la competitividad a nivel nacional siendo relativamente escasas las publicaciones sobre la competitividad urbana. Así, los documentos abordan una descripción general de las ciudades, las causas de las crisis y las consecuencias para la ciudad y su estructura económica, analizadas a partir de los impactos sobre el mercado laboral, los precios de la vivienda, el desarrollo del turismo, entre otros, y las diversas estrategias que adoptaron para afrontar la crisis y convertirla en una oportunidad de desarrollo.

The presented text aims to evaluate the causes that leading to the development of the informal sector and primarily its consequences for the registered economy (formal). Therefore, defines the concept of the shadow economy, and sets out its varied activities. The objective is to analyze the growth of this phenomenon in Brazil, since its supposed rise in the early 70's until recent days. Finally, it will be introduced some measurement methods that allow estimating the size of the shadow economy. Among these methods, in order to evaluate the behavior of the informal sector in Brazil, it was used the MIMIC model (Multiple Indicators and Multiple Causes) that consists of a statistical theory of unobserved variables, or also called latent, which considers multiple causes and multiple effects or indicators. This paper presents empirical evidence on the size distribution of all Cambodian establishments in the nonfarm sector for 2009. Small- and large-scale establishments account for the largest share of employment, pointing to a “missing middle” that is commonly observed in developing countries. The analysis provides little evidence for Zipf’s law because Cambodian industry is characterized by a more dense mass of small establishments than the Zipf distribution would predict.
