La thérapie par le plein air représente une alternative aux programmes d’intervention conventionnels pour jeunes antisociaux. Elle donne à ses participants l’occasion de modifier leurs pensées et leurs comportements dans un contexte d’expédition, à travers la participation à diverses activités de plein air. Ce faisant, ils développent leur répertoire d’habiletés personnelles et sociales, ce qui pourrait faciliter le désistement d’une conduite antisociale. Un devis expérimental prospectif, avec pré-test et post-tests à trois et six mois, a été utilisé afin d’évaluer l’effet de la durée d’une intervention de thérapie par le plein air sur le niveau d’antisocialité et l’insertion socio-professionnelle de jeunes contrevenants. De plus, l’effet potentiellement médiateur des progrès réalisés au chapitre des habiletés interpersonnelles et de la motivation d’accomplissement a été examiné. Un échantillon de 220 jeunes contrevenants a été observé, divisé aléatoirement selon deux conditions expérimentales, soit un programme de 8 à 10 jours et un programme de 17 à 20 jours. Il apparaît que la durée n’a pas d’effet direct significatif sur le niveau d’antisocialité et l’insertion socio-professionnelle des participants. En revanche, la durée du programme a un effet positif indirect sur le niveau d’antisocialité subséquent des participants, à travers l’amélioration des habiletés interpersonnelles et la motivation d’accomplissement des sujets. Aucune des variables mises en jeu n’a eu un impact significatif sur les progrès observés au niveau de l’insertion socio-professionnelle des sujets. La thérapie par le plein air semble favoriser le désistement d’une conduite antisociale en encourageant le développement de certaines habiletés personnelles qui font habituellement défaut chez les jeunes antisociaux.

Cette étude vise à comprendre la place du sentiment d’impuissance de l’intervenant dans l’établissement d’une alliance thérapeutique. La perception des intervenants à l’égard du sentiment d’impuissance et les conséquences possibles qu’ils lui reconnaissent sont analysées. Par les moyens développés par les intervenants pour contrer ce sentiment d’impuissance, des pistes de solutions sont proposées. Par une méthodologie qualitative, vingt-cinq entrevues semi-dirigées ont été réalisées dans le cadre de la recherche «L’identification des interventions qui permettent de bâtir une alliance thérapeutique avec les jeunes contrevenants : un enjeu de première importance» du professeur Louis-Georges Cournoyer de l’École de criminologie de l’Université de Montréal. Elles constituent les données principales de la présente étude. Un groupe de discussion, réalisé en milieu communautaire, a permis de les compléter. Les ruptures d’alliance thérapeutique constituent un contexte favorable au développement du sentiment d’impuissance de l’intervenant, conditionnellement au soutien de l’équipe et à la perception qu’à l’intervenant de son rôle et de son contrôle. Le sentiment d’impuissance peut mener à une remise en question positive. Toutefois, il peut aussi être à l’origine du développement de l’impuissance apprise, qui se traduit par les déficits cognitif, motivationnel et affectif. Parmi les autres conséquences du sentiment d’impuissance, une lutte s’exprime par l’évitement, l’expression de la colère et le contrôle, qui ne sont pas souhaitables en contexte d’intervention. En misant sur le soutien de l’équipe ainsi que sur la perception des intervenants à l’égard de leur rôle et de leur contrôle, il est possible de prévenir et de contrer le sentiment d’impuissance.

Concerned professionals in the juvenile justice field frequently express concern for effective programs that help youth offenders successfully rejoin society. This mixed-method pilot study, involved detention home teens functioning as tutors for special education students in a public school. Tutors experienced gains in self-esteem and overall school/social attitude.

Much has been written about youth crime, justice and corrections in Hong Kong in the past three decades, in particular, about the historical roots of the youth justice system, causes of juvenile delinquency, and the outcomes of different rehabilitative programmes for young offenders. However, little is known in theory, practice and policy about how community-based and custodial sentences can achieve the goals of rehabilitation and correction for young offenders. In this paper, the author analyses the purposes of penal measures with reference to the classical theories of punishment, rather than empirical data or statistics. The author argues that a community-based sentence, in many respects, performs as or more effectively than a custodial programme in achieving the various sentencing aims.

