What is ‘transmedia’? This chapter attempts to understand what this phenomenon is from a transhistorical perspective. The transhistorical nature of media combinations is interrogated in light of media specificity and in relation to the key phenomena of Intermedia. Transmedia is argued to be a transhistorical urge towards unifying that which has been artificially estranged.

This article argues that copyright law is not just a creature of statute, but it is also a social and imaginative contruct. It evaluates a number of critiques of legal formalism. Part 1 examines whether the positive rules and principles of copyright law are the product of historical contingency and political expediency. Part 2 considers the social operation of copyright law in terms of its material effects and cultural significance. Part 3 investigates the future of copyright law, in light of the politics of globalisation and the impact of new information technologies.

The famous wine region of Coonawarra in South Australia has been promoted as ’Australia's other Red Centre', emphasizing its terra rossa soil and its cabernet sauvignon. In his atlas of the wine regions of Australia, John Beeston comments upon the rich and contested history of the region: ’Coonawarra is certainly the most famous cabernet sauvignon region in Australia, and some would argue, the most renowned wine region in Australia per se'. A reporter, Penelope Debelle, captures a sense of the legal conflict over the parameters of the boundaries of Coonawarra: ’Behind the name Coonawarra, an inglorious contest is being waged that pits the romance of South Australia's terra rossa cool-climate wine region against the cold commercial reality of the label.'This Chapter tells the story behind the Coonawarra litigation, addressing the parties to the dispute; the legal and historical context of the case; and the immediate impact case, as well as its lingering significance. It considers the ’Coonawarra' case as, very literally, a landmark in Australian jurisprudence in respect of intellectual property. This chapter engages in the methodology of ’legal storytelling'. In the field of new historicism, the use of anecdotes - petite histoire - has been seen as a useful way of challenging grand historical narratives. Joel Fineman has observed that the anecdote is ’the literary form or genre that uniquely refers to the real.' This chapter has three parts. Part 1 outlines the European Community - Australia Wine Agreement 1994, and the operation of the Australian Wine and Brandy Corporation Act 1980 (Cth). Part 2 considers the various stages of the dispute over the Coonawarra region - moving from the decision of the Geographical Indications Committee, to the ruling of the Administrative Appeals Tribunal; and the conclusive decision of the Full Court of the Federal Court of Australia. Part 3 examines the implications of the Coonawarra litigation for other wine regions of Australia - most notably, the King Valley in Victoria; but also the Hunter Valley in the New South Wales; and the Margaret River in Western Australia. The conclusion considers the ramifications of the European Community-Australia Wine Agreement 2007, which has been initialed by both sides.

Esta análise do caso Schreber de Sigmund Freud em sua intertextualidade com os escritos de Karl Abraham sobre as psicoses sugere que Freud, em sua leitura da autobiografia de Schreber para-além da intentio autoris , teria se apropriado da narrativa paranoica presente nessa obra à maneira de seu peculiar estilo literário, que mimetizaria no plano da escrita os processos sobre os quais ele teoriza. Dessa forma, a narrativa paranoica se apresentaria no caso Schreber a partir da postura querelante com a qual Freud reivindica para si os critérios de sua suposta originalidade intelectual no campo das psicoses frente ao seu precursor, Karl Abraham. Para se resgatar a historicidade do texto de Freud sobre Schreber e ter um instrumental metodológico para a abordagem desse texto de uma perspectiva sóciohistórica, recorre-se às leituras críticas do novo historicismo escola relativamente recente da teoria literária. Expõem-se, então, os três diferentes níveis de negociações presentes no caso Schreber de Freud: 1) negociações intrapsicanalíticas; 2) negociações epistemológicas; 3) negociações estilísticas. Conclui-se que o caso Schreber de Freud foi redigido em um diálogo com o contexto histórico de sua época, refletindo as relações de poder, então vigentes, nas quais Freud se percebia ameaçado em sua autoridade e em seu intuito de institucionalizar a psicanálise como disciplina científica pelos contundentes questionamentos que suas teorias recebiam dos seus discípulos dissidentes. O primeiro capítulo desta tese, introdutório, apresenta em linhas gerais o tema; o segundo capítulo expõe os escritos de Daniel Paul Schreber, com ênfase na sua autobiografia, Memórias de um doente dos nervos, e discute o estatuto de literariedade desse autor; o terceiro capítulo apresenta o panorama dos comentadores da autobiografia de Schreber, explorando as leituras empreendidas por Sigmund Freud e por Jacques Lacan dessa obra; o quarto capítulo descreve os aspectos metodológicos da abordagem que utilizamos para a leitura do texto de Freud sobre Schreber, com base nas análises críticas do novo historicismo; por fim, o quinto capítulo empreende a análise de narrativa do caso Schreber de Freud em sua intertextualidade com os escritos de Abraham sobre as psicoses.

