This essay presents the European Arrest Warrant and its relationship with the principle of double criminality, which was abolished in 2002 with the new Framework Decision (FD). This instrument was essential to implement the principle of mutual recognition and strengthen the police and judicial cooperation in criminal matters in the newly created space of freedom, security and justice. It was urgent to create mechanisms to combat cross-border crime, that alone States have struggled to counter. An analysis of the FD No 2002/584/JHA is made. The execution of warrants and the non-mandatory and optional grounds of refusal are studied in detail. As it is the implementation issue. The role of mutual recognition in practice is studied as well. The procedure is to introduce the principle of double criminality, to explain the concept and its abolition, warning for the consequences derived from them, related to the principle of legality and fundamental rights. The analysis of the European Arrest Warrant in practice in Portugal and in comparison with other Member States allows the measurement of the consequences from the abolition of dual criminality and the position of States on this measure. With the abolition of double criminality, the cooperation in judicial and criminal matters departs from what was intended by the European Council of Tampere. And without cooperation, fundamental rights of citizens are unprotected, so the states have to adopt measures to remedy the "failures" of the European Law.

A problemática jurídica da detenção de requerentes de asilo e de imigrantes irregulares assume uma especial relevância no período da nossa história coletiva, em que o fenómeno migratório, em pleno século XXI (século do movimento dos povos)tenderá cada vez mais a condicionar e a pulverizar as políticas públicas estaduais e supra estaduais. Como fenómeno político, económico, social, religioso e cultural, o fenómeno migratório, goste-se mais ou menos dele, aborde-se de forma mais generalizada ou mais pormenorizada, vai quase obrigatoriamente ter de estar nas prioridades políticas, legislativas e jurídicas dos Estados europeus e também ao nível das Instituições da União Europeia. Muito do futuro da Europa e de Portugal está umbilicalmente associado, política e juridicamente, à forma como souberem trabalhar a imigração em cada uma das suas múltiplas variáveis. Desde logo, dedicando especial atenção a variáveis, como o envelhecimento populacional e as taxas de fecundidade e natalidade, entre muitas outras. Fiel ao seu passado coletivo, faz sentido que a Europa e Portugal da diversidade, da tolerância, do respeito pelos direitos humanos, mesmo em momentos de crise económica e social, como o que vivemos atualmente, não deverão transigir nos seus princípios humanistas e de influência cristã.

Metodologia para determinação de volume de detenção em pequenas bacias urbanas: o caso do córrego Wenzel, Rio Claro/SP

With the accelerated urbanization process of Brazil from the 50s, there was a disorderly occupation of spaces and consequent soil sealing. Unlike this growth, the support capacity of urban environments has not evolved in the same way, generating negative environmental impacts to the citizens. Among these impacts are the effects of flooding. In order to minimize the negative effects of extreme precipitation over cities, the government invests in corrective measures, like compensatory techniques on urban drainage, which have as a basic principle the retention and infiltration of the rainfall, dampening the peak flow and runoff. An example of applying these techniques in urban areas are the detention basins, commonly called large pools. The hydraulic design of these structures is dependent of complex data and variables, and projects involving small areas generally use simplified methods for defining the reservoirs volume of the storage (Tassi, 2005). One of these methods is presented in this study, which relates to the percentage of soil sealing to the specific storage volume (m³/ha) in combination by applying the hydrological model of the Rational Method and analyzing regional rainfall and soil occupation over the basin. Within this context, the basin of the Wenzel stream, which is located amidst the urban area of Rio Claro/SP, also presents the problems related to human occupation in its valley. Thus, by the method presented has been adjusted a curve correlating the percentage of impermeable area and the specific volume of a detention basin. For the current situation of Wenzel Basin with 82% of impermeable area, and return period of 10 years, the specific volume is 262.1 m³/ha. The presented method is consistent with the results of other studies in the area, and the expression obtained allows estimating the volume of storage required to match hydrograph pre and post-occupancy. Avaliação da estratégia de controle de enchentes através de reservatórios de detenção de águas pluviais na sub-bacia do Alto Tietê - São Paulo

A rápida expansão do espaço urbano no Brasil ocorreu e continua ocorrendo, geralmente, de forma desordenada e sem perspectivas imediatas de ordenação das práticas de uso e ocupação do solo. O planejamento da ocupação do espaço urbano, baseado na racionalidade capitalista, embora englobe fundamentos interdisciplinares, na prática tem sido realizado dentro de um âmbito mais restrito do conhecimento, desconsiderando aspectos fundamentais dessa dinâmica. Essa situação tem resultado em grandes transtorno e custos para a sociedade e para o meio ambiente, atingindo diretamente os sistemas de drenagens urbanos e resultando no crescimento dos eventos de cheia. Assim, o planejamento urbano vem buscando alternativas que possibilitem o alcance do desenvolvimento urbano sustentável. Neste sentido, este trabalho objetiva avaliar qualitativamente a implantação reservatórios de detenção implantados no alto curso da sub-bacia do Alto Tietê, de modo a avaliar os problemas apresentados através da realização de um inventário dos avanços atingidos na incorporação destas medidas no gerenciamento dos sistemas de drenagem nesta subbacia.

Aplicação de modelos hidrológicos para avaliação de reservatórios de retenção e detenção combinados à obra de recuperação do canal de macrodrenagem no controle de cheias em uma bacia hidrográfica urbanizada

The aim of this paper was to evaluate the effect of retention and detention reservoirs along with the regulation in channel flow upgrade on flood for an urban watershed located at Rio Claro, SP. For this purpose, modeling and simulation techniques were applied for runoff determination and its propagation in channel. The Soil Conservation Service – SCS hydrologic model as well as Pulz and non-linear Muskingum-Cunge model were used. The software IPHS1 was applied on simulations. The results pointed out that the combination of retention increasing and detention reservoir implementation (120,000 m3, corresponding to 1.5% of the watershed area) with the streamflow upgrade (n decreasing from 0,04 to 0,02) can minimize the flood on the investigated Servidão watershed. Further, after the proposed intervention, the flood was eliminated for the investigated times of recurrence: 5, 20, 50 and 100 years. The prognostic indicated that the available area occupation had a minor effect on flow increasing due to the observed high urbanization.
