This thesis is shows the result of the research work on the inherent Powers of the High Court in criminal jurisdiction. The criminal justice system in India recognizes inherent powers only of the High Court. The Theory and Philosophy of inherent powers are concerned the Distinction between civil and Criminal laws are of very little consequence. In formulating the research programme the confusion created by the concept of inherent powers and its application by High Court form the central point. How fully the concept is understood, how correctly the power is used, and how far it has enhanced the rationale of the administration of criminal justice, what is its importance and what are the solutions for the inherent power to earn a permanent status in the province of criminal jurisprudence are the themes of this study. The precipitation of new dimensions is the yardstick to acknowledge the inherent powers of the High Court and Supreme Court. It is of instant value in criminal justice system. This study concludes innovativeness provided by the inherent powers has helped the justice administration draw inspiration from the Constitution. A jurisprudence of inherent powers has developed with the weilding of inherent powers of the Supreme Court and the High Court. It is to unravel mystery of jurisprudence caused by the operation of the concept of inherent powers this research work gives emphasis. Its significance is all the more relevant when the power is exercised in the administration of criminal justice. Application or non application of inherent powers in a given case would tell upon the maturity and perfection of the standard of justice

The present dissertation, elaborated is based on the deductive method, through the use of the General Theory of Resources concepts, by the main types of judgments existing in the Code of Civil Procedure, the interlocutory judgment and sentence, as well as the features and effects that challenge these decisions, we sought to identify on this theme one of the greatest evils facing the justice system in the world, which is the processing delays. This slowness in adjudication affects seriously the principle of effectiveness, one of the postulates of procedural law and society as a whole. Thus, the use of tort serves to fight the interlocutory decision and appeal which challenges the judge`s ruling. It is a resource for excellence in appellate system as it meets with the most awaited decision of the process. In weighing the importance of the appeal that seeks to oppose the court decision today by the numerous reforms that the procedural system has been through, it has ended up to transform the process ineffective or inconsistent, for it is much easier to have efficacy in a interlocutory decision for preliminary injunction than by judgment on the merits of the judge. This is due to the prevision of the resources and their effect to those decisions. That is, the interlocutory decision involves interlocutory appeal only in the devolved effect, allowing its provisional execution, and the sentence has as recourse to appeal the double effect, remanding and suspension, which necessarily prevents its provisional execution. But it undeniably shows a paradox, because as to give effect to a measure that is based on a mere probability by a summary cognition, partial and superficial, and stop it on a decision by a court that is closer to the truth and sure, for a full and depleting cognition? It is seriously affect the principle of effectiveness. Therefore, starting from this ineffectiveness, sought to defend the solution of this problem with the approval of the bill n. º 3.605/2004 or the new Code of Civil Procedure project that modifies the general rule the effects of appeal. That is, remanding and suspensive, as to merely remanding effect to and thereby enable the provisional execution of the judgment of the court of the first degree of jurisdiction, giving effectiveness and enhancing the decision of the magistrate, making a fair distribution of time in the process and better guaranteed principle of access to justice

O presente estudo examina a técnica da distribuição dinâmica do ônus da prova e a possibilidade de sua aplicação no direito brasileiro, incluindo a sua disciplina no Projeto do Novo Código de Processo Civil. Abordaremos as bases principiológicas da dinamização dos ônus probatórios, bem como os entendimentos doutrinários e jurisprudenciais que já sustentam a possibilidade da dinamização do ônus da prova com base no ordenamento jurídico atualmente vigente. Sustentaremos, todavia, que a adoção da técnica da dinamização do ônus da prova no ordenamento jurídico brasileiro seria cabível somente de lege ferenda, com a aprovação do Projeto do Novo CPC pelo Congresso Nacional. Por fim, no intuito de estabelecer os melhores critérios para utilização da técnica da distribuição dinâmica do ônus da prova, foram analisados os dispositivos contidos no Projeto do Novo CPC, para vislumbramos que a aplicação da técnica, deverá ser excepcional. Analisamos ainda que o magistrado brasileiro deverá aprimorar a sua função de organizador da fase instrutória do processo. Sustentaremos que a técnica da dinamização do ônus da prova é suplementar aos poderes instrutórios do juiz. Todavia, como existem limites materiais, de cunho prático, ao exercício dos poderes instrutórios do magistrado, a técnica da distribuição dinâmica do ônus da prova se mostra útil e eficaz ao sistema processual brasileiro. Assim, o juiz deverá se valer na sentença da técnica da dinamização do ônus da prova em desfavor da parte que deu causa à dificuldade ou impossibilidade de produção da prova, inviabilizando o acesso a determinado meio de prova.