Cape Verdean prison population raised 100% in the last ten years: in this paper I offer an interpretation of this disturbing figure, addressing the issue of young offenders and children in conflict with the law, the perception of youth crime in Cape Verde, and how the government has recently dealt with these issues. Cape Verde currently deploys a repressive approach to the issue of youth crime: in this draconian context, I will follow the application of policies and laws targeting juvenile delinquents as well as the public and media discourse on the issue. At the same time, through interviews with younger inmates in prisons and institutions, I will relocate young offenders’ behavior and activity within their wider social context, providing urgently needed data on the cultural and social dimensions of juvenile offending and violence.

This report, the Full Report, is the culmination of the Task Force’s responsibilities as set out in Executive Order 5, dated October 30, 2007. The Executive Order specifies a number of goals and report requirements.There is a commonly held perception that the use of detention may serve as a deterrent to future delinquency. Data in this report reflect that approximately 40% of youth detained in 2006 were re-detained in 2006. Research conducted by national experts indicates that, particularly for low risk/low level offenders, that the use of detention is not neutral, and may increase the likelihood of recidivism. Comparable data for Iowa are not available (national data studied for this report provide level of risk, but risk level related to detention is not presently available for Iowa). The Task Force finds no evidence suggesting that recidivism levels (as related to detention risk) in Iowa should be different than found in other states. Data in this report also suggest that detention is one of the juvenile justice system’s more costly sanctions ($257 - $340 per day). Other sites and local jurisdictions have been able to redirect savings from the reduced use of juvenile detention to support less costly, community-based detention alternatives without compromising public safety.

In order for young people to meaningfully participate in the criminal justice system they must possess an understanding of their rights and legal procedures. To examine their understanding, 50 young people between the ages of 13-17 who received an extrajudicial sanction or were sentenced to probation, were recruited from the Finch Courthouse in Toronto, Ontario. Semi-structured interviews were conducted with participants regarding their understanding of their due process rights and their rights under the United Nations Convention on the Rights of the Child. Youth who indicated involvement in plea bargaining were also asked about their experiences during this procedure. In addition, the present study examined youths' perceptions of power differences in their interactions with criminal justice officials working within an institution that has tremendous control over offenders' lives. The results indicate that while youth seem to have some understanding oftheir rights and legal procedures, they nevertheless feel ill-equipped to invoke their rights in an adult-led criminal justice system. Furthermore, while past literature has often conceptualized youth understanding based on age (e.g., Crawford & Bull, 2006) the findings of the present study demonstrate that while age plays some role, the lack of power experienced by youth vis-a-vis adults, and specifically criminal justice professionals, has the most bearing on the inability of youth to exercise their rights.

The current study examined how disability and the concepts of risk, need and responsivity are understood by criminal justice professionals and inform their perceptions of young offenders with ID at sentencing under the ‘different but equal’ philosophy. Semi-structured interviews were conducted with 11 lawyers and 8 mental health workers across 6 major urban areas in Ontario. Participants primarily perceived ID through a medical discourse, overlooking social and structural barriers that, in some cases, may hinder adherence to sentencing dispositions. Specifically, participants discussed balancing the reduced culpability of offenders (e.g., intent) – justifying lenient sentencing – with public safety concerns (i.e., ID viewed as a barrier to rehabilitation) – justifying increasing the severity of sentences. Participants assessed clients with ID and their risks, needs and responsivity within the context of other legal factors: criminal history, severity of the offence, and YCJA objectives. Participants articulated the importance of tailored courthouse identification programs, services/funding, and education/training.

