In 2003 Robert Fardon was the first prisoner to be detained under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld), the first of the new generation preventive detention laws enacted in Australia and directed at keeping sex offenders in prison or under supervision beyond the expiry of their sentences where a court decides, on the basis of psychiatric assessments, that unconditional release would create an unacceptable risk to the community. A careful examination of Fardonâs case shows the extent to which the administration of the regime was from the outset governed by politics and political calculation rather than the logic of risk management and community protection. In 2003 Robert Fardon was the first person detained under the Dangerous Prisoners (Sexual Offenders) Act 2003 (Qld) (hereafter DPSOA), a newly enacted Queensland law aimed at the preventive detention of sex offenders. It was the first of a new generation of such laws introduced in Australia, now also in force in NSW, Western Australia and Victoria. The laws have been widely criticized by lawyers, academics and others (Keyzer and McSherry 2009; Edgely 2007). In this article I want to focus on the details of how the Queensland law was administered in Fardonâs case, he being perhaps the most well-known prisoner detained under such laws and certainly the longest held. It will show, I hope, that seemingly abstract rule of law principles invoked by other critics are not simply abstract: they afford a crucial practical safeguard against the corruption of criminal justice in which the ends both of community protection and of justice give way to opportunistic exploitation of â˜the mythic resonance of crime and punishment for electoral purposesâ (Scheingold 1998: 888).

Given the economic and social importance of agriculture in the early years of the Irish Free State, it is surprising that the development of organisations representing farmers has not received the attention it deserves from historians. While the issues of government agricultural policy and the land question have been extensively studied in the historiography, the autonomous response by farmers to agricultural policies and the detailed study of the farmersâ organisations has simply been ignored in spite of the existence of a range of relevant primary sources. Farmersâ organisations have only received cursory treatment in these studies; they have been presented as passive spectators, responding in a Pavlovian manner to outside events. The existing historiography has only studied farmersâ organisations during periods when they impinged on national politics, epecially during the War of Independence and the Economic War. Therefore chronological gaps exist which has led to much misinterpretation of farmersâ activities. This thesis will redress this imbalance by studying the formation and continuous development of farmersâ organisations within the twenty-six county area and the reaction of farmers to changing government agricultural policies, over the period 1919 to 1936. The period under review entailed many attempts by farmers to form representative organisations and encompassed differing policy regimes. The thesis will open in 1919, when the first national organisation representing farmers, the Irish Farmersâ Union, was formed. In 1922, the union established the Farmersâ Party. By the mid- 1920âs, a number of protectionist agricultural associations had been formed. While the Farmersâ Party was eventually absorbed by Cumann na nGaedheal, local associations of independent farmers occupied the resultant vacuum and contested the 1932 election. These organisations formed the nucleus of a new national organisation; the National Farmersâ and Ratepayersâ League. The agricultural crisis caused by both the Great Depression and the Economic War facilitated the expansion of the league. The league formed a political party, the Centre Party, to contest the 1933 election. While the Centre Party was absorbed by the newly-formed Fine Gael, activists from the former farmer organisations led the campaign against the payment of annuities and rates. Many of them continued this campaign after 1934, when the Fine Gael leadership opposed the violent resistance to the collection of annuities. New farmer organisations were formed to co-ordinate this campaign which continued until 1936, the closing point of the thesis.

The transition from a positivist matrix to an idealistic one in Argentinean academic philosophy can be read as a result of a gradual and problematic pollution. It was, also, heavily traversed by considerations that exceeded the theoretical aspects. Based on the willingness to explore this transit, the article pays attention to one of the episodes of this contamination: how the Revista de Filosofía reads Croce and Gentileâs philosophy. Observing there some possibility of dialogue between positivist assumptions, with which the journal takes a position, and the idealism the article analyze how this dialogue and its limits were given from a political consideration. If the idealism was condemned, it is centrally owed to its performance during the first years of the government of Mussolini. If, meanwhile, it was some to rescue of that philosophy, it was that it contributed to think the revolutionary change.

Commentators and scholars alike recognize the important role political dissatisfaction plays in the process of regime change. A considerable body of literature has used dissatisfaction with a regime and distrust in political institutions to explain political dynamics during democratization's initial phase, yet these indicators are rarely used to assess disaffection with politics in established democratic regimes. Recent research on the post-communist region has established that citizens demonstrate high levels of political alienation, and that ethnic minority communities in particular are widely dissatisfied with democratic politics, institutions and regimes. This paper uses the 2004 data from the New Baltic Barometer to analyse individual-level disaffection with politics among the minorities in the Baltic States and explores the structural roots of such disaffection. The paper draws upon interviews with political representatives of minority communities in order to understand their perceptions of opportunities to participate in decision-making. Building on quantitative and qualitative analysis, the paper concludes that disaffection with politics among both the mass of ethnic minorities and their elite groups is best explained by the misrepresentation of minority interests in post-communist Baltic polities.
