Este trabalho tem por objetivo analisar a sustentabilidade da Assistência na Doença aos Militares (ADM), enquanto sistema autofinanciável. O autofinanciamento da ADM, com recurso exclusivo aos descontos efetuados pelos beneficiários, está, aparentemente em contradição com as disposições legais associadas à condição militar e isenta o Estado das suas obrigações. Esta é uma temática atual, cuja análise justifica um tratamento específico e singular, em consonância com as particularidades da condição militar, devendo, por isso, ser ponderados os diversos fatores condicionantes. Assim, partindo das despesas processadas pela ADM face às fontes de financiamento existentes, tentamos responder à questão central formulada - “Em que medida a ADM é sustentável e autofinanciável, com recurso exclusivo aos descontos dos beneficiários?”. Analisamos também se o regime optativo coloca em causa a sustentabilidade da ADM e em que medida esta decisão é condicionada pela perceção de que as disposições legais, relativas à condição militar, estão ou não a ser cumpridas. Concluímos que a ADM não é um sistema autofinanciável com recurso exclusivo aos descontos dos beneficiários, pelo menos por agora, pois suporta despesas que não são sua responsabilidade. Verificamos também que a maioria dos inquiridos, em caso de regime optativo, optaria por não descontar para a ADM, considerando o desconto elevado. Abstract: The Self-financing of the assistance in disease to Military (ADM) , with exclusive resource at the beneficiaries discounts , is disassociated from the military condition and relieves the State of its obligations. This is a current topic, whose analysis justifies specific and unique treatment in consonance with the characteristics of the military condition and should therefore be considered the various conditioning factors. This work aims to analyze the ADM sustainability, while a self-financing system. Thus, based on the expenses processed by ADM, as compared with existing funding sources, we try to answer the central question formulated - "To what extent ADM is sustainable and self-financing, with exclusive resource at the discounts of beneficiaries?". We also analysed if the optional regime puts into question the sustainability of ADM and to what extent this decision is conditioned by the perception that the legal provisions relating to the military condition, are being met or not. We conclude that ADM is not a self-financing system, with exclusive resource at the discounts of beneficiaries, at least for now and that supports expenses that are not their responsibility. We also verified that the majority of the inquired, would choose not discount for ADM, if optional regime is available, and considers the discount high.

À semelhança do que acontece noutros países, é essencial analisar o sistema dual de polícia que se encontra em vigor em Portugal. Existem países cujas reformas têm implicado a criação e desenvolvimento de forças tipo Gendarmerie, e outros países em que se tem assistido à sua extinção. Assim, o presente Trabalho de Investigação Aplicada visa compreender a importância da GNR como força Gendarmerie e, tendo em consideração as alterações que se têm vindo a verificar ao nível das forças deste tipo, quais as linhas força de reconfiguração para a GNR. A investigação inicia-se com o estudo da génese das forças de Gendarmerie e são analisados casos de evolução e dissolução deste tipo de forças, nomeadamente: França, Espanha, Itália, Bélgica e Áustria. São identificadas as potencialidades e vulnerabilidades destas forças e os seus fatores de evolução e dissolução. A Guarda Nacional Republicana é abordada enquanto força de segurança de natureza militar, ao nível da sua tutela, das suas missões, da sua organização e da própria condição militar. A metodologia adotada no trabalho segue o método hipotético-dedutivo. Neste sentido, estabelecem-se questões derivadas com o intuito de responder ao objetivo do estudo (questão central) e para cada uma delas é formulada uma hipótese de investigação. Como forma de recolha de dados, realiza-se uma entrevista a oito elementos da área da segurança interna. De acordo com os dados obtidos, as hipóteses de investigação são verificadas e responde-se às questões derivadas. Consequentemente, dá-se resposta à questão central. Conclui-se que a GNR face aos fatores de dissolução de Gendarmeries deve evitar as suas fraquezas e, eventuais ameaças, devendo potenciar algumas das suas valências e tirar partido dos seus pontos fortes.

