The implementation of term limits on state legislators has provided a wealth of data for study. Florida, the second largest state in the Union with term limits, has not been comprehensively studied. This research examines the effects of term limits on electoral competition, member composition, legislator career paths, legislative leadership, and intra- and inter-governmental influences on Florida's legislature. This study looks at the Florida legislature from 1992 when term limits were enacted through 2004, three electoral cycles in which term limits have been in effect. This study uses both quantitative and qualitative data where appropriate. Electoral data is used to assess electoral and demographic effects, as well as member career trajectories. Interview data with current and former legislators, lobbyists, and executive branch officials is used to analyze both changes in legislative organization and intra- and inter-governmental influences on the legislative process. Term limits has only created greater competition when a legislative seat opens and has actually created a greater advantage for incumbents. Women and minorities have only made minimal gains in winning seats post-term limits. Newly elected legislators are not political novices with a vast majority having previous elective experience. Leadership is more centralized under term limits and the Senate has gained an advantage over the more inexperienced House. Lastly, the influence of staff, lobbyists, and most importantly, the governor has greatly increased under term limits. This research finds that term limits have not produced the consequences that proponents had envisioned.^

Occupational standards concerning allowable concentrations of chemical compounds in the ambient air of workplaces have been established in several countries worldwide. With the integration of the European Union (EU), there has been a need of establishing harmonised Occupational Exposure Limits (OEL). The European Commission Directive 95/320/EC of 12 July 1995 has given the tasks to a Scientific Committee for Occupational Exposure Limits (SCOEL) to propose, based on scientific data and where appropriate, occupational limit values which may include the 8-h time-weighted average (TWA), short-term limits/excursion limits (STEL) and Biological Limit Values (BLVs). In 2000, the European Union issued a list of 62 chemical substances with Occupational Exposure Limits. Of these, 25 substances received a "skin" notation, indicating that toxicologically significant amounts may be taken up via the skin. For such substances, monitoring of concentrations in ambient air may not be sufficient, and biological monitoring strategies appear of potential importance in the medical surveillance of exposed workers. Recent progress has been made with respect to formulation of a strategy related to health-based BLVs.

With advancements in the development of visible light responsive catalysts for H2 production frequently being reported, photocatalytic water splitting has become an attractive method as a potential ‘solar fuel generator’. The development of novel photo reactors which can enhance the potential of such catalyst, however, is rarely reported. This is particularly important as many reactor configurations are mass transport limited, which in term limits the efficiency of more effective photocatalysts in larger scale applications. This paper describes the performance of a novel fluidised photo reactor for the production of H2 over two catalysts under UV-Visible light and natural solar illumination. Catalysts Pt-C3N4 and NaTaO3.La were dispersed in the reactor and the rate of H2 was determined by GC-TCD analysis of the gas headspace. The unit was an annular reactor constructed from stainless steel 316 and quartz glass with a propeller located in the base to control fluidisation of powder catalysts. Reactor properties such as propeller rotational speed were found to enhance the photo activity of the system through the elimination of mass transport limitations and increasing light penetration. The optimum conditions for H2 evolution were found to be a propeller rotational speed of 1035 rpm and 144 W of UV-Visible irradiation, which produced a rate of 89 µmol h-1 g-1 over Pt-C3N4. Solar irradiation was provided by the George Ellery Hale Solar Telescope, located at the California Institute of Technology.

