Les Communautés européennes et l'Union européenne ont toujours exprimé leur engagement à respecter les droits de l'homme. Depuis la première Convention intergouvernementale chargée de la rédaction du projet de Charte des Droits Fondamentaux (1999-2001), une deuxième Convention a été organisée. La dernière a proposé le projet de Constitution pour l'Union européenne qui par la suite a été rejeté dans deux referenda nationaux et a soulevé de nombreuses questions sur la légitimité de l'Union et son avenir. Récemment, le Conseil de l'Union Européenne a décidé d'abandonner le projet de Constitution pour l'Union européenne et a ouvert la voie vers le traité modificatif. À part la légitimité de l'Union en tant que organisation internationale ou ordre juridique international et tous les problèmes auxiliaires que la constitutionnalisation implique, ce processus est inextricablement lié au sujet très controversé de la politique des droits de l'homme. Conformément au traité constitutionnel, la Charte d'un côté et la Convention européenne des droits de l'Homme de l'autre seraient devenu parties intégrantes du système constitutionnel européen. Par contre, le nouveau traité modificatif comprendra juste un renvoi à la Charte. Néanmoins, le problème de l'Union européenne demeure l'absence d'une politique cohérente avec toutes ses éléments - des instruments écrits contraignants, l'efficacité des voies de recours, une agence des droits de l'homme, un budget et un plan horizontal. Tandis que le traité constitutionnel sans pour autant résoudre tous ces problèmes a représenté un grand pas en avant dans cette direction, le nouveau traité semble être un compromis.

L’Europe est à l’heure actuelle en pleine mutation. D’une part, elle s’est élargie en acceptant de nouveaux États passant ainsi de quinze à vingt-cinq membres. D’autre part, elle s’est dotée d’un traité constitutionnel appelé Projet de traité établissant une Constitution pour l'Europe. Celui-ci a été approuvé en juin 2004. Il sera au cœur de notre recherche. Doter l’Union européenne d’un nouvel acte conduit incontestablement à se poser une multitude de questions concernant l’acte lui-même mais également ses conséquences. Que faut-il entendre par « traité établissant une Constitution pour l’Europe » ? Quels seront les effets d’un tel acte au regard du droit communautaire existant et des législations nationales ? Cette recherche répondra à ces questions et offrira un éclairage particulier du traité. Elle sera plus particulièrement axée sur la Cour de justice qui assure le respect du droit dans l’interprétation et l’application de la Constitution (article 28 du projet). Comment les juges devront-ils se comporter par rapport au traité ? Leur action sera-t-elle légitime ? Le débat sera ouvert sur l’interprétation que les juges feront de cette nouvelle norme.

Les Cris de la Baie James sont parmi les premiers bénéficiaires d'un traité moderne qui prévoit un rôle déterminant pour les Autochtones dans la gestion de l'environnement et du développement des ressources naturelles. À travers la Convention de la Baie James et du Nord québécois, les Cris participent à la gestion de l'environnement et sont assurés d'un droit de regard sur les projets de développement futurs dans l'ensemble de leur partie du territoire conventionné. Cette participation, qui est le fruit d'une intense négociation, est aujourd'hui renforcée, à travers des ententes de coopération subséquentes, grâce notamment, à l'émergence du mouvement écologiste qui a contribué à la reconnaissance d'un rôle particulier pour les Autochtones à l'égard de l'environnement. Par l'examen des mécanismes de protection de l'environnement, notamment le processus d'évaluation environnementale, aux termes du chapitre 22 de la Convention de la Baie James et du Nord québécois, cette étude met en lumière l'importance du processus de négociation et des droits qui en résultent par rapport à ceux reconnus en vertu de la doctrine des droits ancestraux telle que développée récemment par les tribunaux canadiens.

In old, phosphorus (P)-impoverished habitats, root specializations such as cluster roots efficiently mobilize and acquire P by releasing large amounts of carboxylates in the rhizosphere. These specialized roots are rarely mycorrhizal. We investigated whether Discocactus placentiformis (Cactaceae), a common species in nutrient-poor campos rupestres over white sands, operates in the same way as other root specializations. Discocactus placentiformis showed no mycorrhizal colonization, but exhibited a sand-binding root specialization with rhizosheath formation. We first provide circumstantial evidence for carboxylate exudation in field material, based on its very high shoot manganese (Mn) concentrations, and then firm evidence, based on exudate analysis. We identified predominantly oxalic acid, but also malic, citric, lactic, succinic, fumaric, and malonic acids. When grown in nutrient solution with P concentrations ranging from 0 to 100 μM, we observed an increase in total carboxylate exudation with decreasing P supply, showing that P deficiency stimulated carboxylate release. Additionally, we tested P solubilization by citric, malic and oxalic acids, and found that they solubilized P from the strongly P-sorbing soil in its native habitat, when the acids were added in combination and in relatively low concentrations. We conclude that the sand-binding root specialization in this nonmycorrhizal cactus functions similar to that of cluster roots, which efficiently enhance P acquisition in other habitats with very low P availability.

