The responsibilities of an Iowa Notary Public are critical to the legal, business, financial and real estate communities and should be taken seri- ously. This pocketbook is designed to assist Iowa notary publics as they perform their duties.

Entrepreneurial structure of the mercantile company in pre-industrial Catalonia

The mercantile company was the basic form of enterprise in pre-industrial Catalonia. The aim of this paper is to study the formation and development of the mercantile companies in Barcelona whose end was the wholesale and retail sale of textiles in the botigues de teles (textile retail shops) throughout the eighteenth century. These firms were officially registered before a notary and their deeds reveal how these establishments were administered and managed.The study covers a sample of 121 mercantile companies, and the articles and documentation that were put into effect by 32 notaries who were active in Barcelona in the 18th century have been consulted in their entirety. From an initial selection of documentation, a total of 228 deeds registering companies have been found, 107 of which (47%) relate to the creation of companies whose various activities were centred in taverns, textile manufacturing, braiding.... While the 121 companies, which make up our sample and which account for 53% of the deeds registered with the notaries mentioned above, focused exclusively on the management of textile retail shops located in the commercial heart of the city. Thus one point of interest that the documentation reveals is that the majority of the mercantile companies registered by Barcelona notaries throughout the 18th century were establishments which traded in textiles. The first part of the article focuses on the structural characteristics of these enterprises, the number and socio-professional status of the partners and the extent of each partner s involvement in the administration and management. The second part of the article examines the capital investment made by each partner, their rights and obligations agreed on, the sharing out of profits and possible losses and the duration of the companies. The final aim of the paper is to highlight the evolution of these companies through one specific case.

Notarios catalanes en Roma: los notarios matriculados en el Archivo de la Curia (1508-1671)

[spa]Este artículo estudia la presencia en Roma de un colectivo de notarios catalanes durante los siglos XVI y XVII. Se trata de los notarios matriculados en el colegio de escritores del archivo de la curia, una institución que tenía la función de crear notarios. Todo notario extranjero que llegaba a Roma tenía que matricularse en este colegio. En los libros de matrícula se insertan diversos datos de cada uno de los notarios, además del signum. Se plantea también la hipótesis de que estos notarios trabajen en Roma ejerciendo el oficio notarial. Por ello se analiza la actividad de algunos de estos notarios en la ciudad de Roma a través de la documentación notarial conservada actualmente en los archivos romanos.

Govan was an ancient settlement, former burgh and now a district in Glasgow, Scotland. It is situated 2.5 miles west of Glasgow City Centre, on the south bank of the River Clyde, opposite the mouth of the River Kelvin and the district of Patrick. Govan was a village comprised of thatched cottages until well into the 19th century. It became a shipbuilding town in the early 19th century.

Instrument of protest from Edward Barrori Palmer, Notary Public of Oakville regarding a protest by Samuel Sutherland, Master of the schooner Elizabeth and Charles McEacherin, mate. The schooner belonged to the Port of Niagara. It set sail from Port Credit to the Port of Niagara. On the 15th day of May there was a violent storm. On the 16th day of May, part of the deck and cargo consisting of lumber went overboard. The mainsail was lost and the jib was split due to the wind. All losses and damages should be borne by the merchants and whomever else it concerned and not by or through the insufficiency of the schooner of neglect by the officers and mariners. This is a 2 ½ page handwritten document, May 16, 1837.

La protection des créances des sous-traitants dans le domaine de la construction

La sous-traitance est une pratique constante dans le domaine de la construction, en raison de ses atouts économiques et techniques. Par cette pratique, les sous-traitants effectuent des travaux sans être, sur le plan juridique, liés contractuellement au maître de l’ouvrage. Comment assurer le paiement de leurs créances, eu égard au risque de défaillance de l'entrepreneur. Le législateur a prévu un régime légal de protection et la pratique a élaboré des mécanismes. Le régime légal, bien qu’il assure efficacement la protection des créances des sous-traitants, comporte certaines faiblesses dans son application qui peuvent causer des inconvénients aux sous-traitants et au propriétaire. L’assurance de titres et des retenues de fonds par l’institution financière ou le notaire peuvent pallier ces difficultés pour le propriétaire. Les mécanismes de protection élaborés par la pratique, tels que le cautionnement et les garanties monétaires, accroissent la protection des sous-traitants lorsqu’ils sont utilisés parallèlement au régime légal et profitent au propriétaire.

