O processo de globalização e o grande fluxo de mão de obra levaram à edição da lei 7064/1982 (“Mendes Junior”) responsável por regular os direitos dos trabalhadores transferidos temporariamente para o exterior. De acordo com essa norma, àqueles empregados transferidos para outros países é assegurado o recolhimento de FGTS e INSS, além do pagamento de outras verbas trabalhistas dispostas na lei. Contudo, a essa legislação editada em 1982 se tornou inócua e desatualizada diante das novas relações de trabalho que lhe foram apresentadas. O presente trabalho pretende analisar o âmbito de aplicação da Lei Mendes Junior através do estudo de caso, onde o empregado é transferido para o exterior sem animus de volta e em caráter definitivo e, em virtude dessa transferência, tem o seu contrato de trabalho rescindido com a empresa brasileira e é admitido por uma empresa estrangeira, integrante do mesmo grupo econômico da sua empregadora original. Através de uma análise sistemática dos dispositivos da lei, é possível observar que a Lei Mendes Junior foi proposta com o objetivo principal de proteger os empregados que foram transferidos para o exterior com a expectativa de retorno para o Brasil. A interpretação da lei confirma a assertiva acima de que a legislação não foi criada para as transferências definitivas. Por fim, o trabalho em epígrafe oferece uma proposta legislativa para dirimir a lacuna da lei.

Indústria farmacêutica de hoje está em transição. Como grandes blockbuster drogas estão perdendo ou estão prestes a perder a proteção de patente, e as grandes empresas farmacêuticas não estão substituindo os produtos com novas drogas químicas inovadoras, a indústria busca novas áreas de crescimento. Uma dessas áreas é o mercado de biossimilares, que está sendo inseridos por produtos farmacêuticos, genéricos e empresas de produtos biológicos. Mesmo que o grande potencial de mercado será acordado por volta de 2020, quando importantes blockbusters biológicos perder a proteção de patente, as empresas precisam decidir logo se querem participar ou não devido a elevadas barreiras à entrada técnicos, bem como de desenvolvimento de longo prazos. Como todas as empresas vêm de diferentes origens, compreendem capacidades diferentes e têm diferentes incentivos de entrada, a questão que surge é se esses fatos estão relacionados com as suas estratégias de entrada correspondentes. A tese utiliza estudos de caso de cada segmento da indústria farmacêutica - produtos farmacêuticos, biológicos e genéricos - e examina através de entrevistas semi-estruturadas, por isso que os participantes do estudo de caso entrevistados explicitamente escolhido sua estratégia de entrada. Os dados de entrevistas será então ligada a quadros estratégicos da revisão da literatura e irá ser utilizado para uma comparação global e análise. O estudo revelou que o fundo do participante do mercado que influenciam a sua estratégia de entrada. Os principais pontos de influência derivam tanto as barreiras à entrada, bem como os incentivos de entrada. A tese não é possível determinar o sucesso futuro do modo de entrada analisados no novo mercado.

A pesquisa aqui apresentada é uma análise detalhada de estratégias de compra associados à Responsabilidade Social Corporativa das empresas multinacionais e visa identificar os elementos que influenciam na escolha de fornecedores locais e os benefícios que tais estratégias podem trazer a estas empresas. A globalização e a pressão por melhores produtos e menores custos levam empresas a repensarem suas decisões de sourcing. Selecionar competências, recursos e ainda escolher onde comprar ou terceirizar, tornou-se uma decisão estratégica fundamental, e muitas multinacionais optam por usar fornecedores locais como um diferencial e uma plataforma de criação de valor para a empresa e para a sociedade. Enquanto esta abordagem reforça a posição de mercado e garante matérias-primas de qualidade a preços justos, o relacionamento com estes fornecedores traz desenvolvimento econômico e social para as comunidades subdesenvolvidas. Estudos sobre fornecedores locais geralmente focam em vantagens competitivas para as empresas, e na adaptação de cadeias de valor para atender estratégias globais de negócios, no entanto, a difusão do conhecimento sobre a criação de valor compartilhado é ainda limitada. Assim, o objetivo desta pesquisa foi identificar os aspectos de estratégia corporativa, gestão de fornecedores e colaboração que influenciam na criação de valor compartilhado. Dois estudos de casos foram expostos em uma pesquisa qualitativa exploratória com o propósito de avaliar iniciativas que tiveram como base o relacionamento com os fornecedores locais. A análise foi separada em três etapas com o objetivo de identificar (1) influências nas decisões de seleção de fornecedores, (2) aspectos que levam ao sucesso da gestão de fornecedores, e (3) o valor gerado como resultado destas decisões. Conceitos teóricos da CSR, SCM, colaboração e criação de valor compartilhado foram utilizados para apoiar os resultados e as principais conclusões. O resultado da pesquisa revelou que a idéia de co-criação de valor faz parte da cultura da empresa e pode ser considerado um dos motivos pelos quais multinacionais decidem usar fornecedores locais. Contudo, mesmo integrados na estratégia, não garantem criação efetiva de valor compartilhado e diversos componentes em uma estratégia de compras que representam responsabilidade social corporativa devem ser ajustados para motivar mudanças significativas. Ainda, vale lembrar que os elementos de colaboração, tais como a transparência e independência são vitais para melhorar o compromisso entre a multinacional e os negócios locais e criar valor compartilhado.

