As normas referentes às crianças-soldado no Direito Internacional

Este trabalho trata da normatização internacional relativa às crianças-soldado e aborda, sobretudo, a utilização de defesas baseadas em alegações de violação aos princípios da legalidade e em ocorrência de erro de proibição por réus de processos penais do Tribunal Especial para Serra Leoa e do Tribunal Penal Internacional. Diante disso, investiga se a proibição geral ao envolvimento infantil em conflitos armados e as infrações a essa vedação particularmente as condutas de recrutar, alistar e utilizar crianças como soldados integram o Direito Internacional Costumeiro e, em caso positivo, em que momento teria ocorrido a inserção nesse campo. Analisa, igualmente, se o argumento da boa-fé pode ser um elemento de defesa válido naqueles processos, com fundamento no relativismo cultural. Pretende, com isso, esclarecer o processo de criminalização daquelas condutas, além de identificar a posição hierárquica ocupada pelas normas em questão. Para tanto, recorre à verificação da prática estatal e da opinio juris relativas ao tema. Com isso, conclui que o regramento possui natureza costumeira e pertence ao domínio do jus cogens.

Nelson Estupiñán Bass: escritor de dos orillas (Homenaje)

Este ensayo examina el significado y la función de la literatura escrita y leída desde la experiencia de la negritud en Ecuador, especialmente en lo que se refiere al ejemplo de Nelson Estupiñán Bass (1912-2002), a quien se considera uno de los principales escritores afroecuatorianos. Parte del problema que se analiza tiene que ver con cómo identificar el contexto social en el cual se lee la producción literaria de Estupiñán. De ahí, el análisis se mueve entre la llamada ciudad letrada y las áreas rurales del norte de Esmeraldas donde varias comunidades luchan por tomar control de sus propias representaciones. Por lo tanto, la pregunta que emerge tiene que ver con el rol conflictivo de un escritor afroesmeraldeño que pretende articular e interpretar las necesidades, los intereses y las historias que definen a los habitantes de la provincia de Esmeraldas mientras asume una posición jerárquica de un intelectual socialmente comprometido que, inconsciente y paradójicamente, deja sin voz a aquellas comunidades que, durante siglos, han hablado por medio de sus mayores y ancestros.

An exploration of the role duality experienced by HR professionals as both implementers and recipients of HR practices: evidence from the Indian railways

This study provides an innovative perspective on empirically assessing HR by focusing on the duality of HR professionals’ experiences as both implementers and recipients or internal customers of HR practices given that they are also employees of the organization. We hypothesize that HR professionals experience HR practices more favorably from an implementer perspective as compared to an internal customer perspective. These differences in experiences are likely to be influenced by HR professionals’ hierarchical position in the HR department. Our analyses of 1,271 HR professionals employed by Indian Railways revealed a number of differences between the two types of experience. Some practices (recruitment and selection, training, and employee welfare) were viewed more negatively from the implementer perspective, whereas others (compensation, benefits, and employment relations) were rated more negatively from the internal customer perspective. Those holding more senior HR positions reported more positive experiences of training and employment relations from an internal customer perspective. Overall our contributions draw on the attribution theory and concepts of intraorganizational power and voice, and have implications concerning the effectiveness of HR practices. © 2015 Wiley Periodicals, Inc.

Comércio internacional, politica comercial brasileira e a atuação da Câmara de Comércio Exterior (CAMEX) na condução das políticas para o setor

The proposal of this study is to present an assessment of the performance of the Brazilian Government Chamber of Foreign Trade (Camex), which is a board of the Council of Government responsible for the formulation, implementation and coordination of the Brazilian trade policy. The study begins with a historical approach to the international trade and the Brazilian foreign trade, mentioning its origins, features and interfaces with the economic development of the country. Based on the approach aforementioned, several interviews were made with authorities, who have remarkable knowledge about the subject, in order to obtain their views, experiences and suggestions concerning the performance of Camex since its creation in 1995. The list of interviewees includes authorities that are currently responsibles for the conduct of the policy on foreign trade, representatives of the organized society, and authorities who were in important positions in this segment of the federal public administration, regarding both the Minister of State, as Director of Cacex and the Executive Secretary of Camex. The conclusions of the study indicate that the Camex has not been succeeding in fully exercise its mandate of formulate, implement and coordinate the foreign trade policy of Brazil. A combination of factors contributes to this situation, especially its small strutcure, the fact that some ministries compete in the segment of foreign trade ¿don't understand¿ Chamber¿s real purpose, and, at last, the absence of a political mandate"(words taken from Motta Veiga) that would fortify its existing legal mandate. Finally, the study suggests some changes in the current organizational modeling of Camex, especially in its hierarchical position in the federal public administration."

