The legal and ethical framework governing Body Donation in Europe - A review of current practice and recommendations for good practice

Discussions at the inaugural meeting of a Trans-European Pedagogic Research Group for Anatomical Sciences highlighted the fact that there exist considerable variations in the legal and ethical frameworks throughout Europe concerning body bequests for anatomical examination. Such differences appear to reflect cultural and religious variations as well as different legal and constitutional frameworks. For example, there are different views concerning the "ownership" of cadavers and concerning the need (perceived by different societies and national politicians) for legislation specifically related to anatomical dissection. Furthermore, there are different views concerning the acceptability of using unclaimed bodies that have not given informed consent. Given that in Europe there have been a series of controversial anatomical exhibitions and also a public (televised) dissection/autopsy, and given that the commercial sale or transport of anatomical material across national boundaries is strongly debated, it would seem appropriate to "harmonise" the situation (at least in the European Union). This paper summarises the legal situation in a variety of European countries and suggests examples of good practice. In particular, it recommends that all countries should adopt clear legal frameworks to regulate the acceptance of donations for medical education and research. It stresses the need for informed consent, with donors being given clear information upon which to base their decision, intentions to bequest being made by the donor before death and encourages donors to discuss their wishes to bequeath with relatives prior to death. Departments are encouraged, where they feel it appropriate, to hold Services of Thanksgiving and Commemoration for those who have donated their bodies. Finally, there needs to be legislation to regulate transport of bodies or body parts across national borders and a discouragement of any moves towards commercialisation in relation to bequests.

Órgão de governação de topo do hospital público português : estrutura e constituição

RESUMO - Pretende-se com este projecto fazer uma reflexão sobre a problemática dos modelos de governação na gestão pública de hospitais e sobre a forma de incrementar a capacidade estratégica da gestão, contextualizando a governação dos hospitais num quadro mais amplo e comunitário, integrando os interesses e expectativas dos diversos interessados no funcionamento dos hospitais públicos. Sinteticamente, a questão fundamental de investigação é: Como conseguirá o sistema de governação de um hospital público incorporar os interesses de todos os seus stakeholders e shareholders? A resposta a esta questão integra duas fases, uma primeira dedicada ao estudo de um novo modelo de configuração para o órgão de governação de topo do hospital público e uma segunda fase dedicada à construção de um questionário para discussão e validação do modelo proposto através da técnica Delphi. A metodologia utilizada passou pela condução prévia de entrevistas exploratórias a informadores privilegiados e pela divisão do projecto em duas partes – uma primeira parte de enquadramento que segue a metodologia clássica da revisão bibliográfica e uma segunda parte prática que segue a metodologia Delphi, precedida de um levantamento das questões críticas para integrar no questionário que servirá de base à discussão dos peritos. Como resultado, o actual modelo pareceu-nos dificultar a consideração das expectativas e dos interesses dos proprietários/accionistas e dos stakeholders em geral do hospital público, concluindo-se pela necessidade de um novo modelo que estabeleça, inequivocamente, os papéis e as funções inerentes ao órgão de governação, garantindo a internalização da perspectiva de todos os interessados. -------------------------------ABSTRACT - The objective of this project is to reflect on the problematic of models of governance in the public management of hospitals and on the means for incrementing strategic management capacity. It does so by contextualizing the governance of public hospitals on a more ample community–wide scale, integrating the interests and expectations of different parties. The main research question is: how can the system of governance of a public hospital incorporate the interests of all its stakeholders and shareholders? The answer to this question involves two phases, one dedicated to the study of the configuration of the top-level governing body of the public hospital and, a second, dedicated to the construction of a questionnaire for discussion and validation of the proposed model by means of a Delphi technique. The methodology involved, first of all, exploratory interviews with key- informants and by the structuring of the project in two parts – the first, dedicated to contextualization by means of a standard literature review and the second, essentially practical by means of the Delphi technique, preceded by the raising of critical questions that integrate the questionnaire that will form the basis of expert discussion. The present model of public hospital governance appears to limit the possibility of integrating the expectations and interests of stakeholders and owner/shareholders. The Board, codified in Chapter 466A, is an independent, self-governing body directed to improve the quality of water in the state. The Board is authorized to request water quality improvement applications from soil and water conservation districts, local watershed improvement committees, cities, public water supply utilities, and county conservation boards and award grants to these entities. These grants are issued from the Watershed Improvement Fund. In 2007, the Fund was allocated $5 million for state fiscal year 2008 for water quality improvements from the tobacco settlement trust fund. On September 24. 2007, the Board awarded grants to ten applicants. Total amount allocated to these projects is $2.656.842. A second Request for applications is under way and will close February 22, 2008.

The Board, codified in Chapter 466A, is an independent, self-governing body directed to improve the quality of water in the state. The Board is authorized to request water quality improvement applications from soil and water conservation districts, local watershed improvement committees, cities, public water supply utilities, and county conservation boards and award grants to these entities. These grants are issued from the Watershed Improvement Fund. In 2008, the Fund was allocated $5 million for state fiscal year 2009 for water quality improvements from the general fund. On February 22, 2008, the Board awarded grants from the SFY 2008 allocation from the Tobacco Settlement Trust Fund to seven applicants. Total amount allocated to these projects is $2,115,694. A Request For Applications was issued Last spring for the SFY 2009 appropriations. On September 12, the Board awarded grants to nine applicants. Total amount allocated to these projects is $3,513,531. A second Request for Applications is underway for the SFY 2009 allocation and will close January 30, 2009.

Annual appropriations of $5 million plus interest earned on the Watershed Improvement Fund allowed the Board to issue two Request For Applications in 2009. On February 27, the Board awarded grants to seven applicants for a total of $2,366,861. On September 21, the Board awarded grants to thirteen applicants for a total of $5,120,832.