Studies on innovation and technology management have emphasized the importance of integration between the research and development (R&D) department and others involved with the product development process (PDP) as a relevant practice for the good performance of technological innovation of product activities. This study addresses the topic of transfers of technologies to new product projects and also integration practices between the R&D department and others involved with the PDP. A qualitative study was conducted that was operationalized through two case studies at large high-tech companies: One is Brazilian and the other is a multinational subsidiary in Brazil. Among its main result, this paper represents and analyzes management practices that are favorable to integration in product development projects that demand development and transfer of technologies, such as: participation of R&D personnel in market activities, the adoption of virtual interaction mechanisms, and the application of methods such as technology roadmaps. © Universidad Alberto Hurtado, Facultad de Economía y Negocios.

La Ingeniería de Pruebas está especializada en la verificación y validación del Software,y formalmente se define como: “Proceso de desarrollo que emplea métodos rigurosos para evaluar la corrección y calidad del producto a lo largo de todo su ciclo de vida” [3]. Este proceso comprende un conjunto de métodos, procedimientos y técnicas formalmente definidas las cuales, usadas de forma sistemática, facilitan la identificación de la mayor cantidad de errores y fallos posibles de un software. Un software que pase un proceso riguroso de pruebas es un producto de calidad que seguramente facilitará la labor del Ingeniero de Software en la corrección de futuras incidencias, algunas de ellas generadas tras la implantación en el entorno real. Este proceso constituye un área de la Ingeniería del Software y una especialidad por tanto, de la misma. De forma simple, la consecución de una correcta Verificación y Validación del Software requiere de algunas actividades imprescindibles como: - Realizar un plan de pruebas del proyecto. - Actualizar dicho plan y corregirlo en caso necesario. - Revisar los documentos de análisis de requisitos. - Ejecutar las pruebas en las diferentes fases del desarrollo del proyecto. - Documentar el diseño y la ejecución de las pruebas. - Generar documentos con los resultados y anomalías de las pruebas ya ejecutadas. Actualmente, la Ingeniería de Pruebas no es muy reconocida como área de trabajo independiente sino más bien, un área inmersa dentro de la Ingeniería de Software. En el entorno laboral existe el perfil de Ingeniero de Pruebas, sin embargo pocos ingenieros de software tienen claro querer ser Ingenieros de Pruebas (probadores o testers) debido a que nunca han tenido la oportunidad de enfrentarse a actividades prácticas reales dentro de los centros de estudios universitarios donde cursan la carrera. Al ser un área de inherente ejercicio profesional, la parte correspondiente de la Ingeniería de Pruebas suele enfocarse desde un punto de vista teórico más que práctico. Hay muchas herramientas para la creación de pruebas y de ayuda para los ingenieros de pruebas, pero la mayoría son de pago o hechas a medida para grandes empresas que necesitan dicho software. Normalmente la gente conoce lo que es la Ingeniería de Pruebas únicamente cuando se empieza a adquirir experiencia en dicha área en el ejercicio profesional dentro de una empresa. Con lo cual, el acercamiento durante la carrera no necesariamente le ha ofrecido al profesional en Ingeniería, la oportunidad de trabajar en esta rama de la Ingeniería del Software y en algunos casos, NOVATests: Metodología y herramienta software de apoyo para los Ingenieros de Prueba Junior 4 los recién egresados comienzan su vida profesional con algún desconocimiento en este sentido. Es por el conjunto de estas razones, que mi intención en este proyecto es proponer una metodología y una herramienta software de apoyo a dicha metodología, para que los estudiantes de carreras de Ingeniería Software y afines, e ingenieros recién egresados con poca experiencia o ninguna en esta área (Ingenieros de Pruebas Junior), puedan poner en práctica las actividades de la Ingeniería de Pruebas dentro de un entorno lo más cercano posible al ejercicio de la labor profesional. De esta forma, podrían desarrollar las tareas propias de dicha área de una manera fácil e intuitiva, favoreciendo un mayor conocimiento y experiencia de la misma. ABSTRACT The software engineering is specialized in the verification and validation of Software and it is formally defined as: “Development process which by strict methods evaluates and corrects the quality of the product along its lifecycle”. This process contains a number of methods, procedures and techniques formally defined which used systematically make easier the identification of the highest quantity of error and failures within a Software. A software going through this rigorous process of tests will become a quality product that will help the software engineer`s work while correcting incidences. Some of them probably generated after the deployment in a real environment. This process belongs to the Software engineering and therefore it is a specialization itself. Simplifying, the correct verification and validation of a software requires some essential activities such as: -Create a Test Plan of the project - Update this Test Plan and correct if necessary - Check Requirement’s specification documents -Execute the different tests among all the phases of the project - Create the pertinent documentation about design and execution of these tests. - Generate the result documents and all the possible incidences the tests could contain. Currently, the Test engineering is not recognized as a work area but an area immerse within the Software engineering. The professional environment includes the role of Test engineer, but only a few software engineers have clear to become Test engineers (testers) because they have never had the chance to face this activities within the university study centers where they take study of this degree. Since there are little professional environments, this area is focused from a theoretical way instead of a more practical vision. There are plenty of tools helping the Test engineer, but most of them are paid tools or bespoke tools for big companies in need of this software. Usually people know what test engineering is by starting working on it and not before, when people start acquiring experience in this field within a company. Therefore, the degree studied have not approach this field of the Software engineering before and in some cases the graduated students start working without any knowledge in this area. Because of this reasons explained, it is my intention to propose this Project: a methodology and a software tool supporting this methodology so the students of software engineering and similar ones but also graduated students with little experience in this area (Junior Test Engineers), can afford practice in this field and get used to the activities related with the test engineering. Because of this they will be able to carry out the proper tasks of this area easier, enforcing higher and better knowledge and experience of it.

