An enduring aspect of the operation of the criminal justice system in Australia has been the disproportionate representation of indigenous persons. Under current sentencing principles, aboriginality can be taken into account as a factor in mitigation because of the nature of social and economic disadvantage suffered by indigenous communities. It is contended that such an approach is inadequate as it fails to comprehend the reasons for that disadvantage. In short, the effects of colonialism and dispossession. An account of punishment will be developed that colonialism and dispossession cannot be omitted from any satisfactory account of the theory and history of punishment of indigenous persons. By relying on the notion of ‘just deserts’ an account of punishment will be proposed that extends the categories currently put forward to justify punishing indigenous persons. Traditional, philosophical accounts of punishment and insights from critical race theory will both be used in an attempt to articulate what ‘just deserts’ means in the context of a post-colonial society.

Although women’s exclusion in sport has attracted significant attention in the western context, similar issues in relation to post-colonial societies have remained in the margins of the sociology of sport. By analysing primary, interview-based evidence, in this article we explore the challenges female rugby players face regarding gender and sexuality in Fiji; a male dominated post-colonial society. In particular, we focus on participants’ resistance to dominant cultural practices and ways in which they (re)negotiate gender norms and sexuality in a double-bind struggle against both traditional and sporting male hegemonies. We argue that the case of Fijian women rugby players illustrates an interplay between a multiplicity of power relations in sport in a post-colonial society and the resilience with which the athletes negotiate and respond to them, as well as the dynamic nature and the transformative potential of their everyday practices.

ResumenHaciendo uso de la metodología prosopográfica y de un enfoque teórico de redes sociales, el presente artículo se propone investigar el funcionamiento social del conocimiento, así como sus mecanismos de transmisión en la sociedad colonial de Costa Rica. También se lleva a cabo una presentación documental de las principales líneas de evolución institucional de la educación en la época. Se llega así a constatar que el conocimiento estaba en manos de una estrecha red social de individuos conectados, enriquecidos y empoderados, que formaban parte de la elite política colonial, quienes lo vedaban sistemáticamente a otros sectores sociales de la época, y lo empleaban para apuntalar su posición social.AbstractBy means of a prosopographic study and using a social networks theoretical approach, this article explores the social functions of knowledge, as well as its ways of transmission in the Costarican colonial society. A documented presentation of the main traits of the evolution of the formal education in the period is also offered. As a result, the work concludes that knowledge was in the hands of a very narrow social network structured with very well connected individuals, who were also rich and politically powerful. These individuals used their position and their monopoly of knowledge to impede access to it to other social groups of the time, using it, at the same time, as a tool to sustain their social position.

This study of the veranda as seen through the eyes of Lady Maria Nugent and Michael Scott, alias Tom Cringle, clearly demonstrates the important role that the piazza, as it was then more commonly known, played in the life of early nineteenth century Caribbean colonial society. The popularity of the veranda throughout the region, in places influenced by different European as well as African cultures, and among all classes of people, suggests that the appeal of this typical feature was based on something more than architectural fashion. A place of relative comfort in hot weather, the veranda is also a space at the interface of indoors and outdoors which allows for a wide variety of uses, for solitary or small or large group activities, many of which were noted by Nugent and Scott. Quintessentially, the veranda is a place in which to relax and take pleasure, not least of which is the enjoyment of the prospect, be it a panoramic view, a peaceful garden or a lively street scene. Despite the great changes in the nature of society, in the Caribbean and in many other parts of the world, the veranda and related structures such as the balcony continue to play at least as important a role in daily life as they did two centuries ago. The veranda of today’s Californian or Australian bungalow, and the balcony of the apartment block in the residential area of the modern city are among the contemporary equivalents of the lower and upper piazzas of Lady Nugent’s and Tom Cringle’s day.

Dancing was an important pastime in colonial society. People would dance to celebrate events such as weddings and harvests, but also as a general recreational activity. Dancing is a shared experience which forges and maintains a sense of community and cultural identity – a sense of belonging. This was significant in the new land, where many people had left their families and friends behind. Speed the Plough was a very popular English country dance which came from a play of the same name, first performed in London in 1798.

O tema desta pesquisa abrange a penetração e a repressão inquisitorial portuguesa à chamada heresia luterana. Antes de qualquer comentário, é necessário dizer que o termo luterano, na Época Moderna, era utilizado pelos inquisidores como termo genérico para identificar os estrangeiros protestantes. É um tema inédito e original, no âmbito das pesquisas históricas especializadas em Inquisição, com o foco direcionado para os processos inquisitoriais do Santo Ofício Lisboeta contra réus em terra brasílica. Trata-se de uma investigação a respeito da introdução e da difusão do luteranismo no Brasil colonial entre os séculos XVI e XVII. Processos da Inquisição portuguesa são as fontes primárias de maior relevância nesta tese. Além de que, há documentos administrativos e jurídicos que aprimoram a exploração da temática. O luteranismo no Brasil Colonial apresentou várias facetas: desde um luteranismo das naus, quando os portugueses expandiam-se para o além-mar e eram tomados por luteranos ingleses e franceses ao luteranismo da terra firme com seus conflitos e guerras coloniais, contando, também, com aquele tipo de luteranismo por adesão voluntária. O crime perseguido e processado pelo Tribunal da Inquisição Portuguesa no Brasil foi um luteranismo articulado com as profundas mudanças sociais, políticas e culturais da Europa Moderna e com as singularidades da sociedade colonial.

Les pratiques reliées à l'alimentation des esclaves de la Louisiane française nous renseignent sur les conflits et les solidarités entre les groupes sociaux, et à l'intérieur de ces groupes dans une société de frontière esclavagiste. Le premier chapitre traite des deux stratégies principales des Blancs par rapport à l'alimentation des esclaves : préserver leurs esclaves et limiter leur rôle dans l'économie. Le deuxième chapitre traite du rôle des esclaves dans l'économie alimentaire comme travailleurs spécialisés et comme producteurs et distributeurs de ressources alimentaires; ces rôles leur permettent d'obtenir davantage d'autonomie dans la société coloniale. Les différentes stratégies des esclaves pour obtenir davantage d'autonomie sont à l'origine de conflits et de solidarité au sein de la population servile.

La fin du XVe siècle marque le début d’une nouvelle ère dans les Amériques. L’arrivée des explorateurs, des conquistadores et des colonisateurs espagnols au nouveau continent signe l’introduction des Amériques dans l’histoire. Dans les écrits rédigés durant les premières décennies de la colonisation, les Autochtones endossent majoritairement le rôle d’objet. À la suite de l’endoctrinement d’une partie de la population autochtone, ce rôle passif se transforme en rôle davantage actif alors que certains Autochtones décident de prendre la parole et la plume. Voilà ce que Felipe Guamán Poma de Ayala décide de faire par l’entremise de sa chronique Nueva coronica y buen gobierno, rédigé en 1615 et adressé au roi Philippe III d’Espagne. Ce mémoire étudie une sélection d’images de la chronique comme traductions culturelles intersémiotiques de la société coloniale dans la mesure où elles traduisent le vécu colonial, y compris les rapports de pouvoir ethniques au sein de la hiérarchie sociale, à l’aide d’unités sémiotiques provenant de divers codes culturels (espagnol, catholique et andin). L’objectif de ce projet de recherche consiste à démontrer la façon dont l’hybridité du système sémiotique du texte cible expose la nature aliénante de la traduction ainsi que la relation antagonique qu’elle entretient avec l’idéologie coloniale officielle.