C.G. Jung and Literary Theory remedies a significant omission in literary studies by doing for Jung and poststructuralist literary theories what has been done extensively for Freud, Lacan and post-Freudian psychoanalysis. This work represents a complete departure from traditional Jungian literary criticism. Instead, radically new Jungian literary theories are developed of deconstruction, feminist theory, gender and psyche, the body and sexuality, spirituality, postcolonialism, historicism and reader-response. As well as linking Jung to the work of Derrida, Kristeva and Irigaray, the book traces contentious occult, cultural and political narratives in Jung's career. The paper will argue that although Bryan S.Turner's recent defence of classical sociology was seen as apostacy by some, it points to real problems in the idealism and a-historicism of contemporary cultural studies. The paper will examine the importance of the classical sociological problematic in getting the field of Romani Studies started, and the continuing relevance of a sociological approach rooted in history and political economy. Introduction The question of the meaning, methods and philosophical manifestations of history is currently rife with contention. The problem that I will address in an exposition of the thought of Wilhelm Dilthey and Martin Heidegger, centers around the intersubjectivity of an historical world. Specifically, there are two interconnected issues. First, since all knowledge occurs to a person from within his or her historical age how can any person in any age make truth claims? In order to answer this concern we must understand the essence and role of history. Yet how can we come to an individual understanding ofwhat history is when the meanings that we use are themselves historically enveloped? But can we, we who are well aware of the knowledge that archaeology has dredged up from old texts or even from 'living' monuments of past ages, really neglect to notice these artifacts that exist within and enrich our world? Charges of wilful blindness would arise if any attempt were made to suggest that certain things of our world did not come down to us from the past. Thus it appears more important 2 to determine what this 'past' is and therefore how history operates than to simply derail the possibility for historical understanding. Wilhelm Dilthey, the great German historicist from the 19th century, did not question the existence of historical artifacts as from the past, but in treating knowledge as one such artifact placed the onus on knowledge to show itself as true, or meaningful, in light ofthe fact that other historical periods relied on different facts and generated different truths or meanings. The problem for him was not just determining what the role of history is, but moreover to discover how knowledge could make any claim as true knowledge. As he stated, there is a problem of "historical anarchy"!' Martin Heidegger picked up these two strands of Dilthey's thought and wanted to answer the problem of truth and meaning in order to solve the problem of historicism. This problem underscored, perhaps for the first time, that societal presuppositions about the past and present oftheir era are not immutable. Penetrating to the core of the raison d'etre of the age was an historical reflection about the past which was now conceived as separated both temporally and attitudinally from the present. But further than this, Heidegger's focus on asking the question of the meaning of Being meant that history must be ontologically explicated not merely ontically treated. Heidegger hopes to remove barriers to a genuine ontology by II 1 3 including history into an assessment ofprevious philosophical systems. He does this in order that the question of Being be more fully explicated, which necessarily for him includes the question of the Being of history. One approach to the question ofwhat history is, given the information that we get from historical knowledge, is whether such knowledge can be formalized into a science. Additionally, we can approach the question of what the essence and role of history is by revealing its underlying characteristics, that is, by focussing on historicality. Thus we will begin with an expository look at Dilthey's conception of history and historicality. We will then explore these issues first in Heidegger's Being and Time, then in the third chapter his middle and later works. Finally, we shall examine how Heidegger's conception may reflect a development in the conception of historicality over Dilthey's historicism, and what such a conception means for a contemporary historical understanding. The problem of existing in a common world which is perceived only individually has been philosophically addressed in many forms. Escaping a pure subjectivist interpretation of 'reality' has occupied Western thinkers not only in order to discover metaphysical truths, but also to provide a foundation for politics and ethics. Many thinkers accept a solipsistic view as inevitable and reject attempts at justifying truth in an intersubjective world. The problem ofhistoricality raises similar problems. We 4 -. - - - - exist in a common historical age, presumably, yet are only aware ofthe historicity of the age through our own individual thoughts. Thus the question arises, do we actually exist within a common history or do we merely individually interpret this as communal? What is the reality of history, individual or communal? Dilthey answers this question by asserting a 'reality' to the historical age thus overcoming solipsism by encasing individual human experience within the historical horizon of the age. This however does nothing to address the epistemological concern over the discoverablity of truth. Heidegger, on the other hand, rejects a metaphysical construel of history and seeks to ground history first within the ontology ofDasein, and second, within the so called "sending" of Being. Thus there can be no solipsism for Heidegger because Dasein's Being is necessarily "cohistorical", Being-with-Others, and furthermore, this historical-Being-in-the-worldwith- Others is the horizon of Being over which truth can appear. Heidegger's solution to the problem of solipsism appears to satisfy that the world is not just a subjective idealist creation and also that one need not appeal to any universal measures of truth or presumed eternal verities. Thus in elucidating Heidegger's notion of history I will also confront the issues ofDasein's Being-alongside-things as well as the Being of Dasein as Being-in-the-world so that Dasein's historicality is explicated vis-a-vis the "sending of Being" (die Schicken des S eins).