Objective: We compared temperament and character traits in children and adolescents with bipolar disorder (BP) and healthy control (HC) subjects. Method: Sixty nine subjects (38 BP and 31 HC), 8-17 years old, were assessed with the Kiddie Schedule for Affective Disorders and Schizophrenia-Present and Lifetime. Temperament and character traits were measured with parent and child versions of the Junior Temperament and Character Inventory. Results: BP subjects scored higher on novelty seeking, harm avoidance, and fantasy subscales, and lower on reward dependence, persistence, self-directedness, and cooperativeness compared to HC(all p < 0.007), by child and parent reports. These findings were consistent in both children and adolescents. Higher parent-rated novelty seeking, lower self-directedness, and lower cooperativeness were associated with co-morbid attention-deficit/hyperactivity disorder (ADHD). Lower parent-rated reward dependence was associated with co-morbid conduct disorder, and higher child-rated persistence was associated with co-morbid anxiety. Conclusions: These findings support previous reports of differences in temperament in BP children and adolescents and may assist in a greater understating of BP children and adolescents beyond mood symptomatology.

The aim of this article is to analyze the theoretical model proposed by [Jabbour CJC, Santos FCA. Relationships between human resource dimensions and environmental management in companies: proposal of a model. Journal of Cleaner Production 2008;16(1):5 1-8.] based on the data collected in four Brazilian companies. This model investigates how the phases of the environmental management system can be linked to human resource practices in order to attain continuous improvement of a company`s environmental performance. Our aim is to contribute to a field, which has little empirical evidence. Although the interaction between the phases of the environmental management system and human resource practices is recommended by the specialized literature [Daily BE Huang S. Achieving sustainability through attention to human resource factors in environmental management. International Journal of Operations and Production Management 2001:21(12):1539-52.], the results indicate that most of the theoretical assumptions could not be confirmed in these Brazilian companies. This work deals with the main contributions of human resource dimensions for the environmental management in a company. While the specialized literature concerning the technical aspects of environmental management expands, there is a gap in the bibliography: integrated approaches between human resource dimensions and environmental management. An extensive bibliographical review was undertaken in order to systematize the human resource dimensions and their contributions concerning the effectiveness of the environmental management system. A model that analyses the relationships between these dimensions and the typical phases of an environmental management system is presented, within a perspective of application for academicians and managers. This paper presents the proposal for a reference model for developing software aimed at small companies. Despite the importance of that represent the small software companies in Latin America, the fact of not having its own standards, and able to meet their specific, has created serious difficulties in improving their process and also in quality certification. In this sense and as a contribution to better understanding of the subject they propose a reference model and as a means to validate the proposal, presents a report of its application in a small Brazilian company, committed to certification of the quality model MPS.BR.

