Objective: Evaluate the legal actions and behavior in the doctor/patient relationship, used by dental surgeons practicing orthodontics. Methods: The population sample of the present study consisted of dental surgeons, active in the field of orthodontics, and registered with Dental Press Publishing Company - Maringá/PR, Brazil, with a total sample size of 525 professionals. The research was conducted using a 17-question survey forwarded to these professionals. Results and Conclusions: The majority of participants in our study are specialized in orthodontics; 75% of professionals use some sort of contract at the office/clinic; 73.7% of professionals periodically request maintenance X-rays; a large percentage of professionals (58.9%) keep patient records on file for life. The interviewed professionals demonstrate good knowledge of the Brazilian Code of Ethics in Dentistry, especially of Chapter XIV - on Communication.

The purpose of this paper is to investigate the essential elements of sport management in Australia in the 1990's. The essential purpose is to view these elements from a legal perspective. In the past 12 months there has been at least three conferences in the sports law area. The majority of this paper has been allocated to the area of legal liability, especially the legal relationships evolving between the player and his co-participant, the player and his club, the player and his coach, and the duties and liabilities of the coach and the club. The area of insurance will also be discussed as it is a vital element in protecting the players, coaches and clubs in the event of any litigation. A well publicised case was that of Rogers v Bugden where the plaintiff Steven Rogers, who was a first grade rugby league football player for Cronulla, suffered a broken jaw and sued his co-participant Mark Bugden and Bugden's employer Canterbury/Bankstown District Rugby League Football Club. It was held that there was a contract of employment and Canterbury/Bankstown was found to be vicariously liable and was ordered to pay Rogers the sum of $68,154.00. The legal actions in tort and negligence are increasing. Sports managers will need to investigate thoroughly the protection available for their clients.

The concept of police accountability is not susceptible to a universal or concise definition. In the context of this thesis it is treated as embracing two fundamental components. First, it entails an arrangement whereby an individual, a minority and the whole community have the opportunity to participate meaningfully in the formulation of the principles and policies governing police operations. Second, it presupposes that those who have suffered as victims of unacceptable police behaviour should have an effective remedy. These ingredients, however, cannot operate in a vacuum. They must find an accommodation with the equally vital requirement that the burden of accountability should not be so demanding that the delivery of an effective police service is fatally impaired. While much of the current debate on police accountability in Britain and the USA revolves around the issue of where the balance should be struck in this accommodation, Ireland lacks the very foundation for such a debate as it suffers from a serious deficit in research and writing on police generally. This thesis aims to fill that gap by laying the foundations for an informed debate on police accountability and related aspects of police in Ireland. Broadly speaking the thesis contains three major interrelated components. The first is concerned with the concept of police in Ireland and the legal, constitutional and political context in which it operates. This reveals that although the Garda Siochana is established as a national force the legal prescriptions concerning its role and governance are very vague. Although a similar legislative format in Britain, and elsewhere, have been interpreted as conferring operational autonomy on the police it has not stopped successive Irish governments from exercising close control over the police. The second component analyses the structure and operation of the traditional police accountability mechanisms in Ireland; namely the law and the democratic process. It concludes that some basic aspects of the peculiar legal, constitutional and political structures of policing seriously undermine their capacity to deliver effective police accountability. In the case of the law, for example, the status of, and the broad discretion vested in, each individual member of the force ensure that the traditional legal actions cannot always provide redress where individuals or collective groups feel victimised. In the case of the democratic process the integration of the police into the excessively centralised system of executive government, coupled with the refusal of the Minister for Justice to accept responsibility for operational matters, project a barrier between the police and their accountability to the public. The third component details proposals on how the current structures of police accountability in Ireland can be strengthened without interfering with the fundamentals of the law, the democratic process or the legal and constitutional status of the police. The key elements in these proposals are the establishment of an independent administrative procedure for handling citizen complaints against the police and the establishment of a network of local police-community liaison councils throughout the country coupled with a centralised parliamentary committee on the police. While these proposals are analysed from the perspective of maximising the degree of police accountability to the public they also take into account the need to ensure that the police capacity to deliver an effective police service is not unduly impaired as a result.