Transcript (original spelling and grammar retained): By His Excellency Robert Prescott Esquire, Captain General and Governor in Chief in and over His Majestys Provinces of Upper and Lower Canada, General and Commander in Chief of all His Majesty’s forces in the Provinces of Upper and Lower Canada, Nova Scotia, New Brunswick and their several Dependencies and in the Island of Newfoundland &ca. &ca. &ca. I do hereby authorise and permit Thomas Clark of Queenstown in the County of Lincoln in the Province of Upper Canada merchant to take possession of all that Lot, piece and parcel of Land (being part of the land reserved by his Majesty for Military purposes) situate, lying and being at Queenstown in the Township of Newark, in the Home District in the said Province of Upper Canada, bounded and abutted as follows, that is to say beginning at the Distance of two Chains and ninety links from the South East End of his Majesty’s Store House, the said distance being measured along the Bank up Stream, thence South thirty nine degrees and an half West one Chain and fifty links thence south fifty degrees and an half East one Chain and thirty links thence North thirty nine degrees and an half East to the Edge of the Bank and from thence along the Bank to the place of beginning, containing thirty one perches and one hundred and twenty five square links and to occupy and hold the said Lot, piece and parcel of Land during pleasure subject nevertheless to the provisoes and Conditions herein after contained, that is to say. First on condition that it shall and may be lawful to and for His Majesty his Heirs and Successors and to and for the Commander in Chief of His Majesty Forces for the time being and to and for the Officer commanding his Majesty’s Forces in Upper Canada for the time being and to and for either of them to determine and make void this present permission to occupy during pleasure the said Lot, Piece or Parcel of Land above described at any time hereafter whenever he or they shall see fit so to do without any compensation or indemnification to the said Thomas Clark or any other Person or Persons whosoever for any Loss Injury or Damage which he the said Thomas Clark or any other Person or Persons whosoever may thereby sustain. Secondly on this further Condition that it shall and may be lawful to and for His Majesty his Heirs and Successors and to and for his and their Officers, Soldiers and Servants at any time hereafter by order of the Commander in Chief of His Majesty’s Forces for the time being or by order of the Officer commanding his Majesty’s forces in Upper Canada for the time being or by order of the Officer of His Majesty’s Corps of Royal Engineers commanding in the said Province of Upper Canada for the time being to enter upon the said Lot Piece and parcel of Land which the said Thomas Clark is hereby permitted to occupy during pleasure or upon any part thereof and to take down and from the said Lot piece and parcel of Land or from any part thereof to remove any dwelling House Store or other Buildings on the said Lot, piece or Parcel of Land or any part thereof erected and to remove any goods or Chattels on the said Lot piece and parcel of Land or on any part thereof or on any such dwelling House Store or other building found or being and that His Majesty his Heirs and Successors or any other Person or Persons whosoever shall not be liable or responsible to the said Thomas Clark or to any other Person or Persons whosoever for any Loss, Injury or Damage which he or they shall or may in such case sustain. Thirdly on this further Condition that the said Thomas Clark shall not erect on the said Lot Piece or Parcel of Land which the said Thomas Clark is hereby permitted to occupy during pleasure or upon any part thereof at any time or times hereafter any dwelling House store or other Building whatsoever of Stone or brick or of any other materials wood only exccepted and that if any dwelling House or Store or other building of Stone or brick or of any other materials except wood shall at any time be erected on the said Lot, piece or parcel of Land or upon any part thereof, then and in such case, this present permission and every Clause and Article thereof shall from thenceforth cease and determine and be absolutely and entirely null and void. This layer is a georeferenced raster image of the historic paper map entitled: A complete representation of the coast of England, together with the interior, divided into counties and military districts : also the coast of France and Holland from the Texel to Brest ... to which is annexed eighteen plans of the ports of the enemy, the principal depôts of the flotilla intended for the invasion of England, by John Luffman, Geogr. It was published by J. Luffman in 1804. Scale [ca. 1:2,500,000]. The image inside the map neatline is georeferenced to the surface of the earth and fit to the 'British National Grid' coordinate system. All map collar and inset information is also available as part of the raster image, including any inset maps, profiles, statistical tables, directories, text, illustrations, index maps, legends, or other information associated with the principal map. This map shows features such as drainage, cities and other human settlements, administrative and military district boundaries, shoreline features including distances between selected ports, and more. Includes insets of foreign military installations and index to the military districts. This layer is part of a selection of digitally scanned and georeferenced historic maps from the Harvard Map Collection. These maps typically portray both natural and manmade features. The selection represents a range of originators, ground condition dates, scales, and map purposes.

A difficult transition to a new paradigm of Democratic Security and the subsequent process of military restructuring during the nineties led El Salvador, Honduras, Guatemala and Nicaragua to re-consider their old structures and functions of their armed forces and police agencies. This study compares the institutions in the four countries mentioned above to assess their current condition and response capacity in view of the contemporary security challenges in Central America. This report reveals that the original intention of limiting armies to defend and protect borders has been threatened by the increasing participation of armies in public security. While the strength of armies has been consolidated in terms of numbers, air and naval forces have failed to become strengthened or sufficiently developed to effectively combat organized crime and drug trafficking and are barely able to conduct air and sea operations. Honduras has been the only country that has maintained a proportional distribution of its armed forces. However, security has been in the hands of a Judicial Police, supervised by the Public Ministry. The Honduran Judicial Police has been limited to exercising preventive police duties, prohibited from carrying out criminal investigations. Nicaragua, meanwhile, possesses a successful police force, socially recognized for maintaining satisfactory levels of security surpassing the Guatemalan and El Salvadoran police, which have not achieved similar results despite of having set up a civilian police force separate from the military. El Salvador meanwhile, has excelled in promoting a Police Academy and career professional education, even while not having military attachés in other countries. Regarding budgetary issues, the four countries allocate almost twice the amount of funding on their security budgets in comparison to what is allocated to their defense budgets. However, spending in both areas is low when taking into account each country's GDP as well as their high crime rates. Regional security challenges must be accompanied by a professionalization of the regional armies focused on protecting and defending borders. Therefore, strong institutional frameworks to support the fight against crime and drug trafficking are required. It will require the strengthening of customs, greater control of illicit arms trafficking, investment in education initiatives, creating employment opportunities and facilitating significant improvements in the judicial system, as well as its accessibility to the average citizen.