The purpose of this research is to analyze the contribution of human resources management throughout the evolutionary stages of environmental management in Brazilian companies. A theoretical framework concerning environmental management and its evolution and the `greening` of the functional and competitive dimensions of human resource management were developed. A methodological triangulation was developed in two complimentary phases. In the first phase, data were collected from 94 Brazilian companies with ISO 14001 certification. The data collected were analyzed and processed using statistical techniques. The conclusions of the first phase supported the second phase of this empirical research. The second phase consisted of a study of multiple cases in four Brazilian companies. The results show evidence of the first known empirical study of contributions of human resource dimensions throughout the stages of environmental management in Brazilian manufacturing companies.

A gap has been identified in the literature on the diagnosis and monitoring of the degree of strategic alignment. The main objective of this article is to diagnose and analyze the strategic alignment profile using the alignment diagnostic profile (ADP) tool, which enables organizations to show visually their degree of strategic alignment. The methodological approach adopted is multiple-case studies, which were conducted at five organizations in the medical diagnostics sector. The results indicate that the ADP enables organizations to understand the steps required to improve their level of alignment and to identify and locate gaps and conflicts.

The study of Information Technology (IT) outsourcing is relevant because companies are outsourcing their activities more than ever. An important IT outsourcing research area is the decision-making process. In other words, the comprehension of how companies decide about outsourcing their IT operations is relevant from research point of view. Therefore, the objective of this study is to understand the decision-making process used by Brazilian companies when outsourcing their IT operations. An analysis of the literature that refers to this subject showed that six aspects are usually considered by companies on the evaluation of IT outsourcing service alternatives. This research verified how these six aspects are considered by Brazilian companies on IT outsourcing decisions. The survey showed that Brazilian companies consider all the six aspects, but each of them has a different level of importance. The research also grouped the aspects according to their level of importance and interdependency, using factorial analysis to understand the logic behind IT outsourcing decision process. A great deal of attention in the supply chain management literature is devoted to study material and demand information flows and their coordination. But in many situations, supply chains may convey information from different nature, they may be an important channel companies have to deliver knowledge, or specifically, technical information to the market. This paper studies the technical flow and highlights its particular requirements. Drawing upon a qualitative field research, it studies pharmaceutical companies, since those companies face a very specific challenge: consumers do not have discretion over their choices, ethical drugs must be prescribed by physicians to be bought and used by final consumers. Technical information flow is rich, and must be redundant and early delivered at multiple points. Thus, apart from the regular material channel where products and order information flow, those companies build a specialized information channel, developed to communicate to those who need it to create demand. Conclusions can be extended to supply chains where products and services are complex and decision makers must be clearly informed about technology-related information. (C) 2009 Elsevier B.V. All have the same lines of production such as glasses, bottles and big bottles. The analysis involves the cash flow comparison of the three companies.

Purpose - The purpose of this paper is to provide a framework for radio frequency identification (RFID) technology adoption considering company size and five dimensions of analysis: RFID applications, expected benefits business drivers or motivations barriers and inhibitors, and organizational factors. Design/methodology/approach - A framework for RFID adoption derived from literature and the practical experience on the subject is developed. This framework provides a conceptual basis for analyzing a survey conducted with 114 companies in Brazil. Findings - Many companies have been developing RFID initiatives in order to identify potential applications and map benefits associated with their implementation. The survey highlights the importance business drivers in the RFID implementation stage, and that companies implement RFID focusing on a few specific applications. However, there is a weak association between expected benefits and business challenges with the current level of RFID technology adoption in Brazil. Research limitations/implications - The paper is not exhaustive, since RFID adoption in Brazil is at early stages during the survey timeline. Originality/value - The main contribution of the paper is that it yields a framework for analyzing RFID technology adoption. The authors use this framework to analyze RFID adoption in Brazil, which proved to be a useful one for identifying key issues for technology adoption. The paper is useful to any researchers or practitioners who are focused on technology adoption, in particular, RFID technology.
