The requirement to prove a society united by a body of law and customs to establish native title rights has been identified as a major hurdle to achieving native title recognition. The recent appeal decision of the Federal Court in Sampi on behalf of the Bardi and Jawi People v Western Australia [2010] opens the potential for a new judicial interpretation of society based on the internal view of native title claimants. The decision draws on defining features of legal positivism to inform the court’s findings as to the existence of a single Bardi Jawi society of ‘one people’ living under ‘one law’. The case of Bodney v Bennell [2008] is analysed through comparitive study of how the application of the received positivist framework may limit native title recognition. This paper argues that the framing of Indigenous law by reference to Western legal norms is problematic due to the assumptions of legal positivism and that an internal view based on Indigenous worldviews, which see law as intrinsically linked to the spiritual and ancestral connection to country, is more appropriate to determine proof in native title claims.

This book provides a comprehensive coverage of one of Australia’s most historic elections, which produced a hung parliament and a carefully crafted minority government that remains a heartbeat away from collapse, as well as Australia’s first elected woman Prime Minister and the Australian Greens’ first lower house Member of Parliament.

The volume considers the key contextual and possibly determining factors, such as: the role of leadership and ideology in the campaign; the importance of state and regional factors (was there evidence of the two or three speed economy at work?); and the role of policy areas and issues, including the environment, immigration, religion, gender and industrial relations. Contributors utilise a wide range of sources and approaches to provide comprehensive insights into the campaign. This volume notably includes the perspectives of the major political groupings, the ALP, the Coalition and the Greens; and the data from the Australian Election Survey. Finally we conclude with a detailed analysis of those 17 days that it took to construct a minority party government.

An analysis of 32 cases reported between July 2010 and September 2014 byprofessional disciplinary tribunals in New South Wales and Victoria againstmedical practitioners found guilty of inappropriately prescribing Sch 8 medications(mainly opioids) and Sch 4 drugs (mainly benzodiazepines) demonstrated, among others, a lengthy delay between the occurrence of the miscreant conduct and the conclusion of disciplinary proceedings. The study also raised questions about the appropriateness of utilising common criminal law theories of punishment and deterrence by non-judicial tribunals.

Ukrainians went to the polls in 2010 to elect a president for the fifth time since independence from the Soviet Union in 1991, electing Viktor Yanukovych with a narrow majority over Yulia Tymoshenko in the second round run-off on 7 February. This article provides a contextual introduction to the 2010 presidential election, an analysis of the campaign and the results and concludes with a discussion of post-election coalition building and what the election means for the consolidation of Ukrainian democracy and Ukraine’s European integration process.

Technique and physical contributions to ball delivery speed in fast bowling have been popular research topics in sports science. However, a common limiting factor of this work is the level of expertise of participants and lack of within bowler investigations (Salter et al., 2007). The relationship between technique, anthropometry and ball speed has not been comprehensively investigated among elite fast bowlers. The purpose of this study was to examine the relationship between technique, anthropometric variables and ball speed using both within- and betweenbowler analyses in a cross section of the Cricket Australia high performance pace pathway.

Esta monografía pretende revisar la incidencia de las redes sociales, tanto tradicionales como virtuales, en el proceso de construcción del movimiento "la Ola Verde" en las elecciones presidenciales de 2010. Este movimiento se constituyó en un fenómeno político y social efímero que en pocos meses logró competir contra maquinarias políticas ya consolidadas pero que no logró la victoria electoral anhelada. Este trabajo de grado está estructurado en tres secciones las cuales nacieron a partir de una caracterización de tres etapas que atravesó la Ola Verde, estos son: la génesis, el crecimiento y el declive del movimiento. De igual manera, la presente monografía analiza el rol de las emociones en las redes sociales tradicionales y en las redes sociales virtuales (Facebook y Twitter).

For applied sport scientists charged with developing talented performers an essential requirement is to identify components contributing to the development and maintenance of expertise. Previous qualitative analysis has revealed several psychological (e.g., mental focus, goal-setting and selfevaluation), socio-cultural (e.g. community and family support, cultural influence), physical (e.g., strength, height) and environmental (e.g., access to facilities and climate) constraints on successful Olympian development (Abbott et al., 2005). Open-ended interviews with expert athletes and/or expert coaches have been used to reveal competencies of elite performers to derive factors associated with success (Durand-Bush et al., 2002). However, the influence of these factors is likely to be sport-specific due to different task constraints and the changing nature of the performer-environment relationship through practice, coaching and competing (Vaeyens et al., 2008). So far, only one study on expertise acquisition in cricket has been undertaken. Weissensteiner, et al. (2009) found that development of expertise in cricket batting in Australia may be facilitated by early unstructured play (i.e. ‘backyard cricket’), a wide range of sport experience during development, and early exposure to playing with seniors.

In fast bowling, cricketers are expected to produce a range of delivery lines and lengths while maximising ball speed. From a coaching perspective, technique consistency has been typically associated with superior performance in these areas. However, although bowlers are required to bowl consistently, at the elite level they must also be able to vary line, length and speed to adapt to opposition batters’ strengths and weaknesses. The relationship between technique and performance variability (and consistency) has not been investigated in previous fast bowling research. Consequently, the aim of this study was to quantify both technique (bowling action and coordination) and performance variability in elite fast bowlers from Australian Junior and National Pace Squads. Technique variability was analysed to investigate whether it could be classified as functional or dysfunctional in relation to speed and accuracy.

This paper closely examines factors affecting students’ progression in their engineering programs through fieldwork conducted at three Australian universities. To extract clues on how specific teaching methods can be used to maximize learning, the investigation considered factors such as understanding how students take in, process and present information. A number of focus groups were conducted with students and the data gathered was combined with survey results of students’ and academics’ learning styles. The paper reports on the process followed, and provides some analysis of the gathered data, as part of an Australian Learning and Teaching Council, ALTC, Associate Fellowship program.