De grandes enquêtes en milieu scolaire, au Québec comme ailleurs, ont documenté depuis les années 2000 la portée des violences homophobes, particulièrement à l’école secondaire, ainsi que leurs impacts négatifs sur les élèves qui en sont victimes, qu’ils s’identifient ou non comme lesbiennes, gais, bisexuel(le)s ou en questionnement (LGBQ). La diffusion des résultats de ces enquêtes, ainsi que les constats similaires d’acteurs sur le terrain, ont fait accroitre les appels à la vigilance des écoles quant aux discriminations homophobes pouvant prendre forme en leur enceinte. Plusieurs des responsabilités résultant de cette mobilisation ont échoué par défaut aux enseignants, notamment en raison de leur proximité avec leurs élèves. Cependant, malgré la panoplie de publications et de formations visant explicitement à les outiller à ce sujet, les enseignants rapportent de manière consistante manquer de formation, d’habiletés, de soutien et d’aise à l’idée d’intervenir contre l’homophobie ou de parler de diversité sexuelle en classe. Cette thèse de doctorat vise à comprendre les pratiques d’intervention et d’enseignement que rapportent avoir les enseignants de l’école secondaire québécoise, toutes orientations sexuelles confondues, par rapport à la diversité sexuelle et à l’homophobie. Dans une perspective interdisciplinaire, nous avons interrogé la sociologie de l’éducation, les études de genre (gender studies) et les études gaies et lesbiennes, ainsi qu’emprunté aux littératures sur les pratiques enseignantes et sur l’intervention sociale. Les données colligées consistent en des entrevues semi-structurées menées auprès de 22 enseignants du secondaire, validées auprès de 243 enseignants, par le biais d’un questionnaire en ligne. Étayés dans trois articles scientifiques, les résultats de notre recherche permettent de mieux saisir la nature des pratiques enseignantes liées à la diversité sexuelle, mais également les mécanismes par lesquels elles viennent ou non à être adoptées par les enseignants. Les témoignages des enseignants ont permis d’identifier que les enseignants sont globalement au fait des attentes dont ils font l’objet en termes d’intervention contre l’homophobie. Ceci dit, en ce qu’ils sont guidés dans leurs interventions par le concept limité d’homophobie, ils ne paraissent pas toujours à même de saisir les mécanismes parfois subtils par lesquels opèrent les discriminations sur la base de l’orientation sexuelle, mais aussi des expressions de genre atypiques. De même, si la plupart disent condamner vertement l’homophobie dont ils sont témoins, les enseignants peuvent néanmoins adopter malgré eux des pratiques contribuant à reconduire l’hétérosexisme et à alimenter les mêmes phénomènes d’infériorisation que ceux qu’ils cherchent à combattre. Sauf exception, les enseignants tendent à comprendre le genre et l’expression de genre davantage comme des déterminants de type essentialiste avec lesquels ils doivent composer que comme des normes scolaires et sociales sur lesquelles ils peuvent, comme enseignants, avoir une quelconque influence. Les stratégies de gestion identitaire des enseignants LGB influencent les pratiques qu’ils rapportent être en mesure d’adopter. Ceux qui optent pour la divulgation, totale ou partielle, de leur homosexualité ou bisexualité peuvent autant rapporter adopter des pratiques inclusives que choisir de se tenir à distance de telles pratiques, alors que ceux qui favorisent la dissimulation rapportent plutôt éviter autant que possible ces pratiques, de manière à se garder de faire face à des situations potentiellement délicates. Également, alors que les enseignants LGB étaient presque exclusivement vus jusqu’ici comme ceux chez qui et par qui se jouaient ces injonctions à la vie privée, les enseignants hétérosexuels estiment également être appelés à se positionner par rapport à leur orientation sexuelle lorsqu’ils mettent en œuvre de telles pratiques. Nos résultats révèlent un double standard dans l’évocation de la vie privée des enseignants. En effet, la divulgation d’une orientation hétérosexuelle, considérée comme normale, est vue comme conciliable avec la neutralité attendue des enseignants, alors qu’une révélation similaire par un enseignant LGB est comprise comme un geste politique qui n’a pas sa place dans une salle de classe, puisqu’elle se fait au prix du bris d’une présomption d’hétérosexualité. Nos résultats suggèrent qu’il existe de fortes prescriptions normatives relatives à la mise en genre et à la mise en orientation sexuelle à l’école. Les enseignants s’inscrivent malgré eux dans cet environnement hétéronormatif. Ils peuvent être amenés à y jouer un rôle important, que ce soit en contribuant à la reconduction de ces normes (par exemple, en taisant les informations relatives à la diversité sexuelle) ou en les contestant (par exemple, en expliquant que certains stéréotypes accolés à l’homosexualité relèvent d’aprioris non fondés). Les discours des enseignants suggèrent également qu’ils sont traversés par ces normes. Ils peuvent en effet choisir de se conformer aux attentes normatives dont ils font l’objet (par exemple, en affirmant leur hétérosexualité), ou encore d’y résister (par exemple, en divulguant leur homosexualité à leurs élèves, ou en évitant de conforter les attentes dont ils font l’objet) au risque d’être conséquemment pénalisés. Bien entendu, cette influence des normes de genre diffère d’un enseignant à l’autre, mais semble jouer autant sur les enseignants hétérosexuels que LGB. Les enseignants qui choisissent de contester, explicitement ou implicitement, certaines de ces normes dominantes rapportent chercher des appuis formels à leurs démarches. Dans ce contexte, une telle quête de légitimation (par exemple, la référence aux règlements contre l’homophobie, la mobilisation des similitudes entre l’homophobie et le racisme, ou encore le rapprochement de ces enseignements avec les apprentissages prescrits pour leur matière) est à comprendre comme un outillage à la contestation normative. La formation professionnelle des enseignants sur l’homophobie et sur la diversité sexuelle constitue un autre de ces outils. Alors que les enseignants québécois continuent d’être identifiés comme des acteurs clés dans la création et le maintien d’environnements scolaires non-discriminatoires et inclusifs aux réalités de la diversité sexuelle, il est impératif de les appuyer en multipliant les signes formels tangibles sur lesquelles leurs initiatives peuvent prendre appui (politiques explicites, curriculum scolaire inclusif de ces sujets, etc.). Nos résultats plaident en faveur d’une formation enseignante sur la diversité sexuelle, qui ferait partie du tronc commun de la formation initiale des maîtres. Chez les enseignants en exercice, il nous apparait préférable de miser sur une accessibilité accrue des formations et des outils disponibles. En réponse toutefois aux limites que pose à long terme une approche cumulative des formations spécifiques portant sur différents types d’oppressions (l’homophobie, le racisme, le sexisme, etc.), nous argumentons en faveur d’un modèle d’éducation anti-oppressive au sein duquel les élèves seraient invités à considérer, non seulement la multiplicité et le caractère situé des divers types d’oppressions, mais également les mécanismes d’attribution de privilège, de constitution de la normalité et de la marginalité, et de présentation de ces arbitraires culturels comme des ordres naturels.

