This paper undertakes the first comparative analysis of restrictive practices legislation in Australia. This legislation, which regulates practices used to manage ‘challenging behaviours’ of people with intellectual disability or cognitive impairment, currently exists in four Australian jurisdictions. The paper demonstrates the gaps in coverage of this legislation and the wide variation of law nationally. We argue that legislation governing restrictive practices is needed, it should regulate the provision of all restrictive practices (not just some) and that there should be a national consistent approach.

In Australia, the legal basis for the detention and restraint of people with intellectual impairment is ad hoc and unclear. There is no comprehensive legal framework that authorises and regulates the detention of, for example, older people with dementia in locked wards or in residential aged care, people with disability in residential services or people with acquired brain injury in hospital and rehabilitation services. This paper focuses on whether the common law doctrine of necessity (or its statutory equivalents) should have a role in permitting the detention and restraint of people with disabilities. Traditionally, the defence of necessity has been recognised as an excuse, where the defendant, faced by a situation of imminent peril, is excused from the criminal or civil liability because of the extraordinary circumstances they find themselves in. In the United Kingdom, however, in In re F (Mental Patient: Sterilisation) and R v Bournewood Community and Mental Health NHS Trust, ex parte L, the House of Lords broadened the defence so that it operated as a justification for treatment, detention and restraint outside of the emergency context. This paper outlines the distinction between necessity as an excuse and as a defence, and identifies a number of concerns with the latter formulation: problems of democracy, integrity, obedience, objectivity and safeguards. Australian courts are urged to reject the United Kingdom approach and retain an excuse-based defence, as the risks of permitting the essentially utilitarian model of necessity as a justification are too great.

Shrimp culture in Bangladesh has emerged as an important aquaculture industry over the last three decades although its culture in greater parts of the farming area is done in traditional ways. In the meantime, the government of Bangladesh has taken necessary measures along with the private sectors to increase production, upgrade processing industries and to promote export performance. Long supply chain in raw material collection, inadequate infrastructure facilities, poor level of cool chain and lack of adequate HACCP-based training on hygiene and sanitation of different groups of people involved in the field level are the main problems of quality loss of raw materials. Shortage of raw materials results in poor capacity utilization of the processing plants. The growth of bagda (P. monodon) hatchery has expanded rapidly over the last few years, remaining mostly concentrated in Cox's Bazar region is enough to meet the target production. However, there is a shortage of pelleted shrimp feed in Bangladesh. A large number of export processors are now producing increasing amounts of value-added products such as individually quick-frozen, peeled and divined, butterfly cut shrimp, as well as cooked products. The export earnings from value added products is about half of the total export value. About 95% of total fish products are exported to European countries, USA and Japan and the remaining to the Southeast Asia and the Middle East. Most of the EU approved shrimp processing industries have been upgraded with laboratory facilities and provided HACCP training to their workers. As of now, HACCP is applied on the processing plants, but to ensure the quality of raw materials and to reduce risks, shrimp farms are also required to adopt HACCP plan. There is increased pressure time to time from importing countries for fish processors to establish effective quality assurance system in processing plants. Fish Inspection and Quality Control (FIQC) of the Department of Fisheries while having moderately equipped laboratories with chemical, bio-chemical and microbiological testing facilities and qualified technical personnel, the creation of facilities for testing of antibiotics is underway. FIQC mainly supervises quality aspects of the processing plants and has little or no control over raw material supply chains from farm to processing plants. Bangladesh export consignments sometimes face rejection due to reported poor quality of the products. Three types of barriers are reported for export of shrimp to EU countries. These are:(1) government participation in trade and restrictive practices (state aid, countervailing duties, state trading enterprises, government monopoly practices), customs and administrative entry procedures (anti-dumping duties, customs valuation, classification, formalities, rules of origin); (2) technical barriers to trade or TBT (technical regulations, standards, testing, certification arrangement); (3) specific limitations (quantitative restrictions, import licensing, embargoes, exchange control, discriminatory sourcing, export restraints, measures to regulate domestic prices, requirements concerning marking, labeling and packaging).