Atuação do psicólogo no campo empresarial: experiência realizada em uma empresa brasileira

No presente estudo são destacadas, a abrangência das atividades de um psicólogo numa empresa brasileira de médio porte e as consequências da sua intervenção para o desenvolvimento da organização como um todo. Os resultados da implantação de uma estrutura de Recursos Humanos sob a perspectiva da psicologia são apresenta dos, sempre que possível, através de dados mensuráveis. As conclusões nos encoraja a convidar profissionais da nossa área a se dedicarem com mais afinco à Psicologia Aplicada ao Trabalho oferecendo suas contribuições à vida das organizações, em especial, às organizações de caráter industrial – comercial, como é o caso da empresa onde se verificou o estudo do presente caso. Pensamos que a possível causa da esterilidade aparente do trabalho do psicólogo nas organizações formais, possa ser atribuída à posição hierárquica do órgão em que se desenvolvem seus serviços. Como solução, sugerimos que o órgão de Recursos Humanos funcione como uma assessoria às unidades de nível hierárquico superior da organização. No caso estudado se ria uma assessoria à Superintendência. .Paralelamente, são discutidos alguns aspectos das atitudes e conflitos éticos do Psicólogo no âmbito organizacional.

Caracterização comportamental e avaliação da qualidade de leite em caprinos da raça saanen no semiárido nordestino

Goats are social animals which groups are organized from dominance hierarchies, established by agonistic behaviors. The quality and productivity of the goat s milk can be influenced by the dominance hierarchy. In this context, the objectives of our work were describe the social and food behavior of Saanen goats in a semi-extensive production system; characterize the social organization from the assessment of dominance hierarchies in two seasonal periods and correlate the physicochemical quality of the goats milk according hierarchical position. The experiment was conducted in the EMPARN s experimental station, located in the district of Cruzeta/RN. We utilized 17 multiparous goats of the Saanen race, with different age and weight. The observations were performed in precipitation and drought phases. The scan method recorded the trough permanence and agonistic interactions by method "all occurrences" in the pasture the alimentary behaviors of eat, ruminate on foot, ruminate lying, leisure on foot, leisure lying and walk, by the focal animal sampling method. The goats milk was submitted to analyzes of: density, protein, fat, lactose, CSS and total solids. The animals spend most of the time feeding themselves, and the activities that demand greater energy expenditure are done in the morning. The animals changed the hierarchical structure during the seasonal periods because of the withdrawal of some individuals of the group, having more aggressive behavior in the rainy season. The dominant animal the lowet production, the more CSS and the lesser fat, the goat in the middle of the hierarchy was the one that obtained the best production and quality. We conclude that the Saanen goats adapt to the environment and the conditions of the group to ensure better survival and its production is influenced by the internal dynamics of the group

Hierarquia de dominância durante a obtenção de Alimento em cebus apella e cebus libidinosus em Cativeiro

The analysis of the index of hierarchy and structural models of the formation of groups allowed to establish the hierarchical position of members of two groups of the genus Cebus. By the analyses of the hierarchical positions and the application of tests to obtain a food resource (TORA), we know the difference between these groups and groups in the wild. The results show a high ranking for both Cebus apella, as well as Cebus libidinosus. The results have enabled us to establish that the hierarchical structure in groups of Cebus in captivity: a) can be fixed and rigid different from highly flexible hierarchical structure studied in groups of wild b) even which similar hierarchy indices, there are differences in the hierarchical structure presents between C. apella and C. libidinosus in captivity c) hierarchy directly influence the behavioral patterns of obtaining food in Cebus

Nutritional and social hierarchy establishment of the primitively eusocial wasp Mischocyttarus cassununga (Hymenoptera, Vespidae, Mischocyttarini) and related aspects

The results on the nutritional influence in the social hierarchy establishment among females from six colonies of Mischocyttarus cassununga show that: - there was no caste determination in the pre-imaginal period concerning ingested food quantities, however, in relation to qualification (proteins and carbohydrate) the Mann-Whitney test applied showed variation among colonies: in two colonics (colony 3, p=0.0209; colony 4, p=0.0090) the larvae which ingested a higher quantity of solid food became adults of hierarchically higher position, however in two other colonies, colony 1 (p=0.6744) and colony 2 (p=0.3367) this difference was not statistically significant; in two experimentally manipulated colonies the caste determination was observed in the imaginal phase (it was verified that the larger the food quantity consumed, the higher the assumed hierarchical position by the individuals); - adult individuals of hierarchically higher position in two colonies ingested a greater amount of solid than liquid food (Mann-Whitney; p ≤ 0.05), however in the other three colonies there was no difference. It can be seen that for all colonies (2, 3, 4, 5 and 6) the high tendency to solid food ingestion occurs. In colony 1, this data was not collected because the observation purpose was different); - inside the colony hierarchy, the older individuals were the ones that occupied higher hierarchical positions; - more than one inseminated female per colony was found in the two experimentally manipulated colonies ; - ovarian development is greater in inseminated females; - the average height of the 3rd tergite was greater for inseminated females, indicating an adaptation to accommodate larger ovary development (t-Student test; p ≤ 0.05).

