The Acquisition of Land Act 1967 (Qld) (the Act) deals with the acquisition of land by the State for public purposes and provides for compensation. The issue that arose for determination in Sorrento Medical Service Pty Ltd v Chief Executive, Dept of Main Roads [2007] QCA 73 was whether the appellant was entitled to claim compensation under the Act in respect of land resumed by the Main Roads Department over which the appellant had an exclusive contractual licence for car parking spaces for use in association with a medical centre leased by the appellant. At first instance, it was held by the Land Court that the appellant was not entitled to compensation for the resumption of the car parking spaces. The basis for this decision by the Land Court was that a right to compensation only exists where resumption has taken some proprietary interest of the claimant in the land. Following an appeal to the Land Appeal Court being dismissed, the appellant instituted the present appeal to the Queensland Court of Appeal (McMurdo P, Holmes JA and Chesterman J).

This was the question that confronted Wilson J in Jarema Pty Ltd v Michihiko Kato [2004] QSC 451. Facts The plaintiff was the buyer of a commercial property at Bundall. The property comprised a 6 storey office building with a basement car park with 54 car parking spaces. The property was sold for $5 million with the contract being the standard REIQ/QLS form for Commercial Land and Buildings (2nd ed GST reprint). The contract provided for a due diligence period. During this period, the buyers solicitors discovered that there was no direct access from a public road to the car park entrance. Access to the car park was over a lot of which the Gold Coast City Council was the registered owner under a nomination of trustees, the Council holding the property on trust for car parking and town planning purposes. Due to the absence of a registered easement over the Councils land, the buyers solicitors sought a reduction in the purchase price. The seller would not agree to this. Finally the sale was completed with the buyer reserving its rights to seek compensation.

Though there is much interest in mobilities and performing mobilities as a characteristic of modern, urban, social life today, this is not always matched by attention to immobilities, as the flipside of mobility in modern life. In this paper, I investigate public space performances designed to draw attention to precisely this counterpoint to current discourses of mobilities performances about the socially produced immobilities many people with disabilities find a more fundamental feature of day-to-day life, the fight for mobility, and the freedom found when accommodations for alternative mobilities are made available. Although public policy is increasingly aligned with a social model of disability, which sees disability as socially constructed through systems, institutions and infrastructure deliberately designed to exclude specific bodies stairs, curbs, queues and so forth and although governments in the US, UK, and to a lesser degree Australia, New Zealand and other Commonwealth nations aim to address these inequalities, the experience of immobility is still every-present for many people. This often comes not just from pain, or from impairment, or event from lack of accommodations for alternative mobilities, but from fellow social performers antipathy to, appropriation of, or destruction of accommodations designed to facilitate access for a range of different bodies in public space, and thus the public sphere. The archetypal instance of this tension between the mobile, and those needing accommodations to allow mobility, is, of course, the antipathy many able bodied people feel towards the provision of disabled parking spaces. A cursory search online shows thousands of accounts of antagonism, vitriol, and even violence prompted by disputes which began when a disabled person asked an able person to exit a designated disabled parking space. For many, it seems, expecting them to pass by such parks so others can experience the mobility they take for granted is too much. In this paper, I examine a number of protest performances in public space in which activist present actions for example, placing wheelchairs in every regular parking space in a precinct to give bystanders, passersby and spectators, as well as antagonistic fellow social performers, a sense of what socially produced immobility feels like. I examine responses to such protest performances, and what they say about the potential social, political and ethical impacts of such protests, in terms of their potential to produce new attitudes to mobility, alternative mobility, and access to alternative modes of mobility.