Depuis quelques années, mais surtout depuis le 11 septembre 2001, les contrôles migratoires sont devenus le locus principal d’affirmation du pouvoir souverain dans les pays occidentaux. La mouvance sécuritaire actuelle semble avoir donné les outils conceptuels nécessaires aux États pour leur permettre d’amalgamer des notions autrefois distinctes, comme la sécurité et l’immigration, et d’en inférer des liens qui paraissent désormais naturels et évidents aux yeux du public. Le Canada s’inscrit aussi dans cette mouvance où l’immigrant et l’étranger sont désormais pensés en relation avec l’illégalité, la criminalité et le sujet de non-droit. En pratique, cela se traduit par la mise en œuvre étatique d’un pouvoir souverain qui se manifeste clairement et ouvertement dans le cadre de contrôles migratoires de plus en plus serrés et contraignants. Ainsi, alimenté par la justification sécuritaire, par l’affect de la peur et par la nécessité de combattre le terrorisme international, le Canada applique ses lois et ses politiques de manière à exercer un contrôle accru sur sa population, plus particulièrement sur les migrants en général, mais encore davantage sur les demandeurs d’asile et les réfugiés soupçonnés de terrorisme. La mise en œuvre de pratiques restrictives à l’endroit des demandeurs d’asile et des réfugiés est facilitée par une conviction très tenace. À la lumière de son comportement, le gouvernement canadien semble convaincu que l’exclusion, l’expulsion, voire le refoulement, à l’extérieur du territoire national des personnes jugées être de potentiels terroristes, permettront de renforcer la sécurité nationale. Cette conviction est elle-même supportée par une autre, à savoir la croyance selon laquelle le pouvoir souverain d’exclure quelqu’un du territoire est absolu et, qu’en situation d’exception, il ne peut être limité d’aucune manière par le droit international. Suivant ceci, la lutte antiterroriste s’exécute presque exclusivement par le rejet des éléments potentiellement dangereux à l’extérieur du pays, au détriment d’autres mesures moins attentatoires des droits et libertés, plus légitimes et plus à même de remplir les objectifs liés à la lutte au terrorisme international. Dans notre étude, par une relecture d’une décision paradigmatique de la Cour suprême du Canada, l’affaire Suresh, nous chercherons à ébranler ces convictions. Notre thèse est à l’effet que la prétention du Canada à vouloir en arriver à un monde plus sécuritaire, en excluant d’une protection internationale contre la torture et en refoulant de potentiels terroristes à l'extérieur de son territoire, constitue une entreprise vouée à l’échec allant potentiellement à l’encontre des objectifs de lutte au terrorisme et qui se réalise présentement dans le déni de ses obligations internationales relatives aux droits de l’Homme et à la lutte contre l’impunité. Généralement, à la lumière d’une analyse de certaines obligations du Canada dans ces domaines, notre étude révélera trois éléments, ceux-ci se trouvant en filigrane de toute notre réflexion. Premièrement, le pouvoir souverain du Canada d’exclure des individus de son territoire n’est pas absolu. Deuxièmement, le droit d’une personne à obtenir protection non plus n’est pas absolu et des mécanismes d’équilibrage existant en droit international permettent de protéger les personnes tout en s’assurant que le Canada ne devienne pas un refuge pour les terroristes potentiels. Troisièmement, le Canada est astreint à d’autres obligations internationales. Celles-ci protègent les personnes exclues d’une protection et forcent le gouvernement à lutter contre l’impunité.