Estudo comportamental de Besourão-de-rabo-branco Phaethornis superciliosus (Aves, Trochilidae) no Parque Ecológico de Gunma

A comunicação acústica em beija-flores durante muito tempo foi negligenciada em função da coloração conspícua que representa uma sofisticada comunicação visual da maioria dos representantes deste grupo. Entretanto, estudos recentes constataram que há indícios de aprendizagem vocal em algumas espécies de Trochilidae. O presente estudo aborda o comportamento vocal do beija-flor Phaethornis superciliosus, espécie abundante na região amazônica. Esta espécie apresenta como sistema de acasalamento a formação em arena, que consiste na agregação de machos em um pequeno território, onde se exibem para outros machos e fêmeas, com o intuito de atrair estas últimas para acasalar. O objetivo geral deste trabalho foi analisar o comportamento vocal de P. superciliosus dispostos em seis arenas no Parque Ecológico de Gunma, Santa Bárbara do Pará, 50 km ao norte de Belém, considerando a emissão e estrutura física do canto, seu repertório, a frequência de emissão ao longo do dia e do ano e a dinâmica das arenas. Verificamos que a população estudada apresenta um repertório vocal composto de duas notas que são emitidas de maneira alternada. Os cantos dos indivíduos analisados apresentaram diferenças significativas entre si considerando os parâmetros físicos do som (frequências máxima e mínima, duração e intervalo entre as notas e o ritmo de emissão das notas). Esta diferenciação inter-individual pode estar relacionada à seleção sexual, na qual o canto pode permitir o reconhecimento individual, sua posição social e seu desempenho para a atração das fêmeas. Constatamos que a atividade vocal é mais intensa no segundo semestre, entre junho e novembro, período que provavelmente corresponde à estação reprodutiva. Realizamos testes de playback, que consistem em reproduzir um som previamente gravado e registrar a resposta provocada em uma das arenas em dois pontos distintos, simulando a entrada de outro indivíduo. Constatamos que o som emitido em resposta ao teste diferiu significativamente do canto espontâneo em todos os parâmetros físicos analisados. A resposta ao playback mostra que houve uma redução na faixa de frequência com que o canto foi emitido e o ritmo de emissão de notas mais rápido. Tais características do canto podem estarrelacionadas a um comportamento mais agressivo. As arenas são formadas emáreas de borda e sempre próximas a igarapés, com o tamanho da área variando entre 86m² e 14m², compostas de dois a quatro indivíduos distantes de 7m a 72m entre si. Nossos resultados mostraram que a organização social da arena deve ser melhor compreendida através de estudos mais detalhados sobre o possível significado que as diferenças individuais no canto podem representar para o estabelecimento da posição hierárquica dos indivíduos nas arenas.

Il giudice tributario come giudice europeo

Questo lavoro, tramite un'analisi attenta ed accurata dello sviluppo delle pronunce della Corte di Giustizia in materia tributaria, ha lo scopo di mettere in evidenza i canoni interpretativi utilizzati dalla Corte, tenendo presente gli effetti che tali pronunce hanno prodotto nei singoli stati ed in particolare sul ruolo del giudice tributario come giudice europeo. Assistiamo infatti oggi ad una vera e propria europeizzazione della produzione giuridica in grado di aprire nuovi spiragli alla tutela del cittadino anche nei confronti dell'amministrazione finanziaria. L'interazione, per molti aspetti problematica, tra gli organi di giustizia tributaria dei singoli ordinamenti ed il giudice comunitario sono diventate vera e propria fucina di un diritto tributario europeo, nell'ambito del quale a svolgere un ruolo di estrema rilevanza è il giudice interno. Le sentenze del giudice tributario nazionale infatti rappresentano lo strumento più efficace di chiarificazione del diritto comunitario. Il presente lavoro si propone quindi di esaminare nel dettaglio il rapporto complementare e funzionalista che si estrinseca nella peculiare funzione attribuita al giudice tributario nazionale che gli fa assumere le vesti di "giudice europeo" nonché la funzione attribuita alla Corte di Giustizia che assume i caratteri sempre più marcati di "giudice tributario sovranazionale". Partendo dalla disamina delle figure dei giudici tributari di Germania, Francia ed Italia, si passerà poi ad evidenziare i ruoli che hanno avuto le Corti nazionali nell'applicazione del diritto comunitario, evidenziando come nei vari casi le sentenze si sono affiancate alla preminenza gerarchica della norma europea.

We rely on a survey of Swiss firms to document deviation from first-best for reasons of internal 'fairness' when allicating resources. This 'socialist' practice is more widespread in smaller than in larger firms. It ignores the reputation and past performance of the managers who apply for dunding, but takes into account their hierarchical position and their past use of resources. Socialism is only partially explained by concerns about empire building and managerial optimism, and it is not meant to benefit shareholders.