Background : In tropical countries, losses caused by bovine tick Rhipicephalus (Boophilus) microplus infestation have a tremendous economic impact on cattle production systems. Genetic variation between Bos taurus and Bos indicus to tick resistance and molecular biology tools might allow for the identification of molecular markers linked to resistance traits that could be used as an auxiliary tool in selection programs. The objective of this work was to identify QTL associated with tick resistance/susceptibility in a bovine F2 population derived from the Gyr (Bos indicus) x Holstein (Bos taurus) cross. Results: Through a whole genome scan with microsatellite markers, we were able to map six genomic regions associated with bovine tick resistance. For most QTL, we have found that depending on the tick evaluation season (dry and rainy) different sets of genes could be involved in the resistance mechanism. We identified dry season specific QTL on BTA 2 and 10, rainy season specific QTL on BTA 5, 11 and 27. We also found a highly significant genome wide QTL for both dry and rainy seasons in the central region of BTA 23. Conclusions: The experimental F2 population derived from Gyr x Holstein cross successfully allowed the identification of six highly significant QTL associated with tick resistance in cattle. QTL located on BTA 23 might be related with the bovine histocompatibility complex. Further investigation of these QTL will help to isolate candidate genes involved with tick resistance in cattle.

Mature weight breeding values were estimated using a multi-trait animal model (MM) and a random regression animal model (RRM). Data consisted of 82 064 weight records from 8 145 animals, recorded from birth to eight years of age. Weights at standard ages were considered in the MM. All models included contemporary groups as fixed effects, and age of dam (linear and quadratic effects) and animal age as covariates. In the RRM, mean trends were modelled through a cubic regression on orthogonal polynomials of animal age and genetic maternal and direct and maternal permanent environmental effects were also included as random. Legendre polynomials of orders 4, 3, 6 and 3 were used for animal and maternal genetic and permanent environmental effects, respectively, considering five classes of residual variances. Mature weight (five years) direct heritability estimates were 0.35 (MM) and 0.38 (RRM). Rank correlation between sires' breeding values estimated by MM and RRM was 0.82. However, selecting the top 2% (12) or 10% (62) of the young sires based on the MM predicted breeding values, respectively 71% and 80% of the same sires would be selected if RRM estimates were used instead. The RRM modelled the changes in the (co) variances with age adequately and larger breeding value accuracies can be expected using this model.

Despite its importance to agriculture, the genetic basis of heterosis is still not well understood. The main competing hypotheses include dominance, overdominance, and epistasis. NC design III is an experimental design that. has been used for estimating the average degree of dominance of quantitative trait 106 (QTL) and also for studying heterosis. In this study, we first develop a multiple-interval mapping (MIM) model for design III that provides a platform to estimate the number, genomic positions, augmented additive and dominance effects, and epistatic interactions of QTL. The model can be used for parents with any generation of selling. We apply the method to two data sets, one for maize and one for rice. Our results show that heterosis in maize is mainly due to dominant gene action, although overdominance of individual QTL could not completely be ruled out due to the mapping resolution and limitations of NC design III. For rice, the estimated QTL dominant effects could not explain the observed heterosis. There is evidence that additive X additive epistatic effects of QTL could be the main cause for the heterosis in rice. The difference in the genetic basis of heterosis seems to be related to open or self pollination of the two species. The MIM model for NC design III is implemented in Windows QTL Cartographer, a freely distributed software.

Female choice has rarely been documented in reptiles. In this study we examined the variation, condition-dependence and female preference for a range of male morphological and colour traits in the agamid lizard, Ctenophorus ornatus. Colour traits were measured with reflectance spectrophotometry which allows the accurate quantification of colour traits independent of the human visual system. All the colour traits varied greatly in brightness but only the throat showed high variation in the spectral shape. For the morphological traits, chest patch size showed the highest amount of variation and was also condition-dependent. Males with a larger chest patch also had a patch which was a darker black. Female mate choice trials were conducted on male chest patch size and body size, which is the trait females have preferred in other lizard species. Females showed no preference, measured as spatial association, for larger males or males with bigger chest patches. In post-hoc tests females did not prefer males with brighter throats or darker chests, Our findings suggest that females show no spatial discrimination between males on the basis of a range of traits most expected to influence female choice.

