This article argues that copyright law is not just a creature of statute, but it is also a social and imaginative contruct. It evaluates a number of critiques of legal formalism. Part 1 examines whether the positive rules and principles of copyright law are the product of historical contingency and political expediency. Part 2 considers the social operation of copyright law in terms of its material effects and cultural significance. Part 3 investigates the future of copyright law, in light of the politics of globalisation and the impact of new information technologies.

This thesis provides a cultural history of Australian copyright law and related artistic controversies. It examines a number of disputes over authorship, collaboration, and appropriation across a variety of cultural fields. It considers legal controversies over the plagiarism of texts, the defacing of paintings, the sampling of musical works, the ownership of plays, the co-operation between film-makers, the sharing of MP3 files on the Internet, and the appropriation of Indigenous culture. Such narratives and stories relate to a broad range of works and subject matter that are protected by copyright law. This study offers an archive of oral histories and narratives of artistic creators about copyright law. It is founded upon interviews with creative artists and activists who have been involved in copyright litigation and policy disputes. This dialogical research provides an insight into the material and social effects of copyright law. This thesis concludes that copyright law is not just a ‘creature of statute’, but it is also a social and imaginative construct. In the lived experience of the law, questions of aesthetics and ethics are extremely important. Industry agreements are quite influential. Contracts play an important part in the operation of copyright law. The media profile of personalities involved in litigation and policy debates is pertinent. This thesis claims that copyright law can be explained by a mix of social factors such as ethical standards, legal regulations, market forces, and computer code. It can also be understood in terms of the personal stories and narratives that people tell about litigation and copyright law reform. El Estado de Derecho se asienta en una serie de condiciones esenciales para el normal desenvolvimiento de una república. Entre esas condiciones figura la independencia política de los jueces, es decir, la imparcialidad de los magistrados en la tarea de administrar justicia. Dicha imparcialidad suele asociarse a la idea de afianzar la justicia “tratando igual a los iguales". Para el formalismo jurídico tradicional, eso implica aplicar la ley vigente sin apelar a las preferencias políticas ni a los valores morales de los jueces. Sin embargo, la pretensión de imparcialidad parece imposible de alcanzar en los “casos difíciles", es decir, en aquellos casos en que no parece existir una única solución que pueda obtenerse por vía deductiva a partir de la ley vigente. El presente trabajo discute el alcance de tal pretensión a la luz de una propuesta desafiante y perturbadora gestada al seno del pragmatismo jurídico norteamericano.

Die neuen Paradigmen der Rechtswissenschaft nötigen uns beim Erwerb juristischen Wissens dazu, uns in eine kreativere und problemorientiertere Dynamik des Lehrens-Lernens einzugliedern. Die neuen Generationen der Rechtsgelehrten sollten darum bemüht sein, die verschiedenen theoretisch-methodologischen Strömungen des Rechts, z.B. des juristischen Realismus, den juristischen Strukturalismus sowie die angewandte juristische Soziologie zu studieren und zu analysieren. Andererseits sollten sie nicht dogmatisch und ausschliesslich den juristischen Positivismus des 19. Jahrhunderts vertreten. Die juristischen Fakultäten und Schulen der Republik Mexiko zeichnen sich dadurch aus, dass sie die traditionelle juristische Lehre bewahren. Darin liegt der Grund, dass es nur wenige Juristen gibt, die sich der juristischen Forschung und der wissenschaftlichen Praxis widmen.

Ante la crisis mundial (por el fin de la época del Estado-nación y el inicio de la aldea global), resulta prioritario repensar las categorías con las que comprendemos el mundo. En este caso, se invita a la reflexión sobre la normatividad social, para hacer ver que no sólo es jurídica, también lo es ético-moral, entre otras. Incluso, la normatividad jurídica no se limita a un conjunto de principios y preceptos, sino que dispone también de una dimensión subjetiva, relativa a las relaciones jurídicas. Éstas dependen del grado de intervención de la voluntad que, a su vez, se ve influenciada por las normas ético-morales. En definitiva, aquí no sólo se denuncian las falacias del positivismo formalista de Estado, sino que se busca la reafección político-jurídica del sistema (frenando la entropía social en ciernes), además de ofrecerse un paradigma normativo adecuado a laglobalización: el normativismo iberoamericano basado en la ética humanista.

Global legal pluralism is concerned, inter alia, with the growing multiplicity of normative legal orders and the ways in which these different orders intersect and are accommodated with one another. The different means used for accommodation will have a critical bearing on how individuals fare within them. This article examines the recent environmental jurisprudence of the European Court of Human Rights to explore some of the means of reaching an accommodation between national legal orders and the European Convention. Certain types of accommodation – such as the margin of appreciation given to states by the Court – are well known. In essence, such mechanisms of legal pluralism raise a presumptive barrier which generally works for the state and against the individual rights-bearer. However, the principal focus of the current article is on a less well-known, recent set of pluralistic devices employed by the Court, which typically operate presumptively in the other direction, in favour of the individual. First, the Court looks to instances of breaches of domestic environmental law (albeit not in isolation); and second, it places an emphasis on whether domestic courts have ruled against the relevant activity. Where domestic standards have been breached or national courts have ruled against the state, then, presumptive weight is typically shifted towards the individual.

This article explores the role of women's inheritance and ownership of property in urban Senegal. It shows how being able to inherit and own property promotes the economic and emotional security of widows and their children in urban areas, and discusses the challenges posed by legal pluralism in working on poverty alleviation and social protection in the city.

The aim of this article is to contribute to the current academic debate on pluralistmechanisms of post-national governance as a particular type of ‘stateless law’. Moreprecisely, this article is conceived as an introduction to aid further research on the shape(and extent) that post-national governance may eventually assume (and reach) in SouthAfrica. Attention is, therefore, paid to legal pluralism as a key factor of pluralist settings ofpost-national government. An overview of the essence and features of post-nationalgovernance is provided, and a brief comparison is made between hard hierarchical andsoft-networked forms of governance. In pursuing the suggested roadmap, reference is madeto the current European landscape on post-national governance, which is ontologicallyinevitable in discussing the essence, structure, aims, challenges and limitations ofpost-national governance. Moreover, the necessity of adopting a comparative modusinvestigandi is due to the circumstance that although South Africa and the EuropeanUnion (EU) share important elements (e.g., legal pluralism, financial instability andfuture common challenges), South Africa has an extremely progressive constitution — aresult that the EU has been unable to achieve formally. Thus, while explaining whySouth Africa may represent fertile ground for such an architecture of governance, this articlediscusses why the South African Constitution may be a ‘value add’ that may help post-national governance avoid the difficulties thus far encountered on the Europeancontinent.
