Published in concomitance with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, this volume brings together a group of renowned legal experts and activists from different parts of the world who, from international and comparative perspectives, investigate the right of indigenous peoples to reparation for breaches of their individual and collective rights. The first part of the book is devoted to general aspects of this important matter, providing a comprehensive assessment of the relevant international legal framework and including overviews of the topic of reparations for human rights violations, the status of indigenous peoples in international law, and the vision of reparations as conceived by the communities concerned. The second part embraces a comprehensive investigation of the relevant practice at the international, regional, and national level, examining the best practices of reparations according to the ideologies and expectations of indigenous peoples and offering a comparative perspective on the ways in which the right of these peoples to redress for the injuries suffered is realized worldwide. The global picture painted by these contributions provides a view of the status of relevant international law that is synthesized in the two final chapters of the book, which include a concrete example of how a judicial claim for reparation is to be structured and prescribes the best practices and strategies to be adopted in order to maximize the opportunities for indigenous peoples to obtain effective redress. As a whole, this volume offers a comprehensive vision of its subject matter in international and comparative law, with a practical approach aimed at supporting legal academics, administrators, and practitioners in improving the avenues and modalities of reparations for indigenous peoples

This paper offers a picture of the obligations existing under international and European law in respect of the loss of nationality. It describes international instruments including obligations in this field with direct relevancy for the loss of nationality of Member States of the European Union, but also obligations regarding loss of nationality in regional non-European treaties. Attention is given to two important judicial decisions of the European Court of Justice (Janko Rottmann) and the European Court of Human Rights (Genovese v Malta) regarding nationality. Special attention is devoted to Article 15 of the Universal Declaration of Human Rights, which forbids the arbitrary deprivation of nationality. A survey is provided of possible sub-principles that can be derived from this rule. Finally, some observations are made on the burden of proof in cases of loss of nationality.

Prenant l’affaire Probo Koala en Côte d’Ivoire comme l’élément déclencheur d’une observation, ce mémoire étudie les fondements des mouvements transfrontières illégaux des déchets dangereux des pays développés vers les pays en développement. En effet, nonobstant la pluralité des dispositions juridiques internationales, le transfert des déchets illicites demeure une actualité dans les pays du tiers monde dont particulièrement ceux de l’Afrique noire et à la fois un tabou dans ceux du Nord et du Sud. Les deux domaines proposés, droit international et national, montrent comment les faiblesses et la non-application des dispositions juridiques conduisent à des actes socialement irresponsables. De ce fait, des réformes tant au niveau juridique que judiciaire ainsi que l’implication des parties prenantes sont suggérées comme solutions pour combattre ce fléau.

Este artículo, introductorio al tema, señala la importancia y la actualidad del mismo, distingue entre el juicio declarativo de reconocimiento de las sentencias extranjeras y los laudos arbitrales, los sistemas de reconocimiento y los requisitos de regularidad, el marco legal y los instrumentos internacionales vigentes en Ecuador, el juez competente para conocer del proceso de reconocimiento y la vía correspondiente, los requisitos que deben reunir las sentencias extranjeras y los laudos internacionales para ser reconocidos en caso de que existan tratados y convenios vigentes y en caso de que no existan tales instrumentos, caso en el cual debe aplicarse la reciprocidad o analogía internacional, si cabe pedir la ejecución sin alcanzar previamente el exequatur cuando se amparan en un tratado o convenio internacional, y la ejecución de la sentencia y el laudo reconocidos. Concluye con la lista de los países que han ratificado los instrumentos internacionales de los cuales Ecuador es parte.