Purpose: Businesses cannot rely on their customers to always do the right thing. To help researchers and service providers better understand the dark (and light) side of customer behavior, this study aims to aggregate and investigate perceptions of consumer ethics from young consumers on five continents. The study seeks to present a profile of consumer behavioral norms, how ethical inclinations have evolved over time, and country differences. ---------- Design/methodology/approach: Data were collected from ten countries across five continents between 1997 and 2007. A self-administered questionnaire containing 14 consumer scenarios asked respondents to rate acceptability of questionable consumer actions. ---------- Findings: Overall, consumers found four of the 14 questionable consumer actions acceptable. Illegal activities were mostly viewed as unethical, while some legal actions that were against company policy were viewed less harshly. Differences across continents emerged, with Europeans being the least critical, while Asians and Africans shared duties as most critical of consumer actions. Over time, consumers have become less tolerant of questionable behaviors. ---------- Practical implications: Service providers should use the findings of this study to better understand the service customer. Knowing what customers in general believe is ethical or unethical can help service designers focus on the aspects of the technology or design most vulnerable to customer deviance. ---------- Multinationals already know they must adapt their business practices to the market in which they are operating, but they must also adapt their expectations as to the behavior of the corresponding consumer base. Originality/value: This investigation into consumer ethics helps businesses understand what their customer base believes is the right thing in their role as customer. This is a large-scale study of consumer ethics including 3,739 respondents on five continents offering an evolving view of the ethical inclinations of young consumers.

Over the last several years, Australian media magnate Kerry Packer has sought to maximise the value of the intellectual property assets of the television station Channel Nine. He has made a concerted effort to expand the scope of copyright protection over television broadcasts screened. The television station Channel Nine has taken a number of legal actions against its rivals and competitors - including the Australian Broadcasting Corporation and Network Ten. It has alleged that the broadcasters have used substantial parts of copyrighted television broadcasts without their permission.

A presente tese tem por objetivo defender, sob a visão do direito civil-constitucional e da função promocional do direito, a inter-relação entre os direitos de posse, propriedade e do meio ambiente e a possibilidade de uma ponderação harmoniosa em caso de desequilíbrio entre esses direitos. Utiliza-se para tanto a dimensão analítica, empírica e normativa. A dimensão analítica tem por objetivo investigar os conceitos jurídicos envolvidos na pesquisa, especialmente em relação à propriedade e à sua função socioambiental. A relação entre tais conceitos sobressai através da análise da função socioambiental da propriedade, da posse enfatizando-se os aspectos da legislação ambiental. O direito fundamental ao meio ambiente é estudado como direito e dever de todos conforme disposto no art. 225 da Constituição de 1988, e, nesse ponto, diretamente eficaz nas relações interprivadas. Aborda-se, na dimensão empírica e normativa essencialmente aspectos práticos, com foco na jurisprudência, especialmente do Supremo Tribunal Federal (STF) e do Superior Tribunal de Justiça (STJ). A ponderação harmoniosa entre a propriedade, a posse e o meio ambiente, busca o equilíbrio na efetivação desses direitos, inclusive mediante a aplicação dos princípios do direito econômico. Por meio da ponderação, é possível alcançar, de forma mais eficiente do que o modelo tradicional de subsunção, uma resposta adequada e fundamentada para os casos difíceis, especialmente na efetivação e na restauração do equilíbrio entre a posse, a propriedade e o meio ambiente quando esses princípios, no caso concreto, colidem uns com os outros. Sobretudo, pretende-se concretizar os direitos fundamentais segundo exigências do pós-positivismo, por meio da aproximação entre o Direito e a Ética, com o fim de se alcançar a Justiça para o caso concreto.