One of the few stylized facts in international relations is that democracies, unlike autoc- racies, very rarely fight each other. We examine the sustainability of international peace between democracies and autocracies, where the crucial difference between these two po- litical regimes is whether or not policymakers are subject to periodic elections. We show that the fear of losing office can deter democratic leaders from engaging in military con- flicts. Crucially, this discipline effect can only be at work if incumbent leaders can be re-elected, implying that democracies in which the executives are subject to term limits should be more conflict prone. To assess the validity of our predictions, we construct a large dataset on countries with executive term limits. Our analysis of inter-state conflicts for the 1816-2001 period suggests that electoral incentives are indeed behind the democratic peace phenomenon: while democratic dyads are in general less likely to be involved in conflicts than any other dyads, this result does not hold for democracies in which the executive faces binding term limits; moreover, the dispute patterns of democracies with term limits depend on whether the executive is in the last or penultimate mandate.

Although current assessments of agricultural management practices on soil organic C (SOC) dynamics are usually conducted without any explicit consideration of limits to soil C storage, it has been hypothesized that the SOC pool has an upper, or saturation limit with respect to C input levels at steady state. Agricultural management practices that increase C input levels over time produce a new equilibrium soil C content. However, multiple C input level treatments that produce no increase in SOC stocks at equilibrium show that soils have become saturated with respect to C inputs. SOC storage of added C input is a function of how far a soil is from saturation level (saturation deficit) as well as C input level. We tested experimentally if C saturation deficit and varying C input levels influenced soil C stabilization of added C-13 in soils varying in SOC content and physiochemical characteristics. We incubated for 2.5 years soil samples from seven agricultural sites that were closer to (i.e., A-horizon) or further from (i.e., C-horizon) their C saturation limit. At the initiation of the incubations, samples received low or high C input levels of 13 C-labeled wheat straw. We also tested the effect of Ca addition and residue quality on a subset of these soils. We hypothesized that the proportion of C stabilized would be greater in samples with larger C Saturation deficits (i.e., the C- versus A-horizon samples) and that the relative stabilization efficiency (i.e., Delta SCC/Delta C input) would decrease as C input level increased. We found that C saturation deficit influenced the stabilization of added residue at six out of the seven sites and C addition level affected the stabilization of added residue in four sites, corroborating both hypotheses. Increasing Ca availability or decreasing residue quality had no effect on the stabilization of added residue. The amount of new C stabilized was significantly related to C saturation deficit, supporting the hypothesis that C saturation influenced C stabilization at all our sites. Our results suggest that soils with low C contents and degraded lands may have the greatest potential and efficiency to store added C because they are further from their saturation level. Motorway off-ramps are a significant source of traffic congestion and collisions. Heavy diverging traffic to off-ramps slows down the mainline traffic speed. When the off-ramp queue spillbacks onto the mainline, it leads to a major breakdown of the motorway capacity and a significant threat to the traffic safety. This paper proposes using Variable Speed Limits (VSL) for protection of the motorway off-ramp queue and thus to promote safety in congested diverging areas. To support timely activation of VSL in advance of queue spillover, a proactive control strategy is proposed based on a real-time off-ramp queue estimation and prediction. This process determines the estimated queue size in the near-term future, on which the decision to change speed limits is made. VSL can effectively slow down traffic as it is mandatory that drivers follow the changed speed limits. A collateral benefit of VSL is its potential effect on drivers making them more attentive to the surrounding traffic conditions, and prepared for a sudden braking of the leading car. This paper analyses and quantifies these impacts and potential benefits of VSL on traffic safety and efficiency using the microsimulation approach.