The potential to cultivate new relationships with spectators has long been cited as a primary motivator for those using digital technologies to construct networked or telematics performances or para-performance encounters in which performers and spectators come together in virtual or at least virtually augmented spaces and places. Today, with Web 2.0 technologies such as social media platforms becoming increasingly ubiquitous, and increasingly easy to use, more and more theatre makers are developing digitally mediated relationships with spectators. Sometimes for the purpose of an aesthetic encounter, sometimes for critical encounter, or sometimes as part of an audience politicisation, development or engagement agenda. Sometimes because this is genuinely an interest, and sometimes because spectators or funding bodies expect at least some engagement via Facebook, Twitter or Instagram. In this paper, I examine peculiarities and paradoxes emerging in some of these efforts to engage spectators via networked performance or para-performance encounters. I use examples ranging from theatre, to performance art, to political activism from cyberformaces on Helen Varley Jamiesons Upstage Avatar Performance Platform, to Wafaa Bilals Domestic Tension installation where spectators around the world could use a webcam in a chat room to target him with paintballs while he was in residence in a living room set up in a gallery for a week, as a comment on use of drone technology in war, to Liz Crows Bedding Out where she invited people to physically and virtually join her in her bedroom to discuss the impact of an anti-disabled austerity politics emerging in her country, to Dislifes use of holograms of disabled people popping up in disabled parking spaces when able bodied drivers attempted to pull into them, amongst others. I note the frequency with which these performance practices deploy discourses of democratisation, participation, power and agency to argue that these technologies assist in positioning spectators as co-creators actively engaged in the evolution of a performance (and, in politicised pieces that point to racism, sexism, or ableism, pushing spectators to reflect on their agency in that dramatic or daily-cum-dramatic performance of prejudice). I investigate how a range of issues from the scenographic challenges in deploying networked technologies for both participant and bystander audiences others have already noted, to the siloisation of aesthetic, critical and audience activation activities on networked technologies, to conventionalised dramaturgies of response informed by power, politics and impression management that play out in online as much as offline performances, to the high personal, social and professional stakes involved in participating in a form where spectators responses are almost always documented, recorded and re-represented to secondary and tertiary sets of spectators via the circulation into new networks social media platforms so readily facilitate complicate discourses of democratic co-creativity associated with networked performance and para-performance activities.

El propsito del presente trabajo es hacer un anlisis de los estacionamientos en el centro de Bogot y sus factores asociados, como precios y uso de los mismos, buscando una relacin con la movilidad en ese sector de la ciudad, a partir del anlisis de las estrategias de gestin de la demanda de transporte. En el trabajo se hace un recorrido por los temas ms relevantes sobre estacionamientos. En primer lugar, se discute la importancia de hablar sobre estacionamientos a partir de los conceptos de distintos autores. Posteriormente, se analiza la normatividad que encierra este tema, para adentrarse en el anlisis del rea de estudio seleccionada por el autor. Finalmente, se analiza la pertinencia de la implementacin de estrategias de demanda de transporte y se presentan recomendaciones para mejorar la situacin actual de los estacionamientos tanto en el rea de estudio como en la ciudad.

A escolha da cidade do Rio de Janeiro como sede de grandes eventos esportivos mundiais, a Copa do Mundo de Futebol de 2014 e os Jogos Olmpicos de 2016, colocou-a no centro de investimentos em infraestrutura, mobilidade urbana e segurana pblica, com consequente impacto no mercado imobilirio, tanto de novos lanamentos de empreendimentos, quanto na revenda de imveis usados. Acredita-se que o preo de um imvel dependa de uma relao entre suas caractersticas estruturais como quantidade de quartos, sutes, vagas de garagem, presena de varanda, tal como sua localizao, proximidade com centros de trabalho, entretenimento e reas valorizadas ou degradadas. Uma das tcnicas para avaliar a contribuio dessas caractersticas para a formao do preo do imvel, conhecido na Economtrica como Modelagem Hednica de Preos, uma aplicao de regresso linear multivariada onde a varivel dependente o preo e as variveis independentes, as respectivas caractersticas que deseja-se modelar. A utilizao da regresso linear implica em observar premissas que devem ser atendidas para a confiabilidade dos resultados a serem analisados, tais como independncia e homoscedasticidade dos resduos e no colinearidade entre as variveis independentes. O presente trabalho objetiva aplicar a modelagem hednica de preos para imveis localizados na cidade do Rio de Janeiro em um modelo de regresso linear multivariada, em conjunto com outras fontes de dados para a construo de variveis de acessibilidade e socioambiental a fim de verificar a relao de importncia entre elas para a formao do preo e, em particular, exploramos brevemente a tendncia de preos em funo da distncia a favelas. Em ateno aos pr-requisitos observados para a aplicao de regresso linear, verificamos que a premissa de independncia dos preos no pode ser atestada devido a constatao da autocorrelao espacial entre os imveis, onde no apenas as caractersticas estruturais e de acessibilidade so levadas em considerao para a precificao do bem, mas principalmente a influncia mtua que os imveis vizinhos exercem um ao outro.

