The present paper aspires to join two different debates: (i) what is the State’s best organizational model to promote distinctive public services; and (ii) what role Law should perform in the promotion of a nation’s economic and social development. More specifically, this study examines whether the institutions created by the Brazilian normative system are able to balance the antagonist interests of the State and minority shareholders in a Government-Controlled Corporation. In this pursuit, this paper analyzes the changes that occurred in SABESP S.A. during the period between the years of 2000 – 2010, of major transformations in the Brazilian Water and Sewage sector. At that time, the company was introduced to the Novo Mercado of BM&FBovespa, was forced to execute agreements with conceding authorities and started to be monitored by ARSESP, an independent regulatory agency. Initial findings suggest that these institutions were able to create incentives for the company to strive for a more efficient performance, often succeeding in aligning the contrasting interests of the State and minority shareholders. Final conclusions are that: (i) Government-Controlled Corporations can be powerful public policy promotion instruments in sectors that are complex and capital intensive; and (ii) Law can and should perform a much more active role in sponsoring economic and social development than merely acting to diminish transaction costs to allow for the adequate functioning of markets.

O Presente trabalho busca estudar o atual modelo de governança da água, principalmente na região metropolitana de São Paulo, aonde temos o modelo de governança francês dos Comitês e Agências de Bacia e, a atuação histórica da Sabesp – Companhia de Saneamento do Estado de São Paulo, em crises hídricas, tendo como foco principal a atual crise de 2013 a 2015.Questiona-se a viabilidade da abertura do capital da prestatora de serviço público e sua possível desnaturação. Acrescenta-se algumas medidas adotadas e, por final, além de uma breve análise da CPI- Comissão Parlamentar de Inquerito, instaurada perante a Câmara dos Deputados de São Paulo, sugere-se algumas possíveis alternativas para amenizar a crise e implementar uma governança mais proxima da realidade local

The human being has a dependency with the natural environment, since it is from withdrawing resources from it is essential for their survival. But this relationship appears to be unbalanced from the moment that society emerges and changes the substrate in which land is located. In this context the study about the formation of technogenic deposits, has assisted in the preparation of environmental diagnoses in an area very changed by society. Technogenic deposits are sedimentary deposits originated by human activities in the environment, with special emphasis in this work in the fluvial plains. Their classification depends on both the manufactured materials found in its layers, and the processes that led to its formation. Thus, the main objective was to understand the formation history of technogenic deposits in the fluvial plains of the Santo Anastacio river and streams of Cedro and Cedrinho surrounding the dam of SABESP (Basic Sanitation Company of São Paulo) in Presidente Prudente-SP. The experimental proceedings are based mainly on realization of fieldwork to characterization study area, collection of technogenic materials in PVC´s (polyvinyl chloride) tube, and analysis of laboratory through of particle size analysis (EMBRAPA, 1997) of the technogenics layers... This undergraduate research final paper analyzed the communication process carried out by the São Paulo State Water and Sanitation Company - Sabesp from the perspective of public communication, social capital and right to information theories. By monitoring Sabesp's institutional fanpage and website from 24 to 30 August 2015, it sought to assess the performance of Sabesp in disclosing public information on the context of the water supply crisis in São Paulo, concerning the fulfillment of requirements of the Right to Information Law (12.527/2011) and the need for interaction and dialogue between the institution and its stakeholders, taken as principles of public communication. The results suggest that digital media can enhance information flow and contribute to foster public relations and civic participation, but there are opportunities for Sabesp to improve communication and reach greater transparency
