The following study considers the fragmentation of law which occurred in 1956 with regard to the law on servitude. As States were unwilling to go as far as the Universal Declaration on Human in establishing that "no one shall be held in [...] servitude", the negotiators of the 1956 Supplementary Conventions moved to expunge the very term 'servitude' from the text and to replace it with the phrase 'institutions and practices similar to slavery' which could then be abolished 'progressively and as soon as possible'. The negotiation history of the 1956 Convention clear demonstrate that the Universal Declaration on Human was the elephant in the room and that it ultimately lead to a fragmentation of the law as between general international law manifest in the 1956 Supplementary Convention on the one hand and international human rights law on the other. It is for this reason that, for instance the 2001 UN and 2005 Council of Europe trafficking conventions mention both 'practices similar to slavery' and 'servitude' as types of human exploitation to be suppressed in their definition of 'trafficking in persons'.

Différents points de vue pour déterminer la portée du secret des délibérations dans certains tribunaux internationaux ont débouché sur le fait que les juges aient le droit de présenter des opinions séparées; alors que d’autres n’ont pas ce droit. En tenant compte du rôle et des objectifs des missions internationales, les juges devraient avoir le droit de présenter des opinions séparées, de la même façon que dans le système de common law et dans un grand nombre de tribunaux constitutionnels.Cependant, ces analogies ont joué un rôle marginal dans les travaux préparatoires du Statut de la Cour Permanente de Justice Internationale en 1920. D’autant que les Etats ne trouvaient pas  orrect qu’une opinión juridique d’un juge international soit condamnée a l’anonymat comme consequence du principe du secret des délibérations, ceci comme conséquenced’un «technicisme» relatif au fait que ladite opinion était contraire à la position majoritaire de la Cour au moment de voter le projet de la décision.Les règles générales de droit international public garantissent un pouvoir autonome au pouvoir judiciaire international. Selon les règles de procédure des tribunaux internationaux, les juges ont le droit de se prononcer avec une opinion séparée, même si ce droit ne se trouve pas typifié de façon expresse dans le Statut ou dans le traité constitutif de l’organisation. Cette règle est présumée à moins qu’il y ait eu une claire volonté des Etats dans le sens contraire.Le droit relatif aux opinions séparées peut être analysé sous la perspective des juges en tenant compte de leur droit à la liberté d’expression. En ce sens, un juge international peut avoir la liberté pour démontrer, de façon systématique, par le biais d’opinions séparées, les vides argumentatifs de la majorité, en évitant un style qui puissent être offensif envers ses collègues. Cette façon de s’exprimer est considéré inoffensive envers l’autorité judiciaire.Les effets positifs par l’absence, ou l’interdiction, d’opinions séparées, en relation avec l’indépendance des juges internationaux ne sont pas faciles à mettre de côté. Cependant, ce genre des mesures restrictives à la liberté d’expression n’est pas suffisamment effectif ni proportionné pour légitimer l’objectif du juge. Il y a des instruments bien plus effectifs y moins restrictifs qui mènent au même résultat (par exemple, un seul mandat, non renouvelable, des juges nternationaux).

This dissertation investigates the relationship between investment and environmental obligations from the perspective of international investment law. In order to do so, the dissertation will consider how these obligations might enter into conflicts and what tools are available to investment tribunals to solve these normative conflicts. The dissertation analyses in order interpretative techniques, conflict resolution tools available in general international law, as expressed in the Vienna Convention on the Law of Treaties, and finally express clauses in international investment agreements. The dissertation includes the review of some relevant case law arising from investment agreements in investment treaty tribunals, to discover how in practice these conflict resolution tools are applied and to assess their effectiveness. This dissertation places itself squarely within the debate between the unity and the fragmentation of international law; therefore it tackles the issue of normative conflicts resolution in a dispute settlement environment with the view of gauging their value in maintaining the unity of international law and defuse the risk of fragmentation. The dissertation can only conclude that much work remains to be done, including by providing a more comprehensive taxonomy of possible interventions, both on the legal and political sphere.

Esta dissertação concentra suas investigações nas contramedidas do direito internacional geral e da Organização Mundial do Comércio (OMC). No âmbito do direito internacional, estudou-se a essência política da sociedade internacional descentralizada, bem como a tendência do processo de fragmentação do direito internacional em direção a regimes mais regulados pelo direito. Além disso, investigou-se a tentativa de ampliação da normatização das contramedidas por meio do Projeto de Artigos sobre Responsabilidade Internacional do Estado de 2001. No âmbito do regime especial da OMC, analisou-se o maior adensamento jurídico das contramedidas como ponto culminante na fase de implementação das decisões no sistema de solução de controvérsias da OMC. Com base na avaliação sobre a necessidade de reforma do instituto das contramedidas da OMC, foram pesquisadas as principais propostas para sua modificação, buscando-se identificar a tentativa de redução do espaço político. A hipótese deste trabalho partiu da afirmação sobre a existência de uma tendência evolutiva no direito internacional geral e na OMC no que tange ao aumento da juridicidade do instituto das contramedidas. Entretanto, essa hipótese confirmou-se apenas parcialmente, pois a tentativa de aprimorar a regulamentação jurídica do instituto das contramedidas ocorre em meio à permanência de elementos políticos.

