This report pursuant to Department of Management procedures provides an overview of the State Public Defender’s fiscal year 2013 operations related to court-appointed counsel, claims processing, and other indigent defense matters. This information, in accordance with the Accountable Government Act, is meant to help improve decision making and increase accountability to stakeholders and the citizens of Iowa. Iowa’s indigent defense system remains strong. The more than 200 employees of the State Public Defender System have been efficiently providing high quality representation on more cases than ever before. In Fiscal Year 2013, public defender offices closed more than 91,000 cases, at an average cost per case of $282.02, and there was a final finding of ineffective assistance of counsel in less than .002% of these cases. Similarly, more than 1,000 contract attorneys continue to provide high quality representation throughout all 99 of Iowa’s counties. In Fiscal Year 2013, 60,929 claims were submitted to the indigent defense fund, at an average cost per claim of $507.86. This was an decrease of nearly 350 claims from Fiscal Year 2012, and the total amount spent from the indigent defense fund increased slightly.

The 2007 Indigent Defense Act provides that each county must elect its representative(s) from the active licensed attorneys who reside within each county to serve on its Circuit Public Defender Selection Panel. The procedures included in this document have been adopted by the Commission on Indigent Defense for the Election of the Circuit Public Defender Selection Panels and the Nomination of Circuit Public Defenders.

Boston lawyer William P. Homans Jr. devoted his fifty-year career to the defense of the poor and downtrodden, the protection of our most basic civil liberties, and the abolition of the death penalty. Descendant of two of Boston's oldest and most prominent families, and combat veteran of both the British and American Navies during World War II, Homans became unlikely guru to the 1960s generation of radical lawyers and antiwar activists. He was on the defense team in the 1968 conspiracy trial of Dr. Benjamin Spock and four other leading opponents of the Vietnam War accused of aiding and abetting resistance to the military draft, and represented Dr. Kenneth Edelin in the 1975 manslaughter prosecution arising out of a lawful abortion performed after Roe v. Wade. The narrative contrasts Bill Homans' storied legal career with a troubled personal life in a balanced but unvarnished manner, testifying to the strength of the human spirit when committed to the pursuit of the common good. About the author: Mark S. Brodin is Professor of Law at Boston College Law School and the author of numerous books and law journal articles in the areas of civil and criminal procedure, evidence, litigation, and employment discrimination. A graduate of Columbia College (1969) and Columbia Law School (1972), he served as law clerk to United States District Judge Joseph L. Tauro and staff attorney with the Lawyers' Committee for Civil Rights in Boston. He has also practiced for brief periods as a public defender in Boston and a prosecutor in Norfolk County.

O objetivo desta dissertação é estudar os Ciclos de Conferências da Defensoria Pública do Estado de São Paulo para entender qual papel eles desempenham em relação a participação popular na gestão da Defensoria Pública. O problema de pesquisa consiste em verificar se e como elas contribuem para garantir a participação social dentro da gestão da Defensoria, levando em consideração o estudo sobre a implementação ou não das diretrizes elaboradas pela população durante a realização dos I, II e III Ciclos de Conferências e a compreensão das diferentes falas que os atores tem em relação aos Ciclos de Conferências. A conclusão é a de que os Ciclos de Conferências não foram absorvidos de forma homogênea pela instituição como um importante mecanismo orientador das prioridades institucionais, capaz de vocalizar os anseios da população, arejando a instituição, e colaborando com a construção de políticas públicas alinhadas às demandas da população. É necessário que seja pactuado e esclarecido o caráter das propostas elaboradas nas Conferências (caráter deliberativo ou consultivo) sob pena do mecanismo participativo em questão perder aderência popular.