In recent events, notions of political protest, civil disobedience, extremism, and criminal action have become increasingly blurred. The London Riots, the Occupy movement, and the actions of hacking group Anonymous have all sparked heated debate about the limits of legitimate protest, and the distinction between an acceptable action and a criminal offence. Long before these events, environmental activists were challenging convention in protest actions, with several groups engaging in politically motivated law-breaking. The emergence of the term ‘eco-tage’ (the sabotage of equipment in order to protect the environment) signifies the important place environmental activists hold in challenging the traditional boundaries between illegal action and legitimate protest. Many of these groups establish their own boundaries of legitimacy, with some justifying their actions on the basis of civil disobedience or extensional self-defence. This paper examines the statements of environmental activist organisations that have engaged in politically motivated law breaking. It identifies the parameters that these groups set on their illegal actions, as well as the justifications that they provide, with a view to determining where these actions fit in the vast grey area between legal protest and violent extremism.

Pilot cars are used in one-lane two-way work zones to guide traffic and keep their speeds within posted limits. While many studies have examined the effectiveness of measures to reduce vehicle speeds in work zones, little is known about the reductions achievable through the use of pilot cars. This paper examines the effectiveness of a pilot car in reducing travel speeds in a rural highway work zone in Queensland, Australia. Analysis of speed data covering a period of five days showed that a pilot car reduced average speeds at the treatment location, but not downstream. The proportion of vehicles speeding through the activity area was also reduced, particularly those traveling at 10 km/h or more above the posted limit. Motorists were more likely to speed during the day, under a 40 kh/h limit, when traffic volumes were higher and when there were fewer vehicles in the traffic stream. Medium vehicles were less likely to speed in the presence of a pilot car than light vehicles. To maximize these benefits, it is necessary to ensure that the pilot car itself is not speeding.

Power calculation and sample size determination are critical in designing environmental monitoring programs. The traditional approach based on comparing the mean values may become statistically inappropriate and even invalid when substantial proportions of the response values are below the detection limits or censored because strong distributional assumptions have to be made on the censored observations when implementing the traditional procedures. In this paper, we propose a quantile methodology that is robust to outliers and can also handle data with a substantial proportion of below-detection-limit observations without the need of imputing the censored values. As a demonstration, we applied the methods to a nutrient monitoring project, which is a part of the Perth Long-Term Ocean Outlet Monitoring Program. In this example, the sample size required by our quantile methodology is, in fact, smaller than that by the traditional t-test, illustrating the merit of our method.