L’interdépendance de l’environnement a mis en évidence le besoin de la communauté internationale de trouver des mécanismes capables de dépasser les frontières et de protéger les biens naturels d’intérêt commun. Étant donné l’inefficacité du concept de patrimoine commun de l’humanité en ce qui a trait à la protection des biens soumis à la souveraineté d’un État, cette étude analyse l’application de la responsabilité internationale au « dommage transfrontière médiat » (c’est-à-dire, le dommage environnemental qui a lieu à l’intérieur d’un territoire étatique, mais qui caractérise une perte au patrimoine environnemental planétaire) comme mesure capable de surmonter les frontières et de protéger l’environnement. La responsabilité internationale se présente sous deux formes en droit international public général, soit la responsabilité des États pour les activités non interdites par le droit international (ou la responsabilité objective), soit celle découlant d’un fait internationalement illicite. Cette dernière comporte encore deux subdivisions : celle ayant pour cause une « violation d’une obligation internationale » et celle pour une « violation grave d’obligation découlant de normes impératives du droit international général ». L’analyse des principes de droit environnemental international et du principe de la souveraineté démontre que le « dommage transfrontière médiat » pourrait, en théorie, être considéré comme un fait internationalement illicite permettant donc la responsabilisation d’un État.

Cette recherche aborde la question de l’avis consultatif de la CIJ sur la conformité au droit international de la déclaration unilatérale d’indépendance relative au Kosovo du 22 juillet 2010 et ses possibles incidences sur la question de la sécession du Québec. Plus précisément, ce mémoire traite de la migration des idées constitutionnelles au sujet des questions d’autodétermination dans les cas kosovar et québécois, en effectuant une analyse comparative des deux situations. Le présent mémoire conclut tout d’abord à un respect du droit international public par la CIJ dans son avis, le Kosovo remplissant les conditions de mise en oeuvre de la sécession remède. Néanmoins, notre recherche conduit à affirmer une impossibilité de transposition de solution du cas kosovar à la problématique québécoise, mais à une possible migration des influences, qui assouplirait la position prise ces dernières années par le Canada, notamment avec la Loi sur la clarté.

Causing civilian casualties during military operations has become a much politicised topic in international relations since the Second World War. Since the last decade of the 20th century, different scholars and political analysts have claimed that human life is valued more and more among the general international community. This argument has led many researchers to assume that democratic culture and traditions, modern ethical and moral issues have created a desire for a world without war or, at least, a demand that contemporary armed conflicts, if unavoidable, at least have to be far less lethal forcing the military to seek new technologies that can minimise civilian casualties and collateral damage. Non-Lethal Weapons (NLW) – weapons that are intended to minimise civilian casualties and collateral damage – are based on the technology that, during the 1990s, was expected to revolutionise the conduct of warfare making it significantly less deadly. The rapid rise of interest in NLW, ignited by the American military twenty five years ago, sparked off an entirely new military, as well as an academic, discourse concerning their potential contribution to military success on the 21st century battlefields. It seems, however, that except for this debate, very little has been done within the military forces themselves. This research suggests that the roots of this situation are much deeper than the simple professional misconduct of the military establishment, or the poor political behaviour of political leaders, who had sent them to fight. Following the story of NLW in the U.S., Russia and Israel this research focuses on the political and cultural aspects that have been supposed to force the military organisations of these countries to adopt new technologies and operational and organisational concepts regarding NLW in an attempt to minimise enemy civilian casualties during their military operations. This research finds that while American, Russian and Israeli national characters are, undoubtedly, products of the unique historical experience of each one of these nations, all of three pay very little regard to foreigners’ lives. Moreover, while it is generally argued that the international political pressure is a crucial factor that leads to the significant reduction of harmed civilians and destroyed civilian infrastructure, the findings of this research suggest that the American, Russian and Israeli governments are well prepared and politically equipped to fend off international criticism. As the analyses of the American, Russian and Israeli cases reveal, the political-military leaderships of these countries have very little external or domestic reasons to minimise enemy civilian casualties through fundamental-revolutionary change in their conduct of war. In other words, this research finds that employment of NLW have failed because the political leadership asks the militaries to reduce the enemy civilian casualties to a politically acceptable level, rather than to the technologically possible minimum; as in the socio-cultural-political context of each country, support for the former appears to be significantly higher than for the latter.

Firms learn general international management and foreign market specific knowledge in their internationalization process. Firms' strategic emphasis on generalized vs. localized learning is an important yet underexplored issue in the extant literature. Drawing on the theoretical framework of dynamic capability, and in the context of emerging multinational enterprises' FDI into developed host countries, this study examines the equifinal process-position-path configurations of firms that will motivate them to engage in localized learning (as opposed to generalized learning). Utilizing primary and secondary data of eleven Chinese foreign direct investments in Australia, collected at both headquarters and subsidiary levels, we conducted fuzzy-set qualitative comparative analysis (fsQCA) that provided substantial support to our propositions. This study contributes to the internationalization process model by identifying equifinal process-position-path configurations, as well as their core and peripheral conditions that motivate localized learning at both the headquarters and the subsidiary levels.

What exactly is tax treaty override ? When is it realized ? This thesis, which is the result of a co-directed PhD between the University of Bologna and Tilburg University, gives a deep insight into a topic that has not yet been analyzed in a systematic way. On the contrary, the analysis about tax treaty override is still at a preliminary stage. For this reason the origin and nature of tax treaty override are first of all analyzed in their ‘natural’ context, i.e. within general international law. In order to characterize tax treaty override and deeply understand its peculiarities the evaluation of the effects of general international law on tax treaties based on the OECD Model Convention is a necessary pre-condition. Therefore, the binding effects of an international agreement on state sovereignty are specifically investigated. Afterwards, the interpretation of the OECD Model Convention occupies the main part of the thesis in order to develop an ‘interpretative model’ which can be applied every time a case of tax treaty override needs to be detected. Fictitious income, exit taxes and CFC regimes are analyzed in order to verify their compliance with tax treaties based on the OECD Model Convention and establish when the relevant legislation realizes cases of tax treaty override.