En se penchant sur L’homme révolté d’Albert Camus, ce mémoire entend évaluer la pertinence de la révolte camusienne à l’aube du troisième millénaire. Du constat de l’absurde quant à la condition existentielle de l’homme, Camus a esquissé une révolte affranchie de toute idéologie en démontant, entre autres, les mécanismes propres à la philosophie de l’histoire et au nihilisme. À partir de la critique des pensées hégélienne, nietzschéenne et marxienne, il a tenté de définir les caractéristiques inhérentes à la révolte. Rédigé au milieu du XXe siècle, L’homme révolté est marqué par les séquelles d’une histoire chaotique déjà plus que cinquantenaire. Pour autant, son propos semble être encore d’actualité. Avec la complicité de philosophes contemporains tels que Cornélius Castoriadis, Pierre Rosanvallon et Bernard Stiegler, c’est autant la pertinence de la révolte camusienne qui est ici considérée qu’une corrélation entre cette révolte et la dignité humaine. L’homme révolté a-t-il encore sa place en ce début du troisième millénaire et dans l’affirmative : quelle est cette place?

Ce mémoire propose une analyse du roman historique La Carthagénoise (Germán Espinosa, 1982). Ce roman porte sur l’échange des idées entre l’Amérique coloniale et l’Europe éclairée. L’invasion française au port caraïbe de Carthagène d’Indes en 1697 est l’événement historique qui déclenche sa trame. Cette œuvre littéraire effectue un parcours à travers deux espaces et périodes historiques – l’Amérique sous domination espagnole et l’Europe des Lumières – dans lesquels s’entrecroisent des personnages réels et fictionnels. L’analyse que propose le présent travail aborde en premier lieu les antécédents du roman historique en Amérique latine. Dans une deuxième partie, il se penche sur les stratégies narratives utilisées dans le roman d’Espinosa et sur l’impact éventuel de ces procédés sur la facette critique de l’œuvre. L’hypothèse centrale de ce travail est que la fiction historique contribue à une vision critique de l’histoire officielle et qu’elle propose une réflexion sur les causes de la stagnation épistémologique en Amérique latine ainsi que des processus historiques inachevés tels que la libération épistémologique et la consolidation des épistémologies émergentes suggérées par la théorie postcoloniale et la pensée décoloniale. Le roman montre également la naissance, la mise en œuvre et l’échec de ce projet de libération épistémologique mené par un personnage féminin. Ce projet vise à finir avec la marginalisation du savoir latino-américain plutôt qu’à sa décolonisation. Parmi les conclusions tirées par ce mémoire, il y a l’idée qu’en raison de la causalité historique de l’Amérique latine, telle que montrée par le roman, le moment n’est pas encore venu de l’avènement d’une libération culturelle qui permette la consolidation des épistémologies émergentes, dans la ligne de ce que suggèrent les études postcoloniales et la décolonialité. Une autre conclusion importante à mentionner est que l’évolution des idées est un processus historique dans lequel les courants idéologiques ne sont pas absolus et sont assujettis aux conjonctures sociales qui déterminent leur existence et permanence.