Titled "An Essay on Antimetaphoric Resistance", the dissertation investigates what is here being called "Counter-figures": a term which has in this context a certain variety of applications. Any other-than-image or other-than-figure, anything that cannot be exhausted by figuration (and that is, more or less, anything at all, except perhaps the reproducible images and figures themselves) can be considered "counter-figurative" with regard to the formation of images and figures, ideas and schemas, "any graven image, or any likeness of any thing". Singularity and radical alterity, as well as temporality and its peculiar mode of uniqueness are key issues here, and an ethical dimension is implied by, or intertwined with, the aesthetic. In terms borrowed from Paul Celan's "Meridian" speech, poetry may "allow the most idiosyncratic quality of the Other, its time, to participate in the dialogue". This connection between singularity, alterity and temporality is one of the reasons why Celan so strongly objects to the application of the traditional concept of metaphor to poetry. As Celan says, "carrying over [übertragen]" by metaphor may imply an unwillingness to "bear with [mittragen]" and to "endure [ertragen]" the poem. The thesis is divided into two main parts. The first consists of five distinct prolegomena which all address the mentioned variety of applications of the term "counter-figures", and especially the rejection or critique of either metaphor (by Aristotle, for instance) or the concept of metaphor (defined by Aristotle, and sometimes deemed "anti-poetic" by both theorists and poets). Even if we restrict ourselves to the traditional rhetorico-poetical terms, we may see how, for instance, metonymy can be a counter-figure for metaphor, allegory for symbol, and irony for any single trope or for any piece of discourse at all. The limits of figurality may indeed be located at these points of intersection between different types of tropes or figures, and even between figures or tropes and the "non-figurative trope" or "pseudo-figure" called catachresis. The second part, following on from the open-ended prolegomena, concentrates on Paul Celan's poetry and poetics. According to Celan, true poetry is "essentially anti-metaphoric". I argue that inasmuch as we are willing to pay attention to the "will" of the poetic images themselves (the tropes and metaphors in a poem) to be "carried ad absurdum", as Celan invites us to do, we may find alternative ways of reading poetry and approaching its "secret of the encounter", precisely when the traditional rhetorical instruments, and especially the notion of metaphor, become inapplicable or suspicious — and even where they still seem to impose themselves.

In the Philippines at present, milkfish farming in ponds includes a wide range of intensities, systems and practices. To make aquaculture possible, ecosystems are used as sources of energy and resources and as sinks for wastes. The growth of aquaculture is limited by the life-support functions of the ecosystem, and sustainability depends on matching the farming techniques with the processes and functions of the ecosystems, for example, by recycling some degraded resources. The fish farm has many interactions with the external environment. Serious environmental problems may be avoided if high-intensity farms are properly planned in the first place, at the farm level and at the level of the coastal zone where it can be integrated with other uses by other sectors. It is believed that the key to immediate success in the mass production of milkfish for local consumption and for export of value-added forms may be in semi-intensive farming at target yields of 3 tons per ha per year, double the current national average. Intensive milkfish farming will be limited by environmental, resource and market constraints. Integrated intensive farming systems are the appropriate long-term response to the triple needs of the next century: more food, more income, and more jobs for more people, all from less land, less resources, and less non-renewable energy.

Pronounced changes have occurred in the fisheries, plankton and benthos of the North Sea over the last five decades. Attribution of the relative contribution of anthropogenic versus natural hydrometeorological modulation to these changes is still unclear. As a background a summary history of our understanding of the state of health of the North Sea is outlined. We then focus on two contrasting periods in the North Sea, one between 1978-82 (cold) and the other post 1987 (warm) when pronounced alterations in many ecosystem characteristics occurred. The scale of the changes in the second of these periods is sufficiently large and wide ranging for it to have been termed a regime shift. A combination of local, regional and far field hydrometeorological forcing, and in particular variability in oceanic inflow, is believed to be responsible for the observed changes. Finally attention is drawn to the poor status of North Sea fish stocks where 7 stocks are documented as being fished outside safe biological limits. This situation is primarily believed to be a consequence of overfishing, but may have been exacerbated by environmental change.

We compare the long-term and seasonal patterns of abundance and phenology of the cyclopoid copepod Oithona similis at the L4 site (1988–2013) in the North Atlantic and at the LTER-MC site (1984–2013) in the Mediterranean Sea to investigate whether high temperature limits the occurrence of this species with latitudinal cline. The two sites are well suited to testing this hypothesis as they are characterized by similar chlorophyll a concentration (Chl a) but different temperature [sea surface temperature (SST)]. The abundance of O. similis at L4 was ∼10 times higher than at LTER-MC. Moreover, this species had several peaks of abundance during the year at L4 but a single peak in spring at LTER-MC. The main mode of temporal variability in abundance was seasonal at both sites. The abundance of O. similis was negatively correlated with SST only at LTER-MC, whereas it was positively correlated with Chl a at both sites. Oithona similis had a temperature optimum between 15 and 20°C reaching maximum abundance at ∼16.5°C at LTER-MC, but showed no Chl a optimum at either site. We conclude that the abundance of O. similis increases with prey availability up to 16.5°C and that temperature >20°C represents the main limiting factor for population persistence.
