Historically, the authority to conclude international treaties was exclusively exercised by administrative bodies (or the chief of state). However, recent studies pointed out that the present legislative bodies have come to play a more active role through ratification or the review of treaties in European and American countries. Harrington (2005) studied judicial reform in British dominions and criticized the past executive-dominant treaty-making process as a “democratic deficit” due to a fear that under this system the nation might be bound by international agreements for which a consensus had not been obtained. These studies indicated that people’s participation in the treaty-making process has increased on a global basis, but neither of them provides sufficient descriptive evidence regarding why and how such procedures were established. The present paper therefore attempts to solve these questions by analyzing the legislative and political process of the treaty-making procedure reform in Thailand’s 2007 constitution as a case study.

Despite the wide range of agendas used in legislative decision-making, the literature has focused almost exclusively on two stylized formats, the so-called Euro-Latin and Anglo-American agendas. As emphasized by Ordeshook and Schwartz [1987], this focus leaves a sizable gap in our understanding of the legislative process. To help address the deficiency, I first define a very broad class of agendas (called simple agendas) whose features are common among agendas used in legislative settings. I then characterize the sophisticated (Farquharson [1969]) voting outcomes implemented by agendas in this class. By establishing a clear connection between the structure of simple agendas and the outcomes associated with them, the characterization extends our understanding of legislative decision-making well beyond the very limited scope of Euro-Latin and Anglo-American agendas.

The increased number of obese children in the United States has prompted many efforts to reduce obesity by predominantly focusing resources to develop better education, awareness, nutrition and physical activity. There has been increased interest within communities and governments to turn to policy makers for help in taking action. The possibility for various health policies geared toward preventing childhood obesity is diverse in nature. In order to understand strategies taken by Texas legislatures to address childhood obesity, this study examines childhood obesity prevention policy recommendations and subsequently uses them to identify relevant legislation. This study follows identified legislation during the 80th Texas legislative session to gain an understanding of the steps that the Texas legislatures are currently taking to prevent childhood obesity. This study concludes that the Texas legislative process was successful at effecting changes in education policy. However, during this legislative session Texas legislators did not follow many strategies and recommendations which may be more effective at reducing childhood obesity. ^

The following is a policy analysis based on the Advocacy Coalition Framework by Paul Sabatier. The study question was who were the stakeholders in the legislative process for the issue of the Texas Youth Commission (TYC) overhaul during the Texas 80th Legislative Session. This analysis included the stakeholders identifying characteristics including beliefs and interests, goals and resources, and finally, the winning legislative solutions as embodied in three bills that were passed. The study linked the stakeholders with three bills and expanded on the literature for the stakeholder group of Policy Brokers. The conclusions were that all stakeholders including Youth Advocates, the Policy People and Policy Brokers were effective in advancing legislative solutions to address the need for an agency overhaul of TYC and that the three new policies will be evaluated in the future as either short term change or long-term reforms based on their implementation. ^

A driving argument behind recent EU treaty reforms was that more qualified majority voting (QMV) was required to reduce the potential dangers of legislative paralysis caused by enlargement. Whilst existing literature on enlargement mostly focuses on the question of what changed in the legislative process after the 2004 enlargement, the question of why these changes occurred has been given far less attention. Through the use of a single veto player theoretical model, this paper seeks to test and explain whether enlargement reduces the efficiency of the legislative process and alters the type of legislation produced, and whether QMV can compensate for these effects. In doing this, it offers a theoretical explanation as to why institutional changes that alter the level of cohesion between actors in the Council have an influence over both the legislative process and its outcomes.

The implementation of term limits on state legislators has provided a wealth of data for study. Florida, the second largest state in the Union with term limits, has not been comprehensively studied. This research examines the effects of term limits on electoral competition, member composition, legislator career paths, legislative leadership, and intra- and inter-governmental influences on Florida's legislature. This study looks at the Florida legislature from 1992 when term limits were enacted through 2004, three electoral cycles in which term limits have been in effect. This study uses both quantitative and qualitative data where appropriate. Electoral data is used to assess electoral and demographic effects, as well as member career trajectories. Interview data with current and former legislators, lobbyists, and executive branch officials is used to analyze both changes in legislative organization and intra- and inter-governmental influences on the legislative process. Term limits has only created greater competition when a legislative seat opens and has actually created a greater advantage for incumbents. Women and minorities have only made minimal gains in winning seats post-term limits. Newly elected legislators are not political novices with a vast majority having previous elective experience. Leadership is more centralized under term limits and the Senate has gained an advantage over the more inexperienced House. Lastly, the influence of staff, lobbyists, and most importantly, the governor has greatly increased under term limits. This research finds that term limits have not produced the consequences that proponents had envisioned.^

