La problemática que aborda este trabajo comprende el análisis de las implicaciones y del significado de la reafirmación del trámite de los recursos administrativos como un requisito de procedibilidad que el particular debe agotar para poder acudir a la jurisdicción administrativa cuando pretende dirimir una controversia originada en una decisión adoptada por una autoridad pública. Nos preguntamos, si con ello, se cumplió todo aquello que inspiró a los precursores de la expedición del nuevo código de procedimiento administrativo y de lo contencioso administrativo. La investigación se desarrolló a partir de un plan de trabajo divido en dos partes. En la primera, se analizó la doble connotación que caracteriza a los recursos administrativos, así como la evolución, la efectividad y la importancia de aquellos de cara a los privilegios de la administración pública. También se abordaron las modificaciones que el legislador ha efectuado a esta herramienta de autocontrol de las decisiones administrativas y la jurisprudencia expedida por el Consejo de Estado y la Corte Constitucional en esta materia. En la segunda parte, con el fin de establecer si la reafirmación del agotamiento del recurso de apelación como requisito de procedibilidad para acudir a la jurisdicción administrativa, traduce los propósitos del legislador al expedir el nuevo código administrativo y de lo contencioso administrativo, se plasmaron aspectos que debieron considerarse en esta reforma, en el marco de las tendencias de un Estado Social de Derecho y de la problemática de la congestión judicial que intenta afrontar el legislador. En ese marco, se explicaron los aspectos que permitieron constatar que los propósitos del legislador se desdibujaron al mantener la obligatoriedad de agotar los recursos administrativos para que el particular pueda someter una controversia a la jurisdicción administrativa.

The primary purpose of this chapter is to examine the effectiveness of common default provisions and the range of common law and equitable remedies available to a joint venture partner in the event of default by a co-venturer. Because of the various joint venture vehicles such as trusts, corporations, partnerships and others, it is proposed to deal only generally with these questions.

In some Queensland universities, Information Systems academics have moved out of Business Faculties. This study uses a pilot SWOT analysis to examine the ramifications of Information Systems academics being located within or outside of the Business Faculty. The analysis provides a useful basis for decision makers in the School studied, to exploit opportunities and minimise external threats. For Information Systems academics contemplating administrative relocation of their group, the study also offers useful insights. The study presages a series of further SWOT analyses to provide a range of perspectives on the relative merits of having Information Systems academics administratively located inside versus outside Business faculties.

In Australia seven schemes (apart from the Superannuation Complaints Tribunal) provide alternative dispute resolution services for complaints brought by consumers against financial services industry members. Recently the Supreme Court of New South Wales held that the decisions of one scheme were amenable to judicial review at the suit of a financial services provider member and the Supreme Court of Victoria has since taken a similar approach. This article examines the juristic basis for such a challenge and contends that judicial review is not available, either at common law or under statutory provisions. This is particularly the case since Financial Industry Complaints Service Ltd v Deakin Financial Services Pty Ltd (2006) 157 FCR 229; 60 ACSR 372 decided that the jurisdiction of a scheme is derived from a contract made with its members. The article goes on to contend that the schemes are required to give procedural fairness and that equitable remedies are available if that duty is breached.

UCON is an emerging access control framework that lacks an administration model. In this paper we define the problem of administration and propose a novel administrative model. At the core of this model is the concept of attribute, which is also the central component of UCON. In our model, attributes are created by the assertions of subjects, which ascribe properties/rights to other subjects or objects. Through such a treatment of attributes, administration capabilities can be delegated from one subject to another and as a consequence UCON is improved in three aspects. First, immutable attributes that are currently considered as external to the model can be incorporated and thereby treated as mutable at- tributes. Second, the current arbitrary categorisation of users (as modifiers of attributes), to system and administrator can be removed. Attributes and objects are only modifiable by those who possess administration capability over them. Third, the delegation of administration over objects and properties that is not currently expressible in UCON is made possible.

The nursing profession in Australia and other OECD countries such as the USA and the UK, have focused on ways to recruit and retain nurses (e.g., Bartram, Joiner, & Stanton, 2004). Research has shown that the most common factors impacting negatively on retention include sources of nursing stress such as workload and work environment. While the literature has shown that nursing staff encounter these stressors, studies do not examine the effects of stress caused by an increasing degree of administrative demand placed on nurses, caused by the new public management (NPM) reform in public and nonprofit (PNP) health care organizations. At best, some studies have alluded to some aspects of administrative related stressors (vis-a-vis nursing related stressors such as death, sickness, etc), but they have not been examined in any detail. Similarly, extant research has not examined how nurses cope with these administrative stressors. These will be the main aims of the present study.

Elder law is a growing area of legal practice due to the increasing numbers and proportions of older people in Australian society. The older generation has greater access to financial resources by way of retirement capital than ever before. Coupled with the current generation’s high level of debt and an increasing dependence on inheritances to meet these debts, this has created an environment in which the potential for elder financial abuse is increasing. This article examines how equitable remedies can be used as an avenue of redress for elder financial abuse. The effectiveness of these remedies, and in particular the prospect of a costs order being awarded against the perpetrator of the abuse in successful claims, may act as a deterrent and assist in preventing elder financial abuse from occurring.