Traffic congestion is nothing new in Latin American cities but has worsened in recent years. Eliminating it is a pipedream, but it should be brought under control. Many economists and transport planners think electronic road pricing would be the best way of tackling it, now that the appropriate technology for implementing it is available. On the other hand, experience shows that, for political reasons, it would be better to begin by adopting simpler methods. To start with, simple road pricing would seem to be the best option. But, over 20 years of experience in London and more than six in Santiago, Chile, made it clear that socio-political barriers have to be surmounted before even this option can be applied in practice. There is more political support for measures to control parking, due in part to the fact that the legal powers do not normally extend to restricting the number of parking spaces available to high-income and influential motorists who have the right to park near their offices and who cause a great deal of the congestion whilst getting there. In Latin America, the relative importance of taxis also diminishes the effectiveness of measures geared to parking, since taxis contribute to congestion although but they do not park. The problem of congestion cannot be solved by using tame measures. The time has come for something bolder, i.e., measures that, at the very least, exercise control over those parking spaces, which so far have been beyond the reach of governments and local authorities, ideally, simple road pricing systems would be even more effective.

This pilot project at Cotton Tree, Maroochydore, on two adjacent, linear parcels of land has one of the properties privately owned while the other is owned by the public housing authority. Both owners commissioned Lindsay and Kerry Clare to design housing for their separate needs which enabled the two projects to be governed by a single planning and design strategy. This entailed the realignment of the dividing boundary to form two approximately square blocks which made possible the retention of an important stand of mature paperbark trees and gave each block a more useful street frontage. The scheme provides seven two-bedroom units and one single-bedroom unit as the private component, with six single-bedroom units, three two-bedroom units and two three-bedroom units forming the public housing. The dwellings are deployed as an interlaced mat of freestanding blocks, car courts, courtyard gardens, patios and decks. The key distinction between the public and private parts of the scheme is the pooling of the car parking spaces in the public housing to create a shared courtyard. The housing climbs to three storeys on its southern edge and falls to a single storey on the north-western corner. This enables all units and the principal private outdoor spaces to have a northern orientation. The interiors of both the public and private units are skilfully arranged to take full advantage of views, light and breeze.

As the earths resources continue to face increasing pressure from a variety of human and natural causes, protection of the environment and biodiversity is a matter of contemporary concern, The conservation of coastal and marine resources, in particular, has become a priority for countries around the world. In this context, marine protected areas (MPAs) are being widely promoted as one of the most effective tools for the conservation of coastal and marine resources. Most MPAs are located in coastal areas of great biodiversity, and hence their development has direct impacts on the lives and livelihoods of coastal communities, especially small-scale and traditional fishing communities. Typically, they are the ones who have to bear the costs of conservation practiceslost livelihood options, expulsion from traditional fishing grounds and living spaces, and violation of human/community rights, to name a few. The articles in this dossier, drawn chronologically from the pages of Samudra Report, the triannual publication of ICSF, draw attention to these issues. They show that conservation and livelihoods are closely intertwined, and that top-down, non-participatory models of conservation can be counter-productive. Despite being poor and powerless, fishing and coastal communities can be powerful allies in conservation efforts, given their longstanding dependence on natural resources and their traditional ecological knowledge systems. As the examples in this dossier reveal, it is possible for fishing communities to protect and conserve the environment, while continuing with sustainable fishing operations. Clearly, only an integrated approach to fisheries management and conservation will prove successful. This dossier will be useful for policymakers, social scientists, non-governmental organizations and others interested in fisheries, conservation, communities and livelihoods.