This study examines the common belief that misdemeanor offences are usually committed by individuals from lower socio-economic classes. 1 suggest that this is a misconception and that individuals from all classes commit misdemeanors. The data are from the Monitoring the Future: A Continuing Study of American Youth (12thGrade Survey), 2000-2008 (University of Michigan. Institute for Social Research Survey Research Center). I will focus on 12th grade students from the years 2000 to 2008. For the purposes of this study, a misdemeanor is less severe than a felony and includes such crimes as disorderly conduct, shoplifting, public drunkenness, or minor assault. In addition, conviction for a misdemeanor usually results in a fine or imprisonment in a jail for less than a year. I will examine evidence tor the common belief about the characteristics of misdemeanor offenders and explore other influences on those who commit misdemeanors. This research shows that family relationships, the importance of religion to the respondent, and race have an effect on whether an individual commits a misdemeanor. Considerable funds have been allocated in the area of juvenile justice in attempts to reduce and prevent the problem of juvenile delinquency. Much of these funds have been funneled to various community-level intervention programs. This dissertation reports the results of a study that examined the effects of one such program, the Juvenile Intervention Facility (JIF) in Broward County, Florida, on reducing the number of cases handled judicially by the Juvenile Court in that county. ^ Juvenile justice policy, which precipitated the creation of the JIF program, assumed that more structured and integrative efforts at the point of entry into the juvenile justice system would lead to greater diversion from the courts to much needed intervention services. By virtue of this process, the number of juveniles handled judicially by the courts was expected to decrease and future delinquent behavior would be prevented. Archival data from four fiscal years were examined, two years pre-JIF, two years post-JIF, a third-year follow-up, and a concurrent outcome measure corresponding to the first year of JIF operations. Data included all juvenile cases referred during the fiscal years defined for Broward and St. Lucie Counties, the state of Florida, and the United States. The study tested four hypotheses: (a) the JIF would reduce the number of cases handled judicially in Broward County Juvenile Court, (b) the decrease in judicially handled cases would be greater for females than for males, (c) there would be greater decreases in judicially handled cases for whites than non-whites, (d) there would be greater decreases in judicial handling for younger than older offenders. Bivariate analyses were conducted, consisting of chi square tests, to test the hypotheses. ^ Results indicate that the impact of the JIF was in the opposite direction of what was expected in that more juvenile offenders were handled judicially through juvenile court. This fact points to the possibility that the JIF has failed to provide the intended consequences of the policy. In the discussion, these “unintended” consequences are addressed in the context of juvenile justice policy creation and the competing constituencies involved in such policy development. ^

Objectif. Les jeunes crossover sont définis comme des adolescents qui sont à la fois victimes de maltraitance et délinquants juvéniles. L'objectif de ce mémoire est d’examiner les relations entre les paramètres de la maltraitance (ex., récurrence, sous-types et variété) et les paramètres de la délinquance juvénile (ex., précocité, volume, variété, gravité moyenne et présence de sous-types) vécus par les jeunes crossover. Méthodes. La source des données est constituée de rapports officiels pour tous les adolescents et adolescentes québécois qui ont plaidé coupables ou ont été reconnus coupables d'un crime entre le 1e janvier 2005 et le 31 décembre 2010. D'abord, un portrait des jeunes crossover québécois est dressé à l’aide de statistiques descriptives. Ensuite, des analyses multivariées sont utilisées pour déterminer si les paramètres de la maltraitance prédisent les différentes dimensions de la délinquance et pour examiner les différences selon le sexe. Résultats. La délinquance des jeunes crossover est plus importante que celle des délinquants non-maltraités. Les expériences différentielles de la maltraitance sont liées à des paramètres hétérogènes de la délinquance juvénile. La récurrence de la maltraitance est un prédicteur important des paramètres de la délinquance ultérieure. De plus, la maltraitance est particulièrement influente sur la délinquance des garçons. Implications. Les interventions au sein des systèmes de la protection de la jeunesse et de la justice juvénile doivent être adaptées afin d'identifier les jeunes à risque de délinquance grave, de cibler les dimensions spécifiques de la maltraitance et d’entraver leurs liens à la délinquance ultérieure. L'intervention doit être privilégiée pour les victimes de multiples incidents de maltraitance et pour les garçons victimes de maltraitance.