Esta pesquisa é um estudo sobre o processo legislativo e a produção de leis na ALES, durante a 16ª Legislatura. O escopo do estudo foi o de analisar o impacto das regras, contidas no regimento interno e na Constituição estadual, na produção de leis entre 2007 e 2010. O pressuposto geral da abordagem advém do Novo Intitucionalismo como movimento teórico da Ciência Política contemporânea, que nos permite inferir que as regras institucionais, para além de serem simples regras de organização das Casas Legislativas, influenciam no processo decisório e, consequentemente, na produção de leis. Importando as análises dos modelos distributivo, informacional e partidário de organização dos Legislativos, a pesquisa permitiu concluir que, a ALES, de 2007 a 2010, manteve seus trabalhos alinhados à versão distributiva. O parlamentar capixaba atuou, individualmente, a fim de manter suas bases eleitorais. Com relação à atuação do sistema comissional, foi identificada a inaptidão das comissões da ALES para influenciar o processo decisório. As comissões permanentes não possuem capacidade de moldar os projetos que por elas tramitam. O regime de tramitação influencia diretamente a produção de leis da ALES, notadamente, nas leis de autoria do Executivo, já que estas, tramitaram, quase que na totalidade, em regime de urgência. No que tange aos partidos, a fragmentação partidária identificada na ALES acaba por refletir nos dados obtidos sobre a produção de leis, na medida em que não existe uma verdadeira articulação em torno dos partidos como atores determinantes no processo legislativo da ALES. Enfim, em apertada síntese, foi possível constatar a imposição da agenda de trabalhos pelo Executivo. Os projetos aprovados, de temas importantes e abrangência estadual, foram, em sua maioria, propostos pelo Executivo; a urgência impacta frontalmente os projetos do Executivo, que são aprovadas em pequeno espaço de tempo; as comissões não possuem poder mínimo de influência nos projetos de autoria do Executivo; e os partidos, altamente fragmentados, não constituem instância com capacidade de articulação.

We report preliminary findings from analysis of a database under construction. The paper explores the legislative process in search for some of the alleged consequences of cabinet coalitions in a presidential system. Coalition effects should be less evident in the success of executive initiatives: strategic behavior hampers this intuitive measure of performance. Better measures, because less subject to strategic considerations, are the odds of passage of legislators' bills and the time proposals take to be approved. Thus measured, coalition effects are discernible. Analysis of the universe of proposals processed in the fragmented Uruguayan Parliament between 1985 and 2000 reveals that coalition, observed about half the period, swells success rates of coalition members by 60% on average (and by as much as 150% for those close to the president). Event history analysis shows that coalitions cut the wait for an executive bill by 3 months, 1/6th the average wait. The reverse effect is felt on the duration of legislators' bills.

This paper analyses how banking regulation was introduced in Switzerland - one of the world's most prominent financial centres - which remained in place until the beginning of the twenty-first century. It shows that the law adopted on 8 November 1934 is a perfect example of capture of the regulator by the regulated. Essentially a political response in the context of the economic crisis of the 1930s, it largely reflected the interests of banking circles by limiting the intervention of the State as much as possible. The introduction of the new legislation was facilitated by the temporary weakness of Swiss banking circles, as they depended on the State to delay or prevent the collapse of many major credit institutions. They did not manage to derail the law as they had two decades earlier when they scuppered the federal bill on banks drawn up between 1914 and 1916. But this time they were better organized and more united, and intervened all the more effectively in the legislative process itself. The 1934 law is thus distinctive in that it made no structural changes to the architecture of the financial centre but merely codified its practices through flexible legislation meant to reassure the public. The law was aimed less at controlling banking activity than at keeping - thanks to skilfully calibrated political concessions - the State from having to intervene more directly in the internal management of banks or in the fixing of interest rates and the export of capital.