Background: Amygdala-orbitofrontal cortical (OFC) functional connectivity (FC) to emotional stimuli and relationships with white matter remain little examined in bipolar disorder individuals (BD). Methods: Thirty-one BD (type 1; n = 17 remitted; n = 14 depressed) and 24 age- and gender-ratio-matched healthy individuals (HC) viewed neutral, mild, and intense happy or sad emotional faces in two experiments. The FC was computed as linear and nonlinear dependence measures between amygdala and OFC time series. Effects of group, laterality, and emotion intensity upon amygdala-OFC FC and amygdala-OFC FC white matter fractional anisotropy (FA) relationships were examined. Results: The BD versus HC showed significantly greater right amygdala-OFC FC (p <= .001) in the sad experiment and significantly reduced bilateral amygdala-OFC FC (p = .007) in the happy experiment. Depressed but not remitted female BD versus female HC showed significantly greater left amygdala-OFC FC (p = .001) to all faces in the sad experiment and reduced bilateral amygdala-OFC FC to intense happy faces (p = .01). There was a significant nonlinear relationship (p = .001) between left amygdala-OFC FC to sad faces and FA in HC. In BD, antidepressants were associated with significantly reduced left amygdala-OFC FC to mild sad faces (p = .001). Conclusions: In BD, abnormally elevated right amygdala-OFC FC to sad stimuli might represent a trait vulnerability for depression, whereas abnormally elevated left amygdala-OFC FC to sad stimuli and abnormally reduced amygdala-OFC FC to intense happy stimuli might represent a depression state marker. Abnormal FC measures might normalize with antidepressant medications in BD. Nonlinear amygdala-OFC FC-FA relationships in BID and HC require further study.

Objective: Impulsivity is associated with the clinical outcome and likelihood of risky behaviors among bipolar disorder (BD) patients. Our previous study showed an inverse relationship between impulsivity and orbitofrontal cortex (OFC) volume in healthy subjects. We hypothesized that BD patients would show an inverse relationship between impulsivity and volumes of the OFC, anterior cingulate cortex (ACC), medial prefrontal cortex, and amygdala, which have been implicated in the pathophysiology of BD. Methods: Sixty-three BD patients were studied (mean +/- SD age = 38.2 +/- 11.5 years; 79% female). The Barratt Impulsiveness Scale (BIS), version 11A, was used to assess trait impulsivity. Images were processed using SPM2 and an optimized voxel-based morphometry protocol. We examined the correlations between BIS scores and the gray matter (GM) and white matter (WM) volumes of the prespecified regions. Results: Left rostral ACC GM volume was inversely correlated with the BIS total score (t = 3.95, p(corrected) = 0.003) and the BIS motor score (t = 5.22, p(corrected) < 0.001). In contrast to our hypothesis, OFC volumes were not significantly associated with impulsivity in BD. No WM volume of any structure was significantly correlated with impulsivity. No statistical association between any clinical variable and the rostral ACC GM volumes reached significance. Conclusions: Based on our previous findings and the current results, impulsivity may have a different neural representation in BD and healthy subjects, and the ACC may be involved in the pathophysiology of abnormal impulsivity regulation in BD patients.

Neuroimaging studies in bipolar disorder report gray matter volume (GMV) abnormalities in neural regions implicated in emotion regulation. This includes a reduction in ventral/orbital medial prefrontal cortex (OMPFC) GMV and, inconsistently, increases in amygdala GMV. We aimed to examine OMPFC and amygdala GMV in bipolar disorder type 1 patients (BPI) versus healthy control participants (HC), and the potential confounding effects of gender, clinical and illness history variables and psychotropic medication upon any group differences that were demonstrated in OMPFC and amygdala GMV Images were acquired from 27 BPI (17 euthymic, 10 depressed) and 28 age- and gender-matched HC in a 3T Siemens scanner. Data were analyzed with SPM5 using voxel-based morphometry (VBM) to assess main effects of diagnostic group and gender upon whole brain (WB) GMV. Post-hoc analyses were subsequently performed using SPSS to examine the extent to which clinical and illness history variables and psychotropic medication contributed to GMV abnormalities in BPI in a priori and non-a priori regions has demonstrated by the above VBM analyses. BPI showed reduced GMV in bilateral posteromedial rectal gyrus (PMRG), but no abnormalities in amygdala GMV. BPI also showed reduced GMV in two non-a priori regions: left parahippocampal gyrus and left putamen. For left PMRG GMV, there was a significant group by gender by trait anxiety interaction. GMV was significantly reduced in male low-trait anxiety BPI versus male low-trait anxiety HC, and in high-versus low-trait anxiety male BPI. Our results show that in BPI there were significant effects of gender and trait-anxiety, with male BPI and those high in trait-anxiety showing reduced left PMRG GMV. PMRG is part of medial prefrontal network implicated in visceromotor and emotion regulation. (C) 2008 Elsevier Ireland Ltd. All rights reserved.