Originally applying solely to chefs, waiters, dishwashers and the like, New York City (NYC) regulations governing cabaret employees were altered in 1943 to include musicians and entertainers, who until the late 1960’s would be required to hold a NYC Cabaret Employee’s Identification Card. The introduction of these notorious “police cards” occurred roughly contemporaneously to the emergence in after-hours night clubs in Harlem of a new and supposedly “wild”, improvisatory brand of jazz: bebop. This article adds to the many rather practical theories on why these cards were introduced a more abstract discussion coined in terms of the relationship between suspicion and tradition and focusing on differing essences of law and improvisatory jazz. While law breathes tradition and is suspicious of improvisation and unpredictability, the converse is true of jazz. Allusion to tradition in jazz improvisation is often viewed as a betrayal of its creative and spontaneous nature. And yet it is only through its departure from the stable transmission of past meaning that improvisation gains meaning. Law, in contrast, while appearing to be entirely composed of tradition, to transmit some sort of determinate and fixed meaning, is constantly betraying itself. As no two legal actions can be exactly the same, judges must improvise on tradition and past precedent every time they are asked to decide a case. Law can thus neither dispense with nor be completely determined by tradition. The legal decision instead lies on the border between what it “is” and what it otherwise could be and every judicial act is, in some sense, a species of improvisation. This article uses the cabaret cards to explore this uncertain terrain between law and improvisation, between tradition and suspicion.

This chapter explores whether ethical cultures can be created within a financial market context. Ongoing regulatory and legal actions, and press coverage of these, suggest that a definition of ethical problems in terms of ‘rogue traders’ and ‘bad apples’ would be inadequate, since entire business areas have been resorting to collusive illegal behaviour. The concept of ‘bad barrels’ seems to capture the situation rather better: the culture of firms fails to discourage transgression and indeed supports it. Unpacking the links between regulatory objectives and the cultural settings of firms and their employees, this chapter questions the chances of success of measures such as enhanced controls on individuals and restructured reward mechanisms. Financial firms typically have very flat, nodal structures, within which traders conceptualise themselves as an elite, in contrast to back office staff and also in contrast to managers. Traders’ functions and their occupational mobility mean that their linkages and attachments may be much stronger with others outside ‘their’ firm than their firm and those within it. Performance, camaraderie and their linkages are important in all work situations, yet all the more so for traders in financial markets. Thus, whether regulators and senior management combine to send a clear and consistent message to traders – or whether the logic of the financial marketplace leads some firms to continue send conflicting or ambivalent messages to them – misconduct is likely to continue to be a tough nut to crack.

Les Québécois sont de plus en plus conscients de l’environnement qui les entoure et de l’importance d’en assurer la qualité et la pérennité. Certains phénomènes, tels les changements climatiques, l’accumulation de polluants organiques persistants et l’amincissement de la couche d’ozone, que nous qualifierons de phénomènes environnementaux diffus, sont engendrés par de multiples émetteurs de polluants et ont des effets globaux qui ne peuvent être liés à un événement précis et dont les impacts sont difficiles à identifier et à quantifier pour le moment. En l’absence de preuve quant aux effets qu’auront ces phénomènes diffus sur les citoyens et les difficultés liées à la preuve scientifique du lien causal entre ce dommage et un émetteur de polluant donné, les recours classiques en responsabilité civile et pour troubles de voisinage, prévus aux articles 1457 et 976 C.c.Q., apparaissent inopérants. Nous nous interrogeons donc sur l’existence d’un droit à l’environnement qui conférerait aux citoyens le droit de vivre dans un environnement sain et leur permettrait ainsi de réclamer que cesse toute atteinte environnementale engendrée par ces phénomènes, même si elle n’a pas d’effet directement sur eux. Considérant l’importance de l’efficacité des recours qui pourraient permettre une mise en œuvre de ce droit, nous procéderons à l’analyse de trois sources potentielles d’un droit à l’environnement sous cet angle. À cet effet, nous étudierons les recours constitutionnels et quasi-constitutionnels liés à la Charte canadienne des droits et libertés, à la Charte des droits et libertés de la personne et au recours institutionnel prévu dans la Loi sur la qualité de l’environnement. Considérant l’absence de reconnaissance suffisante d’un droit à l’environnement et de recours efficaces pour en assurer la mise en œuvre, nous proposerons ensuite des pistes de solution afin que puisse être développé un mécanisme permettant une réponse judiciaire aux phénomènes environnementaux diffus.