Passados mais de dez anos do reconhecimento da autonomia administrativa, financeira e orçamentária às Defensorias Públicas Estaduais, o que se deu através da Emenda Constitucional n° 45/2004, ainda é possível encontrar instituições desta espécie que sofrem com interferências diárias nos mais variados aspectos de sua administração, em total desrespeito ao que determina a nossa Lei Fundamental. Entretanto, curiosamente este problema não tem se mostrado de maneira uniforme no cenário nacional, havendo estados onde as Defensorias Públicas gozam de mais autonomia e prestígio, enquanto existem outros onde estas sofrem para ter igual direito reconhecido. Neste sentido, partindo de um referencial teórico básico sobre autonomia da Defensoria Pública, a presente pesquisa teve por objetivo explorar os elementos que compõe tal conceito, buscando posteriormente verificar e descrever as assimetrias existentes entre os modelos de autonomia encontrados nas Defensorias Públicas estaduais ao redor do país. Para tanto, foram coletados dados através de observação direta, pesquisa documental e entrevistas, os quais foram posteriormente tratados e interpretados através da metodologia da análise de conteúdo. Os resultados obtidos através das consolidações efetuadas no âmbito das cincos categorias de análise propostas permitiram a conclusão de que a assimetria entre os modelos existentes é um fato, sendo perceptível principalmente nas áreas de Administração Financeira e Orçamentária, bem como na Formação da Alta Administração da Instituição. Também foram constatadas duas barreiras fundamentais para a implantação do modelo de autonomia preconizado pelo ordenamento, qual seja, a baixa autonomia na previsão de despesas no processo orçamentário e a ausência de limite próprio de pessoal para a Defensoria Pública na Lei de Responsabilidade Fiscal.

This scholarly work aims to investigate the feasibility and constitutionality of access to justice through the provision of full and free legal assistance by the Brazilian municipalities. Investigates the historical aspects of federalism in a global context, emphasizing the contributions left by American federalism. In the Brazilian context, emphasizing the importance of municipalities as federal entities and their outstanding characteristics, while addressing regional issues of federalism. Leanings to the more detailed analysis of the Brazilian municipalities, contextualizing its legal status, its independence and its constitutional powers. It is emphasized in the same way, the relevant transformations of Brazilian municipalities over the last twenty years of this Constitution of the Federative Republic of Brazil in 1988, especially the various constitutional amendments that affected the local autonomy and budgetary aspects, fiscal and skills, bringing significant changes to the municipalities. It is an approach to the concept of justice and deepening the studies on the fundamental right of access to justice in its various connotations. In this vein, it is a study on the legal advice provided in Brazil, especially the powers of the Public Defender of the States and Union, as well as the provision of such public service by Brazilian municipalities and its relevance to citizens in need. At this point, it deepens the relevance of the theme of this dissertation earning the implications of municipal performance in the provision of legal assistance provided to the needy, and the activity of the Municipal Attorney or legal counsel in conducting such a task and its implications for legal and procedural especially on the constitutionality or otherwise of the conduct of such public service, confronting the constitutional articles that are correlated with the subject. Within this context, evaluates the municipal legal assistance under the test of constitutionality, in particular the assistance given by the Executive, through the Municipal Attorney or specialized secretariats and that provided by the Legislature, although it only has the typical functions of legislating and control the municipal accounts, comes in a few municipalities in Brazil deploying sectors with the performance of legal services to the needy. At this point the thesis, one wonders if some important aspects of this activity such as political influence and patronage, very common in day-to-day municipal prosecutors and legal advisers, public employees or occupying commissioned positions within the municipal administrative structure in several municipalities throughout Brazil. Finally, there will be a conclusion as to the constitutionality of the service being done by presenting proposals and recommendations that may improve the municipal legal aid, allowing a constitutional backing to this important service is being provided in capital cities and municipalities throughout the length of Brazil

The Federal Constitution of 1988 is recognized for its enlargement in the face of large amount of provisions that make it up, among which many are fundamental rights. The fundamental rules set up the foundation of a democratic state, however, are the necessary legal mechanisms to be effective, its exercise is not enough merely to state them, but to offer ways for them to stop being just written standard on paper, and come to be viewed and exercised day-to-day. In this sense, access to justice presents itself in our times, as a cornerstone for a just society dictates. In this light, access to justice can be seen as the most fundamental of rights, which translates as instruments able to safeguard the fundamental rights not only against the action/omission violating the state but also the very particular. Furthermore, access to justice within the legal country, is not right for everyone, despite the willingness of the Citizen Charter in its article 5, paragraph LXXIV, ensuring that the State shall provide full and free legal assistance to those in need. More than half of the population lives in poverty and can´t afford to pay legal fees or court costs as well as a bump in their own ignorance of their rights. The judiciary, in their primary function, is in charge of trying to correct the violation of the rights, intending to effect a true distributive justice, serving as a paradigm for the promotion of substantive equality of human beings, however, is difficult and tortuous access Justice for those without financial resources. In this vein, we present the Public Defender, as keeper of the masses in its institutional role, defending a disadvantage, in the words, as a mechanism for effective access to justice, ensuring therefore fundamental rights. Public Defenders arise at the time or much discussion highlights the priority of actual access to justice, custody, therefore, intimate bond with the pursuit of fundamental rights, in which, that advance the broad range of rights, without whom could defend them or guardianship them