Dans cette thèse, nous étudions la period room présentée dans le musée d’art. À travers un examen de sa spécificité matérielle, spatiale et temporelle, nous analysons les mécanismes propres à cette stratégie de mise en exposition et nous identifions ses principales conditions de possibilité. Ce faisant, nous étudions les différents savoirs qui sont sollicités par la period room, leurs interactions ainsi que l’apport réciproque de cette stratégie de mise en exposition à la construction de ces savoirs et ce, de manière à établir les fondements d’une épistémologie de la period room. Nous montrons ainsi quelle est sa contribution particulière à l’élaboration et à la médiation de l’histoire dans l’espace muséal. Grâce à cette étude, nous posons des assises conceptuelles qui permettent de repenser le rôle de la period room pour la discipline de l’histoire de l’art, déjouant par le fait même les apories de l’historicisme et de l’authenticité en vertu desquelles la period room est le plus souvent discréditée. Nous procédons par études de cas à partir d’un corpus principalement composé de period rooms ayant pour référents des intérieurs français de la seconde moitié du 18ième siècle et qui sont présentées dans des musées d’art américains (Frick Collection, Metropolitan Museum of Art, Philadelphia Museum of Art) et dans un musée canadien d’histoire naturelle et culturelle (Royal Ontario Museum). Dans la première partie de la thèse, nous établissons la typologie muséographique de la period room et nous envisageons les enjeux, notamment idéologiques, associés à la question de son « authenticité » à travers une analyse de son double statut de pastiche et de simulacre. Nous posons en outre l’un des fondements théoriques de notre étude en montrant que, parce qu’elle est formée de l’articulation entre pouvoirs et savoirs, la period room est un dispositif au sens où l’entendent Michel Foucault (1977) et Giorgio Agamben (2007). Dans la seconde partie, nous examinons la spécificité matérielle de la period room en démontrant comment elle est simultanément une réunion d’objets et un « tout », c’est-à-dire un objet muséographique en elle-même. Nous étudions les implications épistémologiques de cette idée pour la représentation de l’histoire proposée au moyen de la period room, tout en portant une attention particulière aux enjeux politiques qui informent cette représentation dans l’espace muséal. Dans la troisième partie, nous nous concentrons sur les particularités spatiales et temporelles de cette stratégie de mise en exposition et nous démontrons que, en dépit de son apparente unité de lieu et de temps, la period room est composée de plusieurs espaces et concentre plusieurs temps. En puisant dans la spécificité même de ce dispositif, nous élaborons des outils théoriques et méthodologiques inédits qui contribuent à repenser la fonction de la period room pour la mise en forme et la transmission de l’histoire. En conclusion, nous présentons une dernière étude de cas qui, examinant l’intervention de Valerie Hegarty dans trois period rooms du Brooklyn Museum (2013), synthétise les principaux enjeux traités dans la thèse et défend la valeur d’actualité de la period room.

A graduação de filosofia no Instituto de Filosofia e Ciências Sociais da Universidade Federal do Rio de Janeiro caracterizava-se, principalmente nos primórdios da década de 70, por uma orientação tradicional, dogmática e a-histórica, gerando no corpo discente a perplexidade e o desinteresse pelo curso. Orientação que, segundo os depoimentos de professores e alunos de períodos anteriores, não era específica da década de 70, mas que perpetuava-se a alguns anos no curso dessa instituição, "gerando, em alguns momentos históricos, o conflito entre a proposta oficial do curso e os anseios e interesses de seu corpo discente. Considerando a filosofia, não como um discurso teórico "perene", "imutável" e "a-histórico", mas como parte inerente à história, refletindo, assim, suas mudanças e contradições, buscam-se através de um estudo histórico que inicia-se no período colonial e vai até a década de 60 no século XX -as causas determinantes do imobilismo, do dogmatismo e da a-historicidade que caracterizaram a graduação de filosofia da Universidade Federal do Rio de Janeiro. Manteve-se sempre como pano de fundo dessa trajetória histórica o conflito entre a proposta oficial da graduação de filosofia e os anseios e interesses, enfim, a perspectiva dos alunos no que se refere ao ensino de filosofia. Conflito que evidencia a dicotomia ser/pensar perpetuada pelo ensino de filosofia no contexto educacional brasileiro.

Trata-se de mostrar a originalidade crítica de Siegfried Kracauer diante da experiência da modernidade estética e de discutir as afinidades estético-teóricas de Kracauer e Benjamim ao analisar a Paris da segunda metade do século XIX, o Segundo Império, em particular, como fenômeno originário da sociedade de massas, da indústria cultural e do entretenimento e, sobretudo, do nazi-fascismo. Kracauer durante seu exílio parisiense (1933-41) escreveu uma biografia da sociedade: Jacques Offenbach e a Paris de sua época (Jacques Offenbach und das Paris seiner Zeit). Obra inovadora pelo seu enfoque da história do presente e com pontos de contatos com a Obra das Passagens (Passagen-Werk) ou Paris capital do século XIX de Walter Benjamin.