La question de la responsabilité pénale des intermédiaires techniques est un enjeu central et actuel dans la réglementation du cyberespace. Non seulement les implications économiques sont énormes mais c'est tout le cadre juridique de la responsabilité pénale des intermédiaires techniques qui est en cause. Or, l'environnement Internet comporte des spécificités qui rendent difficiles l'imputation de responsabilité à l'auteur de l'activité illicite qui peut alors se retrouver hors d'atteinte ou insolvable. La poursuite des intermédiaires techniques devient alors une solution envisageable aux autorités chargées de réprimer les délits, compte tenu de l'état de leur solvabilité et dans la mesure où ils sont plus facilement identifiables. Par le fait même, ces derniers se retrouvent alors pris dans l'engrenage judiciaire pour n'avoir que facilité la commission de l'activité en question, n'ayant aucunement pris part à la réalisation de celle-ci. L'absence dans le corpus législatif canadien d'un régime de responsabilité spécifiquement applicable aux intermédiaires techniques nous oblige à baliser les critères qui emportent leur responsabilité pénale, à partir de «principes directeurs» d'imputabilité se dégageant de plusieurs textes nationaux et internationaux. Dans ce contexte, le mémoire étudiera, dans un premier temps, les conditions d'ouverture de la responsabilité pénale des intermédiaires techniques en droit pénal canadien et, dans un deuxième temps, répondra à la question de savoir si le droit pénal canadien en matière d'imputabilité des intermédiaires techniques est conforme aux principes directeurs ressortant de normes et pratiques internationales.

El trabajo constituye en primer lugar, un ejercicio importante de recopilación y sistematización de la regulación existente en materia de competencia, y en especial, de la colusión en licitaciones como una de las prácticas restrictivas de la Competencia. De igual forma, contiene un análisis microeconómico de un cartel, a efectos de explicar las razones que lo promueven y lo desestimulan. Luego de ello, se hace un análisis profundo de las normas específicas en la materia, contenidas en el Decreto 2153 de 1992 y la Ley 1474 de 2011 y de las acciones que eventualmente podrían iniciarse para combatirla, dependiendo del momento en que se encuentre la licitación y del bien jurídico que pretenda protegerse.

A la Deriva es un documental de 2013 realizado por Laura Díaz y Sara Trejos, estudiantes de periodismo y sociología de la Universidad del Rosario. Cuenta la historia de la crisis laboral de los trabajadores del Hospital San Juan de Dios de Dios y el Instituto Materno Infantil en la ciudad de Bogotá que dejaron de funcionar en el año 2001 sin darles término ni liquidación a más de 1500 trabajadores, quienes aún esperan una respuesta. Este trabajo audiovisual busca acercar al espectador a la vida cotidiana y a los tipos de lucha de cinco de los grupos afectados por este conflicto, con el fin de contradecir el imaginario general de que existe una única forma de hacer resistencia a una crisis, y por el contrario dar a conocer las múltiples estrategias de lucha, que pueden ir desde las tradicionales acciones de hecho, pasar por acciones legales, hasta ocupar un espacio o simplemente crear y fortalecer redes entre amigos y conocidos.

El artículo explora los usos que del derecho colonial hicieron los indígenas en la última etapa de este período de la dominación española, que va desde las reformas borbónicas hasta la Independencia (1750-1810). La primera parte, resultado de una revisión historiográfica, da cuenta de cómo la inicial pretensión del régimen colonial de conservar los sistemas jurídicos indígenas derivó en la creación de un régimen jurídico diferenciado, que separaba la “república de indios” de la “república de españoles”; separación que, si bien no fue efectiva en preservar las tradiciones legales prehispánicas, permitió diversos usos del Derecho como mecanismo de adaptación y resistencia. La segunda parte del texto ilustra estos usos del Derecho, con algunas actuaciones jurídicas de indígenas a finalesdel siglo xviii y principios del xix en el Nuevo Reino deGranada.

El ensayo examina el proceso judicial de una monja en Cuenca, a inicios del siglo XVIII, que buscaba regresar a la ""vida mundana"" y anular su profesión y hábito. Este caso permite mostrar la mentalidad barroca, acercarse a la construcción cultural del cuerpo y a la situación de las mujeres. A partir de los fragmentos disponibles del juicio, el artículo sugiere que Martina Catalina de Barzallo reivindicó el retomo a la vida mundana y el rechazo a las prácticas coercitivas propias de la vida monástica.