Le 28 juin 2012, le Parlement canadien adoptait des modifications à la Loi sur l’immigration et la protection des réfugiés introduisant des changements importants dans le traitement des demandes de protection faites à partir du Canada. Ces modifications incorporent deux nouveaux concepts en droit canadien, le premier étant le pays d’origine désigné, qui figure sur une liste. Ces pays considérés comme « sûrs » sont désignés par arrêté par le ministère de la Citoyenneté et de l’Immigration. Les pays d’origine désignés ne peuvent être source de réfugiés, et les demandeurs d’asile provenant de ces pays reçoivent un traitement particulier. Le deuxième concept est celui d’« étranger désigné » : le ministre de la Sécurité publique et de la Protection civile peut désigner des arrivées de migrants comme étant irrégulières, si ces derniers se présentent aux frontières canadiennes sans les documents réglementaires. Ces étrangers sont obligatoirement mis en détention, et leur demande d’asile, le cas échéant, reçoit aussi un traitement particulier. Ces dispositions soulèvent de nombreuses questions concernant leur validité en vertu de la Charte canadienne des droits et libertés et du droit international. Dans un premier temps, ce mémoire a pour objet de montrer qu’il existe une lacune dans le processus législatif canadien. Lorsqu’un gouvernement est majoritaire au Parlement, il peut faire adopter ses projets de loi sans informer adéquatement l’opposition et les électeurs sur les risques qu’ils présentent de violer les droits et libertés de la personne. À notre avis, cette lacune est problématique, car à notre avis, des lois sont adoptées en violation de la constitution et plus particulièrement de la Charte canadienne des droits et libertés sans que le gouvernement ait à se justifier. Ce mémoire explore l’idée d’utiliser les études d’impact sur les droits de la personne, un modèle d’analyse des lois, règlements et politiques publiques qui vise à évaluer et faire connaître les impacts qu’ils ont ou peuvent avoir sur les droits fondamentaux des personnes affectées. Les cas de la France, de la Grande-Bretagne et de la Commission européenne seront analysés. Ce mémoire examine les dispositions concernant les pays d’origine désigné et les étrangers désignés en vertu de la Charte canadienne et du droit international. Nous concluons que si ces dispositions avaient fait l’objet d’une étude d’impact sur les droits de la personne, le Parlement et les Canadiens auraient été informés des risques de violation des droits fondamentaux des demandeurs d’asile concernés.

This paper describes the relationship between the executive and legislative branches during the first government of Alvaro Uribe Vélez. We will focus on reviewing the legislative output of each branch of power, along with the effectiveness and efficiency they showed as promoters of this production. We will review the impact they had on the legislative agenda setting and on the control of the legislative process  itself, making a diachronic analysis in which each legislature is used as a unit. Thus, we will try to identify the presence (or not) of some kind of pattern interactions,  and we will evaluate, at one hand, the existence of hierarchical and transactional trends, and, on the other, the different types of balances produced  between them.

Este estudo tem como objetivo identificar quais os fundamentos que levam algumas Câmaras Municipais pernambucanas a não acompanhar o parecer prévio do Tribunal de Contas do Estado no julgamento das contas anuais dos prefeitos. Tendo em vista que uma parcela significativa dos julgamentos das contas anuais dos prefeitos realizados pelas Câmaras Municipais não tem acompanhado as recomendações emitidas nos Pareceres Prévios do TCE, inicialmente foram identificadas as abordagens teóricas sobre a estrutura da relação do executivo com o legislativo que oferecem subsídios para o entendimento da face política das Câmaras Municipais nestes julgamentos. Destacou-se também o aspecto técnicoadministrativo viabilizado pelo processo legislativo do julgamento das contas, passível da análise e solicitação de revisão judicial pelo Ministério Público com vistas à anulação, caso não apresente motivação legal formalmente registrada que atenda às disposições constitucionais. O estudo foi realizado por meio de pesquisa bibliográfica, documental e de campo, por meio de entrevistas semiestruturadas com vereadores das Câmaras Municipais pernambucanas. A metodologia qualitativa de análise de conteúdo foi escolhida para a análise dos dados. Os resultados da pesquisa permitiram identificar que os fundamentos que levam algumas Câmaras Municipais pernambucanas a não acompanhar o parecer prévio do Tribunal de Contas no julgamento das contas anuais dos prefeitos não estão formalmente evidenciados no processo legislativo pertinente, cujos documentos oficiais pesquisados não atendem aos requisitos legais de motivação, nem tampouco explicam as razões do não acompanhamento do parecer prévio do TCE. A opinião dos vereadores entrevistados conduz ao entendimento de que tais fundamentos são de natureza política, em detrimento dos fundamentos técnicos, explicados pela relação de preponderância do executivo sobre o poder legislativo municipal.

As interpretações a respeito do funcionamento do presidencialismo de coalizão buscam compreender como o Presidente é capaz de implementar sua agenda política, utilizando, para isso, as suas prerrogativas constitucionais. Sejam eles os poderes legislativos, sejam os de nomeação e de organização das estruturas administrativas. Apesar da existência de uma vasta literatura a respeito do processo legislativo e das relações entre o Legislativo e o Executivo, ainda são poucos os estudos sobre a dinâmica interna de funcionamento do Executivo e do impacto da dinâmica política – a formação do gabinete – sobre as políticas públicas. O presente trabalho analisa a constituição do Programa de Aceleração do Crescimento (PAC), enquanto mecanismo de coordenação criado pelo Presidente, analisando o contexto político, o papel da Casa Civil e as experiências anteriores de coordenação de investimentos prioritários. Do mesmo modo, investiga os possíveis impactos do PAC no Ministério dos Transportes.