La preuve par métadonnées

L’entrée en vigueur de la Loi concernant le cadre juridique des technologies de l’information (ci-après la Loi), est la concrétisation de la prise en compte par le droit, de la preuve technologique. La notion de document technologique est à la fois centrale dans la Loi et dans le Code civil du Québec. Il s’est parfaitement intégré aux divers moyens de preuve du Code civil. Nous allons nous intéresser à cette notion qu’est le document technologique, mais davantage à ses éléments structurants, les métadonnées. Nous allons nous pencher sur la notion, ses origines et ses domaines de prédilection, faisant d’elles, un objet a priori essentiellement technologique, avant de les envisager dans un contexte de preuve. Nous allons voir quel potentiel probatoire les métadonnées représentent, à l’appui d’un document technologique. Enfin, nous nous interrogerons sur leur rôle probatoire autour des notions de copie-transfert et des obligations posées par la Loi, afin que ces deux modes de reproduction des document, puissent légalement tenir lieu du document original, soit la certification et la documentation.

Levantamiento de procesos para las notarias

En este trabajo buscamos investigar los procesos que se llevan a cabo dentro de una notaria como por ejemplo: Procesos relacionados con el Registro Civil, Sucesiones, Procesos escriturarios...etc , pasando desde los documentos necesarios para el proceso hasta como se debe desarrollar las formas, para esto hacemos una introducción a la cadena de valor y una breve introducción a los procesos, también se enumeran las diferentes actividades que debe manejar un notario sus responsabilidades y los conocimientos necesarios para llegar a este puesto.

La Reforma Catòlica a la muntanya catalana a través de les visites pastorals: els bisbats de Girona i Vic (1587-1800)

La present tesi vol explicar la implantació de la Reforma Catòlica en una sèrie de parròquies rurals dels bisbats de Girona (valls de Ridaura, Bas, Hostoles i Amer) i Vic (El Collsacabra i les valls de Susqueda i Sau), entre 1587 i 1800, des dels bisbes posttrentins Jaume Caçador i Pedro Jaime als il·lustrats Tomàs de Lorenzana i Francisco de Veyan. La documentació principal són les sèries de les visites pastorals conservades a l'Arxiu Diocesà de Girona i l'Arxiu Episcopal de Vic; paral·lelament, s'ha reforçat amb documentació parroquial (llibres sagramentals, consuetes, llibres d'obra i confraries), protocols notarials (notaries de Rupit, Sant Feliu de Pallerols, El Mallol i Amer) i impresos episcopals. Els manaments de les visites pastorals s'han contrastat, amb semblances i diferències, amb els decrets del concili de Trento, de les constitucions provincials tarraconenses i les sinodals gironines i vigatanes, i amb les evidències artístiques, arquitectòniques i arqueològiques. Tots ells han servit per demostrar la lentitud en la implantació del programa tridentí, que s'assoleix, de fet, amb força retard (ben entrat el segle XVIII).

The objective of this work is to understand some of the modifications caused for the phenomenon of the westernization in the hinterland of the Capitania do Rio Grande e in the life of the indians populations that inhabited there during the Colonial Period. We break of the quarrel of Serge Gruzinski concerning the westernization, understood while immersed phenomenon in the context of the expansion of the commercial capitalism and that, for the imposition of the culture occidental person to the alteridades of the New World, emprende the conquest of its territories, bodies and souls. The space clipping has covered the hinterland of the Capitania do Rio Grande, specifically the colonial territory of the Freguesia da Gloriosa Senhora Santa Ana do Seridó. The chosen chronological limit for the research corresponds to the Colonial Period and part of the Imperial one. However, the emphasis falls again on the period that it initiates in 1670, year of the oldest concession of would sesmaria known until the moment in the hinterland of the Rio Grande, extending itself until the decade of 1840. Sources of written by hand nature, cartographic printed and compose the used document roll: official correspondence and legislation, petitions of would sesmaria, inventories post-mortem, justifications of debt, registers of parish, maps, action civil court jurisdiction, notes of notary's office, land landmarks. We take the method, analyzed for Carlo Ginzburg, to cross these sources between itself and to detect its implied particularitities and ideas in the space between lineses, but, attributing it status to they of a colonial speech, fruit of the bureaucracy of where it was originated and of the social place of who produced it. We look for to demonstrate, throughout the work, that the phenomenon of the westernization desestruturou the aboriginal societies and its habitat, constructing, over its rubbles, a colonial territory that found in the cartography of the Freguesia de Santa Ana an efficient instrument of control of the space and the population.