A acirrada competição econômica e a profunda revolução tecnológica impõem às organizações contemporâneas mudanças significativas na organização da produção. Nesse contexto configuram-se algumas contradições. Por um lado exalta-se a importância da participação do trabalhador como fator decisivo na construção de vantagens competitivas, uma vez que o sucesso da organização tem como um dos principais requisitos a implantação de modelos de funcionamento que contemplem atividades geradoras de conhecimento novo, disseminem-no amplamente a toda organização e, rapidamente, incorporem-no a novas tecnologias e produtos. Por outro lado, também na busca de maiores graus de competitividade, práticas de flexibilização das relações de trabalho vêm sendo adotadas como forma de diminuição dos custos de produção, através da redução das formas de proteção da relação de trabalho. No Brasil, a ação flexibilizante já vem ocorrendo desde 1965 e encontra-se hoje em tramitação no Congresso Nacional o Projeto de Lei 5483/2001 que, alterando o art. 618 da Consolidação das Leis do Trabalho, pretende a prevalência do negociado sobre o legislado. Neste sentido, o objetivo da pesquisa é verificar os efeitos da flexibilização das relações de trabalho na qualidade de vida no trabalho, no que se refere, especificamente, à gestão do conhecimento e às necessidades sociais do trabalhador quanto aos seus benefícios diretos e espontâneos. Configura-se como um estudo de campo com foco nas organizações, a partir dos representantes da área de gestão de pessoas e nos trabalhadores das indústrias, com mais de quinhentos funcionários, instaladas na Região Metropolitana de Curitiba. O método utilizado para tratamento dos dados possibilita mensuração de variáveis qualitativas e o estabelecimento da comparabilidade entre os trabalhadores sujeitos às práticas de flexibilização e os demais trabalhadores. Os dados coletados por meio de questionários revelaram que a flexibilização das relações de trabalho faz parte integrante do novo perfil das organizações e que há hoje uma tendência de implemento com a abertura legal. Os efeitos causados por essa ação sobre a qualidade de vida no trabalho revelam-se predatórios, na medida em que os trabalhadores com contratos de trabalho flexibilizados encontram-se em posição de desvantagem no acesso à aprendizagem dentro das organizações e, também, na satisfação de suas necessidades sociais. Na análise comparativa entre as duas categorias de trabalhadores, foi possível verificar diferenças significativas no que diz respeito aos indicadores de participação no processo produtivo através da freqüência média de soluções apresentadas e incorporadas, da participação nos processos de aquisição do conhecimento, no acesso a benefícios diretos e espontâneos e na satisfação com o ambiente de trabalho. Essas constatações permitem concluir que as organizações, quando na busca de maior competitividade, incorrem em equívocos à medida em que desconsideram a qualidade de vida no trabalho, especificamente no que diz respeito à gestão do conhecimento e à satisfação das necessidades sociais como fatores maximizantes do desenvolvimento econômico e de incremento da produção.

In the process of creation of the Unified Health System (SUS) as a universal policy seeking to ensure comprehensive care, unscheduled assistance in primary healthcare units (UBS) is an unresolved challenge. The scope of this paper is to analyze the viewpoint of health professionals on the role of primary healthcare units in meeting this demand. It is a transversal study of qualitative data obtained through questionnaires and interviews with 106 medical practitioners from 6 emergency medical services and 190 professionals from 30 units. They explained why people seek emergency care for occurrences pertaining to primary care. The content analysis technique with thematic categories was used for data analysis. Lack of resources and problems with primary health unit work processes (50.8%) were the reasons most frequently cited by emergency care physicians to explain this inadequate demand. Only 33.3% of the health unit professionals agreed that these occurrences should be attended in the primary healthcare services. The limited viewpoint of the role of health services on the unscheduled care, particularly among primary care professionals, possibly leads to restrictive practices for access by the population.

Across two studies, we examined the association between adiposity, restrictive feeding practices and cortical processing bias to food stimuli in children. We assessed P3b event-related potential (ERP) during visual oddball tasks in which the frequently presented stimulus was non-food and the infrequently presented stimulus was either a food (Study 1) or non-food (Study 2) item. Children responded to the infrequently presented stimulus and accuracy and speed responses were collected. Restrictive feeding practices, children's height and weight were also measured. In Study 1, the difference in P3b amplitude for infrequently presented food stimuli, relative to frequently presented non-food stimuli, was negatively associated with adiposity and positively associated with restrictive feeding practices after controlling for adiposity. There was no association between P3b amplitude difference and adiposity or restriction in Study 2, suggesting that the effects seen in Study 1 were not due to general attentional processes. Taken together, our results suggest that attentional salience, as indexed by the P3b amplitude, may be important for understanding the neural correlates of adiposity and restrictive feeding practices in children.