The realization of human rights is a prerequisite to the development of peoples, this requires legal mechanisms and techniques to its consistent and effective promotion, protection and fulfillment. So, agree that there is an institution or public agency created for the purpose of protecting those who suffer most in the face of human rights violations: the needy. In Brazil, among other institutions and public agencies, the responsibility of the Public Defender to promote the protection of human rights. The constitutional system recognizes the institution in its essence the role of the state court, whose duty is to provide guidance and legal defense of the needy. The legal system as a whole sufraga the relevance of the Ombudsman as a mainspring of human rights. In the prison system, with the ultimate regulatory changes, such as Law 12.313 of 2010 which introduced changes to the Law 7.210 of 1984, the institution must ensure the correct and humane enforcement of sentences and the security measures pertaining to the needy. With the Complementary Law 132 of 2009, to systematize other duties of the Public Defender, highlighting their contribution to the movement of access to justice. Within the OAS, to adopt Resolution 2656, 2011, characterizing, with ruler and compass, the relevance of the Ombudsman access to justice and protection of human rights. In this step, the present study concerns the role of Defender in the legal protection of human rights, through monographic and deductive methods, as there remains a technical and theoretical connection between these two points themed legal phenomenon, since the rights humans, especially after the second half of the twentieth century, form the basis of the legal system of the major Western nations in the world. This led, therefore, the emergence of technical and legal institutions aimed at realizing human rights. This applies to the Defender. Access to justice and public service provision of legal assistance are human rights, therefore, essential to humans and necessary for social inclusion. Countries such as Brazil, marked by social inequality, depend on the structuring of institutions like the Defender, designed to promote citizenship to the Brazilian people

A pesquisa analisa como a Defensoria Pública do Estado do Pará está atuando em relação aos direitos sociais da mulher encarcerada em sede de execução penal a partir da Lei nº 054 de 2006. Para tanto, caracteriza o perfil das mulheres condenadas e verifica como a atuação da Defensoria pública, por meio de procedimentos judiciais e extrajudiciais, contribui para a diminuição da vulnerabilidade social e ampliação do capital social, econômico e cultural da mulher encarcerada. Utiliza os conceitos de habitus, campo, capital econômico, capital cultural e poder simbólico de Bourdieu, a ideia de criminalização da pobreza de Loic Wacquant, Joan Scott para o conceito de gênero. Metodologicamente, é classificada como um estudo de caso no Estado do Pará com coleta de dados nos meses de outubro a novembro de 2012, tendo como locus da pesquisa os Centros de Recuperação: CRF (Ananindeua), CRAMA (Marabá) e CRASHM (Santarém), permitindo comparações entre eles. Utiliza uma abordagem quantitativa com aplicação de questionário a todas as voluntárias (202 do universo de 275 presas condenadas) e análise de relatórios. Realizou uma análise descritiva dos dados obtidos, EXCEL e SPSS.17, na elaboração de gráficos e tabelas e análise inferencial (teste Qui-Quadrado de independência). A abordagem qualitativa utilizou entrevista semiestruturada aplicada aos defensores públicos e grupo focal no CRF, com a posterior triangulação dos dados. Concluindo que a mulher encarcerada representa um grupo vulnerável com baixo capital econômico, cultural e social, encontrando dificuldade de acesso à saúde. O acesso à justiça também não é efetivado plenamente no que tange seus direitos sociais, que somente foram atendidos parcialmente por meio de ações judiciais individuais e atuação administrativa, não sendo utilizadas ações judiciais coletivas ou constitucionais, sendo diminuta a participação em políticas públicas e a atuação em rede.
